Section 148A and Section 148 are different steps in an Indian income-tax reassessment. Under the Income-tax Act, 1961, a Section 148A notice generally gives you a chance to explain information suggesting that income escaped assessment. The assessing officer then decides, by a reasoned order, whether issuing a Section 148 notice is fit. A Section 148 notice is the formal notice requiring you to furnish a return for reassessment.
Before responding, identify the relevant tax year and the statute that governs it. The Income-tax Act, 2025 applies its reassessment provisions to Tax Year 2026–27 and later. The 1961 Act continues for proceedings concerning a tax year beginning before 1 April 2026, including certain proceedings that continue or begin after that date.

The short answer: 148A is the opportunity to explain; 148 requires the return
The ordinary sequence under the 1961 Act is:
- The tax department has information suggesting that income chargeable to tax may have escaped assessment.
- If required, the assessing officer conducts an inquiry under the statutory scheme.
- The taxpayer receives a Section 148A show-cause notice with the information being relied on and an opportunity to respond.
- After considering the reply, the officer issues a reasoned Section 148A(3) order deciding whether it is a fit case to issue a Section 148 notice. The explanatory memorandum to the Finance Bill 2026 states that this order requires prior approval from the specified authority.
- If the case is treated as fit, the officer issues a Section 148 notice requiring a return for reassessment.
Your response to a Section 148A notice is therefore an explanation to the proposed action. It is not the same thing as furnishing the return demanded by a Section 148 notice.

Tax Year 2026–27 and later
For Tax Year 2026–27 onward, the 2025 Act contains the reassessment framework in Sections 279–286. In that framework, Section 281 contains the show-cause and decision process, while Section 280 is the notice requiring a return. The Department describes Section 280 as corresponding to Section 148 of the 1961 Act.
Tax years beginning before 1 April 2026
For a tax year that began before 1 April 2026, the 1961 Act remains the governing law under the transition provision in Section 536(2)(c) of the 2025 Act. This includes proceedings pending when the new Act commenced and proceedings initiated on or after 1 April 2026 in respect of an earlier tax year, subject to the old Act’s conditions and limitation rules.
In practical terms, do not assume that every notice issued after 1 April 2026 uses the new Act. The tax year and the transition provision matter more than the date printed at the top of the notice.
What a Section 148A notice means under the 1961 Act
Section 148A is the pre-notice stage. The Finance Act, 2021 inserted it with effect from 1 April 2021. The Finance Bill 2026 explanatory memorandum describes the process as an inquiry, where required, followed by a show-cause notice, an opportunity of hearing, consideration of the taxpayer’s reply, and a reasoned decision on whether issuing a Section 148 notice is fit.
Information suggesting escaped income
The notice should identify or provide access to the information on which the department is relying. That information is the point you must address. It may concern a transaction, an item reported by another person or institution, a mismatch with information already available to the department, or another fact pattern covered by the applicable law. The notice and its attachments, rather than a generic description of reassessment, determine what must be answered.
Inquiry is not automatically identical in every case
The official memorandum says an inquiry is conducted “if required.” That wording matters. It does not support a claim that every Section 148A matter follows an identical investigation or that every taxpayer will receive the same set of pre-notice steps.

The show-cause opportunity
The Section 148A notice gives you an opportunity to explain why the proposed reassessment notice should not be issued, or why the information does not establish a fit case on the facts and law applicable to your tax year. Read the notice for the exact response method, permitted format, attachments, and date. The available official material does not establish one universal response period for all Section 148A notices.
The Section 148A(3) order
After considering the response, the assessing officer makes a decision under Section 148A(3). The order is intended to give reasons for treating the case as fit or not fit for a Section 148 notice. The Finance Bill 2026 explanatory memorandum says prior approval of the specified authority is required for this order. The detailed approval hierarchy and any amendments must be checked against the version of the 1961 Act applicable to the proceeding.
What a Section 148 notice means
Section 148 is the formal reassessment notice under the 1961 Act. The Income Tax Department’s explanatory material describes it as a notice requiring the assessee to furnish a return where income chargeable to tax has escaped assessment.
It creates a different taxpayer task
Once a Section 148 notice is served, the central task is to furnish the return required by that notice within the period and through the method it specifies. A written explanation to an earlier Section 148A notice does not satisfy this separate return requirement.
The notice follows the fit-case decision where that procedure applies
Under the ordinary 1961 Act sequence, the Section 148 notice is issued after the Section 148A show-cause and decision stage. Statutory exceptions and the precise version of the law can alter the route, so the notice itself and the governing provisions must be read together.

