The applicable duty depends on the product’s Harmonized Tariff Schedule classification, origin, customs value, end use and the date of entry. A January 14, 2026 semiconductor proclamation created a Section 232 regime for covered chips, semiconductor-manufacturing equipment and derivative products; U.S. Customs and Border Protection (CBP) describes a 25% additional ad valorem duty for qualifying imports. Businesses should calculate exposure at SKU level, preserve evidence for any end-use exclusion and test sourcing choices against total landed cost rather than the headline duty alone.
What a technology tariff changes in your finances
A tariff is normally assessed when imported merchandise enters the United States. The importer pays the duty to Customs and may recover it through higher customer prices, accept lower gross margin, renegotiate with suppliers or redesign the product and sourcing plan. The financial effect is broader than the duty line: freight, insurance, brokerage, customs-compliance labor, financing and inventory delays can all increase the delivered cost.

Evidence from the U.S. International Trade Commission (USITC) indicates that importers bore nearly the full cost of the tariffs examined in its studies. In its analysis of Section 301 measures, USITC reported a 72.3% reduction in semiconductor imports, a 4.1% increase in U.S. semiconductor prices and a 6.4% increase in the value of U.S. semiconductor production. A separate USITC estimate associated examined Section 232 tariffs with a $3.5 billion reduction in downstream U.S. production in 2021. These are economy-level findings for specified measures and periods, not a forecast for every company or product.

Additional tariffs are often ad valorem, meaning a percentage of the customs value. Confirm whether the percentage applies to the entered value, whether ordinary duty is also due, and whether a Chapter 99 provision changes the result. Keep the tariff, freight and other components separate so management can see which assumption drives the result.
| Cost element | What to record | Why it matters |
|---|---|---|
| Customs value | Transaction value or the valuation method accepted by CBP | The percentage duty is multiplied by this base |
| Ordinary and additional duty | HTS rates plus any Chapter 99, Section 232 or Section 301 measure in force on entry | Multiple actions can apply to one item |
| Logistics | Freight, insurance, port, brokerage and inspection charges | Rerouting or delays can outweigh a small rate change |
| Internal cost | Classification work, recordkeeping, legal review and supplier documentation | Exclusions and corrections require evidence and staff time |
| Working capital | Extra inventory, longer transit and financing cost | Resilience often ties up cash even when unit cost falls |
How to determine whether an imported technology item is covered
A generic description such as “server,” “chip,” “controller” or “electronics” is not enough. Coverage is a sequence of classification, origin, valuation, trade-action and end-use tests.
1. Classify the item under the current HTS
Start with the current U.S. International Trade Commission (USITC) Harmonized Tariff Schedule (HTS). Review the legal text, chapter and heading notes, statistical suffix and any Chapter 99 number. The physical characteristics, principal function, degree of assembly and how the item is imported can change the classification. A ruling, broker opinion or supplier description should support—not replace—your own documented determination.
2. Check special tariff actions
After finding the ordinary HTS line, check current Chapter 99 provisions and the applicable Section 232 or Section 301 instructions. Proclamations and CBP Cargo Systems Messaging Service (CSMS) notices can add a duty, define covered derivatives or prescribe reporting fields. Record the effective date and the entry dates to which each action applies; a rate that was correct last quarter may be wrong for today’s entry.
3. Establish origin and customs value
Country of shipment is not necessarily country of origin. Trace where the product was manufactured and whether processing substantially transformed it. Preserve commercial invoices, bills of materials, production records and supplier origin statements. Confirm the valuation method and additions such as assists, royalties or packing when relevant. An origin change can alter both ordinary duty and additional measures.

