Usually, a married couple in this situation should consider a written postnuptial (also called marital) agreement—not a cohabitation agreement. The agreement can document the owner’s premarital interest while fairly defining the other spouse’s rights for mortgage payments, improvements, appreciation, occupancy, divorce and death. Whether it works depends on the law where you live, how the house has been handled, and whether both spouses sign voluntarily after complete financial disclosure and separate legal advice.

Why the document is usually called a postnuptial agreement

“Cohabitation agreement” most often describes a contract for unmarried partners. Once a couple is married, the comparable contract is generally a postnuptial agreement or marital agreement. The New York City Bar Association describes a postnuptial agreement as essentially a prenuptial agreement entered into after the wedding rather than before it.

Terminology is not merely cosmetic. A state may impose different rules on agreements between unmarried partners and agreements that alter spouses’ property, support or inheritance rights. Ask a family-law attorney which document your jurisdiction recognizes and which law will govern it. If you are not yet married, a prenup may be the appropriate instrument; if you are already married, do not assume a cohabitation template will address spousal rights correctly.

Does the owner automatically keep the house?

In many jurisdictions, a house acquired before marriage starts as the owning spouse’s separate property. That is only a starting point, not a universal result. Marital payments, retitling, commingling of funds, active work that increases value and special matrimonial-home or homestead statutes can create a claim for the non-owner spouse or restrict what the titled owner can do.

The legal result is jurisdiction-specific. Nevada, for example, generally identifies property owned before marriage, and property received by gift, bequest, devise or descent, as separate property, subject to statutory rules and exceptions. That example cannot be applied automatically in another state or country. Some places protect a spouse’s right to occupy the family home even when title is in the other spouse’s name.

Separate title is useful but not conclusive

Keeping title solely in the owner’s name can help demonstrate an intention to preserve separate ownership. It does not by itself resolve claims based on marital funds, labor, an agreement between the spouses or statutory family-home protections. Retitling the house jointly can be powerful evidence that the owner intended to share it, so make that change only after understanding its property and tax consequences.

Commingling can blur the paper trail

Commingling occurs when separate and marital money are mixed so extensively that the separate contribution cannot be reliably traced. Examples include paying the mortgage from a joint account, depositing rent or sale proceeds into a shared account, or using marital earnings for major renovations without records. A court may treat some or all of the property or its increase in value as marital, depending on local law. An agreement can set rules going forward, but it cannot always erase rights that have already vested under mandatory law.

What a well-drafted agreement should decide

The central question is not simply “Who owns the house?” It is how ownership, contributions and housing security will be handled throughout the marriage and if the marriage ends.

Title and the starting value

  • Identify the legal owner and attach the deed or a precise legal description.
  • Record the house’s value, mortgage balance and date-of-marriage equity using a mutually accepted valuation method.
  • State whether the premarital equity remains separate, and whether any later increase is passive appreciation, active appreciation, marital property or a defined mixture.
  • Explain whether refinancing, a home-equity loan or a transfer into a trust changes the agreed treatment.

Mortgage and household payments

List principal and interest separately. Principal payments build equity; interest is a financing expense. Also address property taxes, insurance, utilities, ordinary repairs and major capital work. For every payment, specify whether it is rent for the right to live there, a gift, reimbursement, a contribution that earns a percentage of equity, or a payment that creates a fixed repayment claim.

Payment or contribution Possible treatment to state expressly Records to keep
Mortgage principal No ownership claim; dollar-for-dollar reimbursement; or a formula-based equity share Statements showing principal paid and payment source
Mortgage interest Household expense, rent, or another defined allocation Loan statements and payment ledger
Taxes and insurance Shared household expense or reimbursable contribution Invoices, receipts and account records
Routine repairs Household expense unless the parties agree otherwise Receipts and contractor invoices
Renovations and additions Reimbursement, lien-like claim where permitted, or a stated share of resulting value Contracts, permits, before-and-after valuations

Appreciation and improvements

Distinguish passive appreciation—a market increase unrelated to either spouse’s work—from active appreciation caused by renovations, management or a spouse’s labor. The agreement can assign passive growth to the owner while giving the non-owner a defined reimbursement or percentage for documented contributions. It should explain how value will be measured, who selects an appraiser and how disagreements are resolved.

Occupancy, sale and buyout

  • Can both spouses live in the home while married, and who pays expenses if they separate?
  • Does the non-owner receive a temporary right to remain, especially when children, disability or relocation are involved?
  • Who may decide to sell or refinance?
  • How is a buyout price calculated, including the mortgage, selling costs, agreed credits and valuation date?
  • What happens if the owner cannot refinance or the non-owner cannot qualify for a mortgage?

These terms should be practical rather than one-sided. A clause that requires an immediate sale may conflict with a child’s housing needs or a statutory right of occupancy. Conversely, an indefinite occupancy promise can prevent the owner from accessing equity. State the timetable, notice requirements and dispute process.

Divorce and separation

Specify whether the house itself remains separate, whether the other spouse receives reimbursement or a share of appreciation, and how debts secured by the property are allocated. Address temporary possession, maintenance, listing with a broker, appraisal disputes, closing costs and the consequences of refusing to sign documents needed for a sale or refinance. Support obligations and child-related orders may be governed by mandatory law even when property terms are contractual.

Death and inheritance

A property agreement can address what the surviving spouse receives, but it does not replace an estate plan. Coordinate it with wills, revocable trusts, beneficiary designations, survivorship language on the deed, and any elective-share, homestead or matrimonial-home rights. A promise in the agreement may require a will or beneficiary change to be effective, and some statutory survivor protections cannot be waived casually or at all.

