Under 11 U.S.C. § 523(a)(8), a bankruptcy court may discharge covered education debt only if keeping it would impose an undue hardship on the borrower and the borrower’s dependents. The borrower must ask for that determination in a separate adversary proceeding.
Courts generally use either the three-part Brunner test or a totality-of-the-circumstances test. Brunner separately examines present hardship, whether the hardship will persist, and good-faith repayment efforts. The totality approach weighs financial resources, necessary expenses and other relevant facts together. Neither test is nationwide law; the controlling federal circuit and bankruptcy-court precedent in the district where the case is pending determines the framework.

What § 523(a)(8) covers—and why the debt’s legal category matters
Section 523(a)(8) creates an exception to a bankruptcy discharge for specified education-related obligations unless repayment would cause undue hardship. The statute includes certain loans or benefit overpayments made, insured or guaranteed by a governmental unit or nonprofit organization, and other educational loans that meet the statute’s qualified-loan definition. Read the current statutory text at 11 U.S.C. § 523(a)(8).
A balance described in a billing statement as a “student loan” is not automatically in one uniform statutory category. The loan agreement, lender or guarantor, educational purpose and other facts can affect whether § 523(a)(8) applies. That classification issue is separate from the undue-hardship question. A borrower should identify each debt precisely rather than assume every education-related balance receives identical treatment.

- Other qualified educational loans: Some private education loans can fall within § 523(a)(8) if they satisfy the statutory definition.
- Debts outside the provision: If an obligation does not fit a statutory category, different discharge rules may apply; the court must decide the issue under the facts and governing law.
The statute supplies the undue-hardship exception but does not itself prescribe a single nationwide formula for measuring hardship. Courts developed the Brunner and totality frameworks through precedent, so local authority is decisive.
Why a separate adversary proceeding is required
Ending a bankruptcy case with a discharge does not, by itself, decide that an education debt is discharged. The borrower must commence an adversary proceeding asking the bankruptcy court to determine that repayment would be an undue hardship. Federal Student Aid explains this requirement in its Discharge in Bankruptcy guidance, and the Department of Justice cites Federal Rule of Bankruptcy Procedure 7001(6) for this type of proceeding.
- Identify the debts and parties. Gather promissory notes, account statements, payment histories and information about any federal guarantor, servicer, nonprofit lender or private lender. The complaint should identify the obligations for which a discharge determination is sought.
- File the adversary complaint in the bankruptcy court. The complaint asks the court to declare the debt dischargeable because repayment would impose undue hardship. It is filed within the bankruptcy case but is a separate lawsuit with its own docket and service requirements.
- Serve the defendants and exchange information. The lender, guarantor or other required parties receive the complaint. Discovery, document requests, declarations, hearings or settlement discussions may follow, depending on the case.
- Apply the controlling jurisdictional test. The judge evaluates the evidence under the circuit or bankruptcy-court precedent that governs the district. A federal student-loan case may also be reviewed through the Justice Department’s standardized process described below.
- Obtain a judgment or settlement order. Only a court order (or an approved resolution entered in the proceeding) determines what debt is discharged. A recommendation by a government attorney is not itself a discharge.
The U.S. Attorney’s Office in the district where the bankruptcy is pending handles relevant federal-government adversary cases, according to DOJ process guidance. Private-loan litigation can involve different parties and does not automatically receive the federal-government process.

How the Brunner test evaluates undue hardship
Many courts use Brunner, a three-part framework. The debtor generally must establish all three elements; failure on one can defeat the request in a court that applies this test.
1. Repayment would prevent a minimal standard of living
The first element asks whether, based on current income and expenses, requiring repayment would prevent the debtor from maintaining a minimal standard of living for the debtor and dependents. The analysis is about reasonably necessary living costs, not every discretionary purchase. Courts examine the household budget, income sources, dependents, housing, food, utilities, transportation, insurance, health care, taxes and other recurring obligations shown by reliable records.
A bare assertion that payments are difficult is weaker than a detailed budget tied to pay stubs, tax returns, bank records, bills and sworn testimony. The relevant question is the effect of the required payment in the borrower’s actual household, not an abstract average budget.
2. The hardship is likely to persist for a significant part of the repayment period
The second element is prospective. The borrower must show more than a temporary cash-flow problem and explain why the financial condition is likely to continue for a significant portion of the applicable repayment period. Evidence can include a serious medical condition, permanent or long-term disability, caregiving obligations, age-related barriers, limited earning capacity, unstable regional employment or other circumstances supported by documentation.

