It is meant for a patent mistake visible from the existing record—not a second hearing on the merits. An affected person normally has three months from issue to bring the error to the authority’s notice; the authority’s ordinary outer limit is six months, subject to the statutory exception for purely clerical or arithmetical slips caused by accidental omission.
What Section 161 GST rectification actually does
Section 161 is a narrow correction power. The same authority that passed or issued the document may rectify an error that is obvious from the record already before it. The power covers a decision, order, notice, certificate or any other document issued under the GST law.

The authority may begin the process in three ways:
- on its own initiative;
- after receiving information from a CGST, SGST or UTGST officer; or
- after the person affected points out the error within three months from the date of issue.
The statutory wording, as reproduced by the Central Board of Indirect Taxes and Customs (CBIC), begins: “Without prejudice to the provisions of section 160, and notwithstanding anything contained in any other provisions of this Act, any authority, who has passed or issued any decision or order or notice or certificate or any other document, may rectify any error which is apparent on the face of record…”
Rectification changes the document to reflect what the existing record clearly shows. It does not give the authority a general power to reopen a concluded assessment, reconsider evidence or replace its legal reasoning with a different view.

The legal test: is the mistake apparent from the record?
Patent and self-evident, not debatable
An error is “apparent on the face of the record” when the mistake is patent and can be identified without an investigation or a debate about competing interpretations. The correction should follow almost mechanically once the authority reads the document and the material already on file.
Examples can include a calculation that plainly adds the displayed figures incorrectly, a transposed date where the undisputed date appears consistently elsewhere in the same record, or a copying slip that contradicts an unambiguous figure adopted in the operative reasoning. Whether a particular defect meets the test depends on the document and its record; calling something a “mistake” does not make it apparent.
Use only material already before the issuing authority
The comparison is between the challenged document and the record on which it was issued. A rectification request should identify the exact paragraph, table, figure or internal inconsistency and cite the page or electronic document that already contained the correct information.

If deciding the request would require fresh evidence, cross-examination, a new factual investigation or a re-weighing of documents, the issue is ordinarily outside Section 161. The Allahabad High Court has described rectification as limited to patent mistakes and has cautioned that it cannot be used to reconsider or substitute a concluded order.
A disputed amount is not automatically an apparent error
GST Council material uses an illustration in which an entry of Rs.10,000 rather than Rs.1,00,000 was treated, in the cited approach, as not being an error apparent. The practical lesson is important: a large numerical difference may involve a substantive dispute about what amount was legally or factually payable. Such a dispute may require an appeal or another statutory remedy instead of Section 161.
What Section 161 cannot be used to do
Before applying, test whether the requested result would change the merits of the case. The following requests generally point beyond rectification:

- Rearguing the assessment: asserting that the authority drew the wrong conclusion from facts it considered is normally an appeal point.
- Introducing a new factual case: documents or explanations not part of the original record cannot usually be used to turn rectification into a fresh adjudication.
- Seeking a different legal interpretation: where two interpretations are arguable, choosing the one the taxpayer prefers is not a mechanical correction.
- Reappraising evidence: asking the authority to decide which witness, invoice, return or reconciliation is more credible requires evaluation rather than rectification.
- Recalling a concluded appellate order for later events: in Rajkishor Pati, the court held that recalling an appellate order because the State had filed a special leave petition was outside the rectification power. Filing an SLP, without a stay, was not itself an apparent error in the earlier order.
Where the complaint is that the decision is wrong on facts or law, check the applicable appeal period and other statutory remedies immediately. A rectification request should not be used as a substitute for preserving an appeal.
Section 161 time limits
The relevant date is the date on which the decision, order, notice, certificate or other document was issued. Preserve the issuance date shown on the portal, order header, email or service record.
| Event | Statutory period | How to apply it |
|---|---|---|
| Affected person brings an error to the authority’s notice | Within three months from issue | File with the authority that issued the document and retain proof of submission. |
| Authority’s ordinary power to rectify | Within six months from issue | This is the ordinary outer limit for a Section 161 correction. |
| Purely clerical or arithmetical error caused by accidental slip or omission | Six-month limit does not apply | The exception is narrow; it does not convert a substantive or disputed error into a timeless review power. |
The three-month period for a person’s request and the ordinary six-month period for the authority are separate. Missing the taxpayer window does not automatically create a right to an out-of-time application, and describing a merits disagreement as a “clerical” issue does not qualify for the exception.

