Sale deed, survey map and property tax record: which boundary details matter?

Start with the deed’s complete legal description and every plan or earlier instrument it incorporates. Then compare that description with a survey prepared or certified by a qualified surveyor in the property’s jurisdiction. Use a property-tax or assessor map to identify the parcel and locate source records, not to prove the exact legal line. If the documents conflict, obtain the underlying recorded documents, have a local surveyor analyse the field evidence, and obtain legal advice before moving a fence, filing an application or changing ownership.

There is no jurisdiction-neutral rule that a deed always overrides a survey, or that the newest map automatically controls. The answer depends on the wording, provenance, date, measurements, monuments and local boundary law.

What each record is for

These documents can depict the same land while serving different purposes. A conveyance document establishes what was transferred by its legal description. A professional survey interprets that description against records and physical evidence. A tax map helps an assessor identify and value a parcel. Treating all three as interchangeable is the source of many boundary mistakes.

Sale deed and related title documents

Read the entire legal description, not merely the street address, parcel number or stated acreage. Mark every lot-and-block reference, bearing, distance, monument, road or other boundary feature, easement, covenant and exception. Look for language incorporating a recorded plat, subdivision plan, survey, prior deed or other instrument; that referenced document may contain the dimensions or monuments needed to understand the description.

In England and Wales, HM Land Registry advises checking the title register and title plan, looking for deeds marked copy filed, and reviewing documents supplied by the conveyancer. A leasehold title plan can outline a whole building rather than an individual flat, so the register, plan and lease must be read together. In Los Angeles County, the assessor expressly says its internal property-boundary description is not the legal description and directs owners to the acquisition deed. That is a county-specific instruction, not a universal rule for every assessor database.

Survey map or plan

A survey is useful only in relation to its scope and professional basis. Identify the preparer, licence or chartered status, preparation date, records reviewed, field observations, monuments found or set, adjoining parcels, rights of way and any datum or coordinate system. Confirm whether the document is a boundary survey, subdivision or cadastral plan, an older deed sketch or merely a GIS overlay. A drawing can look highly precise while resting on assumptions or incomplete records.

HM Land Registry notes that deed plans may be unclear and may not settle the exact ground position. Its determined-boundary process generally requires a plan prepared by a surveyor. A surveyor’s conclusion should therefore be read with the surveyor’s notes and evidence, not just the coloured line on the drawing.

Property-tax record or assessor parcel map

Tax records are good for connecting an assessment account or parcel number to a location and for checking assessment data. They are not, by themselves, proof of ownership limits. Sacramento County says its parcel maps are compiled from records and maps, show information as recorded rather than from an independent on-site survey, and are for assessment purposes. The county warns that aerial imagery may not represent actual boundaries and that its maps should not be used to define property lines or settle neighbour disputes. Its easement guidance adds that a map does not replace recorded legal documents or determine ownership rights, parcel legality or whether land is a valid building site.

Los Angeles County likewise distinguishes assessor maps from actual survey maps and recommends a surveyor or engineering firm for an actual survey. A tax map can still reveal a likely map-book or recorded-map reference to investigate. Its role is as a pointer to source records, not a substitute for them.

Boundary details to compare

Comparison point Sale deed and title file Professional survey Tax or assessor map
Primary purpose Records the conveyance and legal description of the interest transferred. Relates the written description to field evidence, monuments and adjoining records. Identifies and values an assessment parcel.
Authority Depends on the executed instrument, registry or recorder file and incorporated documents. Depends on the surveyor’s qualifications, methods, sources and applicable law. Administrative assessment record; authority is limited by the issuing county or jurisdiction.
Details to inspect Bearings, distances, lot and block, monuments, easements, covenants, exceptions and referenced plats or deeds. Survey date, licence, field evidence, monuments, adjoining parcels, rights of way, datum and stated scope. Parcel or account number, map-book reference, assessment acreage and any note identifying the source map.
Physical accuracy May describe the intended land without showing a measured line on the ground. May include measurements and monument evidence, but conclusions still depend on records and professional interpretation. Not an independent on-site boundary measurement; aerial or GIS lines can be approximate.
Can it settle a dispute alone? Usually not if the wording or referenced records are ambiguous. It is important evidence, but local law and the underlying title documents still matter. No. Sacramento County specifically says its parcel map should not resolve neighbour disputes.

How to read the deed before looking at a map

  1. Confirm the jurisdiction and parties. Make sure the instrument concerns the same county, registry district and grantor or seller shown in your title file. A tax account can be split or renumbered without changing the legal description.
  2. Copy the legal description exactly. Preserve calls such as north or south bearings, distances, curve data, monuments, adjoining owners and references to roads, rivers or walls. Do not replace them with an address or an estimated acreage.
  3. Collect every incorporated document. Obtain the recorded plat, subdivision plan, prior deed, survey or filed deed plan named in the description. In England and Wales, request documents marked copy filed and read them with the register and title plan.
  4. Separate rights from the outer line. Easements, covenants, access rights and maintenance obligations can affect use without moving the ownership boundary. A fence mentioned in a deed may be evidence of a feature, not conclusive proof of title.
  5. Check the chain of descriptions. Compare the current deed with the immediately prior conveyance and the referenced plan. A discrepancy in a later transcription can be material, while a changed street address may be irrelevant.

How to assess a survey map

Verify who prepared it and why

Look for the surveyor’s name, licence or chartered designation, seal where required, preparation date and stated purpose. A construction layout, topographic plan or mortgage inspection is not necessarily a boundary survey. Ask whether the surveyor was instructed to retrace a deed, locate monuments, mark a line on the ground or prepare a plan for a formal application.

