Trump Account Contributions Through a Cafeteria Plan vs. Direct Contributions: What Changes?

By TheFinanceBase Team 11 min read

Short answer: Under the 2026 proposed federal regulations, you may elect a prospective payroll deduction through a Section 125 cafeteria plan for a dependent’s Trump Account, such as your child’s. You may not use that salary-reduction election for your own Trump Account. A direct contribution is made outside the employer’s cafeteria-plan election and does not automatically become pre-tax or deductible simply because it goes into a Trump Account.

The distinction affects who can receive the money, how you authorize it, which tax rules apply, employer reporting, and how the contribution limits are counted. The regulations are proposed, so your employer’s plan and the final Federal Register rule must be checked before relying on the treatment described here.

The comparison in one table

Issue Cafeteria-plan salary reduction Individual direct contribution
Who makes the payment? An employee elects a prospective salary reduction through an employer-maintained Section 125 plan. An individual contributes outside that payroll election.
Whose account can receive the money? Under the proposed rule, the employee’s dependent’s Trump Account only. The Section 125 salary-reduction restriction does not govern a contribution made outside the plan; the account’s other eligibility and contribution rules still apply.
How is it authorized? Through the employer’s written cafeteria-plan election process, before the salary is currently available. Through whatever contribution process the account administrator permits; no Section 125 election is involved.
Federal income-tax treatment A qualifying employer Section 128 contribution program may exclude amounts from federal gross income within the applicable limit. That does not make every personal contribution pre-tax. The cited federal materials do not establish a general income-tax deduction or exclusion for an individual contribution.
Payroll taxes The Section 128 gross-income exclusion does not itself remove the amount from FICA, FUTA, or Railroad Retirement Tax Act wages or compensation. Employer W-2 reporting for Section 128 contributions is not the description of an individual contribution made outside payroll.
Main limits The proposed Section 128 exclusion is generally $2,500 per employee per year. The broader annual Trump Account contribution limit is generally $5,000, adjusted for inflation, and qualifying Section 128 contributions count toward it. Contributions must remain within the account’s applicable annual limit, including any amounts that the rules require to be counted from another source.

What “direct contribution” means here

“Direct contribution” can describe two different actions. In this article it means an individual payment made outside an employer’s Section 125 salary-reduction election—for example, a parent transferring money to a child’s account from a personal bank account. It does not mean an employer’s separate Section 128 contribution.

An employer may make a qualifying Section 128 contribution to an employee’s Trump Account or to a dependent’s account. That employer contribution is legally different from an employee giving up salary under a cafeteria plan. The proposed rule permits the salary-reduction route only for a dependent’s account, even though an employer’s own Section 128 contribution can be directed to either an employee’s or dependent’s account.

Why the beneficiary changes the result

The proposed regulations draw a line between the employee’s own account and a dependent’s account. A salary-reduction election gives up compensation that would otherwise belong to the employee. Treasury and the IRS reason that the employee retains a future right connected with the employee’s own account, while the employee does not retain a future right to receive or assign distributions from a dependent’s account after contributing to it.

That rationale produces a practical rule: a payroll election can fund your child’s or other eligible dependent’s Trump Account, but it cannot fund your own account. Calling the deduction “family savings” does not change which account is eligible. The account beneficiary must satisfy the Trump Account rules, and the employer plan must follow the proposed cafeteria-plan requirements.

How a cafeteria-plan contribution works

A cafeteria plan is an employer-maintained written plan under Section 125. The plan describes which qualified benefits employees may choose and how salary-reduction elections operate. For a Trump Account contribution benefit to work, the account contribution feature must be specifically described in the plan; an informal payroll arrangement is not enough.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 1: Confirm that the employer has adopted the benefit

Ask the human-resources or benefits team whether the written Section 125 plan includes Trump Account contributions. The employer must establish eligibility rules, the contribution procedure, beneficiary or dependent designation process, required certifications, employee notices, reporting, and correction procedures. A payroll department cannot treat an ordinary after-tax transfer as a cafeteria-plan election merely because it appears on a paycheck.

Step 2: Identify an eligible dependent account

Under the proposal, the election must be for a dependent’s Trump Account. Confirm the dependent’s identity and eligibility using the employer’s certification process. An election for your own account is outside the proposed salary-reduction permission.

Step 3: Elect an amount before the pay becomes available

The election must be prospective. You can redirect salary that has not yet become currently available, but you cannot retroactively relabel wages you already earned or received. If a payroll deadline has passed, the employer generally cannot apply the cafeteria-plan treatment to that earlier pay period.

Step 4: Review the plan’s change and revocation windows

The proposed cafeteria-plan rule would permit an employee to change or revoke the election during the plan year, prospectively. It would also require at least monthly opportunities to make a prospective change or revocation. The effective date is controlled by the plan’s procedures and payroll cutoff, so a change may affect a later paycheck rather than the next one.

