Kabra and Associates & Ors. v. Rekha Rajkumar Hemdev & Ors. shows why a buyer who first pursued MahaRERA, withdrew a refund case while intending to refile there, and then moved to the National Consumer Disputes Redressal Commission could not simply switch forums for the same dispute.
Why the forum decision is now fact-specific
Homebuyers commonly use “consumer court” to mean a District, State or National Consumer Commission under the Consumer Protection Act, 2019. RERA complaints go to the Real Estate Regulatory Authority for the relevant state or union territory. Both are statutory routes, but they are not interchangeable filing counters.

The decisive question is not only which law appears more attractive. It is also what relief you want, which body has jurisdiction, whether the project and parties fall within that body’s authority, and what you have already done in another proceeding.

- A Consumer Commission may be appropriate when the claim is framed as a consumer dispute and satisfies the Consumer Protection Act, 2019 and the applicable Commission-jurisdiction rules.
- Prior conduct can change the answer. A withdrawal order, a statement that you will refile before RERA, or an order in an earlier case can affect whether a later complaint is maintainable.
There is no supported basis for promising that one forum is universally quicker, cheaper or more successful. Resolution time, fees, procedure and enforcement can vary by state, Commission, authority and case.

What the Supreme Court decided on 4 February 2026
The case and its procedural history
In M/s. Kabra and Associates & Ors. v. Rekha Rajkumar Hemdev & Ors., Civil Appeal No. 6936/2023, the Supreme Court considered buyers’ forum choice after a series of filings.
- The buyers first approached the Maharashtra Real Estate Regulatory Authority (MahaRERA), including a complaint concerning project registration under section 3 of the RERA statute.
- They later sought a refund under section 18 before RERA.
- They withdrew that refund complaint while stating that they would file afresh before RERA.
- In 2022, they filed a consumer complaint before the National Consumer Disputes Redressal Commission (NCDRC) concerning the same dispute.
- The NCDRC held Consumer Complaint No. 122/2022 maintainable.
The developer appealed. The Supreme Court held that, on those facts, the complainants could not retract the procedural choice they had made and pursue the consumer complaint. It allowed the appeal and set aside the NCDRC’s maintainability order. The Court expressly made no comment on the delay between 2019 and 2022.
The order states: “The appeal is allowed, setting aside the order dated 23.08.2023 passed by the NCDRC holding Consumer Complaint No. 122/2022 to be maintainable.” The judgment was authored by Justices Sanjay Kumar and K. Vinod Chandran.
What the ruling does—and does not—establish
- It does establish a practical warning: the sequence of your filings, the relief sought, the reason for withdrawal and the wording of any order matter when you later choose a forum.
- It does not establish a blanket rule that RERA excludes Consumer Commission jurisdiction in every builder dispute.
- It does not create a blanket permission to file in both forums or to move from one to the other whenever the first route becomes inconvenient.
- It does not decide your case. Your project, dates, pleadings, withdrawal terms and prior orders must be reviewed separately.
Earlier NCDRC reporting had stated that RERA did not itself bar a consumer complaint. That explains why older advice may sound broader. The 2026 Supreme Court order means that advice must now be applied together with the buyer’s actual procedural history.

The table is a decision aid, not a prediction of outcome. No current, general figures establish that either route is faster, less expensive or easier to enforce.
A decision framework before you file
1. Define the result you actually want
Write the remedy in one sentence before selecting a portal or form: for example, a refund pursued under section 18 of RERA, a project-registration or compliance issue, or relief for a consumer dispute. Do not use a generic “builder complaint” description if your documents and requested relief point to a narrower statutory route.
Separate the primary remedy from supporting facts. Delayed possession, missing specifications, an unregistered project or a demand for refund may require different legal framing. The authority or Commission will assess the pleadings you submit, not the label you use in an email.

