Reverse Mortgage vs. Home Equity Loan: How the Liens Differ

Both a reverse mortgage and a home equity loan use your home as collateral, but the lien arrangement and repayment path are fundamentally different. With a typical home equity loan, you receive a lump sum and make scheduled payments; if another mortgage is already recorded, the loan is generally a second mortgage behind that first lien. With an FHA-insured Home Equity Conversion Mortgage (HECM), you keep title but existing mortgages normally must be paid off at or before closing, often with HECM proceeds. The HECM lien is then placed in the priority position required by HUD, subject to narrow rules for permitted subordinate liens.

A HECM usually does not require a monthly mortgage payment while you meet its conditions, but interest, mortgage-insurance charges and fees are added to the balance. The debt generally becomes due when the last surviving borrower (or an eligible non-borrowing spouse) dies, sells the home or no longer occupies it as a principal residence. Unpaid property taxes, insurance, required repairs or other violations can also cause default. This is a general U.S. comparison; state law, recorded documents and the exact loan terms control an individual lien.

What the two loans are

FHA-insured HECM reverse mortgage

A Home Equity Conversion Mortgage is the federally insured reverse-mortgage program most consumer guidance discusses. It lets an eligible homeowner convert part of home equity into cash while retaining ownership and living in the property. The home secures the debt, but the lender does not receive title merely because the HECM is recorded. The borrower remains responsible for occupancy, property charges and maintenance.

Instead of sending the lender a required monthly principal-and-interest payment, the borrower can receive proceeds according to the selected HECM payment plan. Interest and applicable fees are added to the outstanding balance, so the amount owed normally increases as time passes and additional advances are made. The loan is generally repaid after a triggering event rather than on a fixed monthly amortization schedule.

Home equity loan

A home equity loan (HEL) is a traditional, closed-end loan secured by the equity in your home. It commonly provides a lump sum at closing and requires repayment under the promissory note. The interest rate may be fixed or adjustable, and the contract sets the payment amount, term, fees and consequences of late payment.

If you already have a mortgage, the HEL is generally a second mortgage: your original first-mortgage payment continues, and the HEL payment is made in addition to it. If no prior mortgage exists, the equity loan may be the first recorded mortgage. Priority depends on the recorded instruments, applicable state law and any subordination agreement—not on the marketing label alone.

Lien treatment at a glance

Issue FHA-insured HECM Home equity loan
Who owns the home? The homeowner keeps title while the home secures the debt. The homeowner keeps title while the home secures the debt.
Existing first mortgage Must generally be paid off before HECM closing or with an immediate HECM advance. HUD rules establish HECM lien priority; only specified subordinate liens may remain. Can remain in place. When it does, the HEL is generally a second mortgage payable in addition to the first.
How funds are delivered According to the HECM payment plan, such as an initial advance, line of credit or scheduled advances; the amount is constrained by eligibility and principal-limit rules. Usually a single lump-sum advance at closing.
Required monthly mortgage payment Generally none while program requirements are met; interest and fees accrue to the balance. Yes, under the loan contract, in addition to any first-mortgage payment.
Balance direction Usually grows as interest, fees and advances are added. Normally declines as scheduled principal is repaid, unless additional borrowing or contract terms increase the balance.
What can make it due Sale, death of the last surviving borrower or eligible non-borrowing spouse, loss of principal-residence status, or certain defaults involving property charges, insurance or maintenance. Failure to make required payments or comply with the note can lead to default and foreclosure; maturity and other due dates come from the contract.

The table describes the usual structures, not a substitute for reviewing the recorded mortgage, note and closing disclosures. A home equity loan is not automatically junior in every legal configuration, and HECM lien priority is specific to the FHA-insured program.

How an existing mortgage is handled in a HECM

HUD’s HECM protocol states that a borrower with an existing mortgage must either pay it off before obtaining the HECM or use an immediate cash advance from the HECM to pay it off. The practical sequence is important because a HECM generally cannot simply sit behind an unpaid first mortgage.

  1. Identify every recorded obligation. The lender and settlement agent obtain a title report and payoff statements for the first mortgage, home-equity lines, tax liens and other encumbrances. Confirm whether a debt is a mortgage, judgment, tax lien or another claim, because each can have different payoff and subordination rules.
  2. Calculate the available HECM proceeds. The HECM principal limit depends on factors such as age, property value and the applicable interest-rate assumptions. From that limit, closing costs, required reserves and the existing mortgage payoff must be covered.
  3. Arrange the payoff. You may bring funds to closing, or the HECM can make an immediate advance designated to pay the existing mortgage. The payoff must be documented so the old lien is released or otherwise treated as required by HUD and the title company.
  4. Check for permitted subordinate liens. HUD allows only specified arrangements to remain subordinate to the HECM. The lender must document that the remaining lien accepts the required priority and that all program conditions are satisfied. An ordinary creditor cannot assume it may remain simply because the borrower has enough equity.
  5. Record the HECM and releases. The settlement agent records the HECM mortgage and the documents releasing or subordinating other liens. Ask for copies of the final recorded documents and the closing disclosure showing each payoff.

