Tax Residency Certificate vs. Form 10F: Which Documents Do You Need for DTAA Relief in 2026?

Short answer: They are different documents. A Tax Residency Certificate (TRC) is issued by the tax authority in the country where you claim tax residence and proves residence for treaty purposes. Legacy Form 10F is information that a non-resident supplies to India. For an Indian DTAA claim relating to a tax year governed by the Income-tax Act, 1961, the usual package is the foreign TRC plus electronically filed Form 10F, unless the TRC already contains the information Form 10F requests. For tax years beginning on or after 1 April 2026, India’s Income-tax Act, 2025 maps the legacy Form 10F process to Form 41.

TRC and Form 10F answer different questions

A Double Taxation Avoidance Agreement (DTAA) can limit or eliminate Indian tax on certain income when the recipient is resident in a treaty partner country and satisfies the treaty’s conditions. The documents supporting that claim do not perform the same job:

  • Tax Residency Certificate (TRC): government-issued evidence that the claimant is resident for tax purposes in a particular country and period.
  • Form 10F (legacy procedure): prescribed particulars supplied by the claimant to India, such as status, tax-identification information, the residence period and address.

A TRC does not automatically replace every procedural filing, and Form 10F does not prove residence by itself. Under legacy Rule 21AB, information already stated in the TRC does not have to be repeated in Form 10F. That means the documents can overlap in content without being interchangeable.

Which documents do you need for DTAA relief?

Your answer depends first on who is claiming relief, where the income is being taxed and which tax year is involved.

Claim situation Residence document Additional information filing India form number by tax-year framework
Non-resident claiming treaty relief in India for a year governed by the Income-tax Act, 1961 TRC issued by the tax authority of the country of residence Electronic Form 10F, except to the extent the TRC already contains the required particulars Form 10F (legacy)
Non-resident claiming treaty relief in India for a tax year beginning on or after 1 April 2026 TRC from the residence-country authority Information supplied under the successor process Form 41 under the Income-tax Act, 2025
Indian resident seeking treaty relief in another country under the legacy Indian process Indian TRC issued in Form 10FB Application to the Indian assessing officer Form 10FA (application) leading to Form 10FB (certificate)
Indian resident seeking a certificate under the 2025 Act process Indian resident certificate issued through the new workflow Online application using the new form Form 42, successor to Form 10FA

The treaty, income category, payer instructions and the other country’s procedure can add requirements. The table describes the Indian framework; it is not a substitute for checking the specific treaty and the recipient country’s filing rules.

What a Tax Residency Certificate proves

A TRC comes from the government or tax authority of the country in which the claimant says they are tax-resident. It is the evidence India or another treaty country uses to establish the residence side of a treaty claim. The certificate should be read for the exact taxpayer name, country, residence period and any tax-identification details it states.

The issuing authority and format are determined by the residence country. India does not issue the foreign TRC needed by a non-resident claiming relief in India; the claimant requests it from their own country’s tax authority. Conversely, an Indian resident who wants to claim a treaty benefit abroad generally obtains an Indian TRC through the Indian assessing-officer process.

Check the period covered before sending the certificate. A certificate for one tax year or calendar period does not automatically establish residence for a different year. If your stay or residence crosses India’s 1 April 2026 legal transition, determine status separately for each tax year rather than treating the entire span as one period.

What legacy Form 10F asks for

Rule 21AB identifies the information that Form 10F supplies to India. The fields concern the claimant, not the treaty rate:

  • Taxpayer status, such as individual, company or firm.
  • Nationality for an individual, or the country or place of incorporation or registration for another entity.
  • The tax-identification number in the country of residence. If that country does not issue one, the form uses a unique number assigned by that government for identifying the taxpayer.
  • The period for which the claimant is resident.
  • The taxpayer’s address in the residence country for that period.

If the TRC already states some or all of these facts, Rule 21AB says they need not be repeated in Form 10F. You still need to submit the form through the applicable electronic process unless the current rules for your tax year provide a different successor workflow. Keep the records that support every item supplied: the authority can ask for them.

