Choose one forum based on the remedy you need and the evidence you can prove. A complaint under the Real Estate (Regulation and Development) Act (RERA) is usually the more direct route for a registered-project dispute about delayed possession, agreed specifications, statutory disclosures, or refund and delay interest. A consumer complaint is often better when you need a broader service-deficiency case involving misleading promises, defective construction, unfair trade practice, compensation and costs.
The Supreme Court has confirmed that RERA does not remove a homebuyer’s consumer-law remedy. You may elect either route, but you should not run parallel proceedings for the same cause of action. Filing strategy matters as much as the forum: identify the precise breach, calculate the relief, check limitation and jurisdiction, and file once in the forum that can grant the order you actually need.

What is the legal choice?
Indian homebuyers generally have two specialist pathways against a builder:
- RERA machinery: a complaint to the state RERA Authority under section 31, with compensation matters assigned to the adjudicating officer under section 71 and appeals to the RERA Appellate Tribunal.
- Consumer commissions: a complaint under the Consumer Protection Act, 2019 before the District, State or National Consumer Commission, selected according to the applicable pecuniary and territorial rules.
These are not two stages of one case. They are alternative remedial systems. In Imperia Structures Ltd. v. Anil Patni, the Supreme Court held that RERA’s section 18 remedy operates “without prejudice to any other remedy available” and that section 79, which bars civil-court jurisdiction over matters assigned to RERA, does not turn a consumer commission into a civil court. The result is a choice of forum, not permission to litigate the same dispute twice.

State rules, filing forms, fees, limitation periods, pecuniary thresholds and execution practice can change. Confirm the current requirements on the relevant state RERA portal and consumer-commission rules before signing and filing a complaint.
When RERA is usually the better fit
Delayed possession, refund and interest
Section 18 directly addresses a promoter’s failure to give possession in accordance with the agreement for sale. If you no longer want the property, the section provides for withdrawal with refund of amounts paid, interest and compensation as applicable. If you remain an allottee and seek the apartment, the statutory remedy is interest for the period of delay, subject to the agreement, applicable rules and the facts proved.
Your claim should identify the contractual possession date, any validly documented extension, the date on which possession was actually offered (if at all), and the calculation period for interest. Do not use a brochure’s general completion estimate when the signed agreement contains a different possession obligation; attach both and explain the conflict.

Agreement, plan and disclosure breaches
RERA is designed for promoter-allottee obligations in a registered project. It is a strong fit where the builder has changed sanctioned plans or promised specifications, failed to make required project disclosures, demanded amounts inconsistent with the agreement, or otherwise failed to perform the statutory and contractual duties that RERA regulates.
Which RERA officer handles the relief?
Section 31 is the entry point for a complaint before the state Authority or the officer designated by state rules. Section 71 assigns adjudication of compensation under sections 12, 14, 18 and 19 to the adjudicating officer. That division matters: frame the prayers so each requested remedy is directed to the forum legally empowered to grant it. An order may be appealed to the RERA Appellate Tribunal and then through the further appellate structure provided by the Act.
When a consumer commission may be the better fit
Deficiency in service and unfair trade practice
A consumer complaint treats the builder as a service provider. It can plead deficiency in housing service, non-delivery, defective construction, misleading advertising or an unfair trade practice. Depending on the proof and the commission’s jurisdiction, the relief may include refund, interest, an order to rectify defects, compensation and litigation costs.

This framing is useful when the central story is not only a missed possession date but also the service you were sold: representations in advertisements, promised amenities, quality failures, repeated non-response, or a pattern of conduct that caused a measurable loss. Preserve the representation and show how it differed from the agreement, sanctioned plan or delivered condition.
Territorial filing after you move
The Consumer Protection Act, 2019 provides territorial options that can include the complainant’s place of residence or work, subject to section 34 and the applicable procedural conditions. A buyer who has relocated should therefore check whether the current residence or workplace gives jurisdiction, rather than assuming the complaint must be filed where the project stands. Keep proof of the address and explain the jurisdictional connection in the pleading.
Compensation for defects and personal impact
For construction defects, attach dated photographs, an engineer’s or architect’s report where available, inspection requests, repair estimates and the builder’s responses. A commission can consider compensation for proven loss and the consequences of deficient service; a request described as “mental harassment” still needs a factual basis linking the builder’s conduct to the harm claimed. Itemise each head of compensation instead of using an unsupported lump sum.