Rectification or appeal? Use the right remedy
| Question | Section 161 rectification | Appeal or another statutory remedy |
|---|---|---|
| What is being challenged? | A patent mistake visible in the existing record. | The correctness of findings, evidence assessment, computation or legal interpretation. |
| What material may be considered? | The record already before the issuing authority. | The material and grounds allowed by the applicable appellate procedure. |
| Does the authority rehear the merits? | No. It makes a limited correction. | Yes, to the extent the appeal or remedy permits reconsideration. |
| Who acts? | The authority that issued the document. | The designated appellate or revisional authority under the GST law. |
| Key timing in the material supplied here | Person’s notice: three months; ordinary authority limit: six months. | Use the separate limitation period prescribed for the particular appeal; do not assume Section 161 periods apply. |
A taxpayer can ask for rectification and still need to protect an appeal, but the two routes serve different purposes. If the alleged error is debatable, file the appeal within its own limitation period rather than waiting for a rectification decision.
How to make a Section 161 request
- Identify the issuing document. Record its type, reference number, issue date, tax period and the authority that signed or uploaded it. Download the complete order and relevant portal acknowledgements.
- Pinpoint the defect. Quote the paragraph, table row, calculation or sentence containing the mistake. Avoid a general statement that the order is “wrong.”
- Match it to the existing record. Attach or reference the return, statement, annexure, calculation sheet or other material that was already before the authority and that makes the correction self-evident.
- Explain why no merits rehearing is needed. State the mechanical correction—for example, the displayed subtotal does not equal the component figures—and explain that no new evidence or legal interpretation is required.
- File within three months. Submit the request to the authority that issued the document, following the current filing practice for that jurisdiction. Keep the electronic acknowledgement, diary number, email delivery record or other proof.
- Respond to any proposed adverse change. If the authority’s correction could worsen your liability or otherwise affect your rights, use the opportunity given to make representations and supply the relevant record.
- Check the final system entry. Where Rule 142(7) applies, verify that the summary of the rectification order—or the withdrawal of an order uploaded on the system—appears electronically in Form GST DRC-08.
Administrative filing instructions can differ by jurisdiction and may change. Confirm the current practice with the issuing authority while relying on the statutory periods above.

Natural justice when rectification may hurt you
Section 161 does not allow an adverse correction to be made without procedural fairness. If the proposed change increases tax, interest, penalty or another liability, or otherwise prejudices the affected person, the authority must provide a fair opportunity consistent with natural justice before the correction takes effect.

Read any notice carefully for the proposed change, the material relied upon and the response deadline. A focused response should address the apparent-error test: identify what the original record shows, explain the mechanical correction and distinguish the request from a merits appeal. If the authority proceeds without a meaningful opportunity to respond, preserve that procedural objection and consider the remedy available under the GST law.
Form GST DRC-08: what it records
Rule 142(7) requires an electronic summary in FORM GST DRC-08 when an order is rectified under Section 161 or when an order uploaded on the system is withdrawn. The Delhi High Court’s 2026 decision records this procedural requirement.
DRC-08 is the system record of the corrective action. It does not enlarge the authority’s substantive power: uploading the form cannot turn a disputed merits issue into an error apparent, extend the ordinary authority limit for non-clerical errors or replace the natural-justice requirement.
Illustrative situations
A correction that may fit Section 161
An order’s calculation table lists three undisputed component amounts, but the total in the operative paragraph is plainly the result of a transcription or addition slip. The components and the correct arithmetic were already on the record, and changing the total does not require deciding a new legal or factual issue. A request should identify the figures, show the arithmetic and ask for the operative total to be corrected.
A correction that likely requires an appeal
The taxpayer says the authority wrongly classified a supply, rejected an exemption, or preferred one set of invoices over another. Even if the resulting tax difference is obvious, deciding the complaint requires legal interpretation or evaluation of evidence. That is not the mechanical correction Section 161 is designed to provide.
A mixed document
An order may contain a genuine typographical error and a separate disputed conclusion. Describe the two issues separately. The patent typo may be suitable for Section 161, while the disputed conclusion must be pursued through the applicable appeal or other remedy. Do not package both into one broad request to “review” the order.
Quick Recap
Common mistakes that weaken a rectification request
- Using the date of service or discovery instead of the document’s issue date when calculating the three-month period.
- Sending the request to an appellate authority rather than the authority that issued the document.
- Calling an adverse finding a “clerical error” without showing the uncontested record that proves the correction.
- Attaching new evidence and asking the authority to reassess it under Section 161.
- Failing to preserve portal acknowledgements, uploaded documents and the original order.
- Waiting for rectification while an independent appeal limitation runs.
- Assuming that a DRC-08 upload itself proves that the underlying correction was legally within Section 161.
A final eligibility checklist
- Was the challenged document issued by the authority receiving the request?
- Can the mistake be demonstrated from the existing record alone?
- Is the correction patent, mechanical and non-debatable?
- Would deciding it avoid a fresh investigation, evidence review or change in legal interpretation?
- Is the request being brought within three months from issue?
- If the issue is actually substantive, has the applicable appeal or other remedy been protected?
- If an adverse correction is proposed, has a fair opportunity to respond been provided?
- After the decision, has the required electronic DRC-08 summary been checked where Rule 142(7) applies?
