That means the state does not impose a regular wage tax on employees and generally does not tax Social Security, pension payments, 401(k) withdrawals, or IRA distributions as personal income. Federal income tax, Social Security and Medicare taxes, and taxes imposed by another state can still apply.
Two separate rules matter: Washington’s 7% capital-gains excise tax on certain long-term investments, and an enacted 9.9% tax beginning January 1, 2028, for individuals and married couples filing jointly whose annual adjusted gross income exceeds $1 million. The first returns under that new law are due in April 2029.

Does Washington have a state income tax right now?
No broad Washington individual income tax is currently charged on ordinary earnings. The Washington Department of Revenue’s current FAQ states, “No. Washington does not currently have an individual income tax.” The state statute generally prohibits state and local personal-income taxation, subject to the enacted high-income exception that begins in 2028.
“No income tax” does not mean no taxes. Washington residents and visitors may owe sales and use tax, property tax, business-and-occupation tax, estate tax, payroll-program contributions, and the state’s separate capital-gains excise tax. Your federal return remains necessary, and another state may tax income connected with work or residence there.

How are employee wages treated?
Washington-based employees
Salary, hourly pay, bonuses, commissions, tips, and other ordinary compensation for work performed in Washington are not currently subject to a Washington individual income-tax withholding. Your employer will still withhold federal income tax, Social Security, and Medicare where applicable. Benefit deductions, retirement-plan contributions, and payroll-program charges can also affect your paycheck without being Washington income tax.
Employees who work in more than one state
A different state can impose its own income tax on work performed there. Keep a contemporaneous record of work location, travel, and workdays when your job crosses state lines. State withholding and credit rules differ, so the absence of Washington income tax does not by itself eliminate a filing obligation elsewhere.
Are Social Security, pensions, 401(k) withdrawals, and IRA distributions taxed?
Under Washington’s current rules, Social Security benefits, pension payments, 401(k) distributions, and traditional or Roth IRA distributions do not incur a Washington personal-income-tax charge. This treatment follows from the absence of a general individual income tax, not from a special exemption for each type of retirement payment.

Federal rules remain separate. Depending on your total income and account type, federal tax may apply to pension, 401(k), or traditional IRA distributions, and part of Social Security may be federally taxable. A state where you previously lived, or where a payment is sourced under that state’s law, may also have different rules.

Retirement accounts and Washington capital gains
Washington’s capital-gains tax is a separate excise tax. The Department of Revenue says transactions through qualified retirement savings accounts are not subject to that tax. Selling an investment inside a qualifying retirement account therefore does not create a Washington capital-gains-tax bill, although withdrawals from that account can still have federal consequences.
How does Washington tax capital gains?
The state imposes a 7% capital-gains excise tax on covered sales or exchanges of long-term capital assets. The Department of Revenue describes covered assets as including stocks, bonds, business interests, and other investments. This is not a tax on wages and should not be described as a general income tax.
Assets generally outside the tax
- Real-estate sales are exempt from Washington’s capital-gains excise tax.
- Transactions through qualified retirement accounts are exempt under current Department of Revenue guidance.
- Other statutory exclusions may apply depending on the asset and transaction facts.
When a return is required
Only individuals who owe Washington capital-gains tax must file the state capital-gains return. The return is due on the same day as your federal income-tax return, including any applicable extension date. The Department of Revenue adjusts the standard deduction annually for inflation, so check the current-year amount before calculating whether a return or payment is required. Do not use an older threshold from a prior tax year.
Keep purchase records, sale statements, dates, basis calculations, and documentation for any claimed exclusion. A brokerage tax form may not contain every item needed for the Washington calculation, especially for private business interests or assets transferred between accounts.

