When a fixed-term lease in India reaches its agreed end date, it normally ends by efflux of time under Section 111(a) of the Transfer of Property Act, 1882. The tenant is then generally required to return possession under Section 108(q). Remaining in the premises can expose the former tenant to a claim for use-and-occupation damages, but it does not automatically create a renewed lease or produce one nationwide eviction procedure. The outcome depends on the agreement, the parties’ post-expiry conduct, the property’s residential or commercial use, rent-control coverage, and the law in the relevant state or union territory.
This is a national overview, not a determination of any particular tenancy. Before acting, identify the local statute, exemptions, authority or court with jurisdiction, and the exact wording of the lease.

What lease expiry means under Indian law
A lease for a stated term is ordinarily determined when that term runs out. Section 111(a) of the Transfer of Property Act, 1882 describes this as determination by “efflux of the time limited thereby.” If the agreement says the tenancy runs from 1 April 2025 to 31 March 2026, the contractual term generally ends at the end of 31 March, subject to any renewal, extension, notice, statutory protection or other clause that changes the result.

In practical terms, the tenant should vacate, return keys and access devices, remove belongings, settle agreed charges and create a written handover record. A landlord should be prepared to receive possession and document the condition of the premises rather than leave the end date ambiguous.

Staying after the end date
Under the general law applicable to a tenancy governed only by the Transfer of Property Act, continued occupation after determination can give rise to damages for use and occupation. The amount is not an automatic penalty or a universal “double rent” rule. A court may examine evidence of what the landlord could reasonably have obtained by letting the premises after the tenant should have vacated, along with the agreement and the facts of the case.
The Supreme Court has quoted the following passage from Atma Ram Properties (P) Ltd. v. Federal Motors (P) Ltd.: “Under the general law, and in cases where the tenancy is governed only by the provisions of the Transfer of Property Act, 1882, once the tenancy comes to an end by determination of lease under Section 111 of the Transfer of Property Act, the right of the tenant to continue in possession of the premises comes to an end and for any period thereafter, for which he continues to occupy the premises, he becomes liable to pay damages for use and occupation at any rate at which the landlord could have let out the premises on being vacated by the tenant.” This is a statement of the general-law position; it does not establish that a particular market rate will be awarded in every dispute.
Confirm whether the lease really expired
Before either side labels the occupation unauthorized, check the documents and communications. The relevant date may not be obvious where the lease has a renewal option, a notice period, a conditional extension, a rent-free fit-out period, or a clause that changes the commencement date.

- Read the term clause, commencement date, expiry date and any wording about time of day for handover.
- Check whether renewal is automatic, optional, conditional on written notice, or subject to a fresh agreement.
- Look for notice, break, termination, lock-in, relocation, force-majeure and holdover clauses.
- Review clauses on deposit adjustment, repairs, utilities, taxes, reinstatement and the form of handover.
- Preserve emails, letters, messages, rent invoices and receipts that show whether an extension was discussed.
A tenant who believes a renewal was exercised should be able to show the required notice and timing. A landlord who says no renewal occurred should preserve the notice sent, the response received and any return or rejection of post-expiry payments.
What a landlord can do after expiry
A landlord may seek return of possession and any money that is contractually or legally due. The available route is not uniform across India. It can depend on whether the property is covered by a state or union-territory rent-control law, whether an exemption applies, whether the use is residential or commercial, and whether a special tenancy statute or authority governs the premises.
Practical sequence for a landlord
- Record the end date. Keep the signed lease, registration details if applicable, rent ledger, notices and evidence of the tenant’s response.
- Send a clear written communication. State that the term has ended, request a specific handover date, identify keys and access cards to be returned, and reserve claims for unpaid sums or use and occupation. Do not describe a disputed renewal as settled fact.
- Decide how to handle payments. A payment received after expiry can become evidence in a holding-over dispute. Have counsel assess whether to accept, return or hold it without prejudice under the applicable law and facts. Keep the transaction and the accompanying communication.
- Inspect and document. At handover, prepare a signed condition report, meter readings, photographs, inventory and key count. If the tenant does not cooperate, record the attempted inspection without entering unlawfully.
- Use the applicable legal forum. If possession is not delivered, obtain advice on the court, rent authority or other forum and the required pleadings, notices and evidence for that property. Do not assume that a notice period or eviction timetable from another state applies.
- Quantify money claims carefully. Separate contractual rent up to the expiry date, utilities and other agreed charges from any post-expiry use-and-occupation claim. Support a damages claim with comparable letting evidence where relevant rather than asserting a rate without proof.
A landlord should not treat expiry as permission to change locks, disconnect essential services or remove belongings without checking the procedure that applies. Self-help action can create a separate dispute even when the landlord has a strong claim to possession.

