For U.S. borrowers, bankruptcy and income-driven repayment (IDR) solve different problems. Bankruptcy is a court proceeding in which you can ask for a student-loan discharge based on undue hardship; filing bankruptcy by itself does not erase the loans. IDR is a federal repayment arrangement that sets payments under program rules when your loans and circumstances qualify. The right path depends on your loan records, household budget, repayment history, likely duration of hardship and, for bankruptcy, the law and practice in your federal court district.
Use the comparison below to organize your facts, verify current federal options through your StudentAid.gov account and servicer, and obtain advice from a qualified bankruptcy lawyer before making a legal decision. No general article can determine which route fits an individual case.

Bankruptcy and IDR are not interchangeable
The threshold question is whether you need a court to decide if some or all of the debt should be discharged, or whether you need a payment formula that reflects your income and household circumstances. Bankruptcy uses an adversary proceeding inside a bankruptcy case. IDR uses federal eligibility rules and an application handled through Federal Student Aid and your loan servicer.

| Question | Bankruptcy student-loan proceeding | Income-driven repayment |
|---|---|---|
| What it is | A legal case with a separate request asking the bankruptcy court to determine undue hardship. | A federal repayment plan with payments calculated under the plan’s rules. |
| Who decides | The bankruptcy judge, after considering the evidence and the applicable law in that jurisdiction. | Federal program rules, your loan holder or servicer, and the information in your application determine eligibility and payment terms. |
| Possible result | Full discharge, partial discharge or different repayment terms if the court grants relief; no discharge if the legal standard is not met. | A new payment obligation under an eligible plan. Enrollment is not a bankruptcy discharge. |
| Information that matters | Present and expected future ability to pay, essential living costs, dependents, repayment efforts, loan documents and jurisdiction. | Loan type, disbursement dates, status, income, family information and other eligibility details. |
| Immediate next step | Discuss the facts with a bankruptcy attorney who handles student-loan adversary proceedings before filing or adding a discharge claim. | Review your account, run the Federal Student Aid repayment calculator and submit the current IDR application if an eligible plan is available. |
There is no universal winner. A plan that lowers a payment may not address a long-term inability to repay, while a bankruptcy case can involve substantial legal work and an uncertain outcome. Treat the routes as separate decisions rather than two versions of the same relief.

How a student-loan bankruptcy request works
Filing bankruptcy is only the first step
Federal Student Aid explains that student loans are not automatically discharged when a borrower files bankruptcy. You must bring a separate adversary proceeding and ask the bankruptcy court to decide whether repayment would impose an undue hardship. The request is a contested legal matter, not an automatic feature of the bankruptcy petition.
- Collect the debt records. Identify each education loan, the current holder, balance, status, payment history and any collection activity. Keep promissory notes, account statements, notices and prior applications.
- Obtain jurisdiction-specific advice. Ask a qualified bankruptcy attorney how the courts in your district evaluate student-loan discharge requests and whether your facts support an adversary proceeding.
- File the bankruptcy case if advised. The petition starts the bankruptcy case, but it does not itself decide the student-loan issue.
- File the adversary complaint. This separate lawsuit within the bankruptcy case identifies the loans and asks for a determination of undue hardship. Follow the court’s service and pleading requirements.
- Exchange evidence and attend required proceedings. Income records, budgets, medical or employment evidence, repayment history and loan documents may be relevant. The government or another loan claimant can respond.
- Receive the court’s judgment. The judge may grant a full discharge, a partial discharge or altered repayment terms, or deny the request. The result applies only as stated in the order.
What “undue hardship” can involve
Federal Student Aid says courts do not use one uniform test. Its guidance identifies questions courts may consider: whether repayment would prevent a minimal standard of living for you and your dependents, whether the difficult circumstances are likely to continue for a significant portion of the repayment period, and whether you made good-faith efforts to repay.
Those questions require evidence, not a single income cutoff. A court can examine your actual budget, unavoidable expenses, health or disability issues, work prospects, household responsibilities, payment history and attempts to manage the debt. The weight given to each fact varies by jurisdiction, and a judge may apply a test or precedent that differs from another court’s approach.
Federal guidance in cases involving the United States
A Northern District of California bankruptcy court page describes Department of Justice and Department of Education guidance for cases in which the United States is a defendant. The agencies assess present inability to repay, whether that inability is likely to persist and past good-faith repayment efforts. When the assessment supports relief, the Justice Department may stipulate to facts and recommend discharge. The court still makes the discharge decision.
This guidance is not a promise that every district, judge or loan claimant will handle a case the same way. Your lawyer should identify the controlling law and the procedure used in your court before you rely on any federal guidance.

