If Social Security says you were overpaid SSI, first decide which result you need: reconsideration challenges whether the debt exists or was calculated correctly; a waiver asks SSA to forgive all or part of a valid debt; and a change in recovery rate asks SSA to take less from each payment. Read the notice, preserve the envelope and records, and file promptly. These requests are not interchangeable, and filing one does not automatically produce the result of another.
For an initial SSI overpayment reconsideration, SSI policy says a request filed within 60 days stops recovery actions during reconsideration. A waiver may be requested at any time, while a lower-rate request addresses only the monthly withholding. Your notice and SSA’s current instructions control the submission method for your case.

| Route | What you dispute | What you want | Form or method | Deadline and collection effect |
|---|---|---|---|---|
| Reconsideration | Whether an overpayment occurred, the months involved, the reason, or the amount | Correction or cancellation of the determination | SSA-561 or SSA-561-U2, Request for Reconsideration | File within 60 days of the initial notice. SSI POMS says a timely initial request stops recovery actions during reconsideration. |
| Waiver | You generally accept that a debt exists but say you were not at fault and repayment would be unaffordable or unfair | Forgiveness of all or part of the debt | SSA-632-BK, Request for Waiver of Overpayment Recovery; for an overpayment of $2,000 or less, the June 2025 form directs people who believe they were not at fault to request by telephone or through a local office instead of completing the form | SSA says a waiver can be requested at any time. Do not assume filing it pauses withholding. |
| Change in recovery rate | The amount SSA is taking each month, not the underlying debt | Smaller monthly withholding because ordinary and necessary expenses are not being met | SSA-634, Request for Change in Overpayment Recovery Rate | Request whenever the current rate causes hardship. It changes collection speed, not the debt decision. |
If you do not know why SSA says you were overpaid, reconsideration is the route for investigating and disputing the determination. You may also request a waiver or a lower rate while those issues are addressed, but explain separately what outcome you seek.

Read the notice before doing anything else
Locate the amount, months, and stated cause
Mark the total overpayment, the months SSA lists, the reason it gives, the proposed withholding, and the date on the notice. Common errors become easier to spot when you compare those details with your own records. The notice may also state where to send a form, how to upload it, and the telephone or office contact for your case.
Calculate the appeal clock conservatively
SSA’s SSI overpayment and appeals guidance describes a 60-day period to appeal. The SSI Appeals Process page says SSA generally assumes a written notice was received five days after the date printed on it unless you show that it arrived later. SSI POMS SI 02220.017 (January 15, 2025) describes the initial overpayment reconsideration period as 60 days from the notice date for the recovery-stop rule. Because the pages describe the clock in different ways, use the date and instructions on your notice and file immediately rather than waiting for the last possible day.
If 60 days have passed
Submit the reconsideration request anyway and explain why it was late. SSA develops whether you had good cause for missing the deadline. If good cause is not established, SSA dismisses the reconsideration request. Include a short timeline, the date you actually received the notice if it was delayed, and evidence supporting the reason for lateness.

Do not assume every appeal stops collection
For SSI, a reconsideration filed within the initial period has the special recovery-stop protection described in POMS. SSI POMS also says recovery does not stop merely because you continue to an administrative law judge hearing or Appeals Council review. Later decisions and notices govern what happens in your individual case. Ask SSA what will be withheld while any later appeal is pending.
How to request reconsideration of the overpayment
Reconsideration is appropriate when you say SSA made the debt decision incorrectly. You can challenge the existence of an overpayment, the months counted, the income or resource information used, the reason for the overpayment, or the arithmetic.
Prepare the challenge
- Write down the exact disagreement. State whether you dispute the entire overpayment or specific months and dollars. Identify each calculation or factual error you can show.
- Gather contemporaneous records. Useful evidence can include pay statements, benefit letters, bank records, rent and utility records, notices of changes you reported, correspondence with SSA, and proof of when a change was reported.
- Complete SSA-561 or SSA-561-U2. Use the current version from SSA’s forms directory and follow the submission method printed on your notice. Describe the requested correction in plain language; attach additional pages if the form’s space is inadequate.
- Ask to inspect the file. SSA says you may ask to see the information it used to figure the overpayment and ask an employee to explain the reason while you examine the file. Request the wage, income, resource, and payment history underlying the calculation.
- Submit before the deadline and keep proof. Save a complete copy, upload confirmation, fax confirmation, mailing receipt, or the name and date of the employee who accepted the request. If you submit in person, ask for a stamped copy or written receipt.
- Track the response. Keep every decision and notice together. If SSA affirms the determination, read the next-level appeal instructions and deadline; do not assume recovery remains suspended.
What a strong reconsideration explanation contains
- The notice date, the months at issue, and the amount SSA calculated.
- The corrected amount or period, with a month-by-month explanation.
- The rule or event you believe SSA misunderstood, such as a reported income change or a payment that was not available to you.
- A list of attached records matching each factual point.
- A request for the file and a plain-language explanation if the calculation is not understandable.
How to request a waiver of recovery
A waiver does not primarily argue that SSA’s math is wrong. It asks SSA to excuse recovery because you were not at fault and repayment would defeat the purpose of the SSI program or be against equity and good conscience. SSA evaluates the facts; a waiver is not automatic.

Fault and ability to repay are separate issues
Explain why you did not cause the overpayment or could not reasonably have known about it. Then explain what repayment would do to your ability to pay ordinary and necessary living expenses or why collection would be unfair for another documented reason. A statement that repayment is difficult, without information about fault and finances, may not answer the questions SSA must decide.

