It prohibits discrimination in specified housing-related financial assistance, including financing to buy, build, rehabilitate or refinance an owner-occupied one-to-four-unit residence and home-improvement financing for a one-to-four-unit residence.
The law is not a blanket rule for every product offered by a bank or credit union. Your transaction, the institution’s license or charter and the conduct you are challenging determine which California protections and complaint channel may apply.

What the California Housing Financial Discrimination Act does
The California Department of Financial Protection and Innovation (DFPI) identifies the Housing Financial Discrimination Act of 1977 as California’s fair-lending law for the housing-finance situations described in its notice. DFPI lists the related regulations in Title 21, Division 3, Chapter 4 of the California Code of Regulations. You can read the DFPI Housing Financial Discrimination Act fair-lending notice and the California Code of Regulations.

The notice states in capital letters: “IT IS ILLEGAL TO DISCRIMINATE IN THE PROVISION OF OR IN THE AVAILABILITY OF FINANCIAL ASSISTANCE” because of the protected considerations it lists. That means a lender cannot make housing-finance assistance unavailable, or provide it on discriminatory terms, because of a protected characteristic or through the prohibited neighborhood-based practices described below.

HFDA status does not turn solely on whether the provider calls itself a bank, credit union, mortgage company or finance lender. First identify what financial assistance you sought, whether the property and use fit the notice, and which agency regulates the institution. California has other laws with different coverage, so a complaint may involve a law other than HFDA.
Which characteristics are protected
DFPI’s notice names these characteristics:
- Race
- Color
- Religion
- Sex
- Gender
- Gender identity
- Gender expression
- Sexual orientation
- Marital status
- National origin
- Ancestry
- Familial status
- Source of income
- Disability
- Veteran or military status
- Genetic information
Protection can matter at several points: whether an application is accepted, how the lender evaluates the request, the amount or rate offered, required terms, an appraisal or valuation, and whether assistance is made available at all. A denial, higher price or request for more documentation is not, by itself, proof of unlawful discrimination. The relevant question is whether the decision or treatment was connected to a protected characteristic or another practice the law prohibits.
Which transactions the notice covers
DFPI describes the covered assistance as follows: “THESE PROVISIONS GOVERN FINANCIAL ASSISTANCE FOR THE PURPOSE OF THE PURCHASE, CONSTRUCTION, REHABILITATION OR REFINANCING OF ONE-TO-FOUR-UNIT FAMILY RESIDENCES OCCUPIED BY THE OWNER AND FOR THE PURPOSE OF THE HOME IMPROVEMENT OF ANY ONE-TO-FOUR-UNIT FAMILY RESIDENCE.”

In practical terms, the notice addresses:
- Money to purchase an owner-occupied one-to-four-unit family residence.
- Financing to construct such a residence.
- Financing to rehabilitate such a residence.
- Refinancing an owner-occupied one-to-four-unit family residence.
- Home-improvement financing for any one-to-four-unit family residence, whether or not the owner occupies it.
The wording is narrower than “all banking.” The notice does not state that every deposit account, credit card, automobile loan, unsecured personal loan or other consumer product is covered by HFDA. If your dispute concerns one of those products, another state or federal rule may be relevant, but you should not assume HFDA applies without matching the facts to its stated scope.

How neighborhood and appraisal decisions are limited
HFDA’s notice addresses more than an applicant’s personal characteristics. It says a financial institution may not consider neighborhood trends, characteristics or conditions unless it can demonstrate in the particular case that doing so is required to avoid an unsafe and unsound business practice.
The notice also bars considering a neighborhood’s racial, ethnic, religious or national-origin composition when appraising housing or deciding whether to provide financial assistance or on what terms to provide it. A lender therefore cannot use a community’s protected-group makeup as a substitute for an individual assessment of the property and transaction.
These rules can become important when a borrower receives an appraisal that appears inconsistent with the property’s condition or comparable sales, when a lender changes terms after learning where a home is located, or when a loan program is made unavailable in a particular area. Keep the valuation, underwriting explanations and communications so the sequence can be evaluated rather than relying on memory.

What the law means when a bank or credit union says no
A lender can deny an application for lawful reasons such as income, debt, documentation, collateral or program requirements. HFDA does not guarantee approval or a particular interest rate. A disappointing outcome becomes a potential fair-lending issue when evidence suggests the institution treated similarly situated applicants differently, relied on a protected characteristic, used a prohibited neighborhood factor, or imposed terms not explained by legitimate underwriting criteria.