If you receive a Section 148A notice: a practical response plan
1. Confirm the tax year and governing Act
Write down the tax year named in the notice, the date of issue, the date of service, and whether the document cites the 1961 Act or the 2025 Act. If the tax year began before 1 April 2026, the transition rules may keep the proceeding under the 1961 Act even if the notice or a later order is dated after that date.

2. Read every attachment and retrieve the underlying information
Do not respond only to the heading or a short summary. Identify each transaction, account, asset, deduction, return entry or third-party report mentioned. If an attachment is missing or inaccessible, record that fact and request the material through the channel identified in the notice so that your response addresses the actual allegation.
3. Build a fact-and-document schedule
For each item, note the date, amount, nature of the transaction, people or entities involved, treatment in the original return, and documents that support your explanation. Typical records may include bank statements, contracts, invoices, sale deeds, loan papers, demat statements, tax certificates, books of account and correspondence. Include only documents that relate to the issue and explain what each document proves.
4. Reconcile the information with the return and books
Check whether the amount was already reported, reported under a different description, subject to tax in another year, exempt under a provision, reversed, duplicated in the department’s data, or connected to a transaction carried out by somebody else. A clear reconciliation is more useful than a general denial.

5. Address both facts and law
Explain the factual chain first, then identify the provision or principle on which you rely. If the issue turns on residency, ownership, timing, source, character of income, or a deduction condition, state the facts that establish your position and attach the records that support them. Do not cite a legal conclusion without explaining how it fits the transaction described in the notice.
6. Prepare a numbered reply
Use the notice’s paragraph or item numbers. For every allegation, state whether you accept, partly accept or dispute it; provide the corrected facts; identify the supporting document; and state the result you request. If information is unavailable, say what you have done to obtain it and provide the best available substitute rather than silently leaving the point unanswered.
7. Submit exactly as instructed
Use the electronic or physical submission method, file format, digital signature or verification method specified in the notice. Keep the submitted reply, attachments, acknowledgment, delivery record and screenshots of any successful upload. A response that cannot be proved later creates an avoidable evidentiary problem.

8. Track the next order
A Section 148A response is followed by the officer’s decision, not automatically by a Section 148 notice. Monitor the communication channel stated in the notice. If a Section 148 notice is later issued, treat it as a new compliance step and prepare the required return separately.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesIf you receive a Section 148 notice: what to do next
Identify the return and period demanded
Read the notice for the tax year, the statutory provision, the return type, the filing method and the date by which the return must be furnished. Do not substitute the date from a different notice or rely on an online article that gives one standard period for every case.
Preserve the original filing position
Collect the return originally filed, computation, financial statements, tax-payment records and documents supporting the relevant income and deductions. Then identify what additional information is needed for the reassessment return. Keep a version-controlled copy of every computation and submission.
Check whether the 148A stage is mentioned
For an ordinary old-Act proceeding, the notice may refer to the Section 148A(3) order or attach it. Check that the order and the Section 148 notice relate to the same tax year and information. A perceived defect is fact-specific; do not assume that a missing document, a date issue or an incorrect description automatically invalidates the proceeding without reviewing the complete record and applicable law.
File the return and continue responding
Furnishing the return does not necessarily end the reassessment. Further notices, information requests or orders may follow under the governing statute. Answer each communication by its own deadline and retain proof of filing.

New Act sections for later tax years
The Income Tax Department’s Reassessment Proceedings FAQs identify Sections 279–286 of the Income-tax Act, 2025 as the reassessment provisions for Tax Year 2026–27 and later. The ordinary route described by the Department uses information suggesting escaped income, a show-cause opportunity under Section 281(1), consideration of the response, and a reasoned Section 281(3) order before or with a Section 280 notice.