Courts distinguish a predictable, supported limitation from speculation. A recent job loss may be severe but temporary; a documented condition that limits the type or amount of work available may support a longer-term conclusion. The court evaluates reasonably reliable evidence rather than requiring certainty about the borrower’s entire future.
3. The borrower made good-faith efforts to repay
The third element asks whether the borrower made good-faith efforts to repay. Payment history is relevant, but good faith is not reduced to a single number. Courts may consider whether the borrower made payments when able, sought available repayment arrangements, communicated with the servicer, investigated options and managed expenses consistently with the claimed hardship. The significance of each fact depends on the governing precedent and the complete record.
Good faith does not require a borrower to make impossible payments. It does require an honest account of the debt, income and expenses and credible efforts to address the obligation before seeking a discharge. A history of ignoring notices, concealing income or taking on avoidable luxury expenses can undermine this element; the court decides what the evidence shows.
How the totality-of-the-circumstances test works
Courts using the totality approach do not divide the inquiry into three mandatory Brunner elements. Instead, they weigh the full circumstances, including:

Past, present and reasonably reliable future resources
The court considers employment history, current wages or benefits, assets, household contributions, earning capacity, retirement resources and other income. It also looks at reasonably reliable future resources—such as a documented change in employment, benefit eligibility or a likely improvement supported by evidence—rather than treating every possibility as fact.
Reasonably necessary living expenses
The budget is tested against the needs of the debtor and dependents. Housing, food, utilities, transportation, health care, insurance, taxes, child-related costs and other necessary expenses are evaluated in context. The court may distinguish necessities from expenses that could reasonably be reduced, but it does not assume that the lowest imaginable budget is the legal standard.
Other relevant circumstances
The framework expressly allows the judge to consider circumstances that do not fit neatly into income and expense figures. These can include medical or caregiving conditions, the history of the debt, repayment conduct, the availability of payment programs, family obligations, timing, and any fact that bears on whether requiring payment would be an undue hardship. Because the inquiry is holistic, one favorable fact does not guarantee a discharge and one unfavorable fact does not automatically end the case.

A totality analysis still requires concrete proof. “All circumstances” does not mean the court can disregard statutory requirements or decide without evidence; it means the evidence is weighed together rather than through three separately labeled elements.

|---|---|---|
| Structure | Three stated elements: present inability to maintain a minimal standard of living, likely persistence of the hardship, and good-faith repayment efforts. | Combined consideration of financial resources, necessary expenses and other relevant facts and circumstances. |
| Time horizon | Current living standard plus whether the condition will persist for a significant portion of the repayment period. | Past, present and reasonably reliable future resources and circumstances. |
| Repayment conduct | Good-faith efforts are a distinct element that must be addressed. | Repayment conduct is one relevant circumstance weighed with the rest of the record. |
| Flexibility | The labeled elements provide a structured checklist, but the jurisdiction’s precedent defines how each is applied. | The holistic format gives the court an expressly broader list of relevant circumstances. |
| Where it governs | Used by many courts, but not imposed nationwide by the statute. | Used by some courts, with application controlled by local precedent. |
The Justice Department describes the two frameworks as considering similar information about present and prospective finances and repayment efforts while retaining different formulations. Its description does not create a circuit-by-circuit map, and the sources do not establish a complete nationwide chart. A borrower must check the law of the relevant federal circuit and bankruptcy court.
Which test applies in an individual case?
The answer depends on the district and the controlling appellate or bankruptcy precedent. A court may follow Brunner, a totality formulation or a locally developed variation. The case caption, the location of the bankruptcy court and the circuit’s published decisions matter; a general internet summary cannot replace that jurisdiction-specific analysis.
Do not assume that a neighboring state uses the same test. Bankruptcy courts are federal courts, but circuit precedent can differ. A decision from another circuit may be persuasive rather than controlling. A lawyer or qualified legal-aid program can identify the authorities that bind the court handling the case.
Regardless of the label, prepare evidence addressing both present hardship and future prospects. A Brunner court will need a clear treatment of each element. A totality court will still need the same underlying financial and repayment facts to weigh the circumstances.
How the two tests overlap—and where the distinction changes preparation
Both frameworks ask whether the borrower’s actual household finances make repayment unjustly burdensome and whether that condition is expected to continue. Both require more than a conclusory statement that the balance is large. Both can examine income, necessary expenses, dependents, health, work capacity and repayment history.
The distinction affects emphasis. Under Brunner, organize the presentation under three headings and address good faith expressly; omitting one element can leave the court without a basis to rule for the borrower. Under a totality approach, connect the same facts into a single explanation of why repayment is not realistically sustainable, including any circumstance that does not fit a three-part checklist.

