Title fraud alerts vs. title insurance: what each does and does not protect

By TheFinanceBase Team 10 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: A property-fraud alert is a monitoring service that can notify you after a deed, mortgage, or other covered record is filed. It does not stop the filing, reverse it, or reimburse your loss. An owner’s title-insurance policy is a contract that can defend or pay covered claims arising from specified title defects, subject to the policy’s date, exclusions, exceptions, limits, and state-approved form. A lender’s title policy protects the lender’s loan, not your home equity.

For most homeowners, the sensible approach is to check whether the county offers a free recording alert, keep a copy of the owner’s policy, and ask the title insurer whether a prospective forgery endorsement such as ALTA 49 or 49.1 is available in the property’s state. Treat the alert and the policy as different layers: one improves detection; the other may provide contractual protection for covered losses.

The difference in one table

Question Property-fraud alert Owner’s title insurance
What is it? A public-record monitoring and notification service. A contract covering specified title risks and claims.
When does it act? After a document is presented for recording and the service detects a match. According to the policy’s coverage date and terms; traditional coverage generally concerns title problems tied to events before that date.
Does it prevent a forged filing? No. It does not authenticate the signer or block submission. Usually no. The policy is financial and legal protection, not a recording-system lock.
What does it provide? Notice that a monitored filing may need investigation. Potential defense, settlement, or payment for a covered claim, subject to limits, exclusions, and exceptions.
Who benefits? The person enrolled, according to the local program’s matching rules. The insured owner under an owner’s policy; a lender’s policy protects the lender’s interest.
Is availability uniform? No. Counties and states differ in enrollment, records monitored, matching, and delivery. No. Policy forms, endorsements, approvals, and offerings vary by jurisdiction and insurer.

The Federal Trade Commission (FTC) describes commercial “title lock insurance” as deed monitoring rather than title insurance. Its consumer alert says, “First, know that ‘title lock insurance’ is not title insurance.”

What a title-fraud alert actually does

It watches for a matching recording

An alert program checks land records for a filing associated with a property, an owner’s name, or both. Depending on the local program, a trigger might be a deed, mortgage, lien, assignment, or another document type. When the system finds a match, it sends a notice through the contact method used at enrollment.

The notification can be valuable because many owners do not routinely search the recorder’s index. It gives you an early signal that a document deserves verification, especially when you did not refinance, sell, grant a power of attorney, or authorize another transaction.

It does not stop the document

Recording offices generally accept and index documents under their statutory procedures; an alert is not an authentication service. It does not prove that the signer was the owner, prevent a fraudulent instrument from being submitted, or place a legal freeze on the parcel. The filing may already be part of the public record by the time the message arrives.

It does not undo a transfer or pay the bill

An alert does not automatically cancel a deed, restore the record, pay a mortgage, reimburse lost equity, or cover attorney fees. Correcting an unauthorized filing normally requires confirmation with the recorder and, depending on the facts and local law, action involving the title insurer, a real-estate attorney, law enforcement, a lender, or a court.

Local coverage controls the result

The FTC recommends asking the relevant state land-record office or county recorder whether a free notification program exists. Do not assume that every county offers one, that enrollment follows the property when you move, or that every service monitors the same documents. Before enrolling, ask:

  • Which office supplies the records and which document types are included?
  • Does the service monitor a parcel number, an owner’s name, or both?
  • How are names, alternate spellings, trusts, and business entities matched?
  • How quickly are messages sent after recording, and through which channels?
  • Is enrollment free, and how do you update contact information?

What owner’s title insurance protects

It addresses covered title defects and claims

An owner’s policy can protect you when someone asserts a covered legal claim against your ownership or priority in the property. Consumer Financial Protection Bureau (CFPB) examples include a prior owner’s unpaid taxes or an unpaid contractor claim for work completed before you bought the home. The policy’s insuring provisions, exceptions, exclusions, deductible or retention (if any), and limits determine whether the insurer must defend or pay.

