A Tax Residency Certificate (TRC) proves that a person or entity is resident for tax purposes during a specified period. Form 10F, and its current paired designation Form 41 on the Indian Income Tax Department portal, supplies information used to support a claim for treaty relief. A TRC is the residence certificate; Form 10F/Form 41 is supporting treaty-claim information.
For an Indian resident using the framework of the Income-tax Act, 2025, the application is made in Form 42 and the Assessing Officer issues the certificate in Form 43 after being satisfied with the application. Form 10F belongs primarily to the legacy Income-tax Act, 1961 framework, while Form 41 is the current form name associated with the same type of information under the 2025 Act. The correct form depends on the tax period and the rules applicable to that period.

The difference at a glance
| Document | What it does | Who supplies or issues it | Legal and filing context |
|---|---|---|---|
| Tax Residency Certificate (TRC) | Certifies that the applicant is resident for tax purposes for a stated period and treaty purpose. | An Indian resident applies to the Assessing Officer; the officer issues the certificate. | Under the Income-tax Act, 2025 rules, the application is Form 42 and the certificate is Form 43. |
| Form 10F | Provides information required to support treaty relief. | The taxpayer supplies the information electronically under the older framework. | Used under the Income-tax Act, 1961 for information required by sections 90(5) or 90A(5), including the electronic-filing process specified in the 2022 CBDT notification. |
| Form 41 | Provides information for a claim to treaty relief and replaces the current naming of the information form in the new framework. | The assessee supplies the information and keeps documents that substantiate it. | The Income-tax Act, 2025 rules refer to Form 41 and section 159; the Income Tax Department portal labels the item Form 10F / Form 41. |
The practical sequence is therefore: establish residence with a TRC, provide the treaty information in the form required for the relevant year, and retain evidence for the information supplied. Neither Form 10F nor Form 41 is itself a TRC.
What a Tax Residency Certificate proves
It certifies residence for a defined period
A TRC is an official certificate stating that the person or entity is resident for tax purposes in the issuing jurisdiction for the period covered by the certificate. In an India-related treaty claim, it is used to demonstrate Indian residence when the treaty requires proof of residence before relief can be considered.
#1 Best Overall
The certificate is period-specific. An applicant should request the period that matches the income, transaction, or treaty claim rather than treating one certificate as permanent proof for every year. The certificate addresses residence status; it does not, by itself, decide whether a particular item of income qualifies for a reduced rate, exemption, or other treaty result.
Who applies and who issues it under the current rules
For the Income-tax Act, 2025 process, an Indian resident applies to the Assessing Officer in Form 42. The Government of India’s notified Income-tax Rules, 2026 describe Form 42 as the Application for Certificate of residence for the purposes of an agreement under section 159(1) and 159(2). The rules then state that the Assessing Officer, after receiving the application and being satisfied in that regard, issues a certificate of residence in Form 43.
This division matters. The resident is the applicant, but the TRC is an official certificate issued by the tax authority. A taxpayer cannot turn a self-completed Form 10F or Form 41 into a substitute certificate by attaching a signature or uploading it to a payer.
What the Form 42 application asks for
The notified Form 42 seeks enough information for the Assessing Officer to assess the residence request and identify the treaty purpose. Depending on the applicant, the form asks for:
- Identity and address particulars.
- Details relevant to tax residence.
- The period for which the certificate is requested.
- The basis on which the applicant claims residence in India.
- The purpose for which the certificate is needed.
- Applicable annexures and supporting information.
The form’s annexure list can include a passport copy, incorporation or registration documents, proof of stay in India, and other relevant material, as applicable to the applicant. The list is not a universal checklist for every case: an individual and an entity will not necessarily have identical documents, and the officer can require information that is relevant to the facts presented.
What Form 10F and Form 41 are used for
Form 10F under the 1961 Act
Under the Income-tax Act, 1961 framework, Form 10F supplies information required for claiming relief under a tax treaty through sections 90 or 90A. CBDT Notification No. 03/2022 expressly designated Form 10F for electronic filing of the information required by section 90(5) or section 90A(5).
Form 10F is therefore an information statement connected with a treaty claim. It is not the government-issued evidence of residence. Where a payer, tax authority, or compliance process asks for Form 10F, the request usually concerns the additional particulars needed to apply the treaty provisions, while the TRC addresses the separate question of whether the taxpayer is resident in the relevant jurisdiction.