Documents for a non-resident claiming relief in India (legacy years)

For a tax year governed by the 1961 Act, assemble the following before asking an Indian payer or tax authority to apply treaty treatment:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Obtain the foreign TRC. Request a certificate from the tax authority of the country where you are resident. Confirm that the legal name and covered period match the income claim.
  2. Read the TRC against Rule 21AB fields. Identify whether it states your status, nationality or incorporation jurisdiction, residence-country tax number, residence period and address.
  3. File Form 10F electronically. Enter the prescribed information that is not already contained in the TRC. Use the tax year and taxpayer details that correspond to the claim.
  4. Retain substantiation. Keep the TRC, the filed form, acknowledgment or submission record, and documents supporting the identity, tax number, address and residence period reported.
  5. Check the payer’s cut-off. A payer may need the documents before making a payment or determining withholding. Ask for its operational deadline and file-format requirements without assuming that those instructions change the statutory test.
  6. Check the treaty article and income type. Confirm that the payment falls within the treaty provision on which you rely. A generic residence document cannot establish eligibility for every category of income.

The Income Tax Department’s legacy guidance summarizes this sequence as furnishing the home-country TRC, filing Form 10F electronically and maintaining supporting documents. Its Form 10F reference must be read in the context of the 1961 Act and the relevant tax year.

Documents for an Indian resident claiming relief abroad

The direction reverses the paperwork. If you are resident in India and want another country to apply its treaty with India, you generally apply to the Indian assessing officer for an Indian TRC under the legacy procedure.

Legacy procedure: Forms 10FA and 10FB

  1. Submit Form 10FA to the Indian assessing officer with the information and evidence requested for your residence status.
  2. When the application is accepted, the certificate is issued in Form 10FB.
  3. Provide Form 10FB to the foreign payer or foreign tax authority in the manner that country requires.

Form 10FA is therefore not the form a foreign resident files to claim Indian treaty relief. It is the Indian resident’s application for an Indian TRC. Form 10FB is the resulting certificate.

New procedure for tax years under the Income-tax Act, 2025

Official 2026 guidance identifies Form 42 as the successor to Form 10FA. The application is online, uses the applicant’s PAN and is tied to a tax year. Depending on the applicant, supporting evidence can include a passport or proof of stay for an individual, or incorporation or registration evidence for another entity, together with other relevant records requested in the workflow.

Is Form 10F still valid in 2026?

Not for every 2026 claim. India’s Income-tax Act, 2025 applies to tax years beginning on or after 1 April 2026. Official 2026 materials map:

Legacy label Successor under the 2025 Act framework Use
Form 10F Form 41 Information supplied by a non-resident claiming DTAA benefits
Form 10FA Form 42 Indian resident’s application for a residence certificate
Form 10FB Certificate resulting from the resident-certificate process; use the form produced under the current workflow Evidence of Indian residence for a treaty claim abroad

For a tax year beginning before 1 April 2026, residential status remains determined under the Income-tax Act, 1961. For a tax year beginning on or after that date, the Income-tax Act, 2025 governs. A period of stay that spans the boundary is evaluated separately for each tax year. Put the tax year on your checklist and on communications with the payer; do not use “2026” alone as if it identified one legal regime.

How to decide which package applies

Use this decision sequence before filing anything:

  1. Where is the tax being charged? If India is taxing the payment and you are claiming residence in another country, you are the non-resident claimant using the foreign TRC plus the Indian information filing.
  2. Where are you resident for treaty purposes? The authority in that country issues the TRC. Do not substitute a passport, business registration or ordinary address for a TRC unless the applicable rules expressly allow it.
  3. What tax year begins when? A year beginning before 1 April 2026 follows the legacy 1961 Act labels; a year beginning on or after that date follows the 2025 Act labels.
  4. Does the TRC contain the prescribed particulars? Compare it with the Rule 21AB list. Avoid duplicating information that is already there, but do not omit fields that remain absent from the certificate.
  5. What does the treaty and payer require? Confirm the relevant income article, submission channel, language or authentication rules and timing with the payer and the other treaty jurisdiction.

Worked examples

Foreign company receiving an Indian payment for a legacy tax year

A company resident in a treaty partner country receives income from India for a tax year governed by the 1961 Act. It obtains its country’s TRC, checks whether the certificate gives its incorporation jurisdiction, residence-country tax number, address and residence period, and files electronic Form 10F for any missing particulars. It preserves the certificate, filing record and corporate documents supporting the reported information. The payer still needs to confirm that the income category qualifies under the treaty provision being claimed.

Individual’s claim straddling 1 April 2026

An individual has payments relating to one tax year beginning before 1 April 2026 and another beginning after that date. The first claim is handled under the 1961 Act labels, including legacy Form 10F where applicable. The second uses the 2025 Act workflow and its Form 41 reference. Residence is not decided by selecting whichever form is newer; each tax year is classified under the law that governs its start date.