For example, a borrower with a documented permanent disability, minimal benefits and no realistic earning capacity would present medical and income evidence under either framework. A borrower whose hardship depends on several interacting factors—moderate income, unusually high necessary medical costs, dependent care and a volatile work history—may need to show how those facts combine. These are illustrations of evidentiary organization, not predictions of an outcome.
The Justice Department’s federal student-loan process
On November 17, 2022, the Justice Department, working with the Department of Education, issued a standardized process for federal student-loan bankruptcy discharge cases. The Justice Department’s Student Loan Guidance page was updated March 17, 2026 and lists the guidance text, a fact sheet and an attestation form. Confirm the current form and instructions before filing because agency materials can be revised.

The process is designed to make expectations more consistent, reduce the burden of pursuing an adversary proceeding and help government attorneys identify cases in which a discharge is appropriate. A borrower may provide information about income, expenses, medical conditions, dependents, repayment history and other circumstances through the process used by the government attorneys.
What it does not do
- It does not amend § 523(a)(8) or replace the judicial test adopted by the controlling court.
- It does not automatically apply to private education loans.
- It does not guarantee that the government will recommend a discharge.
- It does not allow an agency attorney to enter a discharge without a bankruptcy-court order.
The guidance tells government attorneys how to evaluate facts and make a recommendation. The statutory undue-hardship determination remains with the bankruptcy court. The Justice Department’s announcement describes the policy as a fairer and more accessible process, but that description is not a legal holding. Associate Attorney General Vanita Gupta said, Today’s guidance outlines a better, fairer, more transparent process for student loan borrowers in bankruptcy,
in the department’s November 17, 2022 announcement.
A recommendation and a discharge order are different events. If the government supports relief, the borrower still needs the court to enter the appropriate judgment. If the government opposes relief, the borrower may still present evidence and legal argument to the judge.

Common mistakes and how to correct them
Assuming the bankruptcy discharge covers the loans automatically
Problem: The borrower receives a general discharge but never files an adversary complaint. Correction: Confirm whether an undue-hardship proceeding was filed and obtain a judgment that specifically addresses the education debts.
Using the wrong jurisdictional test
Problem: A filing copies a Brunner checklist in a court that applies a different formulation, or relies on a totality argument without addressing the circuit’s required elements. Correction: Identify controlling precedent for the district and organize the evidence to satisfy that authority while still presenting the complete financial picture.
Providing only current income figures
Problem: The record shows today’s shortfall but not why it will continue or what future resources are reasonably reliable. Correction: Add medical, employment, caregiving or other documentation that supports the expected duration of the hardship.
Ignoring repayment conduct
Problem: The borrower offers no explanation for payment history or contacts with the servicer. Correction: Provide a candid timeline, identify efforts to use available options and explain circumstances that made payment impossible or irregular.
Treating the DOJ recommendation as the final decision
Problem: The borrower assumes a favorable government recommendation ends the case. Correction: Continue through the adversary proceeding until the bankruptcy court enters an order specifying the debt discharged.
Using generalized budgets or unsupported claims
Problem: The filing lists round numbers, omits dependents or includes unexplained discretionary spending. Correction: Use actual statements, identify each household member and distinguish necessary costs from expenses that could reasonably be changed.
A practical sequence for deciding what to do next
- List every education debt. Record the current holder, servicer, guarantor, balance, loan type and whether the obligation appears connected to a governmental, nonprofit or qualified private loan.
- Locate the governing court. Identify the bankruptcy district and federal circuit. Use that court’s published precedent or obtain advice from a bankruptcy attorney or legal-aid program familiar with student-loan adversary proceedings.
- Build a documented household budget. Reconcile income and expenses with records and identify dependents and necessary medical or caregiving costs.
- Explain the future. State what evidence shows about work capacity, health, caregiving, age, employment prospects and expected changes in income or expenses.
- Document repayment efforts. Assemble payment records and communications and explain any missed payments or attempts to use available programs.
- File and litigate the adversary proceeding correctly. Follow bankruptcy-court rules for the complaint, service, deadlines, discovery and hearings. In a federal-loan case, provide requested information through the DOJ process while continuing to meet court deadlines.
- Read the final order carefully. Confirm which loans, balances, interest and related obligations are covered. If relief is denied, the order may explain whether a different repayment or later legal option exists.
The process is fact-intensive and can affect both bankruptcy rights and long-term credit obligations. A consumer bankruptcy attorney or nonprofit legal-aid referral may help identify the proper test, prepare the adversary complaint and present evidence without promising a particular result.