Ask for the decision and the terms in writing. Keep any adverse-action or counteroffer notice, the application you submitted, requested documents, rate sheets, fee estimates, appraisal or valuation materials, and messages with loan officers, underwriters or branch staff. Record dates, names, locations, and what was said while events are fresh. These records help an agency determine what transaction occurred and which law or regulator has authority.
HFDA compared with other California protections
California’s legal protections overlap in subject matter but not in scope. The following distinctions come from the agencies’ descriptions and are intended to prevent a housing-finance rule from being applied to every financial product.
| Law or framework | What the official description addresses | Key boundary or date | Official source |
|---|---|---|---|
| Housing Financial Discrimination Act of 1977 | Discrimination in specified financial assistance for owner-occupied one-to-four-unit residences and home improvement of one-to-four-unit residences; includes restrictions on certain neighborhood and appraisal considerations. | Housing-finance scope stated in DFPI’s fair-lending notice; it does not state coverage of every bank or credit-union product. | DFPI fair-lending notice |
| California Consumer Financial Protection Law | Oversight of additional consumer-financial activity under DFPI’s authority. | DFPI says SB 825 took effect January 1, 2026 and clarified that certain DFPI licensees otherwise exempt from the law remain subject to section 90003 enforcement for unlawful, unfair, deceptive or abusive acts or practices concerning consumer financial products or services. | DFPI California Consumer Financial Protection Law page |
| California Financing Law and AB 539 | Regulates finance lenders and brokers making or brokering consumer and commercial loans, subject to statutory exceptions; prohibits misrepresentation and deceptive conduct in connection with those loans. | DFPI says AB 539’s Fair Access to Credit Act protections became operative January 1, 2020. For specified loan amounts, the page describes a 36% annual simple-interest ceiling plus the Federal Funds Rate and other protections. | DFPI AB 539 notice |
| Fair Employment and Housing Act housing protections | Housing and housing-related services, including mortgage lending, under the California Civil Rights Department’s housing guidance. | This is a separate housing-discrimination path from the HFDA notice. | California Civil Rights Department housing guidance |
The table does not assign every bank, credit union or lender to a particular complaint agency. Charter type, licensing status, product and alleged conduct can change the answer. Confirm jurisdiction before relying on a particular agency or remedy.
What to do if you suspect discrimination on a home loan
- Identify the transaction. Write down whether the request involved a purchase, construction, rehabilitation, refinance or home improvement; whether the property has one to four units; and whether an owner occupies it. This establishes whether the facts resemble the HFDA notice.
- Preserve the record. Save the application, denial or counteroffer, rate and fee terms, appraisal or other valuation documents, income and asset submissions, requested-document lists, emails, text messages and call notes. Keep the dates and the names or job titles of people involved.
- Describe the comparison or trigger. Note any statement about race, religion, family, disability, source of income, military status or another listed characteristic. Also note neighborhood comments, appraisal language, a change in terms after the property address was supplied, or different treatment of a comparable applicant. Separate direct observations from assumptions.
- Ask the institution’s management for an explanation. DFPI’s notice directs customers with questions or complaints to the financial institution’s management or to DFPI. Request a written explanation of the decision, the applicable underwriting reason and how to submit a formal complaint. Keep your request factual and attach copies rather than originals.
- Contact DFPI when appropriate. Use DFPI’s fair-lending notice as the starting point for a complaint about an institution or transaction within its authority. Provide the transaction description and documents, and ask DFPI to confirm whether it handles that institution and issue.
- Review the Civil Rights Department route. The California Civil Rights Department explains that the Fair Employment and Housing Act applies to most providers of housing and housing-related services, including mortgage lenders. Its housing information is a separate route for housing-discrimination concerns.
- Confirm the proper regulator. If the product is outside the HFDA notice, or the institution is regulated under a different license or charter, ask the agency or the institution which complaint channel has authority. Filing with the wrong office can delay review; do not assume an agency will transfer or decide the matter for you.
How to present a useful complaint
A clear complaint lets the reviewer test the facts against the law. Include:

Does HFDA cover my credit card, checking account or auto loan?
DFPI’s notice does not say that every deposit, credit-card, automobile or other bank product is covered. Those products require a separate scope analysis under the applicable consumer-finance or anti-discrimination law.
Can a lender consider where a home is located?
Location can be relevant to legitimate property and safety analysis, but the HFDA notice restricts neighborhood trends, characteristics or conditions unless the institution demonstrates that consideration is required to avoid an unsafe and unsound business practice. It specifically bars using racial, ethnic, religious or national-origin composition in appraising housing or setting whether or on what terms to provide assistance.

No. A denial alone does not establish a violation. Evidence about the reason given, treatment of comparable applicants, protected-characteristic comments, appraisal practices and the transaction’s fit with the HFDA scope is needed to evaluate a complaint.

Can I complain about a mortgage lender that is not a bank or credit union?
Possibly. The relevant agency depends on the lender’s license or charter, the product and the alleged conduct. Mortgage lending is included among housing-related services in the Civil Rights Department’s guidance, while DFPI’s authority varies by the institution and law involved.
Recent California developments that are separate from HFDA
Two DFPI updates are easy to confuse with HFDA but address different subjects. SB 825 took effect January 1, 2026. DFPI says it clarified that certain licensees otherwise exempt from the California Consumer Financial Protection Law remain subject to section 90003 enforcement for unlawful, unfair, deceptive or abusive acts or practices involving consumer financial products or services. That is a broader consumer-protection clarification, not an expansion stated in the HFDA notice.
AB 539, the Fair Access to Credit Act, became operative January 1, 2020. DFPI describes specified protections for certain consumer loans made by California Financing Law licensees, including a 36% annual simple-interest ceiling plus the Federal Funds Rate for defined loan amounts. Those rules apply to the covered finance-lender loans described by DFPI, not automatically to every bank or credit-union product and not as a replacement for HFDA’s housing-finance provisions.
A practical decision checklist
- Is the transaction connected to buying, constructing, rehabilitating or refinancing an owner-occupied one-to-four-unit residence, or to home improvement of a one-to-four-unit residence?
- Did the decision, price, terms, appraisal or availability appear tied to a protected characteristic named by DFPI?
- Did the institution refer to neighborhood trends or to racial, ethnic, religious or national-origin composition?
- Do your documents show the timeline and the institution’s stated reason?
- Have you asked management for a written explanation?
- Have you checked DFPI and the Civil Rights Department’s housing guidance without assuming either agency has jurisdiction?
- Have you kept copies and protected account numbers and other unnecessary personal data?
Using this checklist will not predict an agency’s decision. It helps you match the facts to the law’s defined housing-finance scope and present a complaint that can be evaluated on its documents and timeline.
