The correct provision depends on what was sold, how the land was used, whether the asset meets the applicable holding-period test, what you buy afterward, your ownership position, and the tax year in which the transfer occurs.
As a starting point, investigate Section 54B when qualifying agricultural land is transferred and the seller reinvests in agricultural land. Investigate Section 54F when a qualifying long-term asset other than a residential house is transferred and the seller invests in a residential house. The two sections are not interchangeable: the replacement asset is agricultural land under one route and a residential house under the other.

The quick distinction: agricultural land versus a residential house
| Decision point | Section 54B route | Section 54F route |
|---|---|---|
| Replacement asset identified in the Income Tax Department’s return schedule | New agricultural land | New residential house |
| Asset question | Whether the transferred land and its use satisfy the applicable agricultural-land conditions | Whether the transferred asset is a qualifying long-term asset other than a residential house |
| Important holding-period issue under the 1961 Act | Apply the rule for the particular claim and transfer year | The Income Tax Department’s ITR-2 FAQ describes land or a building held for more than 24 months as long-term |
| Dates to document | Transfer, prior land use, replacement-land purchase and any deposit | Transfer, house purchase or construction, existing-house ownership and any deposit |
| Common mistake | Assuming every plot or rural parcel is qualifying agricultural land | Assuming selling a plot and buying a house automatically creates a Section 54F exemption |
The Department’s return schedules make the reinvestment distinction clear: a Section 54B claim records the cost and purchase date of new agricultural land, while a Section 54F claim records the cost and purchase or construction date of a new residential house. Those fields identify the type of reinvestment; they do not replace the full statutory eligibility tests.
First establish which law governs the transfer
The section numbers in this article belong to the Income-tax Act, 1961. The governing Act now depends on the tax year. The Income Tax Department states that the 1961 Act applies to periods before Tax Year 2026–27, including Assessment Year 2026–27 and earlier. The Income-tax Act, 2025 applies for Tax Year 2026–27 onward.

That makes the legally relevant transfer date critical. A contract may be signed in one period while possession, registration, compulsory acquisition or another event that constitutes a transfer occurs in another. Do not choose a section solely from the date on an agreement or from the year in which money reached your bank account. Establish the transfer event and then apply the law for that tax year.
Transfers near 1 April 2026
If a transaction falls close to the changeover, preserve the documents showing the agreement date, payment dates, possession, registration and any statutory acquisition event. The Department’s 1 April 2026 notice says: “For payments pertaining to periods before Tax Year 2026–27, i.e., AY 2026–27 or earlier, the Income Tax Act, 1961 will apply.” That statement should not be used to assume that every land transaction paid around that date has the same transfer year; the legal transfer facts still need to be determined.
Use the current statutory text and amendments for the applicable year. A conclusion reached under the 1961 Act should not automatically be carried forward to a transfer governed by the 2025 Act.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesWhen Section 54B is the provision to investigate
Section 54B is the route to examine when the transferred asset is qualifying agricultural land and the reinvestment is in new agricultural land. The word “land” is not enough. You need evidence about the land’s classification, its actual agricultural use, who used it, and the period that the applicable statute requires.
Questions that matter for the land sold
- How was the parcel described in official land and revenue records?
- Was it actually used for agricultural purposes, and can that use be demonstrated?
- Who carried out or supervised the agricultural use?
- What period of use and ownership must be established under the law governing the transfer year?
- Was the transaction an ordinary sale, or another event treated as a transfer for capital-gains purposes?
Keep records that answer those questions rather than relying on a broker’s description, a village name or the fact that the parcel was outside a city. A property marketed as a “farm plot” may still require a detailed legal and factual analysis.

Questions that matter for the replacement land
For the Section 54B route, the replacement asset is new agricultural land. Retain the purchase deed, registration details, payment trail and the date on which the new land was acquired. The return schedule asks for the cost and purchase date, so those figures should reconcile with the conveyance documents and bank records.
The schedule does not state every condition that must be met. Confirm the permitted purchase window, the character of the replacement land and any use or ownership requirements from the complete law applicable to the transfer year. Do not treat entry of a cost and date in the return as proof that the exemption is valid.