What rights a tenant has after the term ends
Expiry does not give a tenant a right to remain indefinitely. It does, however, mean that the tenant should understand the legal basis for any demand to leave and the process that applies. A tenant may have contractual renewal rights, statutory rent-control protection, an agreed notice period, or evidence that the landlord assented to continued occupation. Those possibilities must be tested against the actual agreement and local law.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteImmediate steps for a tenant
- Check the expiry and renewal clauses. Compare the date in the lease with notices that were sent and any condition attached to renewal.
- Ask for written confirmation. If the landlord is willing to extend, request a signed renewal or extension stating the new term, rent, deposit treatment and handover obligations.
- If leaving, propose a handover. Offer dates, arrange a joint inspection, take photographs and record meter readings and keys.
- If more time is needed, do not assume payment is consent. Explain the requested period in writing and seek express assent. A unilateral transfer of rent or continued occupation is not automatically a new lease.
- Keep proof of every payment and communication. Bank records, receipts, emails and messages may establish what was offered, accepted, rejected or disputed.
- Obtain local advice before ignoring a notice. Rent-control or special-tenancy rules may provide protections or prescribe a response, while a general-law tenancy may expose the tenant to damages after expiry.
Holding over under Section 116: why assent matters
Section 116 of the Transfer of Property Act addresses “holding over.” It applies where a lessee remains in possession after the lease has been determined and the lessor accepts rent or otherwise assents to the tenant’s continued possession. The central question is the parties’ assent shown by their conduct, not merely the fact that money changed hands.
Several shortcuts are unsafe:
- Continued occupation alone does not prove that the landlord agreed to a new tenancy.
- A tenant’s unilateral payment does not compel the landlord to renew the lease.
- Acceptance of a post-expiry amount is not, in every factual setting, automatic proof of a fresh lease; the payment’s purpose, period, receipt, correspondence and surrounding conduct matter.
- Where the landlord clearly accepts occupation for a further period, that evidence can materially change the analysis, but the duration and terms still depend on the statute, agreement and conduct.
The cited eCourts rendering describes the tenant’s offer to continue and the landlord’s intention to assent as concurrent elements. Because interpretations and statutory modifications can vary, the authoritative statutory text and relevant local decisions should be checked before relying on a “rent accepted means renewal” argument.

Security deposits when a lease ends
The national sources do not establish one universal deadline for returning a residential or commercial security deposit, nor one nationwide formula for deductions. The signed agreement and applicable state or union-territory law control. A clause may link repayment to vacant possession, inspection, final utility bills or proof that no dues remain; another may prescribe a different process.
Tenant’s deposit file
- Keep the payment confirmation, bank transfer reference or receipt showing the amount and date paid.
- Save the move-in inventory, photographs and videos, and compare them with dated handover evidence.
- Record electricity, water, gas and other meter readings on the handover date and retain final bills.
- Ask for an itemized statement identifying each proposed deduction and the contractual or factual basis.
- Provide a forwarding address and bank details in writing and keep proof of delivery.
Landlord’s deduction file
- Separate ordinary wear from damage alleged to exceed the agreed standard, using the lease and condition records.
- Keep invoices, estimates, photographs, meter readings and proof of unpaid charges.
- Apply any agreed adjustment to rent or utilities transparently rather than treating the entire deposit as forfeited.
- Issue a written balance statement showing the amount returned and each deduction.
These are recordkeeping and dispute-prevention practices, not a single statutory checklist applicable everywhere. If a contract conflicts with a mandatory local tenancy rule, the local rule may control.

