If one spouse is too young or otherwise ineligible, that spouse may instead be documented as an eligible non-borrowing spouse. The choice affects survivor protection, available proceeds, title and signing requirements, and what happens after the borrowing spouse dies.
Do not choose solely by comparing an advertised cash amount. Have a HUD-approved HECM counselor and the lender put each spouse’s status, projected proceeds, obligations and survivor rights in writing before closing.

Can my spouse and I both be on a reverse mortgage?
Yes, if you are applying for an FHA-insured HECM and both spouses meet its borrower requirements. HECM borrowers are generally at least 62 years old and must satisfy the program’s other eligibility rules. Each co-borrower is responsible for the loan, must be on title, and signs the closing documents.

When both spouses are co-borrowers, the surviving spouse normally may remain in the home and continue receiving available loan benefits after the other spouse dies, as long as the survivor keeps meeting the mortgage obligations. The lender’s final documents should identify both people as borrowers and show their names correctly on the note, mortgage and related records.

If one spouse does not qualify as a borrower, the couple may be able to use a one-borrower structure with an eligible non-borrowing spouse. That arrangement can protect the survivor, but the protection is conditional and is not the same as co-borrower status.
How the two main HECM structures differ
| Structure | Who signs as borrower | Survivor position | Access to future loan proceeds | Main qualification issue |
|---|---|---|---|---|
| Both spouses as co-borrowers | Both spouses, with both on title | Surviving co-borrower can generally remain and continue the loan while meeting its terms | Survivor remains a borrower and can continue to receive benefits available under the loan | Both must meet HECM borrower requirements, including the age threshold |
| One borrower and an eligible non-borrowing spouse | One spouse borrows; the other is disclosed and documented as a non-borrowing spouse | Deferral of repayment may be available after the last borrower’s death, but only while every condition is met | The non-borrowing spouse does not receive future advances as a borrower | Relationship, disclosure, occupancy, ownership or legal-right, and ongoing-obligation requirements |
| One borrower and an ineligible or undocumented spouse | Only the borrower signs as borrower; the spouse may not be properly protected | No assumed right to remain without repaying the loan | The spouse has no borrower entitlement | Missing documentation or failure to satisfy the HECM non-borrowing-spouse rules |
Should both spouses be borrowers?
Both spouses being co-borrowers is usually the clearest survivor arrangement when both qualify. The survivor’s right to remain is tied to continuing borrower status rather than to a separate deferral test. Both spouses, however, are jointly responsible for property charges and other loan obligations. A couple should still compare the proceeds calculation, interest rate, fees and any lender-specific conditions before choosing.
Advantages of co-borrowing
- The surviving spouse is already a borrower, so the loan does not depend on the special non-borrowing-spouse deferral process.
- Both spouses can be included in the loan’s benefit structure rather than treating one spouse only as a protected occupant.
- The arrangement is easier to explain to heirs, the lender and anyone reviewing title and estate documents.
Responsibilities of co-borrowers
- Both borrowers must comply with the loan and keep required property charges current.
- Both names must be handled correctly on title and closing documents.
- If either spouse’s circumstances change, the couple should ask the servicer how occupancy, title or other requirements are affected.
What if my spouse is younger than 62?
A spouse younger than 62 cannot become an eligible HECM borrower merely because the other spouse is old enough. The younger spouse may instead be documented as a non-borrowing spouse. The lender and counselor should identify that status before closing; it should not be left to an informal promise or a later amendment.
The age of the youngest borrower or eligible non-borrowing spouse is one factor in the HECM principal-limit calculation, along with the expected interest rate and the maximum claim amount. Consequently, adding a younger spouse to the case as an eligible non-borrowing spouse can affect the amount available. A couple needs individualized estimates for each eligible structure; it is not accurate to promise that co-borrowing or non-borrowing status always produces more cash.

How protection works for an eligible non-borrowing spouse
Federal HECM rules allow a qualifying non-borrowing spouse to receive a deferral of the loan becoming due and payable after the last borrower dies. Deferral postpones the due-and-payable event; it does not turn the spouse into a borrower or forgive the balance.
Conditions that must be satisfied
The spouse generally must have been married to the borrower at closing and remained married during the borrower’s lifetime. The spouse must be disclosed and named in the HECM documents, occupy the property as a principal residence, and meet the program’s ownership or legal-right requirement after the last borrower’s death. Within 90 days of that death, the spouse must establish a qualifying ownership interest or another legal right to remain for life. The spouse must also continue meeting the loan’s obligations, including required property charges and other conditions.
What the protection does not provide
- The spouse is not a co-borrower and does not receive future advances as a borrower.
- The spouse does not have an unconditional right to remain in the home.
- Deferral can end if the spouse stops living in the home as a principal residence, fails to establish the required legal right, loses the qualifying relationship or fails to maintain loan obligations.
- The loan can still become due for another permitted reason, such as a triggering occupancy event or a failure to pay required taxes, insurance or maintain the property.
If the spouse cannot satisfy the conditions, the lender may require repayment. Remaining in the home could then require paying off the balance from savings, a refinance, a sale or another source.
What happens if I get a reverse mortgage and die first?
If you and your spouse are co-borrowers, your spouse can generally remain in the home and continue the loan’s benefits while complying with the mortgage. If your spouse is a properly documented eligible non-borrowing spouse, the spouse may qualify for the conditional deferral described above. If the spouse was not disclosed, does not meet the eligibility conditions or cannot establish the required right to remain, do not assume the home is protected from repayment.