When Section 54F is the provision to investigate
Section 54F is the route to examine when the transferred asset is a qualifying long-term asset other than a residential house and the seller invests in a residential house. A plot sale can be relevant, but the plot’s sale alone does not create the exemption. The asset must meet the long-term and other statutory conditions, and the house investment and ownership tests must also be satisfied.
Confirm that the asset is long-term
For the 1961 Act, the Income Tax Department’s ITR-2 FAQ describes land or a building held for more than 24 months as long-term. Apply that statement only within the 1961 Act framework and verify the relevant test for a transfer governed by the Income-tax Act, 2025 or a later amendment.
Calculate the holding period from the legally relevant acquisition and transfer events. Inherited property, gifts, development agreements, joint ownership and other non-standard acquisitions can require specific rules. The Department’s FAQ also explains that a transfer can include transactions beyond an ordinary sale, so identify the event that legally triggers the capital gain.

Confirm that the reinvestment is a residential house
The Section 54F return schedule asks for the cost and date of purchase or construction of a new residential house. Keep the agreement, registration or construction records, payment evidence and possession details. If construction is involved, retain contracts, invoices, approvals and the dates of payments and completion-related events needed to demonstrate compliance.

Buying an asset that is merely described as a plot, commercial unit, shop, office or non-residential property does not answer the residential-house requirement. Where a building has mixed use or the title and actual use differ, obtain a transfer-year-specific opinion before claiming relief.
Check existing and later house ownership
Section 54F has ownership and subsequent-purchase or construction conditions that must be checked against the statute for the transfer year. List every residential house already owned on the transfer date, including jointly owned interests, and record any house purchased or constructed after the transfer. Do not assume that a house in another city, a jointly held house or an inherited share is irrelevant; the legal treatment depends on the applicable provisions and facts.
How to choose the route: a practical decision process
- Fix the transfer year. Identify the legal transfer event and determine whether the 1961 Act or the Income-tax Act, 2025 governs. Transactions around 1 April 2026 require particular care.
- Describe the asset precisely. Record whether it was agricultural land, a developed plot, a building, a share in property or another asset. Gather title, revenue and use records.
- Test the holding period. Under the 1961 Act, the Department’s FAQ uses more than 24 months for land or buildings to be long-term. Verify the correct test and any special acquisition rule for the transfer year.
- Match the reinvestment. New agricultural land points toward a Section 54B analysis. A new residential house points toward a Section 54F analysis. The intended purchase cannot cure an asset that fails the relevant original-asset test.
- Review ownership restrictions. For a Section 54F claim, compile existing and later residential-house ownership and acquisition information. For Section 54B, verify the conditions attached to the replacement agricultural land.
- Map every deadline. Place the transfer date, purchase or construction dates and any Capital Gains Account Scheme deposit date on one timeline. Use the deadlines in the law for the relevant year; do not borrow dates from an older article.
- Calculate under the applicable statute. Do not assume that reinvesting the full sale proceeds or only the capital gain always produces the same result. The amount of relief, any proportional limitation and the treatment of expenses must be computed under the governing law.
- Reconcile the return. The official schedule should match the deed, payment records and dates. Correct discrepancies before filing rather than relying on a later explanation.
Common fact patterns
| Fact pattern | Provision to investigate first | Why the result is not automatic |
|---|---|---|
| A seller transfers land used for agriculture and buys another agricultural parcel | Section 54B | The original land’s classification and use, the replacement land and all timing conditions must still be established |
| A seller transfers a long-held plot and buys a residential house | Section 54F | The plot must qualify as a long-term asset other than a residential house, and house-investment and ownership conditions apply |
| A seller transfers agricultural land and buys a house | Usually a Section 54F analysis, if the original asset and other conditions qualify | The fact that the land was agricultural does not turn a house purchase into a Section 54B reinvestment |
| A seller transfers land and buys another plot for future development | Neither route can be assumed | A future-development plot is not automatically new agricultural land or a residential house |
| A seller buys both agricultural land and a house after selling land | Separate analyses may be required | Each potential claim has its own original-asset, replacement-asset, ownership and timing conditions; one purchase does not substitute for the other |
Do you reinvest the sale proceeds or only the gain?
This is a frequent source of errors. Neither section should be claimed on the assumption that a simple “sale proceeds versus capital gain” rule applies in every case. The statute governing the transfer year determines the relevant computation, the amount of qualifying investment and any limitation on the exemption.
Use the figures in the return schedule as evidence of the investment, not as a shortcut to the calculation. Start with the legally determined capital gain, then apply the provision’s formula and conditions for the relevant year. If the computation involves a partial investment, multiple assets, co-ownership or a deposit, have a qualified Indian tax professional verify the result before filing.

