There is no single section 153 deadline. The last permissible date depends on whether you are dealing with an original assessment, reassessment, a fresh assessment after an appellate order that set aside or cancelled an assessment, or an order merely giving effect to an appeal. For an ITAT remand, section 153(3) can provide a fresh period—generally 12 months for qualifying orders received on or after 1 April 2019—but an ITAT order does not automatically restart the clock. You must classify the order, identify the statutory trigger date, and then add any permitted extensions and category-specific exclusions.
The Income Tax Department’s statutory text and limitation table should be read together, with the Act controlling if a summary does not resolve a particular case. Read the official section 153 extract.

Start with the type of proceeding
Section 153 uses different clocks for different proceedings. Before counting months, identify all of the following:
- the assessment year (AY);
- whether the proceeding is an assessment under sections 143 or 144, a reassessment under section 147, a fresh assessment after an appellate setting-aside or cancellation, or an order giving effect to an appeal without a fresh assessment;
- the event that starts the clock—usually the end of an assessment year or financial year, service of a notice, or receipt of an appellate order;
- whether a transfer-pricing reference, search or requisition, or a statutory exclusion applies; and
- the exact wording of the appellate directions.
Those facts are essential. The general rules cannot decide whether a particular ITAT direction is a fresh-assessment case or only an effect order.

Ordinary assessment deadlines by assessment year
For an assessment under section 143 or 144, the ordinary period is measured from the end of the assessment year in which the income was first assessable. The period changes by AY:
| Assessment year | Ordinary period | How to apply it |
|---|---|---|
| AY 2017–18 or earlier | 21 months | Count from the end of the relevant assessment year, subject to statutory exclusions and extensions. |
| AY 2018–19 | 18 months | Use the year-specific rule in section 153. |
| AY 2019–20 | 12 months | Use the year-specific rule in section 153. |
| AY 2020–21 | 18 months | Use the year-specific rule in section 153. |
| AY 2021–22 | 9 months | Use the year-specific rule in section 153. |
| AY 2022–23 onward | 12 months | Count from the end of the assessment year, then adjust for applicable extensions and exclusions. |
These periods are summarized in the Department’s official limitation-period table. The statutory wording, including transitional provisions, remains decisive for the assessment year and facts involved.
What an ITAT remand changes
When section 153(3) supplies a fresh period
Section 153(3) applies to a qualifying fresh assessment after an order under section 254 (the provision governing an ITAT order) that sets aside or cancels an assessment. It also covers specified orders under sections 250, 263 and 264. For an order under section 254, the period is counted from the end of the financial year in which the order is received by the specified income-tax authority.

The period is nine months under the earlier rule. For a qualifying order received or passed on or after 1 April 2019, the substituted period is 12 months. Thus, if an ITAT order setting aside an assessment is received by the specified authority during the financial year ending 31 March 2025, the 12-month period ordinarily runs from 31 March 2025, before considering any valid additions or exclusions.

The trigger is receipt by the authority identified in the statute, not simply the date printed on the tribunal’s order or the date a taxpayer obtains a copy. Keep evidence of when the order reached the specified authority.
A remand is not automatically a restart
An appellate order can have different procedural effects. A direction that sets aside or cancels the assessment and requires a fresh assessment fits the section 153(3) track. A direction that only requires the Assessing Officer to give effect to the appellate result may fall under section 153(5), which has a shorter period. Read the operative paragraphs, not only the word “remand” in a covering letter or case note.
The official consolidated section 153 text describes the fresh-assessment rule and its post-1 April 2019 transition. See section 153 in the Income-tax Act, 1961.

| Situation | Applicable period | Trigger | Important qualification |
|---|---|---|---|
| Fresh assessment after a qualifying setting-aside or cancellation, including under section 254 | 9 months; 12 months for qualifying orders received or passed on or after 1 April 2019 | End of the financial year in which the section 250 or 254 order is received by the specified authority, or the section 263 or 264 order is passed, as applicable | The appellate directions must require a qualifying fresh exercise. |
| Giving effect to an appellate order without making a fresh assessment | 3 months | End of the month in which the order is received by the specified senior income-tax authority | A written request can support a discretionary additional six months if the statutory conditions are met. |
| Giving effect where verification documents or a hearing are required | The section 153(3) period is used | Apply the trigger and transition rule for the relevant fresh-assessment provision | The need for verification or hearing is material; it is not enough that the file is administratively complex. |
Section 153(5) is therefore not a general substitute for section 153(3). It governs an effect order where no fresh assessment is made. The three-month period runs from the end of the month of receipt, rather than from the end of the financial year.

The possible six-month addition
The additional six months is not automatic. The Assessing Officer or Transfer Pricing Officer must make a written request, and the Principal Commissioner or Commissioner must be satisfied that reasons beyond the officer’s control prevented completion within the ordinary three-month period. A taxpayer should ask for the written approval and the reasons relied on when checking the last date.
Other proceedings with their own clocks
Reassessment under section 147
For a reassessment under section 147, the period is nine months from the end of the financial year in which the section 148 notice was served. The period is substituted with 12 months where the notice was served on or after 1 April 2019. This is a notice-service trigger, not an appellate-order trigger.
Special return situations
The statutory extract also contains separate 12-month rules for certain returns furnished under section 139(8A) and returns filed in response to an order under section 119(2)(b). Those provisions are exceptions to the ordinary assessment-year schedule; they do not turn every assessment into a 12-month case.