- Check the balance. The current SSA-632-BK (revision shown as June 2025) says a person with an overpayment of $2,000 or less who believes they were not at fault should request a waiver by telephone or through a local office instead of completing that form.
- For other amounts, obtain SSA-632-BK. Use the current form and its instructions. SSA Associate Commissioner Dawn Bystry said on March 7, 2024, “We simplified our waiver request form to make it easier to understand and less burdensome for people to request a waiver.” The simplified form still requires complete, accurate information.
- Document the fault question. Describe what you reported, when you reported it, what SSA told you, and any circumstances that made the overpayment difficult to detect. Attach notices, call records, receipts, or representative-payee documentation that support the timeline.
- Document present finances. Provide the income, resources, housing costs, utilities, food, medical costs, transportation, dependent-care costs, debts, and other ordinary necessary expenses SSA requests. Use current figures and explain unusual or recurring expenses.
- Submit and retain proof. Follow the notice, form, or local-office instructions for telephone, in-person, mail, or online submission. Keep a copy of every page and confirmation.
Can a waiver be requested later?
SSA states that a waiver can be requested at any time. That does not erase a reconsideration deadline. If you believe the overpayment itself is wrong, protect the time-limited reconsideration right even while preparing a waiver request. A waiver request also should not be treated as a promise that withholding will stop; ask SSA what collection action will occur while it is pending.
How to ask for a lower SSI recovery rate
Use SSA-634 when the debt decision is not the immediate issue but the proposed withholding leaves you unable to meet ordinary and necessary living expenses. This request changes the amount collected from each SSI payment; it does not reduce the total overpayment or establish that SSA was wrong.

Understand the SSI rate described by SSA
SSI POMS SI 02220.026 (October 3, 2024) describes an ordinary adjustment rate of 10 percent for SSI recovery and says an SSI recipient who cannot meet ordinary and necessary living expenses because of that withholding may request a change. The SSI overpayment page describes proposed withholding as the lesser of 10 percent or the full monthly SSI payment. Those descriptions do not determine your exact deduction; your notice and current SSA decision do.
File SSA-634 step by step
- Compare the proposed deduction with your budget. List monthly SSI income and all necessary expenses. Separate necessities from optional spending without understating medical, disability-related, or dependent-care costs.
- Explain the shortfall. Show the amount left after rent, utilities, food, transportation, medical needs, and other necessary bills. Identify any imminent shutoff, eviction, loss of medication, or other concrete risk.
- Complete SSA-634. Use the current form and attach bills, receipts, lease information, benefit statements, or other records SSA requests.
- Request a specific affordable amount. Explain how the proposed rate would affect your budget and what amount you can sustain. SSA decides the rate; do not assume the agency will accept a particular figure.
- Keep paying attention to notices. A lower-rate request concerns withholding while the debt remains outstanding. If SSA denies it or changes the amount, follow the instructions for review or submit updated financial information when circumstances change.
When using more than one route makes sense
You dispute the debt and cannot afford any withholding
File reconsideration to challenge the period, reason, or amount, and separately request a lower recovery rate if the proposed deduction is unaffordable. The first asks whether the debt decision is correct; the second addresses immediate cash flow.

- Helpful in various ways
You accept the debt but need time
Use SSA-634 and provide a realistic budget. A lower rate slows recovery; it does not cancel the balance. A waiver is the route for asking SSA to excuse recovery, not a payment-plan substitute.
Build an evidence file that SSA can follow
Create one folder, paper or electronic, with the notice, envelope, forms, submissions, confirmations, and every response. Add a timeline with dates, amounts, phone calls, office visits, and reported changes. Organize financial records by month so the figures on your form can be checked quickly.
- For reconsideration: match each disputed month to the record that proves the correct income, resource, payment, or reporting date.
- For waiver: separate evidence about fault from evidence about current ability to repay.
- For a lower rate: include current income and necessary expenses, plus documents showing any exceptional or disability-related costs.
- For late filing: document delayed delivery, hospitalization, incapacity, language or access barriers, or another reason you could not act earlier.
Never send your only original document. Keep a log of the date, method, destination, and confirmation number for every submission.
What to do if SSA does not explain the calculation
Ask for access to the information SSA used and for an explanation of the stated reason. Compare the agency’s months and figures with your records line by line. If the explanation reveals a factual error, add that specific correction to your reconsideration. If the numbers are correct but collection would create hardship, put the financial facts in the waiver or recovery-rate request rather than repeating a math dispute.
Payment continuation and later appeals
SSA’s general appeals information for nonmedical initial determinations discusses payment continuation when a request is filed within 10 days, with different consequences for requests filed later but within 60 days. That information should not be assumed to apply identically to every SSI overpayment. For an overpayment, rely on the SSI-specific notice and POMS rule: a timely initial reconsideration can stop recovery during that reconsideration, while further levels such as an administrative law judge hearing or Appeals Council review do not automatically stop recovery. Read each subsequent decision for its own instructions and ask SSA how withholding will be handled.
Practical checklist before you submit
- Read the notice twice and mark the amount, months, reason, notice date, proposed withholding, and submission instructions.
- Choose reconsideration, waiver, recovery-rate change, or clearly separate requests for more than one.
- Use the current SSA-561, SSA-632-BK, or SSA-634 instructions rather than an old saved copy.
- File reconsideration immediately if you may challenge the debt; do not wait for a waiver decision.
- Attach a concise timeline and records that prove each important statement.
- Ask to inspect the file if the calculation or reason is unclear.
- Keep complete copies and proof of delivery.
- Calendar the next response deadline and monitor every SSA notice.
The essential distinction is simple: reconsideration asks SSA to correct the debt decision, waiver asks SSA to forgive recovery, and SSA-634 asks SSA to collect less each month. Choose based on the outcome you need, act within the applicable time limit, and let the written notice and current SSA instructions govern how your request is filed.
