Choose a trust when you need the governing document to control distributions, give a trustee continuing discretion, or keep assets under management beyond the ordinary custodial age. A spendthrift clause can add protection against some transfers and creditor claims, but it is neither automatic for every trust nor an absolute shield. The right choice depends on the governing state statute, the child’s age, the assets, the family’s objectives, and the trust language.
What the two arrangements actually are
Custodial account under UTMA or UGMA
A custodial account is created under a state’s Uniform Transfers to Minors Act (UTMA) or Uniform Gifts to Minors Act (UGMA). Property is transferred to the minor, while an adult custodian holds and manages it for the child’s benefit. The custodian may invest, safeguard and spend the property for permitted purposes, but the arrangement is governed primarily by the enacted statute and the financial institution’s account terms.

The child does not receive a customized distribution schedule simply because the account was opened. The relevant statute determines when the custodianship ends and the child obtains control. That age differs by jurisdiction, by the statute in force, and sometimes by the way the transfer was made. Confirm the rule in the state whose law governs the account instead of relying on a national age.
Trust for a child
A trust is a legal arrangement in which a trustee holds property for one or more beneficiaries under a written instrument. The instrument can describe permitted distributions, standards such as health or education, trustee powers, successor trustees, accounting duties and a later distribution or termination date. A trust may continue after the child reaches adulthood if its terms and applicable law allow it.

“Trust” is a broad category. Some trusts require distributions at specified ages; others give the trustee broad discretion; some contain a spendthrift provision and some do not. The practical result comes from the document, the governing law and the trustee’s administration—not from the word trust alone.
Side-by-side comparison
| Decision axis | Custodial account | Trust |
|---|---|---|
| Who manages the property | An adult custodian manages property transferred for the minor under the applicable UTMA or UGMA statute. | A trustee administers trust property according to the instrument and applicable law. |
| When the child gains control | At the age specified by the governing state law and the transfer’s terms. | At the distribution or termination time written into the trust, subject to legal limits and the document’s operation. |
| Distribution flexibility | The statute supplies the management framework; it is not a substitute for individually drafted distribution terms. | The instrument can set standards, milestones, powers and trustee discretion. Flexibility depends on careful drafting. |
| Creditor exposure | The available sources do not establish a universal creditor result. Do not assume either immunity or exposure without state-specific advice. | A valid spendthrift provision may restrict voluntary transfers and some creditor access while assets remain in trust, but exceptions and treatment of distributions vary by state. |
| Complexity | The Uniform Law Commission describes the custodial-transfer method as simple, although account opening and statutory compliance still matter. | Requires a suitable instrument, a trustee, recordkeeping and ongoing administration. |
| Cost | No reliable national fee figure is established; financial-institution charges and investment expenses vary. | No reliable general cost comparison is established; drafting, trustee, tax and administration costs depend on the arrangement. |
When a custodial account is usually the better fit
You want the simplest legal structure
A custodial account can be practical for a modest gift when the family is comfortable with an adult managing the property temporarily and the child eventually taking control under the state statute. The account avoids writing a bespoke distribution scheme and can be opened through a financial institution that supports the applicable UTMA or UGMA registration.
The child’s eventual control is acceptable
The central trade-off is that the custodian’s role ends when the statutory custodial period ends. If the child will be ready to manage the property at that point, the account’s simplicity may outweigh the loss of long-term control. If the family wants to delay control, impose milestones or retain discretion after majority, a custodial account may not accomplish that objective.
The gift is straightforward
Cash, securities and other property that the institution can properly register may fit a custodial account. Ask the institution which assets it accepts, how title is recorded and what documents it requires. An account is not a way to retain personal ownership while informally earmarking money for a child; the property is transferred for the minor under the statute.

When a trust is usually the better fit
You need a later or staged distribution
A trust can distribute a portion at one age, another portion later, or retain assets under a trustee’s management for an extended period. The document can also authorize distributions for defined purposes or give the trustee discretion to respond to education, health, housing or other circumstances. The trustee must follow the actual language; flexibility is not automatic.
The child may need continuing support or supervision
A trust may be appropriate where a child has a disability, difficulty managing money, a history of addiction, vulnerability to exploitation or a family situation that calls for professional administration. The instrument can identify who makes decisions and how successor trustees are appointed. Specialized advice is important because benefit programs, tax rules and trustee duties can be affected by the design.
The family wants a spendthrift provision
A spendthrift clause generally seeks to restrict the beneficiary’s ability to assign an interest before receiving it and to limit some creditors’ access to property still held in trust. Its effectiveness depends on state law, the clause’s wording and the facts of the claim. Certain creditors or claims may receive statutory exceptions, and a creditor may be able to reach a distribution after it leaves the trust. A spendthrift provision is therefore a planning feature, not a guarantee of asset protection.