State and union-territory tenancy legislation can alter both substantive rights and procedure. Rent-control statutes may restrict eviction to specified grounds, create exemptions based on rent or property type, regulate increases, or assign matters to a rent controller rather than an ordinary civil court. Commercial premises may be treated differently from residences, and some categories of landlord or tenant may be exempt.

The Model Tenancy Act is model legislation, not an automatically applicable national code. A reader must verify whether the relevant state or union territory enacted it, when it commenced, what rules were made, and which properties or tenancies are excluded or modified.
| Situation | What generally matters | What not to assume |
|---|---|---|
| Tenancy governed mainly by the Transfer of Property Act | Expiry under Section 111(a), surrender obligation under Section 108(q), possible use-and-occupation damages, and evidence of assent under Section 116. | That one market-rate damages figure or one notice period applies nationwide. |
| State or union-territory rent-control or special tenancy regime | Coverage, exemptions, permitted eviction grounds, designated authority, notice rules and appeal route. | That the general-law route can be used without checking the local statute. |
| Property covered by an enacted local version of model-tenancy provisions | The enacted text, commencement notification, rules, exclusions and any amendments governing that property. | That the Model Tenancy Act’s proposal applies merely because the property is in India. |
Residential and commercial leases: the same expiry principle, different risks
The basic question—whether the agreed term ended—arises in both residential and commercial leases. The consequences can diverge because commercial premises may involve fit-outs, licences, stock, employees, signage, business interruption and substantially higher evidence of market value. A commercial tenant should not assume that continued payment protects possession, and a landlord should not assume that a business tenant can be removed on a residential timetable.
For a commercial dispute, identify the permitted use, lock-in and renewal provisions, reinstatement obligations, approvals, fixtures, insurance, taxes, common-area charges and any rent-control exemption. Document access, inventory and trading equipment separately so that a possession dispute does not become a claim about goods or business assets.

| Question | Why it changes the analysis |
|---|---|
| Which state or union territory? | Local tenancy legislation, amendments, rules and forum may control. |
| Residential or commercial use? | Exemptions, permitted use, valuation evidence and procedural protections may differ. |
| Expired naturally or terminated early? | Section 111(a) concerns efflux of time; an earlier termination requires examining its own clause and legal basis. |
| Was renewal exercised correctly? | A notice, condition or registration requirement can determine whether a contractual extension took effect. |
| Did the landlord assent after expiry? | Rent acceptance and other conduct are relevant to Section 116, but no single act automatically decides every case. |
| What remains unpaid? | Possession, arrears, utilities and post-expiry damages should be pleaded and evidenced as distinct claims. |
| What does the deposit clause say? | It may define inspection, deductions, timing and the documents needed for repayment. |
Documents to assemble before sending or answering a notice
- Signed lease, renewals, addenda and registration or stamping records where relevant.
- Rent schedule, invoices, receipts, bank statements and utility-account records.
- All notices and messages about expiry, renewal, surrender, repairs or continued occupation.
- Move-in and move-out condition reports, dated photographs, videos, inventories and meter readings.
- Key, access-card and parking records, plus proof of handover or attempted handover.
- Deposit payment proof, proposed deductions, invoices and the requested repayment account.
- Evidence of comparable letting value if a post-expiry use-and-occupation amount is claimed.
For a live dispute, a locally qualified lawyer can classify the tenancy, check the current state or union-territory law, identify the proper forum and tailor the notice or response. That review is especially important where rent-control coverage, a commercial exemption, a disputed renewal or a substantial deposit is involved.