How to decide in five steps
- Write the remedy in one sentence. For example: “I want possession with delay interest,” “I want to exit and recover every payment with interest,” or “I want rectification and compensation for specified defects.” A possession-delay or statutory-compliance remedy usually points first to RERA; a wider service and unfair-practice case may point to a consumer commission.
- Confirm the project’s status. Check the state RERA registration, the registered promoter, the approved plans, the declared completion or occupancy status, and the possession date in your agreement. Save a dated copy of the portal entry and every relevant project document.
- Map each breach to evidence. Separate contractual promises, statutory obligations, advertisement claims, physical defects and payment defaults. If a requested remedy has no document, photograph, expert report or correspondence behind it, narrow the claim before filing.
- Check forum limits. Confirm the RERA Authority/adjudicating-officer allocation, the consumer commission’s current pecuniary jurisdiction, territorial connection, limitation period and filing fee. These are jurisdictional issues, not details to fix after filing.
- Elect one route. State all connected reliefs in the chosen complaint where the forum has power to grant them. Do not file a second case seeking the same refund, delay period or defect compensation while the first remains pending.
Filing a RERA complaint
Prepare the record
- Agreement for sale, allotment letter and application form.
- Payment ledger, bank statements, receipts and demand letters.
- Advertisements, brochures, emails and messages showing promised dates, amenities or specifications.
- Sanctioned-plan or specification documents and any variation notice.
- Possession, completion or occupancy documents, if issued.
- Dated photographs, videos, inspection reports and repair estimates for defects.
- A chronological correspondence file, including your notices and the builder’s replies or silence.
File and frame the prayers
Use the current state RERA portal or prescribed form for a section 31 complaint. Identify the project registration number, parties, agreement date, promised possession date, breach date and the exact sections relied on. If claiming compensation under sections 12, 14, 18 or 19, confirm that the application is directed to the adjudicating officer as required by state procedure. Quantify refund, interest, compensation and costs separately, and attach a calculation sheet whose assumptions are visible.
After the order
Calendar the appeal period and any stay application. If the promoter does not comply, use the state mechanism for execution rather than treating an unimplemented order as the end of the case. Keep proof of service, non-payment and every partial compliance; those records support enforcement and any response to an appeal.

Choose the commission
Use the current pecuniary limits to select District, State or National Commission. Then establish territorial jurisdiction under section 34, including the statutory residence or workplace option where its conditions are met, the builder’s location or the place where the cause of action arose. State the basis in the complaint and attach address evidence.

Build a service-deficiency case
Set out what was promised, what was paid for, what was delivered or omitted, and the loss that followed. Link each allegation to an exhibit: a dated advertisement for a representation, the agreement for a contractual promise, a technical report for a defect, and payment records for the financial claim. Ask for specific directions—refund, possession-related relief, rectification, interest, compensation and costs—rather than a general declaration that the builder acted unfairly.
Observe limitation and appeals
Consumer complaints are subject to statutory limitation. Check the current rule and document why the cause of action is within time or why any delay should be condoned under the applicable provision. Consumer commissions are quasi-judicial bodies intended to offer simple, speedy and inexpensive redressal, but the actual timetable depends on the forum and case. Appeals follow the statutory hierarchy, so preserve the complete record and note every order date.
Can you file both RERA and consumer court cases?
You should not prosecute parallel proceedings for the same cause of action merely to increase pressure. The Supreme Court’s recognition of concurrent remedies means you may choose either system; it does not create a right to duplicate recovery or obtain inconsistent orders. Define the cause of action broadly enough to include the related reliefs you genuinely seek, then elect the forum that can decide them together.

Rajasthan RERA’s official FAQ records that a pending consumer complaint concerning sections 12, 14, 18 or 19 may be withdrawn with the forum’s permission and then taken to the RERA adjudicating officer. That is a procedural route, not an automatic transfer; the relevant commission and state rules control.
Common mistakes and how to avoid them
- Using the brochure date instead of the contractual date: plead the signed agreement date and explain any documented modification.
- Combining every grievance without a remedy: match each allegation to a specific order, amount and exhibit.
- Ignoring the RERA officer split: verify whether the claim is before the Authority or adjudicating officer.
- Assuming relocation solves jurisdiction: residence or workplace filing is subject to section 34 conditions and proof.
- Filing after limitation has expired: calculate the statutory period before sending the complaint; do not rely on ongoing correspondence alone without legal advice.
- Starting a second case after an adverse order: use the correct appeal or execution route instead of repackaging the same cause of action.
- Relying on unsupported defect claims: obtain dated technical evidence and preserve the condition before repairs alter it.
Pre-filing checklist
- Project registration, promoter name and current status verified on the state RERA portal.
- Agreement possession date and every alleged breach identified.
- Refund, interest, rectification and compensation amounts calculated separately.
- Agreement, allotment, payment proof, advertisements and correspondence indexed.
- Defects documented with dates, photographs and technical material.
- RERA Authority versus adjudicating-officer jurisdiction checked.
- Consumer commission pecuniary and territorial jurisdiction checked, including any residence or workplace basis.
- Limitation, filing fee and required forms confirmed under current rules.
- One forum selected; any withdrawal or settlement documented before another proceeding is considered.
- Appeal and execution deadlines entered in a calendar.
What outcome should a homebuyer expect?
No national success-rate, recovery-percentage or universal disposal-time figure applies across Indian RERA authorities and consumer commissions. Outcomes turn on the agreement, project records, proof of payment, technical evidence, limitation and the forum’s jurisdiction. A well-scoped claim in the correct forum is more valuable than parallel filings or an inflated prayer that the evidence cannot support.