What changes on January 1, 2028?
Washington Department of Revenue guidance issued in 2026 says: “Beginning Jan. 1, 2028, Washington will have a new 9.9% tax on individuals and married couples filing jointly with annual adjusted gross income exceeding $1 million.” The first returns are due in April 2029.
| Issue | Current rule | Enacted 2028 rule |
|---|---|---|
| Ordinary wages | No general Washington individual income tax | Detailed administration is still being developed; the enacted tax is aimed at the stated high-income threshold |
| Income level named by DOR | No general AGI-based personal income tax | Annual adjusted gross income exceeding $1 million |
| Rate | Not applicable as a general wage tax | 9.9% |
| Effective date | Current rules apply through December 31, 2027 | January 1, 2028 |
| First return | Not applicable | Due in April 2029 |
The published description gives the rate, threshold, effective date, and first-return timing, but filing, calculation, and administrative details are still being developed. High-income taxpayers should check updated Department of Revenue instructions before the 2028 filing season rather than applying a federal calculation by assumption.
Do remote workers owe tax based on their employer’s headquarters?
No. For Washington wage-sourcing purposes, the key fact is generally where the employee physically performs services, not where the employer’s headquarters or payroll department is located.
A nonresident employee’s compensation is allocated to Washington to the extent services are performed in Washington. If the same employee works in Washington and another state, the usual method is the ratio of Washington workdays to total workdays. The Department of Revenue may approve another reasonable method when the facts justify it.

Example of workday apportionment
Suppose a nonresident works 60 of 240 annual workdays from a Washington home and the remaining 180 days in another state. The ordinary allocation is 60/240, or 25%, of the compensation to Washington for sourcing purposes. Because Washington currently has no general wage income tax, that allocation does not create a regular Washington wage-tax payment today; it can still matter for employer registration, business taxes, payroll records, and another state’s credit or sourcing analysis.
Maintain calendars, time sheets, travel records, telework agreements, and a clear explanation of any approved alternative method. A payroll address alone is weak evidence if it conflicts with where services were actually performed.

An employee located in Washington can create obligations for an employer that has no Washington office. The Department of Revenue states that an out-of-state business with an employee in Washington may trigger physical nexus and a business-tax-reporting obligation.

- Washington business registration: The employer may need to register and report applicable state business taxes.
- Unemployment insurance: Coverage is generally required for employees working inside Washington, subject to program rules and exceptions.
- Workers’ compensation: Washington coverage requirements can apply to employees performing work in the state.
- Paid Family and Medical Leave: Covered out-of-state employers may have reporting and contribution duties for Washington employees.
One employee can be enough to create physical nexus; the number of employees is not a safe harbor. Employers should confirm registration, payroll, and filing requirements before the first Washington workday and update them when the employee’s location changes.

How does Washington determine residency?
Residency and the source of a particular payment are related but separate questions. A person can be a Washington resident while earning income sourced to another state, or a nonresident can perform services in Washington.
RCW 82A.04.010 generally treats a person as a resident if the person is domiciled in Washington, subject to statutory exceptions. A person who is not domiciled in Washington can also meet the definition by maintaining a place of abode in Washington and being physically present there for more than 183 days in the taxable year, again subject to listed exceptions.
Domicile factors
- The place you intend to make your permanent home.
- Where you keep your primary household and personal connections.
- Vehicle, voter, professional, and mailing records.
- Where your spouse or dependents live and where you spend most nights.
No single document decides every case. Keep evidence of the date you moved, the home you maintained, days spent in each state, and the steps taken to establish or abandon domicile.

How do residency and wage sourcing interact?
Use two analyses instead of one. The residency test asks which state regards you as a resident. The sourcing test asks where a specific service was performed or where a gain is assigned under the applicable law. For a remote employee, Washington workdays can matter even when the employee is domiciled elsewhere. Conversely, a Washington domiciliary may still face another state’s tax on compensation for services physically performed there.
Quick Recap
What should employees and retirees do now?
- Identify the payment type. Separate wages, retirement distributions, investment sales, and real-estate transactions.
- Track work locations. Record Washington and non-Washington workdays, travel, and any recurring schedule.
- Check other-state rules. Washington’s lack of a wage tax does not control another state’s withholding or filing requirements.
- Preserve tax records. Keep brokerage statements, basis information, retirement-account records, and residency evidence.
- Review capital-gains exposure. Determine whether an investment is a covered long-term asset and whether a statutory exclusion applies.
- Revisit high-income planning before 2028. Taxpayers near or above $1 million of annual AGI should monitor new Department of Revenue instructions and the April 2029 filing timetable.
Common mistakes to avoid
- Calling Washington completely tax-free while ignoring capital-gains, sales, property, business, payroll-program, or estate taxes.
- Assuming an employer’s headquarters determines the location of wage income.
- Counting days from memory instead of maintaining a workday and residency log.
- Applying the 7% capital-gains rate to wages or retirement withdrawals.
- Using a prior-year capital-gains deduction without checking the inflation-adjusted amount for the current year.
- Treating the 2028 high-income tax as if it were already being collected.