Ask the lender to describe the exact sequence in writing: notice of death, documents the survivor must provide, the 90-day legal-right deadline, payments that must continue, and events that would end deferral. An independent attorney may be needed for title, inheritance or state-law questions.
Title, signatures and the non-borrowing owner
Every HECM borrower must be on title. A spouse who retains an ownership interest but is not a borrower generally signs the mortgage as a mortgagor, acknowledging the lien and loan terms. That signature does not make the spouse a borrower or give the spouse access to proceeds.
Before closing, compare the deed, loan application, mortgage, counseling certificate and final closing package. Names, marital status, borrower roles and occupancy information should match. Ask the lender to correct discrepancies before signing rather than relying on a post-closing correction.

HECM proceeds are based on a principal limit rather than simply on the home’s market value. The calculation considers the youngest borrower or eligible non-borrowing spouse, the expected interest rate and the maximum claim amount. Because those inputs interact, the only reliable comparison is a written estimate for the household’s actual age, property and rate assumptions.

- Ask for an estimate with both spouses as eligible co-borrowers, if that structure is available.
- Ask for an estimate with one borrower and the other spouse documented as an eligible non-borrowing spouse, if permitted.
- Have each estimate identify the principal limit, upfront and ongoing charges, payment options, interest assumptions and required set-asides.
- Ask which age was used in the calculation and whether the younger spouse’s status changes the result.
Treat figures as estimates, not guaranteed cash. A lender’s eligibility decision and the final appraisal, title review and underwriting can change the available amount.
What if my spouse is ineligible or was not documented?
A spouse who is neither a co-borrower nor a qualifying, documented non-borrowing spouse may not have HECM survivor protection. The spouse could be required to repay the loan to stay in the property. Missing disclosure at origination is especially serious because a later attempt to add the spouse may not recreate the original protection.
Before signing, obtain the lender’s written determination of the spouse’s status and ask a HUD-approved counselor to explain the consequences. If the lender cannot clearly state what happens on the borrower’s death, a move to a care facility or another due-and-payable event, pause the transaction until the issue is resolved.

Occupancy and other events that can make the loan due
Reverse-mortgage survivor rights depend on more than death. The home generally must remain the borrower’s or protected spouse’s principal residence, and taxes, insurance, maintenance and other required charges must stay current. CFPB guidance identifies a move to a health-care facility lasting more than 12 consecutive months as a relevant due-and-payable event. Ask the lender how temporary absences, rehabilitation stays and permanent moves are evaluated under the specific loan documents.

When a borrower dies, the surviving spouse should notify the servicer promptly, continue required payments and request a written list of documents and deadlines. Waiting can create avoidable uncertainty, particularly around the 90-day legal-right requirement for an eligible non-borrowing spouse.
HECM versus a proprietary reverse mortgage
Proprietary reverse mortgages are private, non-FHA-insured products. They are often designed for homes whose values exceed the limits commonly served by HECMs, but their spouse protections, proceeds, fees, interest rates, repayment triggers and recourse terms are product-specific.
Do not transfer HECM assumptions to a private loan. Compare the written documents on these points:

A practical decision process for couples
- Confirm eligibility. Verify each spouse’s age, title status, occupancy and other HECM requirements. Identify whether the younger spouse can be an eligible non-borrowing spouse.
- Get counseling. Complete the required counseling with a HUD-approved HECM counselor. Ask specifically about co-borrower and non-borrowing-spouse outcomes, not just general loan mechanics.
- Demand written alternatives. Request side-by-side estimates for every structure for which the lender says the couple qualifies.
- Review survivor conditions. Ask what the survivor must do after death, including the 90-day ownership or legal-right deadline, occupancy, taxes, insurance and maintenance.
- Check title and signatures. Confirm who owns the property, who is a borrower, who signs as mortgagor and how the names appear in every final document.
- Model difficult events. Discuss death, a health-care-facility stay exceeding 12 consecutive months, permanent relocation, divorce and inability to pay property charges.
- Obtain independent advice where needed. Use an attorney for state-law title, inheritance or marital-property questions; counseling is not a substitute for legal advice.
- Keep the records. Retain the counseling certificate, lender determinations, estimates, closing documents and servicing contacts so the survivor can find them quickly.
Questions to ask before signing
- Are both spouses borrowers, or is one a non-borrowing spouse? Where is that status stated?
- If one spouse dies, exactly when does the loan become due, and what deferral is available?
- What documents must a non-borrowing spouse provide within 90 days?
- Who must remain on title, and who signs the mortgage as mortgagor?
- Which age was used for the principal-limit calculation?
- How much can be drawn initially and later, and what fees or set-asides reduce those amounts?
- What happens if the survivor enters a health-care facility for more than 12 consecutive months?
- Which taxes, insurance, maintenance and other charges must the household pay?
- Is the offer an FHA-insured HECM or a proprietary loan, and where are survivor protections stated in the contract?
Bottom line for a married couple
If both spouses qualify, co-borrowing generally provides the most straightforward survivor arrangement. If one spouse is younger than 62 or otherwise ineligible, an eligible non-borrowing-spouse structure can preserve a conditional right to remain, but only when the spouse is properly disclosed, occupies the home, establishes the required ownership or legal right within 90 days after the last borrower’s death and keeps meeting every loan obligation. Neither structure should be selected from a headline cash figure. Compare individualized estimates, verify title and signatures, and have a HUD-approved counselor explain the survivor consequences before closing.