Form 41 under the 2025 Act
The current Income Tax Department form page labels the item Form 10F / Form 41 under the Income-tax Act, 2025. The 2026 Rules say that other documents and information required for a claim to relief from double taxation under section 159 must follow Form 41. The assessee must keep documents substantiating the information provided, and the tax authority may call for those documents to verify the relief claim.
This is a naming and framework change, not a change that turns the information form into a residence certificate. For a current-period Indian-resident application, Form 42 is the application and Form 43 is the issued TRC. Form 41 carries the supporting treaty-claim information.
Why the portal may show both names
Readers working across tax years may see Form 10F and Form 41 together because the portal serves taxpayers dealing with both the older and newer statutory frameworks. The label does not mean that every tax period uses the same legal provision or that the forms are interchangeable without checking the year. Use the form and instructions that apply to the period of the income or payment being reported.
Is Form 10F the same as a TRC?
No. A TRC is the certificate of tax residence issued by the competent tax authority. Form 10F is the older information form used to support treaty relief, and Form 41 is the corresponding current information form under the 2025 Act framework. A payer may request both because each answers a different compliance question: the TRC addresses residence, while Form 10F/Form 41 supplies treaty-claim particulars.
Submitting Form 10F or Form 41 does not automatically establish residence, and holding a TRC does not automatically guarantee that a treaty claim will succeed. Eligibility also depends on the applicable treaty, the type and source of income, the conditions in the treaty article, and the supporting evidence required for the claim.
How do I get a tax residency certificate in India?
The Income Tax Department’s Form 42 user manual describes an online process through the e-Filing portal. The following sequence reflects that process and the structure of the notified form.
- Confirm the tax period and legal framework. Determine whether the request relates to a period governed by the Income-tax Act, 1961 or the Income-tax Act, 2025. Do not select a form solely because its number appears in a portal search result.
- Make sure the portal prerequisites are available. The manual says the applicant needs an active PAN and a registered e-Filing portal account. Resolve account-access, PAN, or profile mismatches before beginning the application.
- Open the Form 42 service. Sign in to the e-Filing portal, locate the residence-certificate service, and select Form 42. The exact screen labels can change, so follow the current portal instructions associated with the form.
- Enter applicant particulars. Provide the identity, address, and other applicant details requested by the form. Use information consistent with the PAN record and the documents that will be attached.
- Describe the residence request. State the period the certificate should cover, the basis for claiming Indian tax residence, and the purpose of the request. A precise period and clearly stated purpose help the officer evaluate the application against the relevant treaty use.
- Attach applicable evidence. Depending on the applicant and facts, the Form 42 annexures can include a passport copy, incorporation or registration papers, proof of stay in India, and other relevant information. Attach only documents that support the facts stated, and keep the originals or reliable records available.
- Complete verification and submit. Review names, dates, addresses, requested period, and attachments before completing the portal verification. Save the acknowledgement and a copy of the submitted application.
- Respond to any request from the Assessing Officer. The certificate is issued after the officer receives the application and is satisfied with it. If clarification or additional evidence is requested, answer consistently with the original application and retain the response record.
- Receive and check Form 43. Once issued, verify that the certificate identifies the correct person or entity and period. If the certificate does not match the treaty claim, address the discrepancy before giving it to a payer or attaching it to a relief claim.
The manual describes the online route, but it does not remove the need to read the instructions for the relevant period. Portal availability, validation fields, and documentary requests can change as the new rules are implemented.

How the documents fit into a treaty-relief claim
| Stage | Document or action | Question it answers |
|---|---|---|
| 1. Establish residence | TRC, issued by the competent tax authority | Was the taxpayer resident in the stated jurisdiction for the stated period? |
| 2. Provide treaty particulars | Form 10F for the applicable 1961 Act period, or Form 41 under the current framework | What information is required to process the treaty-relief claim? |
| 3. Substantiate statements | Records retained by the assessee | Can the information supplied in the form be verified if the tax authority asks? |
| 4. Apply the treaty rules | The relevant treaty, domestic provisions, and transaction records | Does the particular income or payment satisfy the treaty conditions? |
The existence of the first two documents does not answer the fourth question. A TRC and a completed information form support a claim; they do not replace analysis of the treaty article or establish a guaranteed tax outcome.