Indian consultant paid by a foreign client

An individual resident in India wants the foreign country to apply the India treaty. Under the legacy process, the individual applies to the Indian assessing officer with Form 10FA and gives the resulting Form 10FB to the foreign payer or authority. For a tax year covered by the 2025 Act framework, the resident uses the online Form 42 process and supplies the requested identity or stay evidence.

Common mistakes and how to correct them

Treating the two documents as synonyms

Problem: A claimant sends only Form 10F and assumes it proves residence, or sends only a TRC when the Indian procedure requires additional particulars. Fix: Separate the proof question (TRC) from the information-filing question (Form 10F or its successor).

Using the wrong direction of the process

Problem: An Indian resident submits Form 10F to obtain a certificate for a foreign claim, or a foreign resident looks for Form 10FA. Fix: For an Indian claim by a non-resident, use the foreign TRC and Indian information filing. For an Indian resident claiming abroad, use the Indian resident-certificate application and resulting certificate.

Using a 1961 Act form for a 2025 Act tax year

Problem: A 2026 payment is automatically labeled “Form 10F” without checking the year’s start date. Fix: Classify the tax year first. Form 41 replaces the legacy Form 10F reference for the corresponding new-law workflow; Form 42 replaces Form 10FA for an Indian resident’s application.

Repeating or omitting TRC information

Problem: The form copies a different address or identification number from the certificate, or leaves out a field because the filer assumes the TRC covers it when it does not. Fix: Reconcile names, numbers, dates and addresses line by line. Use the Rule 21AB overlap rule only for facts actually stated in the TRC.

Ignoring evidence retention

Problem: The claimant files the form but cannot support the tax number, residence period or address later. Fix: Keep the TRC and source records that substantiate each submitted field, along with the electronic acknowledgment.

Assuming a document guarantees treaty relief

Problem: The claimant believes a TRC automatically fixes withholding or proves that every payment receives a treaty rate. Fix: Check the treaty article, income type, tax year and any payer or foreign-jurisdiction procedure. The documents establish residence and prescribed particulars; eligibility still depends on the treaty and facts.

Practical file checklist

Non-resident claiming in India under the legacy framework

  • Current TRC from the residence-country tax authority.
  • Electronic Form 10F containing any Rule 21AB particulars not already in the TRC.
  • Evidence supporting taxpayer status, nationality or incorporation, tax-identification number, residence period and address.
  • Submission acknowledgment and a copy supplied to the payer if requested.
  • Treaty article, income category, tax year and payer deadline confirmed.

Indian resident claiming abroad

  • Legacy Form 10FA application and resulting Form 10FB, when the 1961 Act applies.
  • Form 42 online application and the requested PAN-linked identity, stay, incorporation or registration evidence, when the 2025 Act applies.
  • Foreign payer or authority instructions for presenting the Indian certificate.

What to verify before relying on a generic checklist

Indian official guidance establishes the broad document framework, but it does not answer every operational question for every treaty partner. Before submitting, verify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The exact tax year and whether it begins before or on/after 1 April 2026.
  • The country whose authority must issue the TRC and the period the certificate must cover.
  • The treaty’s treatment of your particular income category.
  • Whether the payer needs the documents before payment, with a wet signature, authentication, translation or a particular upload format.
  • Whether the other treaty jurisdiction has its own residence certificate, declaration or refund procedure.

If the treaty entitlement, residence status or documentation conflict is material, obtain advice from a qualified cross-border tax professional who can review the facts for both jurisdictions. A document checklist cannot resolve a residence tie-breaker or an income-classification question that the treaty itself leaves fact-dependent.

Bottom line for choosing the right document

Start with the direction of the claim and the tax year. A non-resident seeking Indian DTAA relief generally needs a foreign-issued TRC and the Indian information filing: legacy Form 10F for an applicable 1961 Act year, or Form 41 for the corresponding 2025 Act year. An Indian resident seeking relief abroad obtains an Indian residence certificate through Form 10FA/Form 10FB under the legacy process, or Form 42 under the new process. The TRC is the residence evidence; the form supplies prescribed particulars. Use both where required, avoid duplicating facts already present in the TRC, and verify treaty- and payer-specific instructions before relying on the claim.
