Tax-Loss Harvesting After a Market Decline: U.S. Rules and Step-by-Step Instructions

Yes, you can sell an investment at a loss and replace it, but buying substantially identical stock or securities within 30 days before or after the sale can trigger the wash-sale rule. A wash sale does not usually destroy the loss permanently: the disallowed amount is added to the basis of replacement shares and recognized later when those shares are disposed of.

The process is safest when you review every taxable and retirement account, disable automatic reinvestments, document the replacement security, and report the adjustment correctly on Form 8949 and Schedule D. The rules below are U.S.-specific and should be checked against the instructions for the tax year you are filing.

What tax-loss harvesting actually does

Tax-loss harvesting is the deliberate sale or other disposition of an investment for less than its adjusted basis so that a capital loss is realized. A price decline shown on a statement is only an unrealized loss; it becomes reportable only after you sell, exchange, or otherwise dispose of the position.

Section 165 provides the general framework for deducting losses. Section 1091 limits that deduction when substantially identical stock or securities are acquired during the statutory period around the loss sale. Harvesting therefore involves two separate decisions: whether a particular lot has a useful realized loss, and whether replacing the exposure would create a wash sale.

Before placing an order, compare the candidate lot’s loss amount and short-term or long-term character with your realized and expected gains. The sale should also fit your investment allocation; a tax result is not a reason to abandon an allocation you still need.

Tax-loss harvesting is a transaction process, not a guarantee of a tax saving. The eventual value of a loss depends on your complete return, the character of the loss, later sales of replacement shares, and the records you preserve. A loss that is deferred by the wash-sale rule can affect a later year rather than producing an immediate result.

The wash-sale rule and its 61-day window

The wash-sale period runs from 30 days before the loss sale through 30 days after it. Counting the sale date itself, this is commonly called a 61-day window. Section 1091 says that “no deduction shall be allowed under section 165” when substantially identical stock or securities are acquired in that period.

For planning purposes, mark the intended sale date on a calendar and examine every transaction from the 30th day before that date through the 30th day after it. The pre-sale review matters even if you made the earlier purchase for a different reason and never intended it to be a replacement. Likewise, a purchase made after the sale can retroactively affect the loss treatment.

Transactions that can create a wash sale

Activity during the window Why it matters
Buying substantially identical stock or securities The classic replacement purchase can make all or part of the loss currently nondeductible.
Acquiring substantially identical securities in a fully taxable trade An exchange or trade can count even when no cash purchase appears in the account.
Entering a contract or option to acquire substantially identical stock or securities A right to acquire the security can be enough; review open options and contracts before selling.
Acquiring substantially identical stock for an IRA or Roth IRA Retirement-account activity is included in the IRS wash-sale definition.
Automatic dividend or capital-gain reinvestment A small scheduled purchase can match part of the shares sold and create a partial wash sale.

The test is whether the replacement is “substantially identical,” not whether it has the same ticker symbol. The law and IRS instructions do not provide a universal ETF-by-ETF list. Similarity can depend on the facts, so treat an uncertain replacement as a tax question rather than assuming that two funds are safely different.

Do not confuse a 30-day waiting period with a rule that requires you to remain out of the market entirely. You may choose a different investment for exposure, but that choice must be evaluated for similarity and portfolio fit. If you cannot establish that the substitute is sufficiently different, waiting until the post-sale period ends may be simpler than trying to defend a close comparison.

What happens when a loss is disallowed

A wash-sale adjustment generally defers the loss instead of erasing it. The disallowed amount is added to the adjusted basis of the replacement shares. When those shares are later sold, the higher basis changes the later gain or loss and the period of deferral ends through that future transaction.

Only the matched portion is deferred when fewer replacement shares are acquired than were sold. For example, if a hypothetical sale produces a $1,000 loss on 100 shares and 40 replacement shares are acquired in the window, the matched 40 percent would carry a $400 disallowed amount, allocated to the replacement lots under the applicable rules. The remaining $600 is not matched by those purchases. Your actual allocation depends on the lots and transactions involved.

