Add an appraisal contingency if you cannot comfortably pay a low-appraisal gap. If another property must sell or close first, use a home-sale or home-close contingency. Depending on the property, also consider title review, insurability, flood and disaster-risk, homeowners-association documents, and specialist inspections.
A contingency only protects you if the contract states the condition, deadline, notice method, and remedy clearly. State law, the form used in your transaction, and local practice determine whether you can cancel, renegotiate, obtain repairs, or recover earnest money. Have the actual offer reviewed by a local real-estate attorney or qualified buyer agent before signing.

What a contingency does in a purchase offer
A contingency makes your obligation to buy conditional on a defined event or investigation. If the condition is not satisfied within the contract period and you follow the required notice procedure, the agreement may give you a right to cancel, renegotiate, request repairs, or preserve your earnest money. Those outcomes are not automatic; the signed contract controls.
Contingencies are different from ordinary due diligence. A lender may order an appraisal, for example, but that does not necessarily give you a contractual right to terminate when the value is low. Likewise, inspecting a house is not the same as having an inspection contingency that permits cancellation or other remedies.

The three core contingencies for most financed buyers
1. Financing or mortgage contingency
This clause gives you a stated period to obtain the mortgage described in the offer. It should identify the loan type or material terms, the application and approval deadline, and what happens if the lender cannot approve the loan on those terms. The Consumer Financial Protection Bureau (CFPB) recommends making an offer contingent on obtaining financing. Freddie Mac explains that a financing contingency can allow the buyer to leave the transaction if the loan is not obtained within the agreed period.
Ask your lender what could still prevent approval after preapproval: income or employment changes, credit changes, documentation problems, debt-to-income limits, property eligibility, or an interest-rate change that alters qualification. A contingency is not a substitute for promptly submitting documents and responding to underwriting requests. Some contracts require you to seek financing in good faith and provide evidence of a denial or inability to qualify.
2. Satisfactory-inspection contingency
An inspection contingency creates time for a professional evaluation of the home’s condition. Depending on the form, you might be able to accept the property, request repairs or a credit, renegotiate, or cancel if the results are unacceptable. The agreement may define “satisfactory” broadly, set repair thresholds, or give the seller a chance to cure specific defects.

Hire an independent inspector and read the written report rather than relying on a summary. Allow enough time for follow-up inspections when the general inspection identifies a concern. Roof, sewer, foundation, pest, chimney, well, septic, pool, mold, radon, and structural examinations may require separate specialists. The CFPB states that “a home inspection is different than an appraisal, but you generally need both.” An appraisal estimates value for the lender; an inspection evaluates physical condition.

Confirm the contract’s response mechanics. It may require written notice by a precise date, delivery through a specified method, and copies of reports or repair requests. Missing the deadline can end the protection even when the inspection finds a serious problem.
3. Appraisal contingency
An appraisal contingency addresses a valuation below the contract price. If the appraised value is lower, the clause may let you cancel, renegotiate the price, or proceed under an agreed formula. Freddie Mac describes these as common responses; the National Association of Realtors (NAR) describes an appraisal as a check that the value is at least the purchase price.
Decide before making the offer how much cash you could use for a gap. A lender generally bases the loan-to-value calculation on the lower of the purchase price or appraised value. Without protection, you may need to bring the entire shortfall, not merely a small down-payment adjustment. Your clause can specify a maximum gap you will cover, require renegotiation first, or give you a cancellation right if the parties cannot agree.

Contingencies that depend on your finances or the property
Home-sale contingency
Use this when proceeds from selling your current home are needed to fund the purchase or qualify for the new loan. The clause should state the period to secure a sale and what counts as a satisfactory contract or closing. It increases uncertainty for the seller, who may continue showing the property and accept a kick-out provision that gives you a short period to proceed if another buyer appears.
Home-close contingency
A home-close contingency is different: your existing home is already under contract, but that sale must close before you can complete the new purchase. NAR distinguishes this from a contingency to sell the home. Identify the expected closing date, what happens if the first transaction is delayed, and whether the seller can continue marketing the property or invoke a kick-out clause.
Title review
A title contingency or review period lets you examine ownership, liens, easements, judgments, restrictions, and other legal interests. Lenders usually require a title search, but cash buyers should order one as well. The contract should explain how you object, how long the seller has to cure a defect, and whether you may cancel if it cannot be resolved. Local settlement practices determine the documents and cure periods.

Check insurance availability and premium before your unconditional deadline, especially for older homes, coastal properties, wildfire-prone areas, prior claims, or unusual construction. CFPB says lenders typically require homeowners insurance and that buyers may shop among insurers. A clause can make the purchase conditional on obtaining coverage that meets the lender’s requirements at an acceptable cost. Ask for an actual quote; an agent’s informal estimate is not proof that a carrier will bind the policy.

Flood and disaster-risk review
Standard homeowners insurance typically does not cover flood damage. A separate flood policy may be needed, and a mortgage on property in a designated Special Flood Hazard Area generally requires flood insurance. CFPB reports that flooding causes about $8 billion in damage in the United States in an average year. CFPB, citing FEMA, also reports at least a one-in-four chance of flooding over a 30-year mortgage in a Special Flood Hazard Area. Properties outside designated zones can still flood.
Ask about prior flooding, water intrusion, wildfire, storm, and other disaster damage; review seller disclosures and repair records; check more than one risk map; and obtain insurance quotes. A flood-risk or insurability review period gives you time to investigate before waiving other protections.
HOA or condominium-document review
For a condominium or property governed by a homeowners association, request the declaration, bylaws, rules, budgets, reserve information, meeting minutes, insurance documents, pending assessments, and litigation disclosures. A review contingency gives you a defined period to accept the documents or cancel if fees, restrictions, finances, or planned projects do not work for you. Delivery timing matters: the review clock may start when the complete package is received, not when you first request it.
Special inspections
Property-specific conditions can justify additional inspection rights. Termite inspections are common in some regions; pools, wells, septic systems, private roads, solar equipment, retaining walls, and historic structures may need specialists. These are not universal requirements. Tie each requested inspection to an identified risk and state whether the result permits repair negotiations, a credit, or termination.

