What a Credit Card Charge-Off Means for Your Credit Score and Debt

A credit-card charge-off is the creditor’s accounting decision to treat a seriously delinquent account as a loss. It does not cancel what you owe. After roughly four to six months of missed minimum payments, a card issuer may charge off the account, but timing is creditor-specific rather than a universal legal deadline. The issuer can still collect, hire a debt collector, or sell the account.

A charge-off is severe credit damage because it follows months of late payments and may be accompanied by a separate collection account. Paying or settling can reduce the balance and update the account’s status, but accurate negative history generally remains until the legal credit-reporting period expires.

What a charge-off actually is

Creditors use “charge-off” as an accounting term. Under guidance from the Federal Trade Commission (FTC), an issuer may charge off a card after a borrower misses payments for about four to six months. The account is written down as a loss on the creditor’s books, but the borrower’s obligation continues. As the FTC puts it in How To Get Out of Debt: “Even if this happens, you still will owe the debt.”

The account may remain with the original issuer, be assigned to a collection agency, or be sold to a debt buyer. A sale changes who seeks payment, not the underlying history. Interest, fees, and applicable state-law limits depend on the contract and governing law, so the balance shown by a collector should be checked rather than assumed.

Charge-off timing is not a fixed six-month rule

Four to six months is a consumer-guidance range, not a deadline that applies to every card or state. Issuers’ policies differ, and military protections, payment arrangements, bankruptcy, disputes, or other account events can affect timing. The first missed payment that led to the charge-off is important for determining the reporting period; a later sale to a collector does not create a new delinquency date when the original information is accurate.

How a charge-off affects your credit score

There is no honest, universal number of points to subtract. The effect depends on the scoring model, the age of the delinquency, your utilization, the number of other late accounts, and the rest of your credit file. Someone with an otherwise clean, long file may see a different change from someone who already has several serious delinquencies.

The account can hurt in several ways at once:

  • Months of 30-, 60-, 90-, and 120-day late-payment notations may precede the charge-off.
  • The charge-off itself signals a severe default to lenders.
  • A collection tradeline may appear if the debt is assigned or sold.
  • The charged-off balance can inflate revolving utilization until the account is paid, settled, or otherwise updated.
  • Recent severe derogatory information can make approval, pricing, deposits, or credit limits less favorable.

As the account ages, scoring impact often lessens, but the record does not disappear early merely because it becomes less influential. The Consumer Financial Protection Bureau (CFPB) says most negative information can generally be reported for seven years, and accurate information cannot be removed simply because a credit-repair company is paid.

How long it stays on your credit report

Federal law sets a specific starting rule for this type of account. For an account placed for collection, charged to profit and loss, or treated similarly, the seven-year reporting period begins after the expiration of the 180-day period that begins with the delinquency immediately preceding the charge-off or collection activity. This rule appears in the 2024 edition of the U.S. Code.

In practical terms, the relevant date is tied to the original delinquency that led to the charge-off, not the date a collector bought the debt and not the date you later made a payment. The exact removal date should be confirmed on each bureau report because reporting histories can contain factual errors.

What payment changes—and what it does not

Payment normally changes the balance and may change the status to “paid charge-off.” A negotiated settlement may show “settled” or “settled for less than the full balance.” Those updates can matter to a lender reviewing a recent application, but they generally do not erase accurate late-payment and charge-off history before the seven-year period ends.

Do not pay a company that promises to delete accurate information or to produce a guaranteed score increase. You can dispute information that is inaccurate, incomplete, duplicated, or not yours; you cannot require a bureau to remove accurate negative data simply because the debt was paid.

What happens after the charge-off

A charge-off does not end collection rights. The original creditor may continue contacting you, hire a company to collect, or sell the account. Under the CFPB’s definition, a debt collector is a person or company that regularly collects debts owed to someone else, including debt buyers.

Validation before you negotiate

When a collector first contacts you, federal collection rules generally require validation information identifying the creditor, the amount claimed, and your rights to dispute the debt. Request and review that information before sending money or agreeing to a settlement. Compare the collector’s records with your statements and credit reports, and watch for duplicate tradelines or an amount that does not match the account history.

Keep copies of letters, emails, account statements, call notes, and proof of every payment. If you dispute the debt in writing within the applicable period, collection activity may be required to pause until the collector responds, subject to the Fair Debt Collection Practices Act (FDCPA) and Regulation F’s detailed procedures.

Credit-reporting time is different from the lawsuit deadline

The seven-year credit-reporting period is not a statute of limitations for suing. CFPB consumer guidance says many state statutes of limitations fall in the three-to-six-year range, but the actual period varies by state, debt type, contract language, and facts such as a judgment or a previous payment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Regulation F bars a debt collector from bringing or threatening legal action on a time-barred debt. A collector may still be allowed to seek voluntary payment, subject to disclosure and other restrictions. In some states, a payment or written acknowledgment can restart the limitations clock. Before acknowledging an old debt, making a token payment, or signing a new promise to pay, check the governing state law and obtain advice from a qualified consumer-law attorney if litigation is threatened.

If court papers arrive

Do not ignore a summons. The response deadline is set by the court, and missing it can lead to a default judgment even when the debt amount or ownership is wrong. Gather the validation notice, account statements, contracts, and credit-report entries, then contact a licensed attorney or an approved legal-aid service in your state.

Paying in full versus settling

Neither option automatically removes accurate history. The right choice depends on cash available, lawsuit risk, tax exposure, and whether the agreement can be documented.