If the mortgage payoff and required charges exceed available HECM proceeds plus the borrower’s funds, the transaction may not be eligible under HUD rules. A HUD-approved housing counselor and the lender can explain whether a specific payoff structure works; do not rely on a verbal estimate of equity.

How a home equity loan sits with an existing mortgage

With a conventional HEL, the first mortgage usually remains open. The new lender records its mortgage after the existing first lien, making the HEL a second mortgage. You then have two separate obligations secured by the same property.

  1. Review the first mortgage documents. Look for provisions requiring lender consent, limits on additional liens, or insurance and tax requirements that apply to any junior mortgage.
  2. Establish usable equity. The HEL lender orders an appraisal or valuation and reviews the combined loan-to-value ratio. The maximum amount is based on the lender’s underwriting rules, not simply the difference between market value and the first-mortgage balance.
  3. Sign a separate note and mortgage. The HEL note sets the rate, payment, term, late charges and default remedies. The mortgage or deed of trust identifies the collateral and is recorded according to local law.
  4. Make both payments. Your first-mortgage payment does not disappear. The HEL payment is separate and remains due even if the property value falls or you stop using the borrowed funds.
  5. Track priority changes. A refinance of the first mortgage, a modification, a tax lien or a judgment can alter the practical priority among claims. A lender may require a subordination agreement when the first mortgage is refinanced.

Because priority is determined by recording rules, notice and the documents themselves, ask the closing agent for the final title policy or an equivalent explanation of lien order. “Second mortgage” describes the common arrangement when a first mortgage remains; it is not a universal legal conclusion for every property.

Payment mechanics and the direction of the balance

HECM: deferred mortgage payments, accruing debt

Meeting the HECM conditions generally means no required monthly mortgage payment. That does not make the borrowing free. Interest and fees are added to the balance, and the balance can rise even when you take no new advance. The amount available through a line of credit or future advances can change as interest accrues and as the plan’s limits apply.

You still must pay property taxes, homeowners insurance and other required property charges, keep the home in acceptable repair and occupy it as your principal residence under the program rules. Some borrowers set aside funds or authorize payments for these obligations; that arrangement does not eliminate the underlying responsibility.

Home equity loan: amortizing payment obligation

An HEL usually has a scheduled monthly payment that includes interest and principal. A fixed-rate loan provides a predictable payment, while an adjustable-rate contract can change according to its index, margin and adjustment caps. The balance generally falls as principal is paid, but late fees, capitalization provisions or a payment increase under an adjustable rate can change the amount owed.

Because the HEL payment is due regardless of whether the home is occupied or sold, budget it alongside the first mortgage, taxes, insurance, utilities and maintenance. A missed payment can place the property at risk even if substantial equity remains.

When each lien can become due

HECM repayment events

A HECM is generally due when the last surviving borrower dies, the home is sold, or the borrower no longer occupies the property as a principal residence. An eligible non-borrowing spouse can affect the timing and protections, so the loan documents and counseling certificate should be reviewed for the household’s status.

Failure to meet property obligations can create a separate default path. Unpaid taxes or insurance, failure to maintain the home, or failure to satisfy occupancy requirements can lead the servicer to demand correction, call the loan due and, if unresolved, pursue foreclosure. The absence of a monthly mortgage bill does not waive these duties.

Home equity loan default

The HEL becomes delinquent when required payments are missed or another covenant in the note is breached. The lender may assess fees, report the delinquency and use foreclosure remedies allowed by the mortgage and state law. If a first mortgage also exists, its lender has its own rights; the order in which claims are enforced and how sale proceeds are distributed depends on lien priority and local procedure.

Title, foreclosure and what happens to equity

Neither product automatically transfers title to the lender at closing. You remain the owner, can generally sell the property subject to paying the debt, and must comply with the mortgage’s insurance and property-care requirements.

At a sale or foreclosure, proceeds are distributed according to lien priority, approved costs and applicable law. A first-priority claim is paid before a junior claim. For a HECM, HUD’s insurance and program rules govern the insured lien; for an HEL, the first mortgage normally has priority when it remains recorded ahead of the HEL. Equity left after all valid liens and costs are paid belongs to the homeowner or estate, subject to any other claims.

HECM heirs generally have options and deadlines established by the servicer and program rules, including selling the home or paying the balance to keep it. Obtain a written payoff statement rather than estimating the debt from the original advance, because accrued interest and fees affect the amount due.

