Short answer: The IRS does not give tax-preparation companies a general right to search or retrieve taxpayer records. Federal law instead restricts what a tax return preparer may do with tax return information received while preparing a return. Under Internal Revenue Code § 7216, a preparer generally may use or disclose that information only for preparing or helping prepare a return, under a specific regulatory exception, or after obtaining the taxpayer’s knowing and voluntary consent for a defined use or disclosure.
That rule concerns information held by the preparer. It is different from the IRS disclosing records from its own files to a third party. An IRS authorization such as Form 8821 can permit a designated person to receive specified IRS information, but it is not a blanket access credential for a tax company.

The legal starting point: no blanket IRS access
The phrase “access taxpayer data” can describe two different data flows. A tax company may receive documents, account details and other return information directly from you during preparation. Separately, the IRS may hold transcripts and other records in its own systems. The principal federal rule for a preparer’s handling of information supplied in the preparation relationship is IRC § 7216, not a general IRS grant of database access.

“Tax return preparer” is the statutory term. It can include an individual and, depending on the activity, a business whose personnel prepare or assist with returns. The rule does not mean that every employee of a financial-services company may freely use everything a customer submitted. The purpose of the use, the identity of any recipient, the kind of information involved and the applicable exception all matter.
What § 7216 prohibits and what penalties can apply
Covered conduct
A preparer can violate § 7216 by disclosing tax return information to another person or by using it for a non-preparation purpose without a valid legal basis. The prohibition reaches conduct that is knowing or reckless; it is not limited to an intentional sale of a customer list. The permitted purpose is preparing or assisting in preparing an income-tax return, subject to the detailed regulations.
The IRS also describes a separate civil penalty in § 6713. These provisions are legal exposure for unauthorized use or disclosure, not evidence that a violation automatically produces a particular result in every case.

| IRC § 6713 | A civil penalty of $250 for each unauthorized disclosure or use, subject to a $10,000 annual cap per person, as described by the IRS. |

When a preparer must obtain your consent
If a proposed use or disclosure is outside return preparation and outside a regulatory exception, the preparer generally must obtain your consent in advance. Treasury Regulation § 301.7216-3 requires consent to be knowing and voluntary. The IRS summarizes the consent rules in its FAQs related to strengthened taxpayer control over tax information.

Information a consent should identify
A consent is not a blank check. It should identify the tax return information covered and explain the purpose. For a disclosure, it generally must identify the recipient as well as the purpose of the disclosure. For a use, it must describe the particular use the preparer wants to make. A form that merely says the company may use “your information” for “business purposes” may not give the specific description contemplated by the regulation.
The document should be read as a permission for the stated action, not as permission for every later use by everyone who receives the information. If the proposed activity changes, a different or additional consent may be necessary.

Consent normally cannot be the price of preparation
The regulations generally treat consent as involuntary when a preparer conditions preparation services on agreeing to an unrelated use or disclosure. In practical terms, a company ordinarily cannot say that it will prepare your return only if you authorize marketing, cross-selling or another separate activity.
There is a limited condition in the regulation for disclosure to another preparer that will assist with preparation or provide auxiliary services connected to preparation. That narrow situation does not turn consent into a general waiver, and it does not authorize unrelated onward use.
Form and timing requirements
The IRS Section 7216 information center says the final regulations became effective December 28, 2012. It directs preparers to Revenue Procedures 2013-14 and 2013-19 for consent guidance. IRS Publication 4299 (Rev. 10-2026) states that Revenue Procedure 2013-14 supplies mandatory language for consents involving Form 1040-series returns. A preparer should use the applicable current regulation and revenue procedure for the return and situation at issue.

Regulatory exceptions are specific, not a general sharing license
Consent is only one lawful basis. Treasury Regulation § 301.7216-3 and related provisions permit defined disclosures and uses without a separate consent in particular circumstances. The details and limits of each exception control.
Preparation-related sharing
The rules allow certain sharing needed to prepare or assist in preparing a return. Examples include specified disclosures to the IRS and certain sharing within a U.S. preparer firm for return preparation or auxiliary services. A firm cannot assume that every affiliate, contractor or overseas recipient falls within the same exception. The recipient, location, service and purpose must fit the regulation.
Lists, statistical compilations and conflict reviews
The regulations also address defined circumstances involving lists, statistical compilations and conflict reviews. These provisions are limited by their conditions. They should not be treated as permission to sell or broadly distribute identifiable customer tax data.
Why the exception’s details matter
An exception can authorize one operational step while leaving a later step outside its scope. For example, a disclosure needed to complete return preparation does not automatically authorize the recipient to market another service using the same information. The safest question is always: which exact exception, for which exact recipient and purpose, is the preparer relying on?
Preparer-held information versus IRS-held records
Section 7216 regulates a preparer’s handling of tax return information obtained in the preparation relationship. It does not grant the company a right to log in to IRS systems or conduct a general search of IRS-held records.