Lot-level detail is important. If the 40 replacement shares arrive in two separate purchases, the disallowed amount must be allocated across those replacement lots rather than simply changing one account-wide total. Each affected lot then carries its own increased basis into a later sale. Keep the original loss calculation beside the replacement-lot calculation so that the connection remains clear months or years later.

A deferred loss can also make a later gain or loss look different from the result suggested by the broker’s original purchase price. The adjustment belongs with the replacement shares, so closing the original position does not finish the recordkeeping task.

Does the rule reach other accounts?

Yes. Review all accounts you control, not just the brokerage account where the loss sale occurs. An IRA or Roth IRA acquisition of substantially identical stock can fall within the wash-sale definition even though the retirement account does not issue the same kind of taxable gain-and-loss report as a brokerage account.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check household activity you can control, including automatic reinvestment settings and scheduled purchases. A broker may not see every related-account transaction, and a Form 1099-B may omit a cross-account match. The taxpayer remains responsible for a complete calculation.

Why an IRA purchase deserves special caution

If an IRA or Roth IRA purchase creates a wash sale, the adjustment can be especially difficult to use because the replacement account has different tax treatment. Do not assume that placing the replacement order in a retirement account avoids the rule. Confirm the treatment with a tax professional when accounts are coordinated.

Make the account review practical: download activity for each taxable account, IRA, and Roth IRA; search for the security name as well as its ticker; and check reinvestment entries that may be easy to overlook. If another person or account is outside your control, document what you reviewed and ask a professional how the facts affect your filing.

Step-by-step harvesting procedure

  1. Export every tax lot. From each taxable account, collect security name, quantity, adjusted basis, proceeds, acquisition date, holding period, and unrealized gain or loss. Include retirement-account activity that could affect the wash-sale analysis.
  2. Identify the tax objective. Net realized and expected gains against candidate losses. Rank lots by loss size and by short-term versus long-term character, then remove any sale that would undermine your target allocation.
  3. Search the 30 days before the planned sale. Look for purchases, dividend reinvestments, option exercises or grants, contracts, taxable trades, and IRA or Roth IRA acquisitions of substantially identical securities. Do not rely only on the current account’s transaction list.
  4. Estimate the matched amount. Compare the number of shares sold with replacement shares acquired in the window. A full match can affect the entire loss; a smaller purchase generally creates a partial adjustment that must be allocated to replacement lots.
  5. Sell the selected lot. Keep the trade confirmation, execution date, quantity, proceeds, and the broker’s cost-basis information. The loss is realized by the disposition, not by placing an order or seeing a lower quote.
  6. Select a replacement deliberately. If maintaining market exposure matters, choose a security that is not substantially identical under your facts. Record why you selected it and what exposure it is intended to provide. Because the IRS materials do not establish a universal list of safe ETF pairs, obtain advice when equivalence is unclear.
  7. Block accidental purchases for the next 30 days. Turn off dividend and capital-gain reinvestment, recurring buys, and automated options strategies that could acquire the sold security. Monitor every account through the end of the post-sale period.
  8. Reconcile broker reporting. Compare each Form 1099-B with your own transaction ledger, including accounts and purchases the broker could not link. Form 1099-B box 1g reports wash-sale loss amounts in specified covered-security situations, but it is not a complete cross-account calculation.
  9. Prepare the return. Enter the transactions on Form 8949, apply code W when required, show the disallowed loss as a positive adjustment, and carry the resulting totals to Schedule D.

Save a dated copy of the worksheet you used before trading. If the security changes value while you are deciding, update the lot and exposure analysis rather than relying on a screenshot from an earlier quote. The objective is a defensible transaction history, not simply a trade executed during a volatile session.

How to compare two harvesting choices

When more than one lot or replacement is available, evaluate the choices on all five axes below rather than choosing the largest paper loss.

Decision axis Questions to answer
Loss size and character How large is the adjusted-basis loss, and is it short-term or long-term?
Portfolio exposure Does the sale and replacement keep the intended asset, sector, geographic, or risk exposure?
Wash-sale risk Could any account, reinvestment, option, contract, or related purchase be substantially identical?
Trading costs Will commissions, spreads, bid-ask execution, or market movement outweigh the tax objective?
Recordkeeping Will the replacement basis and future holding period be easy to track, or will the transaction create complex lot adjustments?