Why the type of education debt matters
U.S. Courts bankruptcy information lists many government-funded or government-guaranteed educational loans among commonly nondischargeable debts, subject to applicable exceptions. That special treatment means you must identify the legal character of every debt rather than assuming that all education-related balances receive identical treatment. Gather records for federal loans, private education loans and any other account that a creditor describes as educational, and have counsel analyze each one.
How income-driven repayment works
IDR is a program route, not a court remedy
An IDR plan adjusts required payments according to federal program rules and the information in your application. The plan can change the amount and schedule you owe, but enrolling does not ask a bankruptcy judge to cancel the principal and does not itself discharge the debt.

Default affects eligibility
The Federal Student Aid IDR FAQ states that defaulted loans are not eligible for IDR while they remain in default. The FAQ describes routes that may restore eligibility, including rehabilitation and certain consolidation circumstances. Those choices can have their own requirements and consequences, so check your account status and obtain current instructions before selecting one.
The SAVE plan status in 2026
Federal Student Aid’s current SAVE FAQ reports that a court order ended the SAVE Plan in March 2026. Borrowers affected by that change must choose another plan for which they qualify, and the servicer’s notice sets the borrower’s deadline. Because plan availability and deadlines can change, use the notice in your own account and the current Federal Student Aid guidance rather than an older article, calculator screenshot or saved application.

What an IDR review looks like
- Sign in to your StudentAid.gov account. Review the federal loans shown, their owners or servicers, current repayment status and any notices about plan changes.
- Confirm the loan details. Note each loan type, disbursement date, outstanding balance, interest rate and whether any loan is in default. Correct missing or inaccurate records with the servicer.
- Use the Federal Student Aid repayment calculator. Enter current income and family information as requested. Treat the result as an estimate of available plans, not an approval or a guaranteed payment.
- Complete the current IDR application. Provide the requested income and household documentation and select an eligible option. Save the confirmation and copies of everything submitted.
- Track the servicer’s response. Confirm the effective date, first payment, amount, annual recertification requirement and any deadline stated in a notice. Contact the servicer promptly if the calculated amount does not match the approved terms.
Federal Student Aid recommends using its repayment calculator and application process to review eligible repayment options. The calculator cannot override loan-type restrictions or a default status, and a servicer may request additional information.

Facts to compare before choosing a path
Make one written file containing the facts below. It gives an IDR review and a bankruptcy consultation the same reliable starting point.
Household cash flow
- Gross and take-home income for every contributing household member.
- Whether income is stable, seasonal, commission-based, interrupted or likely to change.
- Housing, utilities, food, transportation, insurance, taxes, medical care, childcare and other essential expenses.
- Dependents and unusual necessary costs that a simple percentage-of-income calculation may not show.
Loan and payment history
- Federal or other loan type, original disbursement date and current holder.
- Current balance, interest rate, payment amount and repayment plan.
- Delinquencies, default status, collection activity, deferments, forbearances, rehabilitation or consolidation history.
- Records showing payments made and efforts to contact the servicer or obtain a workable arrangement.
Future hardship and legal setting
- Why the budget is unaffordable now and what evidence supports that explanation.
- Whether the limitation is expected to last for a significant portion of the repayment period.
- Medical, employment, caregiving or other facts that affect future earning capacity, with appropriate documentation.
- Your state and federal judicial district, because bankruptcy standards and procedures are not uniform.
A practical decision framework
When a bankruptcy consultation deserves priority
Consider making a bankruptcy consultation the first call when your documented budget shows that even essential expenses leave no realistic capacity for the loans, the problem is expected to persist, and you need a legal determination about discharge or modified terms. The attorney can also identify debts that may not be covered by a student-loan order and explain whether an adversary proceeding is procedurally appropriate.
This is not a prediction of success. The judge must apply the governing law to your evidence, and the result can be full relief, partial relief, changed terms or no relief.
When an IDR eligibility review deserves priority
An IDR review is the practical first administrative step when your loans appear to be eligible federal loans, your income or family size may produce a manageable payment, or you need a formal payment arrangement while your circumstances are changing. Run the current calculator, apply through the official process and verify the servicer’s written determination.