Follow the evidence hierarchy shown on the plan

Read the notes identifying deeds, plats, registry records, occupation evidence and monuments. A found stone, iron pin or marked corner may carry different weight from a line inferred from a small-scale map. Check whether dimensions are measured in the field, scaled from a plan or supplied by an earlier document. If the survey uses coordinates, identify its datum and coordinate system; coordinates from different systems cannot be compared safely without conversion.

Distinguish a legal line from a feature

Fences, hedges, walls, ditches and buildings are physical features. They may coincide with the legal boundary, may have been placed inside it, or may be maintained by agreement without changing ownership. HM Land Registry states that a feature does not by itself establish ownership or maintenance responsibility; the register and deed wording must be checked.

What a tax map can and cannot tell you

Use the parcel or account number to locate the assessment record, then note the map book, page, subdivision or recorded-map reference. Those references can lead you to the recorder’s or registry’s source document. Compare the tax-map shape with the deed’s lot, block and adjoining-parcel calls only as a screening exercise.

Do not treat assessed acreage as a measured legal area. Do not move a fence because a coloured GIS line runs through it, and do not assume an aerial image shows the true edge. Sacramento County’s guidance expressly limits its parcel maps to assessment use and says they do not replace recorded legal documents. Los Angeles County makes the same practical distinction by directing owners to a surveyor for an actual survey map.

What to do when the records conflict

  1. Confirm that the records refer to the same land. Match the legal description, recording information, subdivision or parcel history and jurisdiction. Tax-account divisions and parcel identifiers are not always the same as a legal parcel.
  2. Retrieve the complete source file. Obtain the full deed, every referenced plat or survey and any filed document from the appropriate recorder or land registry. A summary screen or assessor description is insufficient.
  3. Have a qualified local surveyor retrace the line. Provide the surveyor with the source documents and ask for a written explanation of the monuments, measurements, occupation evidence and assumptions used. Do not rely on a generic measuring service that is not authorised to perform boundary work in the property’s jurisdiction.
  4. Pause physical changes. Do not remove or install a fence, wall, hedge or gate, or encroach with a building, solely because of a tax map or an unverified overlay.
  5. Communicate with the adjoining owner. If a neighbour is involved, share the evidence and discuss a practical standstill before altering a feature. A negotiated boundary agreement may address the legal position, maintenance of a feature, or both, depending on local law.
  6. Get legal advice before formal action. A solicitor or property lawyer is important where a transfer of land, easement, highway, building right, cost allocation, registration application or threatened litigation is involved.

England and Wales: why a title plan may not show the exact line

HM Land Registry guidance for England and Wales explains that title plans are based on Ordnance Survey mapping and normally show general boundaries. They identify the registered extent but are not precise ground measurements. The register, filed deeds and other documents may provide additional evidence, yet even original deeds can be unclear.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The official overview says there is usually no record of the exact line between properties or of who owns a dividing hedge, wall or fence. Most owners do not need a formally recorded exact boundary. Where precision is necessary, parties can consider a boundary agreement or a determined-boundary application.

Determined boundaries

HM Land Registry’s public guide calls for supporting evidence, a completed DB form and a plan showing the line, usually prepared by a chartered land surveyor. The page accessed for this article states an application fee of £90, in addition to surveyor and solicitor fees; fees and procedures can change, so check the live guidance before applying. If a neighbour makes a valid objection, the parties are given an opportunity to agree; an unresolved matter may be referred to a tribunal.

The practice guidance says registration with general boundaries is sufficient for most titles and warns that trying to agree a line can itself produce disagreement. A boundary agreement may settle the position of the legal boundary, maintenance of a boundary feature, or both. If land is transferred, separate conveyancing steps may be required.

Scale of determined boundaries

HM Land Registry reported on 24 September 2026 that less than 1% of registers have determined boundaries, attributing this chiefly to the possible expense of applying. That figure applies only to England and Wales registers; it is not a worldwide rate.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Physical features, rights and the legal boundary

Three questions are often confused: where the legal boundary lies, which feature marks it on the ground, and who must maintain that feature. A deed may grant an access easement across land without changing the outer boundary. A hedge may stand on one owner’s side while both owners maintain it by agreement. A highway edge may be treated differently from a private boundary. HM Land Registry specifically cautions that a title plan does not show the exact boundary between private land and a public highway.

When reading a document, label each statement as an ownership call, an easement or covenant, a physical-feature reference, or a maintenance obligation. Ask the surveyor and lawyer to address the categories separately rather than forcing one line on a map to answer all four questions.

Decision guide: which professional help is proportionate?

  • Routine record check: If you are confirming a parcel before refinancing or paying taxes, obtain the deed, title register and tax record and reconcile identifiers. A survey may not be necessary if no line is disputed.
  • Planned fence, extension or purchase: Commission a boundary survey when the proposed work is close to the line, the deed plan is unclear, or neighbouring occupation differs from the map.
  • Active disagreement: Stop construction or removal, exchange the source documents, obtain an independent local survey and consult a property lawyer about agreement, mediation or court procedures.
  • Formal registration in England and Wales: Ask a chartered surveyor and conveyancer whether a determined-boundary application is appropriate; prepare for the stated application fee plus professional costs and possible objection proceedings.

Practical checklist before relying on a boundary line

  • Have you read the full legal description rather than only the address or acreage?
  • Have you obtained every plat, survey, prior deed and filed document it incorporates?
  • Does the survey identify its preparer, date, licence, sources, monuments and method?
  • Are dimensions field-measured, copied from an earlier plan or scaled from a map?
  • Are you treating a tax parcel map as an assessment aid rather than a legal survey?
  • Have you separated the ownership line from easements, highway limits and maintenance duties?
  • Have you checked the rule and procedure for the property’s own jurisdiction?
  • Before changing a boundary feature or filing an application, have a qualified local surveyor and, where necessary, a lawyer reviewed the evidence?