4. Prove the end use
Some semiconductor provisions turn on where and how the item will be used. Link the imported part to a purchase order, customer specification, equipment serial number, project code or other contemporaneous record. If an exclusion requires installation in a qualifying facility or use for a specified activity, document that condition before entry and retain evidence through the recordkeeping period.
Maintain an item-level tariff register
A practical register should have one row per SKU, part number or product family and at least these fields:
- Internal SKU, supplier and purchase-order number
- Complete product description, technical parameters and bill of materials
- HTS classification, Chapter 99 number and classification rationale
- Country of origin, manufacturer and shipping country
- Customs value, currency and valuation method
- End use, facility or customer and the evidence supporting it
- Ordinary duty, additional actions, exclusions and effective dates
- Broker instructions, rulings, filings and the person responsible for review
What the January 14, 2026 semiconductor rules do
The White House proclamation issued January 14, 2026 invokes Section 232 for semiconductors, semiconductor-manufacturing equipment and derivative products. It states that semiconductors are essential to each of the 16 critical-infrastructure sectors identified by National Security Memorandum 22 of April 30, 2024. The proclamation establishes the policy framework; CBP instructions determine how an importer reports and pays the measure at entry.
CBP guidance describes a 25% additional ad valorem duty for certain covered semiconductor imports. The guidance also demonstrates why a product label cannot answer coverage: it specifies tariff headings and technical tests, including performance parameters for logic chips and bandwidth thresholds for dynamic random-access memory (DRAM). A component that looks similar to another component may fall on a different side of the rule because its specifications or use differ.
Product groups addressed
- Covered semiconductor devices
- Specified semiconductor-manufacturing equipment
- Derivative products identified by the proclamation or CBP implementation guidance
Do not apply the 25% figure to every chip, board or electronic product. Verify the exact HTS and technical conditions in the current CBP notice and the proclamation’s annexes before filing an entry.

Exclusions and end-use treatment
The proclamation and CBP guidance describe exclusions for specified uses. An exclusion is conditional relief, not a general exemption for a company or industry. The importer remains responsible for demonstrating that the merchandise and its use satisfy the stated requirements.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteData-center equipment
Some covered items destined for qualifying data-center applications are treated separately. Tie the item to the data-center project, installation location and technical specification required by the applicable notice. A reseller’s statement that equipment is “for cloud use” is weaker than a documented facility and bill of materials.
Repair and replacement parts
Repair or replacement treatment can depend on whether the part is replacing an installed component and whether it is used to restore an existing system. Keep the service order, asset identifier, failure record and disposition of the replaced part. New-build inventory should not be labeled as repair stock merely to obtain a lower duty.
U.S. research, development and startups
Specified U.S. research-and-development and startup activities may qualify under the stated conditions. Preserve grant, laboratory, development-project or corporate records showing the imported item’s role. A company’s general research mission does not establish that every import is for an eligible project.
Consumer, civil-industrial and public-sector uses
CBP guidance identifies separate treatment for certain non-data-center consumer products, civil-industrial applications and public-sector uses, along with other technology-supply-chain categories. Match the shipment to the precise definition and documentary requirements. If a product is sold into several channels, maintain records by lot or customer so an eligible use is not assumed for the entire SKU.