“where a reference under sub-section (1) of section 92CA is made during the course of the proceeding for the assessment or reassessment, the period available for completion of assessment or reassessment, as the case may be, under the said sub-sections (1), (1A), (2), (3) and (3A), shall be extended by twelve months.”
This extension concerns proceedings covered by the cited section 153 sub-sections. Confirm that a section 92CA(1) reference was actually made during the relevant proceeding and retain the reference date.
Search or requisition
For an assessment or reassessment pending on the date of a search under section 132 or a requisition under section 132A, section 153(3A) provides a 12-month extension for the listed connected cases. The provision covers the searched or requisitioned person and specified cases connected with seized assets, books, documents or information. Check that the case falls within the statutory list; the mere fact that a search occurred somewhere in a group does not establish the extension for every taxpayer.
Periods excluded from the calculation
Explanation 1 to section 153 excludes specified periods from the limitation calculation. The categories include, among others:

- time taken to reopen proceedings or provide a rehearing under section 129;
- qualifying periods during which a court stay operates;
- time allowed for an audit or inventory valuation;
- the period connected with a reference to a valuation officer;
- specified settlement-commission and advance-ruling proceedings; and
- specified periods used to obtain information through exchange-of-information procedures.
Each category has its own statutory start and end points. A general delay, an adjournment, or an internal department backlog does not automatically stop the clock. Identify the exact event, document its dates, and verify that it matches an Explanation 1 category before adding time.
How to calculate a defensible last date
- Identify the proceeding. Label it original assessment, reassessment, fresh assessment after setting aside or cancellation, or effect order without fresh assessment.
- Fix the relevant transition rule. For an original assessment, record the AY. For reassessment, record when the section 148 notice was served. For a fresh appellate assessment, record when the qualifying order was received or passed as required by section 153. For an effect order, record when the appellate order was received by the specified senior authority.
- Read the operative appellate directions. Determine whether the assessment was set aside or cancelled, whether a new assessment is required, or whether the officer is only to recompute or give effect.
- Apply the base period. Use the AY table, the nine- or 12-month reassessment rule, the nine- or 12-month fresh-assessment rule, or the three-month effect-order rule.
- Add only established extensions. Check for a section 92CA(1) reference, a qualifying section 132 search or section 132A requisition, and any approved six-month addition under section 153(5).
- Subtract or exclude statutory periods as directed by Explanation 1. Record the start and end date for every exclusion separately; do not use an undifferentiated “department delay” figure.
- Check the order date and service record. Compare the signed order, dispatch or electronic transmission record, and proof of receipt by the authority. A one-day difference can matter when the deadline falls at month-end.
- Preserve the calculation. Keep the appellate order, receipt evidence, notices, TPO reference, search records, stay orders, audit directions and any written approval for an extension in one chronology.
Illustrative calculations
Qualifying ITAT setting-aside order
Assume an ITAT order under section 254 sets aside the assessment and is received by the specified authority during the financial year ending 31 March 2025. Because the qualifying order is received after 1 April 2019, the substituted 12-month period applies. The unadjusted period ends 12 months after 31 March 2025. A valid exclusion or statutory extension must then be added according to its own rule.
Effect order with no fresh assessment
Assume an appellate order is received by the specified senior income-tax authority on 10 July. The ordinary section 153(5) period is three months from the end of July, not three months from 10 July. Any further six months requires the written-request and approval process; it cannot be assumed merely because the work was not completed.

Common mistakes
- Using “12 months” as a universal answer. Twelve months describes some AY schedules and post-2019 fresh-assessment or reassessment situations, but not every section 153 proceeding.
- Treating every ITAT remand as a restart. The character of the order and its directions determine whether section 153(3) or section 153(5) applies.
- Starting from the wrong date. The relevant trigger may be the end of an AY, service of a section 148 notice, receipt by a specified authority, or the end of the month of receipt.
- Adding the six-month effect-order period automatically. Written request and approval based on reasons beyond control are required.
- Adding every period of inactivity. Only exclusions recognized by the statute count, and their endpoints differ.
- Ignoring the TPO or search provisions. A section 92CA(1) reference and a qualifying search or requisition can each change the available period, but only for the cases covered by the statute.
What records should a taxpayer review?
For a case-specific deadline, assemble the assessment order, notice history, appellate orders and operative directions, proof of when each order reached the specified authority, any section 148 service record, TPO-reference documentation, search or requisition material, court-stay orders, audit or valuation directions, and written approvals for extensions. A tax professional can then map each document to the relevant section 153 sub-section and Explanation 1 category.
The Department’s limitation summary is a useful starting checklist, while the consolidated statutory page and the official section extract dated 5 May 2026 should control the final computation.