Consideration Repayment in full Settlement for less
Total dollars Usually higher, but resolves the stated balance if all terms are met. May require fewer total dollars, but the creditor must accept the agreed amount.
Monthly affordability Can be spread over a written payment plan if the creditor agrees. Often requires a lump sum or short schedule; missed settlement installments can void the deal.
Credit-report status Typically updates to paid; prior accurate derogatory history remains. Typically updates to settled or settled for less; prior history remains.
Lawsuit risk Can reduce risk after a valid agreement is completed, but obtain confirmation of the account’s disposition. Can reduce risk only if the written agreement covers the full claim and is honored.
Tax consequences Generally no canceled-debt income when the full balance is paid. The forgiven portion may be treated as taxable canceled debt, subject to exclusions.
Documentation Keep receipts and a letter showing a zero balance. Obtain the settlement amount, due dates, release language, and reporting treatment in writing before paying.

Never assume a phone representative’s promise is enough. A written agreement should identify the account, the exact amount and deadline, what happens after payment, and whether the creditor will release the remaining balance. Use a payment method that creates a durable record.

Other ways to address the debt

Option What it can do Questions to ask
Nonprofit credit counseling Reviews the budget and may offer a debt-management plan for eligible unsecured debts. What fees apply, which creditors participate, how long repayment takes, and whether accounts must be closed?
Debt-management plan Combines approved payments through a counseling agency; creditors may reduce rates or fees if they participate. Is the charged-off account accepted, and what happens if a creditor declines?
Debt-settlement firm Attempts negotiated reductions, often after funds accumulate. What upfront or success fees are charged, what collection or lawsuit support exists, and what happens if negotiations fail?
Consumer-law attorney Can assess validation, reporting errors, collection violations, limitations defenses, or a lawsuit. Is the lawyer licensed in the relevant state, and is the fee hourly, flat, or contingent?
Bankruptcy counsel Explains whether bankruptcy could discharge the debt and how exemptions, assets, and tax issues apply. What debts would be affected, what costs apply, and are there recent charges or transfers that need review?

Taxes when a charged-off balance is canceled

A charge-off by itself is not a cancellation. If a lender later forgives or cancels all or part of the balance, the Internal Revenue Service (IRS) generally treats the canceled amount as ordinary income. Many creditors report cancellations of $600 or more on Form 1099-C under the IRS’s 2025 instructions and publication guidance.

Review the form against your records. A 1099-C can be incorrect, and it can arrive while collection activity continues. Contact the creditor about discrepancies and discuss the tax return with a tax professional. If no form arrives, canceled debt can still be taxable unless an exception or exclusion applies.

Common exclusions

  • Bankruptcy: Debt discharged in a qualifying bankruptcy case may be excluded under the applicable rules.
  • Insolvency: If your liabilities exceeded the fair value of your assets immediately before cancellation, some or all of the canceled amount may be excluded, subject to detailed calculations.
  • Other fact-specific exclusions: Additional rules can apply to certain mortgages, farms, or business debts, but they require professional review.

Use the IRS forms and instructions in effect for the tax year of the cancellation. Keep the settlement agreement, account statements, asset-and-liability calculation, and any bankruptcy records.

What to do now: a practical sequence

  1. Pull all three credit reports. Identify the original creditor, account number, first delinquency information, charge-off date, reported balance, last update, and any separate collection tradeline.
  2. Check accuracy line by line. Look for a wrong owner, duplicate collection, impossible dates, an inflated balance, or an account that is not yours. Dispute factual errors with each reporting company and the furnisher, keeping copies and delivery records.
  3. Set aside the lawsuit question. Determine your state, debt type, contract, and likely statute-of-limitations period before making a payment or written acknowledgment on an old account.
  4. Request validation from a collector. Compare the validation information with your statements and reports. Do not share bank details or make a payment until you know who owns the debt and what the agreement covers.
  5. Build a written resolution plan. Compare affordable repayment, settlement, nonprofit counseling, and legal options by total cost, monthly cash flow, reporting status, lawsuit risk, tax effects, fees, and documentation.
  6. Complete the paper trail. Obtain signed settlement or payment terms, make payments as required, save confirmations, and check later reports to ensure balances and statuses were updated accurately.
  7. Handle any canceled debt. Review Form 1099-C, assess bankruptcy or insolvency exclusions, and ask a tax professional how to report the amount.

Common mistakes to avoid

  • Assuming “charged off” means the debt vanished.
  • Confusing the seven-year reporting period with the state deadline for a lawsuit.
  • Making a small payment on an old debt without checking whether state law can restart the limitations period.
  • Paying a settlement before receiving terms in writing.
  • Believing a paid or settled status deletes the preceding accurate late-payment history.
  • Ignoring court papers or treating a 1099-C as automatically correct.
  • Paying for a guaranteed deletion or guaranteed score increase.

When professional help is worth the cost

Consider a consumer-law attorney when a collector threatens suit on a time-barred debt, cannot substantiate the account, reports materially false information, or violates collection-contact rules. A nonprofit counselor can help when several unsecured accounts compete with rent, utilities, or medical costs and you need a sustainable budget. A tax professional is appropriate when a settlement creates a large possible 1099-C, insolvency is close to the threshold, or bankruptcy is involved.

The essential distinction is simple: a charge-off changes how the creditor accounts for a loss; it does not erase the debt. Your next decisions should be based on verified ownership and dates, the law of the state that governs the account, a written payment or settlement agreement, and a realistic budget.