How to handle an uncertain exclusion
- Identify the exact exclusion paragraph and effective date in the proclamation or CBP notice.
- Map every condition to a document you can produce, such as a contract, purchase order, technical specification or facility record.
- Ask your customs broker how the exclusion is reported and what Chapter 99 number or data element is required.
- File conservatively when evidence is incomplete, then seek a correction or ruling through the appropriate CBP process rather than making an unsupported claim.
Build a tariff exposure model finance can defend
Start with a clean baseline
Load the last 12 months of import entries and open purchase orders. Aggregate by SKU, HTS line, origin, supplier and end use, but retain entry-level detail for audit. Reconcile the customs value to the general ledger and inventory subledger. Separate imports that are already covered from those that are merely possible candidates.
Run policy and operating scenarios
At minimum, model a current-law case, a case in which an applicable exclusion is unavailable, and a case with a new or higher additional duty. Add operating sensitivities for exchange rates, freight, transit time, demand, scrap and supplier qualification delays. The model should show monthly cash duty, unit landed cost, gross-margin effect, inventory investment and customer-price impact.
For an illustration, assume a shipment has a $100,000 customs value and the applicable additional duty is 25%. The additional duty is $25,000 before ordinary duty and other costs. If freight and insurance are $8,000 and brokerage and compliance cost are $2,000, the modeled delivered cost is $135,000 before financing or delay cost. This is a calculation example, not a universal treatment; the actual duty base and rate must come from the entry’s classification and rules.
Connect the model to decisions
- Pricing: decide whether contracts permit a tariff surcharge and how quickly prices can be changed.
- Margin: identify products for which the duty exceeds the available gross margin.
- Cash: forecast the timing of duty payment and any safety-stock build.
- Capital: compare supplier qualification, tooling and duplicate-capacity investments with recurring duty.
- Risk: assign probabilities to policy changes, exclusion loss, port disruption and supplier failure instead of hiding them in one contingency percentage.
Should you diversify, nearshore, reshore or absorb the duty?
No single response is optimal for every technology supply chain. USTR’s 2025 resilience policy series emphasizes supplier diversity, transparency and better analytical tools. IMF research describes a resilience-efficiency trade-off: redundancy and geographic spread can reduce disruption risk but raise operating cost and reduce the efficiency of a highly concentrated network. Use the same landed-cost and service metrics for every option.
| Option | Potential benefit | Main trade-off | Questions to answer |
|---|---|---|---|
| Keep the current source and absorb | Fastest implementation and no qualification project | Margin compression and continued policy concentration | Can the product remain profitable under the adverse-rate case? |
| Pass through the cost | Protects margin if customers accept a price change | Demand loss, contract disputes or competitive disadvantage | Do contracts allow adjustment, and how price-sensitive is demand? |
| Diversify countries or suppliers | Reduces dependence on one origin, plant or route | Audits, lower initial yields, smaller volumes and dual-source overhead | How long to qualify, and is alternate capacity genuinely available? |
| Nearshore | Shorter transit and potentially easier oversight | Higher labor or component cost and limited specialist capacity | Will origin actually change, and can the supplier meet volume? |
| Reshore | Greater domestic control and less import exposure for the finished item | Tooling, labor, permitting and ecosystem gaps | What is the payback after qualification and utilization risk? |
Evaluate each path on total landed cost, qualification time, available capacity, quality, lead time, working capital, geopolitical and tariff exposure, and reversibility. A second supplier that cannot deliver during a surge is a paper mitigation, not operational resilience. Conversely, a domestic source with substantially higher cost may still be rational for a safety-critical item or one with a long replacement cycle.

Use value-chain data to find hidden exposure
Import records show the immediate customs event but not always the upstream dependency. The Bureau of Economic Analysis (BEA) Global Value Chain statistics are designed to show how countries and the United States link together to produce goods and services. Use them for macro exposure by industry and country, then join the results to internal bills of materials, purchase orders and supplier master data.
Map tier-one suppliers and, where material, the locations of wafer fabrication, assembly, testing, substrates, memory and specialized equipment. Flag single-source parts, long qualification cycles and components whose country of origin could change after a processing step. This map helps management distinguish a tariff paid on a finished server from a tariff risk embedded in an upstream chip or manufacturing tool.
Common mistakes and how to correct them
- Using a product name as classification: obtain technical specifications and apply the legal HTS text and notes.
- Confusing shipping country with origin: trace manufacture and transformation, and retain supplier evidence.
- Assuming an exclusion is automatic: match each condition to contemporaneous end-use records.
- Applying today’s rate to old entries: key the model and filing instructions to entry date and effective date.
- Modeling only the duty: add freight, insurance, brokerage, labor, inventory and delay costs.
- Double counting a tariff: show ordinary duty, Chapter 99 measures and Section 232 or 301 amounts as separate lines and verify whether an instruction prevents stacking.
- Ignoring downstream economics: test customer prices, demand and domestic production effects, not just importer cost.
- Leaving ownership unclear: assign a finance owner, a customs-classification owner and a business owner for end-use evidence.
Set a review cadence and control points
Tariff schedules, exclusions and CBP instructions can change quickly. Review high-value or high-risk SKUs after every proclamation, Federal Register action or CBP bulletin. Perform a monthly check of open orders and a quarterly revalidation of classifications, origins and end uses; increase the frequency during active policy changes.

That process gives management a defensible choice among pricing, sourcing and inventory actions instead of relying on a single headline percentage.