If the account is in default, resolve that eligibility problem through an informed rehabilitation or consolidation decision before assuming that an IDR application will be accepted.
When both reviews are necessary
Some borrowers have mixed loans, a fluctuating income and a hardship that may be temporary or permanent. In that situation, do not treat an IDR estimate as proof that bankruptcy is unnecessary, or a bankruptcy consultation as proof that an IDR plan is unavailable. Ask the attorney and servicer separate questions, keep the records they request and compare the written consequences before acting.

Assuming the bankruptcy petition erases the loans
A petition starts a bankruptcy case; it does not decide the student-loan discharge question. Ask specifically whether an adversary proceeding is required, which loans it would cover and what evidence must be presented.
Using a single hardship formula everywhere
Federal Student Aid says courts do not use one uniform undue-hardship test. Online summaries based on another state or district may omit a factor your court considers important. Get advice tied to your federal judicial district.

Relying on obsolete SAVE information
Because the SAVE Plan ended in March 2026 under the reported court order, older descriptions of its payment rules or enrollment windows may be wrong for your account. Read the servicer notice and current official FAQ, including the deadline for selecting another eligible plan.
Stopping payments without a plan
Do not intentionally miss payments because you expect bankruptcy or an IDR application to succeed. Ask your attorney or servicer how to protect your account while a case or application is pending, and keep proof of every request and response.
Treating an estimate as a promise
A calculator result is an eligibility and payment estimate based on the information entered. It is not a court ruling, an approval notice or a guarantee that the servicer will use the same income documentation.
Costs, timing and outcomes that cannot be generalized
The available official material does not establish one national bankruptcy cost, processing time, tax result, savings amount or success rate for student-loan discharge cases. Fees, attorney arrangements, court schedules, evidence requirements and case complexity differ. Ask a lawyer for a written explanation of expected fees and possible additional work.
IDR processing time, payment effective dates, recertification requirements and deadlines also depend on the plan, your servicer and current federal instructions. Keep enough cash-flow flexibility for the period between applying and receiving the servicer’s final notice, and do not change your budget based solely on an unconfirmed estimate.
Where to get current information and help
- Federal Student Aid account: Review loan ownership, repayment status, notices and available applications in your StudentAid.gov account.
- Federal Student Aid repayment calculator and IDR FAQ: Use the current calculator and eligibility explanations, including rules for loan type, disbursement dates and default.
- SAVE FAQ and servicer communication: If you were in SAVE, read the current federal notice and the deadline supplied by your servicer before selecting another plan.
- U.S. Courts bankruptcy information: Use the courts’ general explanation of bankruptcy debts as background, then ask counsel to apply the relevant exception and facts to your loans.
- Qualified legal advice: Choose a bankruptcy attorney familiar with student-loan adversary proceedings in your jurisdiction. A general bankruptcy consultation may not address the specialized discharge issue.
Bottom line
Choose the next step based on the problem you are trying to solve. IDR is an administrative review for an eligible federal repayment plan; bankruptcy is a court process that can produce discharge or changed terms only if the judge grants relief after an undue-hardship proceeding. Verify your current loan status and IDR options through official Federal Student Aid channels, assemble a complete household and payment record, and obtain jurisdiction-specific legal advice before deciding whether to pursue bankruptcy.
