Tax Notice, Assessment Order or Demand Notice: What to Do Next

Do not pay or ignore a tax notice until you have verified who issued it, which tax year and notice type it covers, the amount claimed, and the exact response, payment and appeal dates. Download the notice from the issuing authority’s official portal, reconcile the figures to your return and payment records, then choose the correct response: pay, correct a processing error, request time or instalments, or file an appeal.

The deadlines and remedies depend on the jurisdiction. The India and UK rules below are concrete examples; if your notice comes from another authority, follow that authority’s form, portal and statutory time limits.

First, identify what you received

A tax notice, assessment order and demand notice are not interchangeable. The heading and legal references determine what you can do next. Record the issuing authority, tax year or accounting period, notice or order number, date of issue, date and method of service, tax and interest components, payment deadline, response deadline, appeal instructions and the bank or portal details for payment.

Common documents

  • Information or enquiry notice: asks for records, explanations or a return. It may not establish a final amount due, but missing the response date can lead to an assessment or penalty.
  • Assessment or determination order: the authority has calculated liability, often after changing figures in your return. It normally explains the computation and the review or appeal route.
  • Notice of demand or liability: states an amount that is payable by a specified date. In India, the Income Tax Department identifies Form 7 as the notice of demand for liability payable on assessment.
  • Penalty notice: imposes a separate charge for a filing, payment or compliance failure. Its appeal period can differ from the underlying tax assessment.

An email, text message or letter is not proof that a demand is genuine. Sign in by typing the authority’s known web address or using its official app; do not use a payment link supplied only in an unexpected message. Match the downloaded document to your taxpayer account and keep the original file, attachments, envelope or electronic service record.

Do this on the day you receive the notice

  1. Authenticate it. Check the notice in the authority’s official portal or another official channel. Confirm that the reference number, tax year and balance appear in your account.
  2. Create a deadline record. Write down service date, response deadline, payment deadline and appeal deadline. Set reminders several days before each one. A date calculated from “issue” is different from one calculated from “service” or “receipt.”
  3. Save a complete evidence pack. Keep the notice, assessment or computation, every attachment, filed and amended returns, payment challans or receipts, bank statements, withholding certificates, payroll records, invoices, contracts and proof of service.
  4. Reconcile the calculation. Compare income, deductions, losses, tax withheld, credits, earlier payments, interest and penalties line by line with the filed return and your records.
  5. Classify the result. Decide whether the amount is correct, already paid, caused by a missing credit, a mechanical processing error, or a genuine disagreement about facts or law.
  6. Protect the shortest deadline. If you need more time, an instalment plan, rectification or a stay, submit that request before the payment or appeal period expires. A correction request does not automatically extend an appeal deadline or stop collection.
  7. Escalate proportionately. A qualified tax professional should review large balances, suspected fraud, cross-border income, insolvency, company or trust assessments, and any case in which a deadline is imminent.

Choose the correct response

If the amount is correct

Pay through the official account or payment instructions, not through an unverified link. Use the exact reference required for allocation, allow for bank processing time, and download the confirmation. Recheck the account after payment and retain proof showing date, amount and reference. If you cannot pay in full, request an authorised extension or instalments before the stated payment period ends; approval is not automatic.

If you already paid or a credit is missing

Submit the authority’s demand-response, correction or credit-claim workflow with payment references, challans, bank evidence, withholding certificates and the relevant return computation. Explain which line is wrong and identify the amount that should be removed or credited. Do not simply write “already paid”: give the payment date, amount, account, reference and tax period. Continue monitoring the balance until the authority confirms the adjustment.

If the authority made a computational or processing error

Use the named rectification, review or correction route and attach a short schedule showing the authority’s figure, your figure, the difference and the document proving it. If the notice also gives an appeal right, file or preserve that appeal within its deadline while the correction is pending. Rectification may fix arithmetic or data-transcription errors, but it may not decide a disagreement about evidence or legal interpretation.

If you dispute the facts or law

File the formal appeal or review identified in the notice. State the grounds in numbered points, identify each disputed adjustment, show the amount you believe is correct and attach an indexed evidence schedule. Ask separately whether collection is stayed or payment can be deferred during the appeal. Filing an appeal alone does not necessarily suspend interest, penalties or enforcement.

If payment is unaffordable

Request an extension, instalment arrangement or hardship relief before the payment deadline. Include a realistic cash-flow proposal, income and expenditure information, assets, liabilities and the reason the hardship is temporary or unavoidable. Keep submitting required returns and paying new liabilities while the request is considered. An arrangement can be refused or cancelled if instalments are missed.

If the deadline has passed

Act immediately. Submit the late appeal, review or condonation request if the authority allows it, explain the precise cause of delay, give a timeline and attach evidence such as illness records, service problems or documented reliance on incorrect official information. Late relief is discretionary and jurisdiction-specific. A late request does not automatically stop collection, so ask about a stay or payment arrangement at the same time and obtain professional advice quickly.

India: assessment and demand notices

What the official process covers

The Income Tax Department’s assessment guidance identifies Form 7 as the notice of demand for liability payable on assessment. The e-Filing portal provides a “Response to Outstanding Demand” workflow and payment options. Use the demand reference shown in the portal, not a manually altered payment description.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Appeal deadline

For an assessment or penalty appeal, the Income Tax Department’s current official guidance (2026) generally allows 30 days from service of the notice of demand. The Form 7 instructions also direct a taxpayer intending to appeal an assessment, fine or penalty to present the appeal to the Commissioner of Income-tax (Appeals) within 30 days of receiving the notice. The authority may condone a late appeal for sufficient cause, but condonation is not guaranteed; submit the appeal and a specific delay explanation as soon as possible.