Title insurance is not homeowners insurance. Homeowners insurance generally addresses physical loss and liability risks; title insurance addresses specified defects in the legal history of ownership, liens, and other covered claims. California’s Department of Insurance describes title policies as covering loss arising from defective or invalid title and other covered liens or claims, while emphasizing that the contract defines covered risks and exclusions. That state explanation illustrates the contract-based nature of coverage; your state’s approved form and your policy control.

Traditional timing is important

Most owner’s title policies are issued at closing and focus on title conditions and events that existed before the policy date but were not discovered or listed as exceptions. A forged deed in the chain of title before you bought the property may be relevant if it creates a covered defect. A later event is not automatically covered merely because it concerns your house or appears in the public record after closing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the policy’s definition of “covered risk,” the date and time coverage begins, listed exceptions, exclusions for matters created or accepted by the insured, notice requirements, and the section explaining how claims are handled. A title commitment or closing disclosure is not a substitute for the final owner’s policy.

Lender’s policy versus owner’s policy

These policies protect different economic interests. A lender’s title policy protects the lender against title problems that impair its mortgage or lien priority. The CFPB states: “Lender’s title insurance only protects the lender against problems with the title.” If a covered claim reduces the lender’s security, the lender may receive the policy benefit; that does not insure your equity, moving costs, appreciation, or every loss you experience.

An owner’s policy is the policy relevant to your investment in the property. It is typically optional in a mortgage transaction, while a lender may require its own policy as a loan condition. Check your closing package for the named insured and policy number. If only the lender appears, do not assume that document gives you owner coverage.

The 2026 development: prospective forgery endorsements

What ALTA announced

On June 23, 2026, the American Land Title Association (ALTA) announced ALTA 49 and ALTA 49.1 endorsements. The announcement describes prospective protection for specified forgery of deeds or mortgages recorded after the applicable policy or endorsement date. ALTA 49 is described for eligible homeowners obtaining a policy; ALTA 49.1 can extend similar future coverage to some existing owner’s-policy holders.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What “prospective” means

The endorsement does not make earlier events disappear. A qualifying forged deed or mortgage recorded before the endorsement’s effective date is not converted into a covered future event. Coverage remains subject to the actual form, conditions, exclusions, policy limits, and claim procedures. An endorsement also does not necessarily cover every impersonation method, every document, or every resulting expense.

How to check availability

Ask the title insurer or title agent, in writing:

  • Is ALTA 49 or 49.1 approved and offered for this property’s state?
  • Which policy or existing policyholder qualifies?
  • What exact date and time does coverage begin?
  • Which forged deeds or mortgages qualify, and which are excluded?
  • What limits, deductibles, notice deadlines, and cooperation duties apply?
  • Does the endorsement change any listed exception or require additional underwriting?

Do not rely on a general advertisement or the endorsement’s name. The issued form and your state’s rules control.

Does title insurance protect against deed fraud?

Sometimes, but not automatically. A forged deed can create a title defect, yet the insurer will analyze the policy’s covered risks, exceptions, exclusions, effective date, and the facts of the transaction. If the forgery occurred before the policy date and creates a covered defect, an owner’s policy may provide a defense or indemnity. If the forgery is recorded after the policy date, traditional coverage may not apply unless the policy or a prospective endorsement expressly covers that later event.

An alert and insurance address different moments. The alert may tell you that a suspicious instrument was recorded. The policy determines whether the resulting legal claim or loss falls within an insured risk. Neither one guarantees that a fraudulent document can be ignored.

How to compare an alert with insurance

1. Compare the function

Ask whether the product only sends a notice, or whether a contract promises legal defense and payment for a defined loss. A monitoring subscription can be useful even when it has no indemnity; calling it insurance can create the wrong expectation.

2. Compare the timing

Identify whether the protection concerns an old defect in the chain of title, a filing after purchase, or both. Write down the policy or endorsement date. A later-forgery endorsement is different from standard coverage for a pre-policy defect.

3. Identify the protected party

For an alert, determine who is enrolled and what matching rule is used. For insurance, read the “insured” definition. A lender’s policy and an owner’s policy can exist in the same closing file but protect different parties.

