Before treating a proposed tax cut as money you will receive—or as a cost the government will incur—identify the exact rule, confirm whether Congress enacted it, check its effective date, and read an official estimate with its baseline, time period and assumptions. Then determine who benefits and how the proposal would be financed.
The framework below is for U.S. federal tax proposals. State and local measures require the same checks against that jurisdiction’s bill text, status records and fiscal analysis.

1. What exactly is being promised?
Start by converting the slogan into a rule that could be written into the Internal Revenue Code. “Cut taxes,” “no tax on tips” or “a middle-class tax break” is not specific enough to test. Ask for proposed statutory language or a detailed policy document, and record the version and date you are examining. Legislative language can change as a bill moves through Congress; comparing text versions can reveal changes that a speech or summary hides.

Define the tax and the taxpayer
- Which tax changes: individual income tax, payroll tax, corporate income tax, capital-gains tax, estate tax, excise tax or another levy?
- Who qualifies: all taxpayers, only individuals, employers, particular industries, households below an income threshold, or people meeting a specific condition?
- Are eligibility rules based on adjusted gross income, filing status, age, work status, location or the type of income?
Define the benefit
Determine whether the proposal is a rate reduction, deduction, credit, exclusion, deferral or refund. A refundable credit can produce a payment even when a household owes little income tax; a nonrefundable credit generally cannot reduce liability below zero. Ask for the dollar amount or rate, per-person or per-return treatment, phaseouts, caps, interaction with other provisions and any documentation requirements.

Define timing and conditions
Find the proposed start date, the tax years covered, any sunset date and conditions that could delay or cancel the benefit. “Permanent” should be checked against the actual text: legislation can include expiration dates, transition rules or authority that requires later regulations.
2. Has it become law, and when would it apply?
A speech, campaign platform, press release or introduced bill does not change federal tax law. The Congressional Research Service explains: “A bill has no legal effect on existing law until it is enacted—that is, until it passes both houses of Congress and is signed by the President (or the President does not act on the bill within ten days of presentment when Congress is in session, or Congress overrides a presidential veto).”
Use the official bill-status record and enacted text, rather than a headline, to establish the proposal’s legal status. Congress.gov provides bill text and actions, while CRS explains how legislative text versions and actions can be traced.
| What you are seeing | What it means | What to verify |
|---|---|---|
| Campaign statement or platform | A policy promise, not a change to existing federal law | The promised rule, eligibility, amount, timing and conditions |
| Introduced bill | Legislation under consideration; it has no legal effect merely because it was introduced | Bill number, text version, date, committee and subsequent actions |
| Passed one chamber | Still not enacted federal law | Whether the other chamber passed the same text and whether presentment occurred |
| Enacted law | A legal change, subject to its own effective-date and transition provisions | Enacted text, signing or enactment date and the tax years covered |
Separate enactment from the effective date
An enacted provision may apply immediately, begin on a later date, apply only to future tax years or have retroactive rules. Read the effective-date section and any transition language. A law enacted during filing season does not automatically change every return already filed, and a provision scheduled for a future year does not create a current-year benefit.

3. What does the official revenue estimate say?
For federal tax legislation considered by Congress, the Joint Committee on Taxation (JCT) produces the official staff revenue estimates. JCT states that “The starting point for a revenue estimate prepared by the Joint Committee staff is the Congressional Budget Office (‘CBO’) 10-year projection of Federal receipts, referred to as the ‘revenue baseline.’”
Locate the estimate associated with the exact proposal version being discussed. Record:
- the bill or policy version and date;
- the baseline used;
- the fiscal years covered, commonly a 10-year window for federal scoring;
- whether the number is a cost (reduced receipts), a revenue increase or the net effect of a package; and
- any stated assumptions or footnotes.
A number quoted without its version, baseline and period cannot be compared reliably with another number. A later amendment may alter eligibility, timing or offsets enough to change the estimate.
Do not confuse an estimate with a promise of cash savings
A federal revenue estimate describes the effect on government receipts under specified assumptions. It is not a household-by-household forecast, and it does not tell you how much a particular taxpayer will save. Your result depends on filing status, income, eligibility, behavior and interactions with other tax rules.

4. What is included in the estimate?
JCT says its conventional estimates account for anticipated taxpayer behavioral responses. For example, a changed tax rate can affect the timing or form of income, deductions and transactions. That does not mean every possible economic consequence is included.
Identify the analytical scope
Ask whether the quoted figure is:
- a conventional revenue estimate with behavioral responses;
- a distributional analysis showing effects by taxpayer group;
- a separate macroeconomic or “dynamic” estimate;
- a calculation that includes interest costs; or
- a broader budget estimate combining several policies.
Macroeconomic, interest or other effects may be reported separately or combined in a presentation. Do not compare a conventional tax score with a broader dynamic or package figure as though both measure the same thing. The label and footnotes matter as much as the headline number.
Check the time window and sign
A first-year cost, a 10-year total and an annual average answer different questions. Confirm whether receipts are shown as positive revenue, negative revenue (a cost), or a net total after offsets. A proposal with a large initial cost and a later expiration can look very different under a one-year and a 10-year presentation.

An overall revenue total does not show who receives the benefit. Ask for distributional results by income group or by another category relevant to the policy, such as households, employers, industries or taxpayers with a particular type of income. Also identify the measure being reported: average tax change, share of taxpayers affected, share of the total benefit, or change in after-tax income.

