Restaurant Gift Cards Explained: Expiration Dates, Refunds and Bankruptcy Claims

Restaurant gift cards usually cannot lose their purchased value before five years under federal law, but that protection has important exceptions. A card bought with money is generally covered by Regulation E: the underlying funds must remain available for at least the later of five years after issuance or five years after the last load. A cash refund is not automatically required when you change your mind, and a restaurant closure or bankruptcy can make redemption uncertain. The safest approach is to check the card’s terms, preserve proof of purchase and monitor official bankruptcy notices if the business stops accepting cards.

What a restaurant gift card is under federal law

The Federal Trade Commission treats cards redeemable at restaurants as retail gift cards. That category includes physical cards, digital codes and other prepaid instruments issued or sold for restaurant purchases. The legal result depends on how the card was obtained, where the transaction occurred and the terms printed or provided by the issuer.

The most important distinction is whether money or another form of value was exchanged. A card purchased by you or given to you after someone paid for it is generally the type covered by federal gift-card protections. Promotional, award and loyalty cards issued without payment can be subject to different federal treatment, so do not automatically apply the five-year rule to a free bonus card.

Do restaurant gift cards expire?

Usually, the purchased funds cannot expire before the federal five-year floor. Regulation E §1005.20 generally requires the underlying funds on a covered card to remain available until the later of:

  • Redemption: Instore
  • No returns and no refunds on gift cards.
  • Five years after the card was issued; or
  • Five years after the funds were last loaded.

If the card itself displays an expiration date, the issuer must provide a reasonable opportunity to purchase or obtain a card with at least five years remaining and must make the expiration information clear. The card expiration date and the expiration of the underlying funds are related but not always identical. A plastic card can stop working while the value is still required to remain available.

When the card expires but money remains

If a card expires while the balance is still available under the federal rule, the issuer may provide a replacement card or transfer the remaining balance. A replacement fee cannot be charged in that situation under the federal regulation, although applicable state law can provide additional protections or restrictions. Contact the issuer before discarding an expired card, and keep the card number and any balance evidence.

State law can be more protective

The five-year rule is a federal baseline for covered cards, not a promise that every state uses identical rules. Some states restrict expiration dates more tightly, prohibit certain fees or impose special rules for low balances and unclaimed property. The law governing the transaction can depend on the state where the card was sold, the restaurant’s terms and other jurisdictional facts. Check the relevant state’s gift-certificate statute before asserting a legal right.

Can a restaurant charge an inactivity fee?

Federal law limits dormancy, inactivity and service fees on covered gift cards. An issuer generally may charge such a fee only when all of these conditions are met:

  • At least one year has passed with no activity on the card.
  • The fee amount, frequency and condition that triggers it were clearly disclosed.
  • No more than one inactivity fee is charged in a calendar month.

“Activity” and the exact fee terms should be read in the card agreement. A balance inquiry, reload or purchase may have different treatment depending on the terms. If a fee appeared sooner than allowed, was not disclosed clearly or was charged more than once in a month, ask the issuer for a correction and keep screenshots or statements showing the charges.

Can you get a refund for an unused restaurant gift card?

There is no single federal rule that guarantees cash back merely because you no longer want an unused restaurant gift card. Federal consumer guidance directs cardholders to read the issuer’s terms, check expiration and fee information, and contact the issuer. Whether you receive money, a replacement card, a transfer to another account or nothing depends on the merchant’s policy and any stronger state-law right.

A practical refund request

  1. Read the terms. Check the printed card, packaging, receipt and the issuer’s online terms for refund, replacement, transfer, expiration and lost-card provisions.
  2. Ask the restaurant or issuer directly. Request the specific remedy available: a cash refund, a replacement card, a transfer to another card or an electronic balance.
  3. Provide proof. Have the card number, purchase receipt, activation evidence, purchase date and any remaining-balance record ready.
  4. Check state law. If the business refuses, compare its position with the gift-certificate rules in the state governing the transaction. A voluntary merchant policy is not the same thing as a federal entitlement.

Use a written request when practical and save the response. If the card was bought from a third-party seller, identify whether that seller or the restaurant is responsible under the terms; the party that processed payment may not be the party that controls redemption.

What happens if the restaurant closes?

A closure can reduce a card’s practical value even when the balance has not legally expired. The restaurant may continue honoring cards at another location, a successor or competitor may accept them, or redemption may stop. The Federal Trade Commission warns that a card from a business that goes out of business or files bankruptcy may be worth less than expected.

Check for a successor or alternate location

Before assuming the card is worthless, contact the restaurant’s remaining locations, parent company or publicly identified successor. Ask whether the card can be used at another location, exchanged for a new card or submitted for a balance transfer. Get the answer in writing when possible. Do not assume that a similarly named restaurant, a buyer of the premises or a former franchisee has agreed to honor old cards.