The transition between the two Acts is the main source of confusion. The Department states that residential status for tax years beginning before 1 April 2026 continues to be determined under the Income-tax Act, 1961. That statement does not resolve every transitional filing question, so the period, payment date, treaty claim, and portal instructions should all be considered together.
| Situation | Framework to examine | Likely document terminology | Practical action |
|---|---|---|---|
| Tax year beginning before 1 April 2026 | Income-tax Act, 1961 rules for residential status and treaty information | Form 10F may be the relevant information form. | Check the 1961 Act provisions, the 2022 electronic-filing notification, and the instructions for that period. |
| Current-period request under the Income-tax Act, 2025 | Section 159 and the Income-tax Rules, 2026 | Form 42 application, Form 43 certificate, and Form 41 treaty information. | Use the current portal label and preserve the documents supporting Form 41. |
| Payment, income, or claim spanning periods | Potentially more than one framework | Terminology may differ for each period. | Map each payment and certificate period separately instead of reusing one form number across all years. |
If the period is unclear, ask the payer or a qualified Indian international-tax adviser which year’s documentation is required, and confirm the answer against the applicable statutory instructions. Do not assume that a form accepted for one year is automatically valid for another.
Evidence to keep with Form 41 information
The 2026 Rules specifically require the assessee to keep documents substantiating the information supplied in Form 41. The tax authority may call for those documents to verify a relief claim. A practical record set should be organized so that every material statement in the form can be traced to a contemporaneous document.
- A copy of the submitted Form 41 and its acknowledgement.
- The Form 43 TRC and the Form 42 application that led to it, where applicable.
- Documents supporting identity, address, and the period of residence stated in the forms.
- Passport, incorporation, registration, or proof-of-stay material where those documents were relied on in Form 42.
- Contracts, invoices, payment statements, withholding records, and other transaction documents relevant to the treaty claim.
- Correspondence with the payer or tax authority about the requested forms, corrections, or clarifications.
- Evidence of electronic submission and any response to a verification request.
Keep the records in a way that preserves dates and versions. If a form is corrected, retain the original submission, the corrected submission, and the reason for the change.

Common mistakes and how to fix them
Calling Form 10F a residence certificate
Why it fails: The form contains treaty information but is not issued as a certificate of residence.
Fix: Obtain the appropriate TRC and provide Form 10F or Form 41 separately when the treaty process requires it.
Rank #4
Using Form 10F for a 2025 Act application without checking the period
Why it fails: The new rules use Form 41 for the treaty information and Form 42/Form 43 for the residence-certificate process.
Fix: Identify the tax year and follow the portal instructions and statutory form names for that year.
Assuming the TRC guarantees a lower withholding rate
Why it fails: Residence is only one condition in a treaty claim. The relevant treaty article and the nature of the income still matter.
Fix: Check the treaty conditions and retain transaction records in addition to the TRC and information form.
Requesting a certificate for an imprecise period
Why it fails: A certificate covering the wrong months or tax year may not match the payment or treaty claim.
Fix: Identify the income period, payment date, and treaty year before completing Form 42.

Illustrative situations
An Indian individual receiving foreign-source income
The individual may need an Indian TRC to demonstrate residence for the relevant period. If the applicable treaty process also requires additional particulars, the individual supplies those through the information form prescribed for that period: Form 10F under the older framework or Form 41 under the current one. The certificate and information form should be kept together, but they remain separate documents.
An Indian company asked for both documents by a foreign payer
The payer’s request does not mean one document duplicates the other. The company can provide the TRC as residence evidence and the applicable information form for treaty particulars, subject to the payer’s jurisdictional requirements and the treaty’s conditions. Incorporation, registration, address, and transaction records may be relevant to the evidence file.
A claim involving a year before and after the transition
A taxpayer should not assume that one Form 10F/Form 41 submission covers both periods. The year beginning before 1 April 2026 remains tied to the 1961 Act rules for residential status, while a current-period request may fall under the 2025 Act and 2026 Rules. Separate the periods, identify the applicable form terminology, and check the instructions before filing.
When professional advice is useful
Many straightforward applications can be prepared from the portal instructions and the applicant’s records. Professional help becomes useful when the residence period is disputed, the applicant has ties to more than one country, income falls under several treaty articles, a payer rejects the submitted documents, or the transition between the two Acts creates uncertainty. A qualified Indian international-tax adviser can help map the facts to the treaty and assemble evidence, but no adviser can turn an incomplete or inaccurate residence claim into a valid TRC.
Quick Recap
Final filing checklist
- Identify the exact tax year and payment period.
- Determine whether the 1961 Act or 2025 Act framework governs the request.
- Use Form 42 for the current Indian-resident TRC application where applicable.
- Expect Form 43 to be the certificate issued by the Assessing Officer under the current rules.
- Use Form 10F or Form 41 only for the treaty information required for the relevant framework.
- Check that the TRC period matches the income or payment being documented.
- Keep evidence supporting every material statement in the treaty information form.
- Do not describe Form 10F or Form 41 as the TRC or treat either form as a guarantee of treaty relief.