2. Build a complete filing history
Prepare a chronology showing every complaint, case number, authority, relief, withdrawal application, order and appeal. Keep the exact text of any statement that you would refile in a particular forum. The Kabra and Associates order demonstrates that a withdrawal coupled with an intended RERA refiling can matter later, even when a consumer complaint is presented afterward.
If another case is pending, obtain advice on whether a new filing would duplicate the same cause of action or create inconsistent positions. Never omit a prior complaint from a new pleading.
3. Confirm the forum’s jurisdiction
For RERA, identify the state or union-territory authority responsible for the project. For a consumer case, determine whether the District, State or National Commission is correct under the current rules. Jurisdiction can depend on the parties, transaction, location and claim; do not select a Commission solely because its online form is easier to find.
The Ministry of Consumer Affairs maintains the Consumer Protection Act, 2019, related rules and regulations, including rules on the jurisdiction of District, State and National Commissions. Use the current official text rather than an old blog summary.
4. Check dates and procedural deadlines
List the agreement date, promised possession date, payments, possession or cancellation events, notices, discovery of the alleged deficiency, and every earlier filing. Then verify the applicable limitation and appeal periods with the relevant authority or Commission. The available national sources do not establish a single limitation calculation that can safely be applied to every buyer.
5. Match the relief to the evidence
For each requested remedy, identify the contract clause, payment record, project document or communication that supports it. If you seek a refund, show the payment trail and the event that triggered the claim. If you rely on registration or possession representations, preserve the relevant project records and dated promises.
If you choose the RERA route
Step 1: Identify the correct authority and project record
Use the current official process of the state or union territory where the project is regulated. Confirm the project’s registration details, promoter name, phase or tower and status. A project may have multiple registrations or phases, so ensure the record you cite matches your agreement.

Step 2: State the statutory basis and relief
Explain whether the complaint concerns registration under section 3, a refund claim under section 18, or another RERA issue supported by the applicable law. State the amount or action requested and how it is calculated. Avoid combining unrelated grievances without explaining their connection.

Include the agreement, allotment letter, payment schedule, bank records, demand letters, possession or construction evidence, promised specifications and communications. Add the project registration record and every prior RERA filing, withdrawal request and order. Keep a page-numbered index and an unedited copy of electronic records.
Step 4: Verify current filing mechanics
Check the authority’s live instructions for form, fee, affidavit or verification requirements, service method, hearing options and deadlines. These details are location-specific and are not safely inferred from another state’s portal.
Step 5: Preserve the submission trail
Save the filed complaint, acknowledgement, fee receipt, uploaded documents, notices and hearing orders. If you later consider withdrawal, read the proposed application and the resulting order carefully. Do not rely on an informal assurance that you can restart the dispute in another forum.
If you choose a Consumer Commission
Step 1: Select the Commission under the current rules
Determine whether the District, State or National Commission has jurisdiction using the current Consumer Protection Act, 2019 rules and any applicable regulations. Confirm territorial and pecuniary requirements before drafting. The correct Commission is a legal question, not simply the one nearest your home.
Step 2: Draft a precise consumer complaint
Identify the buyer, promoter and project; set out the agreement and payment history; describe the alleged deficiency or unfair conduct; specify the relief; and state all relevant dates. Explain any earlier RERA or consumer proceeding, its result and the terms of withdrawal. A transparent history lets the Commission address maintainability directly.
Step 3: Use electronic filing only after checking the live portal
The Consumer Protection Act, 2019 provides for electronic filing and online fee payment. A Ministry of Consumer Affairs release dated 26 February 2021 described e-Daakhil features including electronic notices, document access, video-conference hearing links, online responses and SMS or email alerts. Those rollout figures were historical as of that date; they are not current availability data. Confirm that the present e-Daakhil portal accepts your filing and follow the Commission’s current instructions.

Step 4: Upload readable, ordered documents
Use consistent file names, a chronology and an index. Keep proof of filing, fee payment, service and every subsequent response. If a document is unavailable, explain what you requested and attach the evidence of that request rather than silently omitting the document.
Step 5: Address maintainability in the first filing
Because the 2026 Supreme Court order focuses on forum choice, do not wait for the builder to raise your earlier RERA case. Explain why the Consumer Commission has jurisdiction, what happened in the earlier proceeding and why the present relief is or is not the same. Obtain case-specific legal advice where the earlier matter was withdrawn or remains pending.