Step 5: Check the paystub and year-end reporting

Verify that the elected amount was directed to the intended dependent account and that the payroll record matches the election. IRS 2026 Form W-2 and W-3 instructions specify box 12 code TA for reporting Section 128 contributions to an employee’s or dependent’s Trump Account. Code TA reporting identifies the Section 128 contribution; it does not mean the contribution escaped all employment taxes.

How an individual direct contribution works

A direct contribution is made outside the employer’s Section 125 election. You might initiate it through the account provider’s contribution portal, an authorized transfer, or another method the account administrator accepts. Because no salary is being redirected through the cafeteria plan, the Section 125 prospective-election rules do not apply to that payment.

  1. Confirm the account is open and eligible. Make sure the intended beneficiary has an account and meets the current Trump Account eligibility rules.
  2. Check the remaining annual room. Include contributions that the rules require to count toward the general annual limit, including qualifying employer Section 128 contributions.
  3. Use the administrator’s contribution instructions. Enter the correct beneficiary and account details. A transfer to the wrong account can create correction and recharacterization problems.
  4. Keep evidence of the payment. Retain the confirmation, date, amount, beneficiary, and funding account so you can reconcile the annual total.
  5. Do not assume a tax deduction. The cited federal materials do not establish a general federal income-tax deduction or exclusion for an individual direct contribution. Obtain current tax advice if you are considering a deduction or state-tax treatment.

A direct contribution can be simpler when an employer does not offer the cafeteria-plan feature, but it does not acquire the cafeteria plan’s payroll-election treatment merely because the money ultimately reaches the same type of account.

Tax treatment: income tax and employment tax are separate questions

Federal income-tax exclusion

Section 128 can exclude qualifying employer contributions from federal gross income up to the applicable limit. The 2026 proposed regulations describe a general exclusion limit of $2,500 per employee per year. Amounts above the limit generally are not excluded under Section 128. This is a proposed-rule limit, not a promise that every employer contribution under every arrangement receives the exclusion.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The exclusion applies to a qualifying employer contribution program. It should not be restated as a blanket rule that an employee’s personal direct contribution is pre-tax. The sources cited for this comparison do not establish a general federal deduction or exclusion for that personal payment.

FICA, FUTA, and railroad retirement taxes

An income-tax exclusion and an employment-tax exclusion are different provisions. The proposed rule states that excluding a qualifying Section 128 contribution from gross income does not itself remove the amount from wages for Federal Insurance Contributions Act or Federal Unemployment Tax Act purposes, or from compensation under the Railroad Retirement Tax Act. In practical terms, a payroll contribution can receive the specified federal income-tax treatment while still being included in the wage or compensation base used for employment taxes.

W-2 reporting

For 2026 reporting, the IRS Form W-2/W-3 instructions direct employers to report Section 128 contributions to an employee’s or dependent’s Trump Account in box 12 using code TA. This reporting instruction concerns employer Section 128 contributions. It is not a rule that an individual direct contribution must appear on an employee’s W-2.

The two annual limits you must keep separate

Limit Amount and qualification What it controls
Section 128 employer-contribution exclusion Generally $2,500 per employee per year under the 2026 proposed regulations; excess amounts generally are not excluded under Section 128. How much qualifying employer contribution may receive the specified federal gross-income exclusion.
General Trump Account contribution limit Generally $5,000 per year, adjusted for inflation, under the IRS’s 2026 description. The broader annual amount that may be contributed to the account; qualifying Section 128 employer contributions count toward it.
One-time pilot contribution $1,000 for an eligible child when the statutory eligibility and election conditions are met, according to IRS 2026 material. A separate pilot-program contribution, not a replacement for the recurring contribution limits or a comparison of funding methods.

The limits answer different questions. The $2,500 figure concerns the proposed income-tax exclusion for qualifying employer contributions. The $5,000 figure concerns total annual account contributions. An employer contribution can therefore use part of the $5,000 account capacity even when the amount receiving the Section 128 exclusion is subject to the lower $2,500 threshold.

Employer administration is more than changing a payroll code

An employer offering the cafeteria-plan route needs a separate written program that coordinates the cafeteria plan, the Trump Account rules, and payroll reporting. The proposed materials identify several required or expected elements:

  • Employee eligibility and enrollment rules.
  • The amount and timing of permitted contributions.
  • Dependent designation and required certifications.
  • Employee notices explaining the election and its prospective operation.
  • Reporting procedures, including applicable W-2 treatment.
  • Correction procedures for an ineligible beneficiary, excess amount, missed election, or payroll error.
  • Processes for changing or revoking an election prospectively, with at least monthly opportunities under the proposal.