4. Map the scope

List the property or parcel, monitored document types, covered risks, exceptions, exclusions, limits, claim expenses, and response deadlines. If a vendor cannot provide clear terms, you cannot sensibly compare its promise with a policy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Check local availability and price

County alert programs may be free, but availability and coverage are local. Insurance premiums and endorsement availability depend on the transaction, insurer, state approval, and policy terms. The evidence available for this topic does not establish a national price or a uniform fee schedule, so obtain a quote and the actual form for your property.

What to do when an alert arrives

  1. Preserve the notice. Save the email, text, or letter, including the document number, recording date, parcel reference, and sender.
  2. Verify through the recorder. Use the county recorder, register of deeds, or equivalent land-record office’s official contact information rather than links or phone numbers in a suspicious message. Obtain the recorded instrument and confirm what it says.
  3. Compare it with your records. Check whether you or an authorized representative recently signed a deed, mortgage, refinance, lien release, power of attorney, or related instrument.
  4. Contact the owner’s title insurer or agent. Use the claims or customer-service contact shown in your policy. Provide the policy number and a copy of the recorded document, and ask for written instructions and any notice deadline.
  5. Get qualified local help. A real-estate attorney can explain the procedure for challenging an unauthorized filing. Depending on the facts, notify the lender, law enforcement, or a relevant government office.
  6. Secure related accounts. Change compromised passwords, review mortgage and banking activity, and investigate identity-theft indicators if personal information was used. These steps address possible identity misuse; they do not themselves clear the land record.

Do not assume that silence from the alert service means the title is clean. Monitoring can miss a document because of delays, indexing errors, name variations, or a record type outside the program’s scope.

Can someone “steal the title” to a house?

A person can record a fraudulent deed or mortgage that purports to transfer an interest or encumber the property. Recording the document does not automatically make the fraud legally valid, but it can create a serious public-record problem that must be corrected. The practical risk is disruption: a lender, buyer, insurer, or government office may need evidence that the instrument was unauthorized.

A notification service can shorten the time before you discover the filing. It cannot make the forged instrument valid or invalid by itself. Whether an owner’s policy responds depends on the policy language and the claim’s facts.

Common misunderstandings to avoid

  • “An alert is a lock.” It is not. The FTC characterizes deed-monitoring services as notification after a filing, not prevention.
  • “Title insurance covers every kind of fraud.” Coverage is limited to insured risks and is subject to exceptions, exclusions, dates, and limits.
  • “My mortgage means I have owner protection.” A lender’s policy protects the lender’s loan interest. Owner protection requires an owner’s policy naming you as insured.
  • “A later forgery is automatically covered.” Ask whether a specific policy provision or endorsement covers it and confirm the effective date.
  • “Every county has the same free alert.” Programs are local, and records monitored and delivery times differ.
  • “A survey proves how common deed fraud is.” ALTA says it surveyed 245 title-insurance professionals across 40 states, the District of Columbia, and the U.S. Virgin Islands in spring 2026 about seller-impersonation fraud. That description is not a nationally representative prevalence or alert-effectiveness statistic, and no specific result statistic is established here.

A practical protection checklist

  • Locate the county recorder or equivalent land-record office for the property.
  • Ask whether a free notification program exists and which records it monitors.
  • Enroll with current email, phone, and mailing details if the program fits your needs.
  • Find the final owner’s title policy and record its policy date, named insured, exceptions, exclusions, limits, and claims contact.
  • Confirm whether you also have a lender’s policy and understand that it protects the lender.
  • Ask the title insurer whether ALTA 49, 49.1, or another applicable forgery provision is available and obtain the actual form.
  • Keep closing documents and prior deeds where you can retrieve them quickly.
  • If an unexpected filing appears, verify it with the recorder and notify the insurer and appropriate local professionals promptly.

Bottom line for homeowners and homebuyers

A title-fraud alert is an early-warning tool; title insurance is contractual risk transfer. The alert may reveal a suspicious recording after it happens, while an owner’s policy may defend or pay a covered title claim. Neither is a universal lock against fraud. Check the local recorder for a free alert, confirm that you bought an owner’s policy rather than only a lender’s policy, and review any 2026 prospective forgery endorsement by its exact form, effective date, exclusions, and state availability.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