Can a homebuyer file in both RERA and consumer court?
There is no safe blanket “yes” or “no.” The answer depends on the claims, parties, relief, timing and orders in the particular record.
- If you have not filed anywhere, decide deliberately after checking both statutes, jurisdiction and the remedy you need.
- If a RERA complaint is pending, do not file a second case for the same dispute without advice on duplication, election and maintainability.
- If you withdrew a RERA complaint, read the withdrawal application and order word for word. A statement that you would refile before RERA was central to the Supreme Court’s analysis in Kabra and Associates.
- If a Consumer Commission has already issued an order, preserve it and assess appeal or review options under the applicable procedure rather than starting over elsewhere.
- If an older article says RERA never bars a consumer case, treat that as incomplete after the 4 February 2026 Supreme Court decision.
Filing in two places can also produce inconsistent statements about the same contract, amount or remedy. Consistency and full disclosure are safer than attempting parallel pressure tactics.

Common mistakes and how to correct them
Relying on a headline instead of the holding
“RERA bars consumer court” overstates the 2026 decision. The holding turned on the buyers’ own sequence of filings and withdrawal. Correct the mistake by reading the order and comparing its facts with yours.

A withdrawal application can become part of the later maintainability record. Before signing, state the intended next step accurately and obtain advice on whether the order preserves any alternative remedy.

Choosing a Commission by convenience
An online form or nearby office does not establish jurisdiction. Verify the current District, State or National Commission rules and document the basis for your selection.
Using stale portal information
The 26 February 2021 e-Daakhil announcement is useful for understanding the features described at that time, not for proving present coverage. Confirm the live portal, accepted file formats, fees and hearing process before uploading anything.
Leaving out an earlier case
Omitting a RERA complaint, withdrawal or order can undermine credibility and invite a preliminary maintainability objection. Put the complete history in the chronology and attach the orders.
Mixing remedies without a calculation
List each requested amount or action separately, identify its contractual or statutory basis and show the calculation. A forum cannot evaluate an unexplained total assembled from unrelated demands.
What is not established about cost and speed
The available official material does not provide a current India-wide comparison of filing fees, total legal costs, resolution times or enforcement rates between RERA and Consumer Commissions. Those figures can differ by state, claim, hearing schedule and compliance history. Treat any universal “fastest forum” or “cheapest forum” claim as unverified unless it is tied to your location, date and case type.
Likewise, the Supreme Court’s decision does not promise that a RERA filing will succeed, that a Consumer Commission will reject a complaint, or that either body will award a particular refund. It answers a maintainability question on a specific procedural record.
Three practical examples
Example 1: No prior filing
A buyer has a registered-project dispute, has not filed anywhere and seeks a remedy under the RERA framework. The buyer should verify the project authority, identify the statutory basis, check current forms and deadlines, and file one carefully documented RERA complaint rather than starting parallel proceedings.
Example 2: RERA withdrawal followed by a proposed refiling
A buyer withdraws a refund complaint while stating that it will be filed afresh before RERA. Before approaching a Consumer Commission for the same dispute, the buyer should obtain the withdrawal order and case-specific advice. The Kabra and Associates facts show why the earlier election can control maintainability.
Example 3: Older consumer advice conflicts with current facts
A buyer finds an older article saying RERA does not bar consumer proceedings. That statement cannot replace a review of the buyer’s own filings, relief and orders. The buyer should disclose the RERA history and test jurisdiction and maintainability under the current Supreme Court position.
Where to verify the current process
- RERA: Use the official website and filing instructions of the state or union-territory Real Estate Regulatory Authority that covers the project. Confirm forms, fees, deadlines, service and hearing procedure there.
- Consumer complaints: Read the current Consumer Protection Act, 2019, rules and regulations published by the Ministry of Consumer Affairs, including the jurisdiction rules for District, State and National Commissions.
- Electronic filing: Check the live e-Daakhil portal and the receiving Commission’s instructions. Do not treat the February 2021 rollout description as a current state-by-state availability list.
- Professional advice: If you have filed, withdrawn or received an order in another forum, have an India-qualified real-estate or consumer-law professional review the entire record before a new complaint is submitted.
The practical bottom line
Start with the remedy and jurisdiction, not with a slogan about RERA or consumer court. Preserve the agreement, payment trail, project records and every prior pleading and order. Then choose one route deliberately and disclose the full history. After 4 February 2026, a homebuyer who has already made and documented a forum choice cannot assume that a later Consumer Commission complaint will be available for the same dispute simply because older NCDRC commentary sounded permissive.