Payment, interest and a possible stay

After assessment, if the demand is not paid within 30 days—or within a shorter period approved by the Joint Commissioner—interest and penalty may apply under the Department’s guidance. If the facts or law are disputed, ask for a stay of demand while appealing. A cited stay memorandum context refers to 20% of disputed tax as a possible condition; that figure is not a universal rule, and the conditions depend on the case and the order granting the stay.

More time or instalments

The official Form 7 instructions say an application for an extension of time or permission to pay by instalments should be made to the Assessing Officer before the period specified for payment expires. File the request through the channel the notice or local office specifies, explain hardship and propose dates and amounts. Keep proof of delivery and do not assume that asking for instalments suspends the demand until written approval arrives.

India response checklist

  • Download the complete assessment order, demand notice and computation from the e-Filing account.
  • Compare returned income, amended returns, tax deducted or collected at source, advance tax, self-assessment tax and earlier challans with the demand.
  • Use “Response to Outstanding Demand” when the portal offers the relevant reason, and upload readable evidence.
  • File the Commissioner (Appeals) appeal within the applicable 30-day period if you dispute the assessment or penalty; protect that deadline even if you also seek rectification.
  • Request stay, extension or instalments separately and retain every acknowledgement number.

UK: HMRC tax decisions and liability notices

Appealing a decision or penalty

GOV.UK guidance allows a taxpayer to appeal a tax decision or penalty and to ask HMRC in writing to delay payment during an appeal or review. The request should state what you believe the correct amount is. For Self Assessment, HMRC’s manual states that an appeal should be in writing within 30 days of the issue of the Notice of Liability. A tribunal may consider a late appeal, but permission is not automatic; explain the delay and provide supporting evidence.

Payment while an appeal is pending

Do not assume that a UK appeal automatically stops collection. Ask HMRC in writing whether payment can be deferred or enforcement paused during the review or appeal, identify the disputed and undisputed portions, and continue paying any amount you accept as due. Keep the request, delivery evidence and HMRC’s response. Interest can continue on unpaid amounts unless the applicable rules or a written arrangement provide otherwise.

  • Check the figures against the Self Assessment return, payments on account, PAYE or other credits and correspondence.
  • Send a written appeal within 30 days where that period applies, with numbered grounds and the amount you say is correct.
  • Ask separately for payment delay, a review or a time-to-pay arrangement, and follow any information request by its deadline.
  • If late, submit the appeal and reasons immediately and be prepared for the matter to be referred to the tribunal.

India and UK rules compared

Issue India (Income Tax Department) UK (HMRC)
Typical document discussed here Assessment order and Form 7 notice of demand; e-Filing outstanding-demand workflow Tax decision, penalty or Self Assessment Notice of Liability
Appeal period Generally 30 days from service of the notice of demand for an assessment or penalty appeal; condonation may be available for sufficient cause Self Assessment appeal in writing within 30 days of issue of the Notice of Liability; a tribunal may consider a late appeal
Is payment automatically stopped by an appeal? Not automatically; request a stay of demand and follow the order’s conditions Not automatically; ask HMRC in writing to delay payment during appeal or review
Correction route Use the applicable rectification or “Response to Outstanding Demand” route; preserve the appeal deadline Use the review or correction route named in the decision and preserve the appeal deadline
Extension or instalments Apply to the Assessing Officer before the Form 7 payment period expires Ask HMRC for an agreed payment delay or arrangement; approval and conditions are case-specific
Late-payment consequences Interest and penalty may apply when an assessed demand is unpaid after the allowed period Interest and collection action may continue under the relevant liability rules unless HMRC agrees otherwise

These are examples, not cross-border defaults. A notice from a state, municipal, payroll, customs or another national authority can use different forms, deadlines and suspension rules.

Build an evidence schedule that an officer can check

Attach a concise index rather than a disorganised document dump. Number each disputed point and map it to evidence:

  • Issue 1—missing payment: payment date, amount, tax period, transaction reference and bank or challan receipt.
  • Issue 2—missing withholding credit: payer, certificate or statement, gross income, tax withheld and the return line.
  • Issue 3—wrong computation: authority’s figure, corrected calculation, formula and source records.
  • Issue 4—factual disagreement: contract, invoice, account statement or correspondence proving the relevant event.
  • Issue 5—hardship: cash-flow summary, essential costs, available assets, proposed instalment dates and evidence supporting the request.

Use a file name that includes the tax year and notice number, check that scans are legible, and keep an identical local copy. Save the portal acknowledgement, upload list, payment confirmation and every subsequent message.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes that make a demand harder to resolve

  • Ignoring a genuine notice: interest, penalties or enforcement can accrue while you wait.
  • Using only the email link: phishing messages can redirect payments or steal credentials.
  • Appealing without reconciling: an unsupported objection delays resolution; identify the exact line and evidence.
  • Assuming rectification extends appeal time: submit the appeal or obtain written confirmation that the period is protected.
  • Paying the wrong reference: the money may sit unallocated while the demand remains open.
  • Treating a stay percentage as universal: conditions vary by order and jurisdiction; India’s cited 20% figure is case-specific.
  • Waiting for a professional appointment: send a deadline-preserving filing first where necessary, then supplement it with advice.

When professional help is worth the cost

Obtain advice from a professional authorised in the jurisdiction that issued the notice when the balance is material compared with your finances, the assessment alleges fraud or negligence, several tax years are involved, records are incomplete, a business or trust is affected, a cross-border treaty issue appears, or enforcement is imminent. Give the adviser the complete notice, service evidence, return, calculations, payment history and a deadline list. Confirm the adviser’s local authorisation and who will sign or submit the appeal.