Employees should ask where these terms are documented. If the employer has not amended its written plan, a promise from a supervisor or a one-time payroll adjustment may not produce a valid Section 125 election.

Examples that show what changes

Example 1: Payroll election for a child

An employee elects a prospective salary reduction for a child’s Trump Account during an available enrollment window. The employer’s written plan includes the benefit and confirms the child as an eligible dependent. The election can be administered through payroll under the proposed rule, subject to the account’s annual limit and the plan’s change deadlines.

Example 2: Payroll election for the employee

The same employee asks payroll to direct the salary reduction to the employee’s own Trump Account. That election is not permitted under the proposed cafeteria-plan rule. The employee would need to consider another funding route that the current account rules allow, rather than treating the request as an eligible Section 125 election.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 3: Personal transfer to a child’s account

A parent transfers money from a personal bank account to a child’s Trump Account. This is a direct contribution outside the cafeteria plan. The parent must follow the account administrator’s procedures and the annual contribution limit. The cited sources do not establish that the payment is deductible or pre-tax.

Example 4: Employer contribution to a dependent’s account

An employer makes a qualifying Section 128 contribution to an employee’s dependent’s account without reducing the employee’s salary. That is an employer contribution, not an employee salary-reduction election. It may qualify for the proposed Section 128 gross-income exclusion within the $2,500 per-employee limit, while still counting toward the dependent account’s general $5,000 annual contribution limit and remaining subject to employment-tax treatment.

Example 5: Combining methods

An employee uses the employer plan for a dependent’s account and later makes a personal transfer. Before sending the second payment, the employee must total all contributions that count toward the account’s annual limit. The fact that one payment came through payroll and the other did not does not create a second $5,000 allowance.

Common mistakes and how to correct them

Calling every payroll contribution “pre-tax”

Use narrower language. The proposed Section 128 exclusion concerns qualifying employer contributions and federal gross income. It does not establish that every employee salary-reduction amount or every personal contribution is pre-tax, and it does not erase employment taxes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Using the employee’s account instead of a dependent’s

Check the beneficiary before the election becomes effective. The proposed salary-reduction permission is limited to a dependent’s account. If payroll sends money to the wrong account, contact the employer and account administrator promptly and follow their correction process rather than attempting an informal reversal.

Making an election after wages are available

A cafeteria-plan election must be prospective. Ask for the plan’s election cutoff and the first paycheck it can affect. A retroactive instruction cannot convert already available wages into a valid salary reduction.

Confusing the $2,500 and $5,000 figures

Track the income-exclusion threshold separately from the total account contribution limit. The lower figure does not necessarily cap all contributions, and the higher figure does not guarantee that every dollar receives the Section 128 income-tax exclusion.

Ignoring the proposed status

Proposed regulations are not final regulations. The cited proposal, REG-101355-26, was published by Treasury and the IRS in Internal Revenue Bulletin 2026-37 on August 11, 2026. Its text says the rule would apply to plan years beginning on or after publication of a final rule in the Federal Register. Before enrolling or changing a plan, confirm whether a final rule has been published and whether your employer has adopted current terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to ask your employer or account administrator

  • Does the written Section 125 plan include Trump Account contributions?
  • Can the election fund only a dependent’s account, and how is dependent status certified?
  • What is the prospective election deadline and the first affected paycheck?
  • How often can I change or revoke the election, and what payroll cutoff applies?
  • How are excess contributions, incorrect beneficiaries, and missed payroll deductions corrected?
  • How will qualifying Section 128 contributions appear on Form W-2?
  • Which amounts count toward the dependent’s $5,000 annual account limit?
  • Has the employer updated its procedures for the final federal rule, if one has been issued?

Choosing the practical route

Use the cafeteria-plan route when your employer has adopted the benefit, you are funding an eligible dependent’s account, and the prospective payroll process fits your cash-flow and recordkeeping needs. Expect employer certification, election windows, payroll cutoffs, and employment-tax reporting.

Use a direct contribution when you are paying outside payroll or your employer does not offer the cafeteria-plan feature. Treat the payment as a personal contribution for planning purposes unless a separate, current authority establishes different tax treatment. In either case, verify the beneficiary and keep a running total against the account’s annual contribution limit.

Current status to verify before acting

The salary-reduction rule, plan requirements, limits, employment-tax treatment, and applicability language described here come from the 2026 proposed regulations and related IRS materials. Treasury’s August 11, 2026 announcement summarized the program, while the proposed regulation supplies the legal detail. The IRS’s 2025-52 FAQ independently states that salary reduction may fund a dependent’s account but not the employee’s own account.

Because the rule is proposed, check the final Federal Register publication, the current IRS guidance, and your employer’s written plan before making an election. A final rule or revised plan could change an eligibility condition, deadline, reporting instruction, or tax result.