The IRS separately says it generally cannot share a taxpayer’s information with outside parties unless the taxpayer authorizes the disclosure or the law authorizes it. Topic no. 312, Disclosure authorizations, explains Form 8821, which lets a taxpayer authorize a designated person to receive specified tax information from the IRS. The IRS’s Taxpayer Bill of Rights explanation of confidentiality describes the underlying confidentiality principle.
| Question | Preparer-side rule | IRS-side rule |
|---|---|---|
| Whose records are involved? | Information the preparer receives or creates in preparing or assisting with a return. | Information maintained in IRS files and systems. |
| What normally authorizes access or use? | The preparation purpose, a defined regulatory exception, or valid specific consent. | A taxpayer authorization such as Form 8821, or another legal authorization. |
| Does the authority create unlimited access? | No. The permitted purpose, recipient and information remain limited. | No. Form 8821 identifies the information and person covered by the authorization. |
How to evaluate a data request from a tax company
When a preparer asks you to sign a consent or agrees to share information, use this sequence before accepting it:
- Identify the information. Determine whether the request covers a complete return, a particular schedule, income figures, contact details or another defined category of tax return information.
- Identify the purpose. Ask whether the information is needed to prepare or assist with your return, or whether it will be used for a separate service, analytics, marketing, list-building or another activity.
- Identify every recipient. For a disclosure, check whether the form names the recipient, including another preparer, firm or service provider. A generic reference to “partners” does not tell you who will receive the information.
- Check for an exception. If the company says consent is unnecessary, ask which regulatory exception applies and how the proposed action fits its conditions.
- Check whether the choice is genuinely voluntary. Preparation generally cannot be conditioned on consent to an unrelated use or disclosure. Ask what preparation option is available if you decline.
- Check the timing and scope. Consent should be obtained before the covered use or disclosure. Confirm whether it expires, which tax year or return it covers and whether it permits one action or a continuing activity.
- Keep a copy. Retain the signed form and any explanation so you can compare later communications or requests with the permission you actually gave.
Common situations and how the rules apply
A request to market another product
Using return information to market an unrelated product is not the same as using it to prepare the return. A preparer generally needs a specific, knowing and voluntary consent unless a defined exception applies. The company should describe the information and marketing purpose, and preparation should not ordinarily depend on your agreement to that separate activity.
Sharing with another preparer
A second preparer may receive information when the disclosure assists with preparing the return or provides auxiliary services connected to preparation. The regulation recognizes this limited situation, but it does not authorize the second recipient to repurpose the information for unrelated activities. Verify who the recipient is and what service that person will perform.

Certain disclosures within a U.S. preparer firm can qualify for a preparation or auxiliary-services exception. The fact that two entities use the same brand or belong to the same corporate group does not, by itself, answer whether the exception applies. The firm must still meet the regulation’s conditions.

Asking the IRS to disclose records
If the goal is for the IRS to send specified information to a tax professional, that is an IRS disclosure authorization question. Form 8821 is designed for a taxpayer to designate a person and the tax information covered. It does not give the designee unrestricted access to all IRS records.
What the official guidance does and does not establish
The IRS materials identify the governing restrictions, consent requirements, exceptions and penalty amounts. They do not provide a current statistic showing how often tax-preparation companies access, use or disclose taxpayer data. Historical participation figures or the existence of a penalty should not be presented as a measure of present-day industry behavior.
For a real consent or disclosure dispute, consult the version of the regulation, revenue procedure and IRS guidance that applies to the return, tax year and transaction. The IRS Section 7216 information center is the agency’s central starting point for preparer guidance, while Publication 4299 provides additional consent information for taxpayers and preparers.

The IRS gives tax-preparation companies no general authority to browse taxpayer records. A preparer may handle information for return preparation, under a narrowly defined regulatory exception, or with your specific and voluntary consent. IRS-held records are governed separately, and an authorization such as Form 8821 is limited to the information and recipient you designate. Before signing, match the requested data, purpose and recipient to the exact permission described in the document.