A larger loss is not automatically better if it creates a high wash-sale probability, forces an unwanted allocation, or leaves you unable to document the replacement basis.

Compare the choices at the lot level, not only by security. One lot may have a larger loss but a different holding-period character; another may fit the allocation better or avoid an existing pre-sale purchase. Include the cost of crossing the bid-ask spread and any commission, even where the account advertises commission-free trading. A tax adjustment that is hard to reconstruct can create more practical risk than a modestly smaller, well-documented harvest.

Partial repurchases, options, and contracts

Partial repurchases

When replacement quantity is smaller than the quantity sold, match only the replacement shares. IRS examples allocate the disallowed amount across the replacement lots and increase each affected lot’s basis. Keep lot-level records rather than applying one adjustment to the entire sale.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For instance, selling 100 shares and acquiring 10 substantially identical shares does not automatically make the entire 100-share loss unavailable. The relevant portion is tied to the 10 replacement shares, subject to the detailed allocation rules and the dates of each lot. Record the quantities and dates precisely so the partial calculation can be checked.

Options and contracts

Review contracts and options to acquire substantially identical stock or securities. The wash-sale rules can apply even when the option has not been exercised. Commodity futures and foreign-currency losses follow different rules described in IRS Publication 550, so do not transfer the stock wash-sale analysis to those instruments without checking their separate treatment.

An open option or contract can therefore change the analysis even when the account shows no new shares. Before selling, list grants, purchases, exercises, assignments, and expirations that fall inside the window, and ask for specialized advice if the instrument’s terms make substantial identity unclear.

Digital assets

IRS Schedule D instructions state that the wash-sale rules generally apply to digital assets that are also stock or securities for tax purposes, including tokenized securities. Ordinary cryptocurrency may be classified differently; the classification of the specific asset controls the analysis.

Reporting the transaction on your tax return

Form 8949 and Schedule D

IRS instructions direct taxpayers to list wash-sale transactions on Form 8949, enter code W, and report the disallowed loss as a positive adjustment. Schedule D summarizes the resulting capital gains and losses after those adjustments.

Document or field What to do
Form 8949 Report the sale and apply code W with the required positive wash-sale adjustment.
Schedule D Carry the Form 8949 totals into the capital-gain and capital-loss summary.
Form 1099-B, box 1g Use the broker-reported wash-sale amount for covered-security transactions, then add adjustments the broker did not report.
Basis records Retain the increased basis of replacement lots and the documents supporting the allocation.

The IRS Schedule D instructions also state that a wash-sale loss generally cannot be deducted unless it was incurred in the ordinary course of a dealer’s business. An individual investor should not treat a wash-sale loss as currently deductible merely because the broker’s statement displays it.

Enter the adjustment as a positive number even though the underlying transaction was a loss. That presentation increases the reported gain or reduces the reported loss to reflect the portion currently disallowed. Follow the form instructions for the filing year and retain the supporting worksheet in case the broker’s covered-security figure differs from your complete calculation.

Check the correct filing-year instructions

Wash-sale reporting is tax-year sensitive. Verify the Schedule D instructions for the return year and the Form 1099-B instructions that apply to the transactions. For example, the 2025 Schedule D instructions and 2026 Form 1099-B instructions should be checked against the filing year rather than assumed to govern every return.

Records to retain

  • Trade confirmations showing dates, quantities, and proceeds.
  • Original and adjusted cost-basis statements for every affected lot.
  • Account statements showing dividend or capital-gain reinvestments.
  • Option, contract, and exchange records that could represent an acquisition right.
  • A dated worksheet listing the 30-day-before and 30-day-after review for each loss sale.
  • Your rationale for why the replacement was not substantially identical, or the professional advice you received when the answer was uncertain.
  • The reconciliation between your ledger, Form 1099-B, Form 8949, and Schedule D.

Keep these records until the replacement shares are sold and the related basis adjustment has been reflected in that later transaction. A future return may depend on an adjustment created by an earlier harvest.