How the main agreement choices compare

Option When used Property scope Contribution accounting Main caution
Prenuptial agreement Before marriage House plus other assets, debts and support terms Can set rules before marital payments begin Must be signed before the wedding and comply with local timing and disclosure rules
Postnuptial or marital agreement After marriage House alone or the couple’s broader finances Can recognize payments and improvements already made and set future formulas Extra scrutiny may apply because spouses already owe each other duties
Cohabitation agreement Usually for unmarried partners Property and expenses during cohabitation Can allocate contributions if permitted by local law May not address married-spouse, support, inheritance or matrimonial-home rights
No written agreement Default legal rules Determined by statutes, case law, title and conduct Usually requires tracing payments and proving intent Outcome can be uncertain and expensive to resolve during a breakup

When signing is especially worth considering

  • The house was purchased before marriage and represents a substantial share of one spouse’s net worth.
  • The couple will use joint income to pay principal, make improvements or service a home-equity loan.
  • One spouse expects to contribute substantial unpaid labor, cash or professional work to the property.
  • There are children from a prior relationship, a family trust, an inheritance or business assets to protect.
  • The couple wants a predictable buyout or occupancy process instead of leaving every issue to litigation.
  • Either spouse has cross-border ties or owns property in more than one jurisdiction.

An agreement is not automatically necessary for every couple. If the home is modest, finances are fully shared and both spouses prefer statutory rules, the cost and emotional strain of negotiating a contract may outweigh its value. That decision should follow a jurisdiction-specific consultation, not a generic online form.

How to create the agreement without undermining it

  1. Identify the governing law. Start with the state or country where the home is located and where you live. Ask counsel whether another jurisdiction’s law could apply because of a move, marriage location or property location.
  2. Gather complete financial information. Exchange deeds, appraisals, mortgage statements, bank and investment statements, debts, tax records and ownership interests. Identify the source of the down payment and all major post-marriage expenditures.
  3. Use separate lawyers. Each spouse should have an independent family-law attorney. One lawyer cannot ethically give both spouses fully independent advice about a contract that reallocates rights.
  4. Negotiate the contribution formula. Decide how principal, interest, taxes, insurance, repairs, renovations and appreciation will be treated. Put the valuation date, appraisal process and buyout mechanics in writing.
  5. Address housing and death rights. Cover separation occupancy, sale, refinance, relocation, wills, trusts, beneficiary designations and any statutory home protections.
  6. Allow meaningful review time. Avoid presenting a finished document immediately before a crisis, move or major financial transaction. Pressure, threats or lack of time can later support an argument that consent was not voluntary.
  7. Sign with required formalities. Follow local witnessing, notarization, acknowledgment and filing rules. Keep signed originals and a secure digital copy; give each spouse and counsel a copy.
  8. Review after major changes. Revisit the agreement after refinancing, a transfer of title, a large renovation, a move to another jurisdiction, birth or adoption of a child, serious illness or a significant inheritance.

Enforceability: what courts commonly examine

Courts assess the law applicable to the agreement, not merely the couple’s stated intentions. Common issues include:

  • Disclosure: Were assets, debts, income and the home’s value disclosed accurately and completely?
  • Voluntariness: Did each spouse sign without duress, fraud, threats or an improper last-minute ultimatum?
  • Independent advice: Did each spouse understand the rights being waived or changed?
  • Fairness and public policy: Is the agreement unconscionable, or does it attempt to waive rights that local law makes nonwaivable?
  • Formal execution: Were signatures, witnesses, notarization, language and filing requirements satisfied?
  • Clarity and consistency: Do the property schedule, payment formula, deed, wills and beneficiary forms say the same thing?

Spouses may owe each other fiduciary or heightened duties under local law. A contract that looks acceptable on paper can still fail if the negotiation process was coercive or the financial information was incomplete. Independent review is therefore part of the substance, not a ceremonial step.

Common mistakes and how to avoid them

Calling a married-couple contract a cohabitation agreement

Using the wrong label can signal that the document was not designed for marital rights. Ask counsel to draft the instrument recognized in your jurisdiction.

Promising “no claim” without defining payments

A blanket waiver may not explain what happens when the non-owner pays principal or funds a roof, addition or kitchen. Use a schedule and formula instead of relying on a broad sentence.

Ignoring records

Even a careful agreement is difficult to administer without statements, invoices and valuations. Keep a separate ledger for principal, improvements and reimbursements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Forgetting the deed and estate plan

A marital agreement cannot automatically change title, a beneficiary designation or a will. Coordinate each document and confirm that later refinancing or a deed transfer does not contradict the contract.

Assuming one state’s rule travels with you

Moving can change homestead, matrimonial-home, support and enforcement rules. Obtain a review before relocating or buying another property.

A practical decision test

Discuss a postnuptial agreement with independent lawyers if all three statements are true: one spouse wants to preserve a documented premarital interest; the other spouse will contribute money, labor or housing dependence that deserves clear treatment; and both want predictable rules rather than a future dispute over tracing and intent. If any statement is false, a lawyer can still explain the default law and whether simpler record-keeping or an estate-plan update is sufficient.

The goal is not to declare one spouse the permanent winner. It is to make the economic exchange visible: what the owner brought into the marriage, what both spouses contribute, what housing each can rely on, and what happens if the marriage ends through separation or death. Because mandatory family and property rules differ sharply, have the final document prepared and reviewed under the law that actually governs your home and marriage.