JCT can prepare distributional analysis for tax legislation. The Congressional Budget Office’s tax-expenditure work illustrates why the comparison method and underlying law matter; its 2019 distribution report is evidence of analytical method, not a current forecast for a new proposal.
Questions that expose a misleading average
- Does the average include people who receive no benefit?
- Are results grouped by income percentile, dollar income, filing unit or another definition?
- Is the reported amount a tax reduction, a change in after-tax income, or a share of total benefits?
- Do phaseouts, caps and eligibility rules shift benefits toward or away from particular groups?
- Are business effects allocated to owners, workers, consumers or another group, and is that allocation explained?
Request the distributional table or methodology rather than inferring incidence from the proposal’s slogan. A provision described as broad can have concentrated dollar benefits, while a provision with a small average benefit can affect many households.

Identify every proposed offset: spending reductions, new taxes, enforcement changes, fees, borrowing or other revenue measures. Then compare the tax break and its financing over the same period and under consistent assumptions.

An estimate that combines a tax cut with an offset may show a small net cost even though the tax provision alone reduces receipts substantially. Conversely, an offset may be delayed, temporary or dependent on assumptions that differ from those used for the tax break.

Use a same-basis comparison
- Match the same bill stage and text version.
- Use the same fiscal years and baseline.
- Distinguish recurring measures from one-time collections or temporary savings.
- Check whether behavioral responses are treated consistently.
- Separate conventional revenue effects from macroeconomic or interest effects.
If a campaign number cites a financing source without an official estimate, treat the offset as a claim to verify, not as an established fact.
7. Are tax-expenditure figures being used correctly?
The Treasury Department describes tax-expenditure estimates as measurements relative to a defined current-law baseline. They are useful for describing the value of exclusions, deductions, credits and other provisions under that method, but they are not automatically the same as the revenue that would result from repealing a provision.
Why the baseline changes the answer
A tax-expenditure figure depends on what the analysis treats as the reference tax system. Change the baseline, and the measured “cost” can change even when the statutory provision does not. Ask which baseline and tax-year assumptions produced the figure.

Why totals may not add up
Treasury notes that provisions can interact. The combined estimate for several provisions therefore need not equal the arithmetic sum of each provision estimated separately. Interactions can arise when taxpayers use more than one deduction or credit, when one provision changes eligibility for another, or when behavior changes in response to the package.
When someone says a provision “costs” a particular amount, ask whether the number is a Treasury tax-expenditure estimate, a JCT legislative score, a repeal estimate, or another measure. Labeling the method prevents unlike figures from being treated as interchangeable.
8. How to check a campaign number step by step
- Capture the claim. Save the speaker’s wording, date, document and any cited dollar amount or percentage.
- Find the rule. Obtain proposed statutory language or the most detailed policy document available. List the tax, taxpayer, benefit, limits, start date, duration and conditions.
- Fix the version. For a bill, record its number, chamber, text version and date. Check later amendments and substitute text.
- Check legal status. Use the official status record and enacted text to determine whether the measure is only proposed, has passed one chamber, or has become law.
- Read the effective date. Determine which tax years and transactions are covered and whether transition rules apply.
- Locate the official estimate. For federal congressional tax legislation, look for the JCT estimate tied to that version. Record the CBO revenue baseline, period and sign of the estimate.
- Read the footnotes. Identify behavioral responses, exclusions, interactions and any separate macroeconomic, interest or dynamic analysis.
- Check distribution. Find the matching JCT or other official distributional analysis and note how groups and measures are defined.
- Trace financing. Match every offset to an estimate using the same period, baseline and assumptions.
- State what remains unverified. If no official estimate, exact version or assumptions are supplied, report that limitation instead of repeating the campaign number as fact.
9. Warning signs that a tax claim is incomplete
- The claim gives a large total but no bill text, version, date or effective year.
- A proposal is described as “passed” when it has only been introduced or approved by one chamber.
- A one-year figure is compared with a 10-year score.
- A tax-expenditure total is presented as the guaranteed proceeds from repeal.
- A gross tax cut is described as the net package cost without showing offsets.
- A conventional estimate is compared with a dynamic or macroeconomic estimate.
- An average benefit is used to imply that every taxpayer receives the same amount.
- The source cites no baseline or mixes current-law and alternative-law comparisons.
10. What changes for state and local proposals?
The federal sources and JCT process do not establish the status or cost of a state, county or city measure. For those proposals, use the jurisdiction’s own legislative text and status system, revenue department guidance, fiscal note and official budget or revenue forecast. Confirm whether the measure requires voter approval, how it interacts with local tax rules, and which government entity prepared the estimate.
11. A compact checklist for your notes
- Exact tax provision and statutory language
- Eligible taxpayers and benefit formula
- Caps, phaseouts and interactions
- Start date, covered tax years and sunset
- Bill number, text version and legal status
- Official estimate, baseline and time horizon
- Behavioral and other effects included
- Distribution by income or relevant group
- Offsets and net package effect
- Unverified assumptions or missing documents
Using this checklist turns a campaign slogan into a testable policy claim. It also keeps a legal question—whether the measure is law—separate from fiscal questions about cost, incidence and financing.