Old Act can still govern after commencement of the new Act
Section 536(2)(c) of the 2025 Act preserves the 1961 Act for pending proceedings and for proceedings initiated on or after 1 April 2026 concerning a tax year beginning before that date. The Department also says that fresh proceedings for earlier assessment years may be initiated under the old Act after 1 April 2026 if the statutory conditions are met.
Example of a continuing old-Act proceeding
Suppose an old-Act Section 148A(1) show-cause notice was issued before 1 April 2026 for a tax year that began before that date. The consequential Section 148A(3) order and Section 148 notice may be issued after 1 April 2026 under the 1961 Act, provided the proceeding complies with the old Act, including Section 149’s limitation requirement. The later calendar date does not by itself convert the matter into a 2025 Act case.
Do not import new-Act exceptions into an old-Act notice
The Department lists circumstances in which the new-Act Section 281 procedure may be skipped, including specified information under a faceless information-collection scheme, directions concerning impermissible avoidance arrangements, and certain findings or directions in official orders. Those are descriptions of the 2025 Act. They should not be silently applied to a Section 148A matter governed by the 1961 Act.
Approval provisions for earlier assessment years
The Department identifies the old Section 151 specified-authority hierarchy as applicable to reassessment notices for AY 2026–27 or earlier, even after the new Act begins. The precise approval requirement depends on the applicable statutory text, dates and facts, so a complete role-by-role chart should not be inferred from the section number alone.
Deadlines, limitation and the numbers you should not assume
There is no single universal Section 148A response period in the available official material
Response periods can depend on the notice, the applicable Act, amendments and the facts of the proceeding. Follow the date printed in your notice and preserve evidence of service. If the notice appears to give an impossible, ambiguous or already-expired period, raise that issue promptly through the stated channel and obtain case-specific advice.
Section 149 matters for old-Act transitional proceedings
The Department confirms that continuation of the 1961 Act after commencement of the 2025 Act remains subject to the limitation period in Section 149. Calculating that limitation requires the relevant tax year, the dates of the information and notices, statutory changes and any applicable exclusions. A general number cannot safely replace that calculation.
Do not confuse completion periods with taxpayer response periods
The 2025 Act FAQ states that a Section 279 reassessment order is generally due within one year from the end of the financial year in which a Section 280 notice was served, subject to extensions and exclusions for specified situations. That is an administrative completion period for a new-Act reassessment order. It is not a deadline for replying to a Section 148A notice, filing a Section 148 return, or calculating old-Act Section 149 limitation.
Common mistakes and how to avoid them
- Treating 148A as the return notice: use the 148A stage to explain the information; furnish a return only when a Section 148 notice requires it.
- Using the wrong tax year: identify the year in the notice before applying any deadline, limitation rule or section number.
- Assuming every post-1 April 2026 matter uses the 2025 Act: earlier tax years can remain under the 1961 Act through the transition provision.
- Sending a general denial: answer each item with a reconciliation and supporting records.
- Ignoring attachments or inaccessible information: request the missing material and document the request.
- Relying on an internet deadline: use the actual notice and verify the governing law.
- Declaring a notice void without reviewing the record: validity depends on the full notice, dates, approvals, tax year and statutory version.
- Failing to keep proof of submission: save the reply, attachments, acknowledgment and delivery evidence.
When professional tax advice is sensible
Consider qualified Indian tax advice when the notice involves several years, substantial amounts, cross-border income, alleged undisclosed assets, related-party transactions, complex business records, a limitation objection, or a question about the transition between Acts. An adviser can map the chronology, test the applicable statute, reconcile the information and prepare a response without treating a preliminary 148A reply as a substitute for the later 148 return.
For a straightforward matter, you can still use the same discipline: identify the tax year, preserve the notice and attachments, answer each allegation with documents, follow the stated submission method and track every subsequent communication.
Quick Recap
A final decision checklist
- Is the document labelled Section 148A, Section 148, or a provision of the 2025 Act?
- Which tax year does it name, and did that tax year begin before 1 April 2026?
- What information or transaction is said to indicate escaped income?
- Are you being asked for an explanation or for a return?
- What date and submission method does the actual notice specify?
- Have you reconciled every item with the original return and supporting records?
- Could the old Act’s Section 149 limitation or an approval requirement affect the case?
- Have you saved proof of every submission and response?