How control and distributions differ in practice
Custodian’s authority
The custodian manages the property for the minor and must use it consistently with the governing statute and fiduciary duties. The account is not the custodian’s personal asset. A custodian should keep records, separate the child’s property from personal funds, follow the institution’s procedures and arrange the required transfer when the custodianship ends.

Trustee’s authority
The trustee’s powers come from the instrument and governing law. The trustee may have to make mandatory payments, may be allowed to make discretionary payments, or may have a combination of both. A trustee should document decisions, follow any distribution standard, avoid conflicts and provide reports when required. A child’s request alone does not override the document.
Why the difference matters at adulthood
With a custodial account, the statutory termination event can place the child in direct control even if the family would prefer a later transition. With a trust, the written schedule or discretion can keep assets managed longer, but the family must accept the responsibilities and expenses of a trust and trustee.
Spendthrift protection: what it can and cannot do
What the clause is designed to accomplish
A spendthrift provision typically prevents a beneficiary from voluntarily selling, pledging or assigning a future trust interest. It can also postpone a creditor’s access to assets that remain in the trust. The clause must be drafted and administered under the law that governs the trust.

- Not every trust contains a spendthrift provision.
- State statutes differ on which creditors or claims may be exceptions.
- A clause may not protect property after a distribution is made to the beneficiary.
- Courts may examine whether the trust is valid, whether the trustee complied with the instrument and whether the claim falls within an exception.
- A self-settled trust, in which the person seeking protection is also the person who created and funded it, may receive different treatment from a third-party trust.
General summaries can explain the concept, but they cannot predict the result for a particular beneficiary, creditor or state. Obtain current advice before treating a spendthrift clause as a shield against a known claim.

The 2026 model-law development—and why it does not set your child’s age
The Uniform Law Commission’s current listing describes a 2026 Transfers to Minors Act. It reports that the model includes an option to continue a new custodianship after the minor reaches the age of majority, up to age 25, among other changes. The listing is a model-act description, not evidence that any particular state has enacted that version.
The Commission describes the general concept this way: “The Uniform Transfers to Minors Act provides a simple way for anyone to transfer property to a minor under a custodial arrangement where an adult manages the property for the minor’s benefit.” Before relying on an extended custodianship, check the enacted statute, effective date and account language in the relevant state. Do not state that a child can remain in a custodial arrangement until 25 unless that jurisdiction actually provides it for the transfer at issue.
Taxes, financial aid and benefits: why a generic winner is not possible
The available evidence does not establish a universal tax advantage for either arrangement. Tax treatment can depend on the donor, the beneficiary, the type of asset, income and distributions, gift-tax rules, trust classification and current federal and state law. A trust’s tax result can differ substantially according to its terms and administration.
Likewise, there is no supported one-size-fits-all financial-aid result. Applications may ask about assets, ownership, income and distributions, and rules can change. A child’s eligibility for means-tested benefits may also be affected by how property is owned and distributed. Treat these questions as separate planning issues and obtain current, authoritative tax, aid and benefits guidance for the family’s facts.