Choose contingencies by risk, cash and competitiveness
Evaluate every clause against five questions: what loss does it prevent, can you absorb that loss in cash, how long does it take, how much could it weaken the offer, and what exact remedy does the contract provide? Freddie Mac cautions that too many contingencies can make an offer less attractive and add time or complexity. That does not mean waiving a protection you genuinely need.
| Contingency | Main risk addressed | Keep it when | Trade-off to discuss |
|---|---|---|---|
| Financing | Loan denial or unacceptable loan terms | You need a mortgage to close | Requires prompt lender cooperation and a defined approval period |
| Inspection | Unknown defects or unsafe condition | You cannot independently absorb major repair costs | May involve repair negotiations and inspection time |
| Appraisal | Value below contract price | You cannot cover a gap from cash | Seller may prefer a capped-gap or waived clause |
| Home sale | Failure to sell current residence | Sale proceeds are needed | Seller may keep marketing or use a kick-out right |
| Home close | Existing sale fails to close on time | Your current home is under contract | Creates timing risk and may allow continued showings |
| Title | Liens, ownership defects or restrictions | Always worth reviewing; essential for cash buyers too | Cure periods depend on local practice |
| Insurance/flood | Uninsurable property or unaffordable risk | Coverage is uncertain or disaster exposure is elevated | Quotes and risk maps must be obtained quickly |
| HOA documents | Unexpected fees, rules or weak reserves | Buying a condo or HOA property | Document delivery can compress the review period |
Write deadlines and notice requirements precisely
For each contingency, put the condition, action, deadline, and remedy in the contract rather than relying on an email or verbal promise. A practical review sequence is:
- List the condition. State the loan type or terms, inspection standard, appraisal threshold, required sale or closing, insurance requirement, or document package to be reviewed.
- Set a calendar date and time. Avoid vague phrases such as “within a reasonable period.” Confirm whether the period is measured in calendar or business days and when it begins.
- Specify the buyer’s action. Identify the application, inspection, appraisal response, title objection, document review, or insurance evidence required.
- Specify notice delivery. Follow the contract’s permitted email, portal, personal-delivery, or agent-delivery method and retain proof.
- State the remedy. Clarify whether an unmet condition permits cancellation, a price change, repairs, a credit, an extension, or another response.
- Coordinate overlapping clocks. An inspection specialist, lender appraisal, title search, and insurance quote may need to occur at the same time. Build in time for weekends, holidays, re-inspections, and lender underwriting.
Earnest money, waivers and common failure points
Earnest money is not automatically protected whenever a buyer changes their mind. NAR warns that premature waivers, missed deadlines, failure to give required notice, or abandoning the transaction can put the deposit at risk. A contingency that has expired may no longer support cancellation, even if the underlying problem appears later.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors- Waiving inspection too early: You may lose contract-based options when serious defects emerge.
- Waiving appraisal protection without a cash plan: You could be responsible for the entire difference between price and value.
- Assuming preapproval equals final approval: Underwriting and property review can still fail.
- Ordering insurance after the deadline: A carrier may decline the property or quote a premium you cannot afford.
- Ignoring specialist findings: A general inspection may not evaluate a sewer line, foundation, pool, septic system, or pests.
- Relying on an agent’s reminder: Put every deadline on your own calendar and confirm written notices were received.
If a problem appears, notify your agent and attorney immediately, preserve reports and correspondence, and follow the contract rather than simply refusing to close. Ask for a written extension before a deadline expires; an extension is effective only when all required parties sign it.
Questions to answer before submitting the offer
- What loan approval and loan terms must be secured, and by what date?
- How many days are allowed for the general inspection and any specialist inspections?
- If the appraisal is low, how much of a gap can you cover without draining emergency reserves?
- Must your current home sell, or merely close, before you can fund this purchase?
- Can the property be insured at a premium you can afford, and is separate flood insurance required or prudent?
- Are there title, HOA, condition, or disaster-risk issues that require a review period?
- What notice, documentation, and timing preserve your earnest money under this specific form?
How to balance protection with a competitive offer
Start with risks you cannot financially absorb, not with a goal of having the fewest clauses. A buyer with ample cash may choose a capped appraisal gap, while a buyer whose down payment is tightly budgeted may need a full appraisal contingency. Someone purchasing a move-up home may need sale or close protection even when a seller finds it inconvenient. A property with an aging roof, flood exposure, or complicated HOA warrants more investigation than a newer, straightforward home.
Discuss alternatives with your agent: shorter but realistic periods, a defined repair threshold, a capped appraisal contribution, a larger earnest-money deposit paired with retained protections, or a seller credit subject to lender rules. Do not waive a contingency merely because another offer did. The financial exposure should be clear before you sign.
U.S. legal scope
This is general U.S. consumer guidance, not state-specific legal advice. State and local law, disclosure rules, standard forms, title customs, and market practices vary. Only the signed agreement determines your rights, obligations, cancellation procedure, and earnest-money treatment. Have a local real-estate attorney or qualified buyer agent explain the actual form and deadlines before you submit it.
