Not automatically. First call your mortgage servicer and a free HUD-approved housing counselor to find out whether a modification, repayment plan, forbearance, refinance, or another option could make the payment sustainable. Selling can be sensible when a realistic sale will pay the mortgage and selling costs and leave enough for your next housing arrangement. If the home is worth less than the balance, a short sale or deed-in-lieu may be possible, but neither automatically erases the remaining debt.
Decide whether the problem is temporary or permanent
Your first decision is not “sell or keep.” It is whether the payment problem is a short-term disruption or a lasting mismatch between the mortgage and your finances. That distinction affects which assistance programs a servicer may review and whether selling is urgent.

Temporary hardship
A temporary hardship might follow a layoff, illness, delayed income, disaster, or another event you expect to resolve. Ask the servicer whether a forbearance, repayment plan, or short-term arrangement can pause or spread missed payments. These options do not necessarily reduce what you owe; understand when deferred amounts become due and what the future payment will be.
Long-term affordability problem
If your income has permanently fallen, expenses have increased, or the payment will remain unaffordable even after a temporary pause, ask about a loan modification or refinance if you could qualify. A modification may change the interest rate, term, or other loan terms, but eligibility and the final payment depend on the servicer’s review. If no sustainable payment is available, compare an ordinary sale, a short sale, and a deed-in-lieu before the account moves further toward foreclosure.

Call the mortgage servicer before you miss more payments
Use the phone number on your mortgage statement, not a number supplied by an unsolicited “rescue” company. Explain the reason for the hardship and ask for the servicer’s mortgage-assistance application and every loss-mitigation option for which you may be reviewed.
Have a clear, factual snapshot ready:
- Whether the hardship is temporary or permanent and when it began.
- Current household income, regular expenses, assets, and debts.
- The payment you can realistically sustain, rather than an optimistic amount.
- Any relevant military permanent-change-of-station orders or other documented circumstances.
- Recent pay information, bank statements, tax documents, and the other items the servicer requests.
Submit a complete application promptly and keep copies, dates, names, and confirmation numbers. Ask what happens while the application is being reviewed, how payments should be made, and which deadlines still apply. Do not stop paying or redirect payments merely because a third party tells you to; get instructions directly from the servicer.
Get independent, free housing counseling
The Consumer Financial Protection Bureau says foreclosure-prevention counseling from a HUD-approved housing counselor is free. A counselor can organize your budget, explain the options you may ask the servicer to review, help prepare documents, and communicate with the servicer. Counseling cannot guarantee that you will keep the home or that a particular option will be approved.
Use the CFPB’s “Find a Housing Counselor” tool or call the HOPE Hotline at 888-995-HOPE (4673). The CFPB also lists 855-411-CFPB (2372) to connect consumers with a counselor. The HOPE Hotline is described as available 24 hours a day, seven days a week. There is no legitimate need to pay an upfront fee for this official referral.

CFPB guidance on deed-in-lieu assistance puts the urgency plainly: “The worst thing you can do is nothing.” Contacting the servicer and counselor early generally gives you more time to assemble documents and evaluate alternatives.
Compare the five paths
| Path | What it means | Questions to answer before choosing |
|---|---|---|
| Try to keep the home | Request a refinance, modification, repayment plan, or forbearance. Availability depends on the loan, servicer review, and your circumstances. | Is the hardship temporary? What payment can the household sustain? What does the servicer offer in writing, including any deferred amount? |
| Ordinary sale | Sell at a price sufficient to pay the mortgage payoff and transaction costs, then use the remaining proceeds for the next housing plan. | What is a realistic market price, the exact payoff, all selling costs, and the net amount left? Where will you live afterward? |
| Short sale | Sell for less than the outstanding mortgage balance, with the servicer or lender agreeing to the transaction. | Has approval been issued? Will any deficiency be waived in writing? Is relocation assistance available, and when would you have to move? |
| Deed-in-lieu | Voluntarily transfer ownership to the lender instead of proceeding through foreclosure, if the lender accepts the deed. | Does the agreement resolve the entire balance? Is a deficiency waiver explicit and written? Could the transfer create tax issues? |
| Foreclosure process | A legal process that can follow unresolved default. Procedures and timing depend on state law and the facts of the loan. | Have you contacted a counselor? Should an attorney or legal-aid organization review papers or deadlines? |
When an ordinary sale may be the cleanest exit
A normal sale is different from a short sale: the expected proceeds cover the mortgage payoff and selling expenses. The CFPB says selling is typically better for a borrower’s finances and credit than foreclosure, a short sale, or a deed-in-lieu, but that is general guidance, not a promise about an individual credit file or financial result.
Build a conservative net-proceeds estimate before listing:

- Estimate a realistic sale price using local, recent comparable sales. A listing price or online estimate is not the same as a completed sale.
- Subtract commissions, transfer taxes, title or attorney charges, repairs, concessions, moving costs, and other transaction expenses that apply in your area.
- Subtract the cost of the next housing arrangement, such as a security deposit, first month’s rent, moving expenses, or a replacement mortgage payment.
- Test a lower sale price and a longer marketing period so the plan does not depend on a best-case outcome.
If the resulting amount is enough to pay the loan and fund a workable next step, a regular sale may avoid the uncertainty of a distressed transfer. If the numbers do not work, do not sign a listing agreement or accept an offer without discussing the shortfall with the servicer.

What a short sale changes
In a short sale, the proposed sale price is below the mortgage balance or the total amount needed to close. The servicer or lender must agree; a buyer’s offer alone does not authorize the sale. Approval may require financial documents, a purchase contract, an appraisal or broker-price opinion, and a review period that can affect the buyer and your moving schedule.
Ask for the approval letter before closing and read its treatment of:
- The exact amount the lender will accept.
- Whether the lender waives the remaining deficiency or reserves the right to pursue it.
- Any contribution required from you or another lienholder.
- Who pays taxes, assessments, liens, and transaction charges.
- Whether relocation funds are available and the conditions for receiving them.
Do not assume that “approved short sale” means the debt is fully released. Deficiency rules vary by state, loan type, and the written agreement. Have a local attorney review the approval if the language is unclear, and ask a tax professional whether canceled debt or a property transfer could affect your return.

What a deed-in-lieu changes
A deed-in-lieu transfers ownership to the lender voluntarily. It can avoid the formal foreclosure process only if the lender accepts the transfer and the required agreement is completed. The lender may decline if there are junior liens, title problems, insurance issues, or other conditions.

Before signing, require a document that states whether the transfer satisfies the entire mortgage obligation. If any balance could remain, request a specific deficiency waiver in writing. Also clarify the move-out date, property condition requirements, treatment of other liens, and any relocation assistance. A deed-in-lieu may have tax consequences, so obtain state-specific legal and tax advice rather than relying on a verbal promise.

Ignoring notices does not preserve your options. As a delinquency continues, fees, interest, legal steps, and deadlines may accumulate. Foreclosure procedure differs by jurisdiction, and the available time can depend on the loan and the stage of the case. A counselor can help identify what is pending, but a counselor cannot provide legal representation.
If you receive a summons, complaint, sale notice, or other legal paper, or if a foreclosure sale appears imminent, contact a foreclosure attorney or legal-aid provider promptly as well as a HUD-approved counselor. Bring every notice and your payment history. Missing a response deadline can limit defenses or alternatives, so treat legal papers as urgent.

A practical decision worksheet
Write down the answers to these questions and take them to your servicer and counselor:
- What is the exact mortgage payoff, including current fees and daily interest?
- What monthly payment, including taxes and insurance, can the household sustain for the next several years?
- How much cash is available for a move, deposit, repairs, or a temporary gap?
- What is the realistic sale price range, and what costs would be deducted at closing?
- Would a sale leave enough for safe, stable housing afterward?
- If the home is underwater, will the servicer approve a short sale or deed-in-lieu?
- Does the proposed agreement release the entire debt, and where is that waiver written?
- What state-specific deficiency, tax, and foreclosure rules require professional advice?
The answers may point to a sustainable retention option, an ordinary sale, a negotiated distressed exit, or legal advice about an imminent foreclosure. They also give you a record of the assumptions behind the decision instead of forcing you to choose under pressure.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsBottom line
Sell only after comparing a realistic net sale amount and your next housing costs with the alternatives the servicer and counselor identify. If a regular sale can pay the loan and leave a workable reserve, it may be preferable to a distressed exit. If the sale would not cover the balance, pursue written short-sale or deed-in-lieu terms, including any deficiency waiver. Whatever the numbers, call the servicer and a HUD-approved counselor now rather than waiting for the situation to resolve on its own.