Capital Gains Account Scheme and unused amounts
If the required reinvestment was not completed by the applicable date, a Capital Gains Account Scheme deposit may be relevant. Track the deposit date, account type, withdrawals, utilisation and the statutory deadline that applies to the transfer year. Keep the bank certificates and utilisation evidence with the land or house documents.
The Income Tax Department’s transition guidance contains a specific rule for old-Act deposits: amounts deposited before 1 April 2026 remain subject to the conditions of the 1961 Act. If the prescribed period expires with an unused balance, the Department says the unused portion is taxed when that period ends. A deposit is therefore not a permanent exemption; it postpones the need to complete the qualifying reinvestment subject to the applicable rules.
What happens if a previously claimed exemption is later breached?
A claim does not become permanently safe merely because it was accepted in an earlier return. The Department says that when an exemption originally claimed under old-Act Sections 54, 54B or 54F is followed by a breach of its attached conditions after the new Act commences, the earlier exempt amount can be taxed in the year of violation.
Its transition example concerns a new house sold within the old three-year lock-in. In that situation, the later-year charge follows the 2025 Act, while the trigger and amount are determined using old Section 54. The practical lesson is to preserve the original purchase, construction and return records until every applicable lock-in and other condition has expired.
Documents to assemble before claiming either route
- Original purchase deed, inheritance or gift documents and acquisition-cost records
- Sale agreement, conveyance deed, registration record and proof of consideration
- Revenue records, land-use classification and evidence of actual agricultural activity where Section 54B is being considered
- Replacement agricultural-land deed and payment trail for a Section 54B analysis
- Residential-house purchase or construction agreement, invoices, approvals, registration and payment records for a Section 54F analysis
- A list of residential houses owned on the transfer date and acquired or constructed afterward
- Bank statements showing the movement of sale proceeds, reinvestment funds and any Capital Gains Account Scheme deposit
- Return schedules, computation worksheets and correspondence supporting the dates and amounts reported
Pitfalls that commonly derail a claim
Calling every parcel agricultural
A rural location, agricultural zoning or a seller’s description is not conclusive. Classification, actual use and the statutory period must be supported by records.

Using the wrong Act
Applying a 1961 Act explanation to a transfer in Tax Year 2026–27 or later can change the analysis. Establish the transfer year first.
Treating the return schedule as the law
The schedule identifies the replacement asset and requests dates and costs, but it does not list every eligibility condition, exception or calculation rule.
Ignoring existing house ownership
A Section 54F review must include houses already owned and later purchases or construction. A plan to buy a house is not enough if an ownership restriction is triggered.
Missing the deposit and clawback consequences
Unutilised Capital Gains Account Scheme money and a later sale or other breach can create tax in a later year. Keep a calendar and preserve records through the end of the relevant condition period.
Assuming the full investment is always required or always sufficient
The amount of relief depends on the statutory computation for the transfer year. Obtain a calculation rather than relying on a rule of thumb.
Bottom-line decision
Start with Section 54B only when the facts support qualifying agricultural land and the reinvestment is new agricultural land. Start with Section 54F when the transferred asset is a qualifying long-term asset other than a residential house and the reinvestment is a residential house, subject to the applicable ownership, timing and calculation rules. If the transfer is on or after 1 April 2026, analyse it under the Income-tax Act, 2025 framework; if it belongs to an earlier period, use the 1961 Act framework. Because the available official material does not itself provide every current deadline, formula, cap or exception, a case-specific claim should be checked against the complete law by a qualified Indian tax professional.