Eligibility and obligations that affect lien risk

HECM requirements

  • HECMs are generally for homeowners age 62 or older.
  • HUD-approved counseling is required before closing so the borrower can review alternatives, costs and obligations.
  • The property must be the borrower’s principal residence under program rules, and occupancy must continue as required.
  • Property taxes, homeowners insurance and required repairs must be kept current.
  • Existing mortgage payoffs and any permitted subordinate-lien arrangements must satisfy HUD and lender documentation requirements.

These requirements are continuing conditions, not one-time underwriting checks. A borrower who cannot reliably fund taxes, insurance and maintenance should discuss set-asides, payment plans or alternatives with the counselor before signing.

Home equity loan requirements

  • The lender evaluates income, credit history, existing debt and property value to determine approval and amount.
  • The first mortgage, if any, continues under its own terms.
  • The HEL payment, taxes, insurance and maintenance must all fit the household budget.
  • The mortgage is recorded against the home, and refinancing the first mortgage may require the HEL lender’s consent or subordination.

Worked examples of the lien difference

Example 1: Existing first mortgage and a HECM

Suppose a qualifying homeowner has a recorded first mortgage. The HECM closing cannot simply leave that first mortgage unpaid while adding a junior reverse-mortgage lien. The existing balance is paid before closing or from an immediate HECM advance. The settlement statement shows the payoff, and the HECM is recorded in the priority position required by HUD. If the borrower lacks enough HECM proceeds and cash to clear the mortgage and required charges, the lender may be unable to close the HECM.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 2: Existing first mortgage and a home equity loan

The homeowner keeps the first mortgage and borrows a lump sum through an HEL. The HEL is recorded behind the first mortgage, creating two monthly obligations. If the homeowner later refinances the first mortgage, the HEL lender may need to sign a subordination agreement so the refinanced first mortgage retains priority.

Example 3: No existing mortgage

With no prior mortgage, an HEL may be recorded as the first lien. A HECM still requires a recorded mortgage securing the reverse debt, and the borrower remains responsible for property charges and occupancy. The absence of a first mortgage simplifies payoff logistics but does not remove HECM program conditions.

How to compare actual offers

Do not choose based only on the advertised rate or the phrase “no monthly payment.” Put the two loan estimates or offer packages side by side and check:

  • Lien order: Which liens will be released, remain, or be subordinated at closing?
  • Rate type: Is the rate fixed, adjustable or subject to future changes? What index, margin, caps and adjustment dates apply?
  • Cash available: For a HECM, how much of the principal limit is consumed by the existing-mortgage payoff, fees and required set-asides? For an HEL, what is the net lump sum after closing costs?
  • Payment duty: What payment is due each month, and what happens if income falls or the rate adjusts?
  • Balance projection: For a HECM, how do interest and fees accrue? For an HEL, how much principal is repaid in each scheduled payment?
  • Due events: What sale, death, move, occupancy change or default makes the balance payable?
  • Property obligations: Who pays taxes, insurance and repairs, and how are missed obligations handled?
  • Exit and inheritance: What payoff amount, deadlines and options apply if you sell, refinance, move or leave the property to heirs?
  • Fees and counseling: Request an itemized closing-cost disclosure and complete required HECM counseling before committing.

Reverse mortgages that are not HECMs

“Reverse mortgage” is a category, not a guarantee that every rule above applies. Proprietary reverse mortgages are private products and are not FHA-insured. Single-purpose reverse mortgages may be offered by some state or local governments or nonprofit organizations for a limited use. Their lien priority, eligibility, disbursement rules, fees and repayment triggers can differ from HECM requirements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask which program is being offered, who insures or administers it, whether FHA and HUD rules apply, and how an existing mortgage will be handled. Do not assume that a statement about HECM lien priority or age eligibility describes a proprietary or single-purpose product.

Questions to ask before signing

  1. What liens are currently recorded against the property, and which will be paid, released or subordinated at closing?
  2. Will the new mortgage be first priority, second priority or another position under the recorded documents?
  3. For a HECM, exactly how much of the proceeds will pay the existing mortgage, closing costs and set-asides?
  4. What event makes the loan due, and how much notice will the servicer provide?
  5. What are the continuing requirements for occupancy, taxes, insurance and repairs?
  6. How will the balance change under realistic interest-rate and advance assumptions?
  7. Can the lender provide the payoff amount and lien-release process in writing?
  8. Which HUD-approved counselor can explain alternatives without selling the loan?
  9. What happens if the home is sold for less than the outstanding balance?
  10. What documents should the borrower or heirs retain after recording?

Bottom line

A home equity loan usually adds a junior lien and a second required payment when a first mortgage already exists. An FHA-insured HECM generally clears existing mortgages at closing, places its lien in the HUD-required priority position and postpones required mortgage payments while the borrower meets program conditions. The trade-off is an accruing balance and strict ongoing duties for occupancy, taxes, insurance and maintenance. Compare the recorded lien order and the events that make each loan due—not just the interest rate or the promise of cash—to determine which structure fits your household.