Preserve evidence immediately

  • Photograph both sides of the physical card or save the digital code securely.
  • Keep the purchase receipt, activation confirmation and payment record.
  • Record the balance and the date you checked it.
  • Save closure announcements, emails and any instructions from the restaurant.

What happens to a restaurant gift card in bankruptcy?

Bankruptcy does not produce one automatic result. The debtor may continue honoring cards, a buyer or competitor may accept them, or redemption may end. The bankruptcy court’s orders, the debtor’s operating plan and the card’s legal classification determine what happens next. Even if a card is legally a claim, there may be little money available for unsecured creditors.

Monitor the case before filing

Look for notices from the bankruptcy court, the debtor’s claims agent and any official case website identified in those notices. They may explain whether cards are being honored, whether a sale has occurred, which claims form to use and the deadline (the “bar date”). A retailer’s customer-service statement is not a substitute for a court notice when a bankruptcy case is pending.

File a proof of claim when the card is not honored

Bankruptcy Rule 3001 defines a proof of claim as “a written statement setting forth a creditor’s claim.” When a claim is based on a writing, the rule requires supporting information. A gift card, receipt and account records help establish the amount and basis of the claim.

  1. Identify the correct case. Confirm the legal name of the debtor and the bankruptcy court case number.
  2. Find the official claim form and bar date. Use the court or claims agent instructions, not an unverified form found elsewhere.
  3. Calculate the claim. State the unused balance and explain that it arises from a purchased restaurant gift card. Do not claim a value you cannot support.
  4. Attach evidence. Include a copy of the card or code, receipt, activation record, balance evidence and relevant correspondence, while redacting unnecessary personal or payment information.
  5. Submit before the deadline. Follow the permitted filing method exactly and retain the confirmation, tracking number or stamped copy.
  6. Update your address. If your contact information changes, follow the court’s procedure so distribution notices reach you.

Filing a claim does not guarantee payment. The amount and timing depend on the estate, allowed claims and the plan or settlement approved by the court.

Are gift-card holders paid first in bankruptcy?

Priority is case-specific. A purchased gift card may receive different treatment from a promotional card, merchandise-return credit or other customer claim. In a settlement described by the Texas Attorney General involving RadioShack, purchased gift cards received priority treatment, while merchandise-return and certain promotional cards were treated as general unsecured claims that might receive little or no payment. That result is an example from one case, not a rule for every restaurant bankruptcy.

Do not describe a gift-card claim as secured or priority merely because the card was purchased. Use the classification stated in the bankruptcy notices and claim instructions, and challenge an incorrect classification through the procedure provided by the court.

Why California cardholders may have different rights

California provides a useful example of why location matters. California Attorney General guidance states that California law protects covered gift certificates and that a business must continue honoring them even after filing bankruptcy. The office also recommends considering a proof of claim when a business owes consumers money. This statement describes California law specifically and should not be generalized to another state without checking that state’s statutes.

Factor What to check Why it matters
Purchased or promotional Was money or other value exchanged? Promotional, award and loyalty cards can have different federal treatment.
Redemption locations Which restaurants, franchisees and online channels accept it? A card may not transfer to a successor or separately owned location.
Expiration wording What date appears on the card, and when do the underlying funds expire? The physical card date and balance-availability period can differ.
Inactivity fees When can a fee begin, how much is it and how often can it recur? Federal rules require one year of inactivity, clear disclosure and no more than one fee per calendar month.
Refund and replacement policy Does the issuer offer cash refunds, transfers or replacement for loss or expiration? A merchant policy may provide more than federal law, but it is not automatic.
Issuer condition Is the restaurant financially stable, closing locations or changing ownership? Bankruptcy or closure can interrupt redemption and force a claim.
Governing state law Which state’s gift-certificate rules apply? States can add protections beyond the federal baseline.

Common mistakes and how to avoid them

  • Assuming every card lasts five years. First determine whether it was purchased or promotional and read the applicable terms.
  • Treating an expiration date as automatic loss of the balance. Ask the issuer about replacement or balance transfer when funds should still be available.
  • Expecting a federal cash refund. Request the merchant’s stated remedy and then check state law.
  • Waiting until after a bankruptcy deadline. Monitor notices as soon as the restaurant stops honoring cards.
  • Discarding the card or receipt. Rule 3001’s supporting-information requirement makes documentation important.
  • Assuming a competitor must accept the card. Acceptance by a buyer or competitor is possible, not guaranteed.

A concise action plan

  1. Identify whether the card was purchased or promotional.
  2. Read the expiration, fee, refund and redemption terms.
  3. Check the current balance and save evidence.
  4. Contact the restaurant or issuer if the card is expired, lost, rejected or affected by a closure.
  5. Check the governing state’s gift-certificate law for additional rights.
  6. If bankruptcy is filed and the card is not honored, obtain the official claim form, calculate the supported balance and file before the bar date.