How to choose: a decision framework
Choose a custodial account when all of these are true
- You want a relatively simple transfer and management arrangement.
- The family accepts the governing state’s age and the child’s eventual direct control.
- No customized distribution schedule or continuing trustee discretion is needed.
- The financial institution can hold the intended assets in the required custodial registration.
- You are prepared to identify the governing law and complete the transfer correctly.
Choose a trust when one or more of these goals is central
- You want distributions delayed, staged or conditioned on a standard.
- The child may need managed support beyond the custodial age.
- You want a named trustee, successor process and written decision rules.
- A spendthrift provision is appropriate after evaluating state exceptions and claim risks.
- The assets or family circumstances are complex enough that a statutory account is too rigid.
Pause and obtain individualized advice when
- The family lives in more than one state or the child may move before control transfers.
- The gift includes a business interest, real estate, concentrated securities, digital assets or another difficult-to-administer property.
- A creditor, divorce, lawsuit or benefit-eligibility concern already exists.
- The child has a disability or receives means-tested benefits.
- The donor is considering an irrevocable trust, a self-settled arrangement or a tax-sensitive transfer.
Setting up a custodial account: a practical checklist
- Identify the governing law. Ask which state’s UTMA or UGMA statute applies and verify the age and termination rules in the current enacted code.
- Confirm the account type. Tell the financial institution that the account is a statutory custodial account and ask for its exact registration, forms and permitted assets.
- Name the parties accurately. The minor is the beneficiary-owner under the statute; the adult is the custodian. Do not title the property as the custodian’s personal account.
- Document the transfer. Keep the transfer record, valuation information and account agreement with the child’s financial records.
- Manage for the child. Track contributions, investments, expenses and distributions. Use funds only as allowed by the governing law and maintain clear records.
- Plan for termination. Calendar the statutory date, confirm the institution’s handoff process and prepare to deliver control and records to the child.
Creating and administering a trust: a practical checklist
- Define the objective. Decide whether the priority is delayed control, staged payments, support for a special circumstance, trustee discretion, creditor planning or another specific goal.
- Select governing law and trustees. Consider where the trustee will serve, whether a successor is named and whether the proposed trustee can handle investments, accounting and distributions.
- Draft precise terms. Address beneficiaries, permitted distributions, mandatory versus discretionary payments, ages or milestones, trustee powers, reporting, removal and successor procedures.
- Evaluate a spendthrift clause. Ask counsel how the clause works under the selected law, which exceptions apply and what happens after distributions.
- Fund the trust correctly. Retitle or transfer each asset as required. An unfunded trust cannot manage property that was never transferred to it.
- Administer continuously. Keep separate accounts, document decisions, satisfy tax and reporting obligations and follow the instrument rather than informal family instructions.
- Review after major changes. Revisit the document after relocation, marriage, divorce, disability, a new child, a large inheritance or changes in law.
Common mistakes and how to avoid them
Assuming every trust is spendthrift
A trust may omit a spendthrift clause or contain language that does not produce the expected protection. Read the instrument and obtain a jurisdiction-specific interpretation.
Promising a universal custodial age
UTMA and UGMA rules are state-based. The age can vary, and a newer model act does not change a state’s law until enacted. Verify the statute and the account terms for the actual transfer.
Using a custodial account to impose trust-like conditions
A custodian cannot rewrite the statutory arrangement by telling the institution to release funds only for a privately chosen milestone. If the family needs enforceable conditions or discretion, use a properly drafted trust.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Believing a spendthrift clause defeats every claim
Exceptions differ, and distributions may be treated differently from assets still held in trust. Do not transfer assets or structure a trust in response to a known claim without legal advice.
Ignoring administration after signing
Incorrect titling, commingled funds, missing records or distributions outside the instrument can undermine the intended plan. Administration is part of the legal arrangement, not clerical cleanup.
Choosing based on an unsupported tax or aid promise
No general tax-saving, financial-aid or fee outcome is established here. Those results require current rules and the family’s complete facts.
Questions to take to a lawyer or financial institution
- Which state statute governs this transfer, and exactly when does the child receive control?
- Has that state enacted the relevant 2026 model-act provisions, or does an older statute apply?
- Would the proposed assets be accepted in a custodial registration, and what are the institution’s charges and procedures?
- What distribution schedule and trustee discretion would meet the family’s objective?
- Which spendthrift exceptions and post-distribution risks apply in this state?
- How will the arrangement affect current tax reporting, benefits and financial-aid applications?
- Who will keep records, file required returns and take over if the custodian or trustee cannot serve?
Bottom line
A custodial account is generally the better fit for a simple, properly documented transfer when the family accepts the statutory handoff of control. A trust is generally the better fit when the family needs tailored timing, continuing management or carefully drafted discretion. A spendthrift clause can strengthen a trust’s protection against some transfers and creditor claims, but state exceptions and distributions limit what it can do. Verify the governing state law—especially before relying on the 2026 model-act update—and obtain individualized advice for tax, benefits, creditor or complex-asset questions.