Use consistent identifiers in your ledger: account, ticker or security description, acquisition date, quantity, basis, sale date, proceeds, replacement lot, and adjustment. Save statements in their original form when possible, because a later download may show only the broker’s adjusted basis and not the original transaction that created it.

Common mistakes and how to correct them

Counting an unrealized decline

A statement loss is not a reportable capital loss. Confirm that the position was actually disposed of and that the trade date falls in the tax year you intend to report.

Checking only the 30 days after the sale

The window also includes the 30 days before the sale. Review prior purchases before deciding that a new loss sale is clean.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ignoring automatic reinvestment

Small reinvested dividends can match only part of a sale, but that is enough to require a partial adjustment. Suspend the program or include the reinvested lot in the calculation.

Assuming a different fund is automatically safe

“Substantially identical” has no universal ETF taxonomy in the cited statute and instructions. If the distinction is uncertain, get tax advice instead of relying on a ticker change alone.

Accepting the broker’s 1099-B as complete

Broker reporting may not capture another account, an IRA or Roth IRA, or a transaction outside the broker’s covered-security reporting. Reconcile all activity yourself.

Forgetting future basis

A deferred loss increases the replacement lot’s basis. If that adjustment is not carried forward, the later sale will be reported incorrectly.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Failing to document the replacement decision

A trade confirmation proves that a purchase occurred, but it does not explain why the replacement was considered different. Keep a short contemporaneous note describing the intended exposure and the reason the security was selected. Where the comparison is close, preserve professional advice rather than relying on memory.

When professional advice is warranted

Consider professional advice when a replacement could be substantially identical, several accounts are involved, options or contracts are open, digital assets are tokenized or otherwise unusual, or a large loss would create many adjusted lots. The rules are U.S.-specific, and the applicable instructions can change by tax year. This article explains the mechanics but does not determine the treatment of your particular securities or accounts.

Advice is also useful when a spouse, controlled account, or retirement plan makes purchases that you cannot easily see, when a broker’s 1099-B conflicts with your ledger, or when a partial repurchase requires several basis allocations. Ask the adviser to address the exact security, dates, quantities, account types, and filing year rather than giving only a general wash-sale overview.

Frequently Asked Questions

Can I sell a stock at a loss and buy it back?

You can sell it, but buying substantially identical stock or securities within 30 days before or after the sale can create a wash sale. The matched loss is generally disallowed currently and added to the replacement shares’ basis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How long do I have to wait to avoid a wash sale?

The statutory window covers 30 days before through 30 days after the loss sale. To avoid a post-sale purchase inside that window, monitor the security for the 30 days after the sale and also review purchases made during the 30 days before it.

Does the wash-sale rule apply across my IRA and brokerage accounts?

An acquisition of substantially identical stock for an IRA or Roth IRA is included in the IRS wash-sale definition. Review all accounts you control; broker reporting may not connect the transactions for you.

How do I report tax-loss harvesting on Form 8949?

Report the sale on Form 8949, use code W when required, and show the disallowed loss as a positive adjustment. Carry the resulting totals to Schedule D and retain the replacement-lot basis records.

What if I buy fewer replacement shares than I sold?

Only the matched portion is generally disallowed. The adjustment is allocated across the replacement lots, which receive increased basis; the unmatched portion is not matched by those purchases.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does automatic dividend reinvestment count?

It can. A reinvested dividend or capital-gain distribution is a purchase of shares and may match part of the shares sold. Disable reinvestment during the review period or include the lot in your calculation.

Are options and contracts included?

A contract or option to acquire substantially identical stock or securities can fall under the rule, even if it has not been exercised. Review these instruments separately and seek advice when their terms are complex.

Will my Form 1099-B show every wash sale?

No. Box 1g reports wash-sale amounts in specified covered-security situations, but a broker may not capture purchases in another account, an IRA or Roth IRA, or other transactions. You remain responsible for the complete calculation.

The Bottom Line

After a market decline, harvest only a realized loss that fits your investment plan. Review the full 61-day window across taxable and retirement accounts, test whether any replacement is substantially identical, prevent accidental purchases, preserve lot-level basis records, and report code W and the positive adjustment on Form 8949 when required. When the security, account structure, option activity, or filing-year rules are uncertain, obtain individualized tax advice.
