Short answer: Most investors choose among an agency or portfolio mortgage, a privately negotiated loan, and seller financing. The best structure is the one that fits the property’s use and condition, your documented finances, required leverage, closing timetable, compliance obligations, and realistic repayment or sale plan. A low rate is not automatically the cheapest or safest choice if the loan matures before the property can refinance or sell.

Start with the property and the exit

Financing should follow the deal, not the other way around. First identify whether the property will be a long-term rental, a renovation project, a mixed-use asset, or space for your own operating business. Then document its condition, expected income, repair scope, title status, insurance availability, and likely value after work. Those facts determine which lenders can legally and practically lend, how much cash you need, and what underwriting evidence will be persuasive.

As an Amazon Associate I earn from qualifying purchases.

Next model the entire capital stack: purchase funds, closing costs, lender fees, points, repairs, interest during renovation, taxes, insurance, utilities, reserves, and a contingency for overruns. Compare that total with your available cash and the proceeds you could obtain from a conservative refinance or sale. A loan that closes quickly but requires a large balloon payment can be more dangerous than a slower mortgage with a longer amortization period.

Use written term sheets and compare the same assumptions across providers. At minimum, record the interest calculation, points, all fees, loan-to-value (LTV) or loan-to-cost (LTC) limit, lien priority, maturity date, payment schedule, extension rights, guarantees, default remedies, and conditions for funding repair draws.

Agency and portfolio mortgages

What this category includes

Agency mortgages are loans underwritten to rules associated with a housing finance agency and delivered through approved lenders. Portfolio mortgages are retained by a bank or other lender and can use that institution’s own underwriting. Both are lender-originated products; the investor applies through a mortgage lender rather than directly to the agency.

Fannie Mae describes a purchase-money transaction as one in which proceeds finance the acquisition of a property or its acquisition and rehabilitation. That definition does not mean every investor-purpose property qualifies. Eligibility is product-specific and can depend on occupancy, property type, condition, borrower income and assets, reserves, credit history, and the lender’s overlays. Fannie Mae does not originate mortgage loans or lend directly to consumers; it works through mortgage lenders and other partners.

When a mortgage is a good fit

  • The property fits a documented residential or eligible investment-property program.
  • You can provide tax returns, pay records or other income evidence, asset statements, credit documentation, and required reserves.
  • You value a longer amortization period and standardized disclosures over maximum speed.
  • Your projected cash flow can support the payment after applying conservative vacancy, maintenance, taxes, insurance, and management assumptions.

Typical process

  1. Confirm eligibility. Ask an approved lender to verify occupancy rules, property type, condition standards, maximum units, reserve requirements, and any investor-property overlays before ordering an appraisal.
  2. Submit documentation. Provide identification, income and asset records, debt information, a purchase contract, insurance details, and an explanation of the intended use.
  3. Underwrite the borrower and property. The lender reviews credit, debt obligations, liquidity, appraisal, title, insurance, and—in programs that use it—rental income or a property cash-flow calculation.
  4. Clear conditions and close. Resolve appraisal, title, insurance, repair, and documentation conditions. Confirm the final cash-to-close and reserve balance rather than relying on an initial estimate.

Advantages and limits

Standardized underwriting can produce predictable disclosures, a payment schedule, and potentially long-term amortization. The trade-off is less flexibility. A property needing major repairs, with unusual construction, uncertain insurance, or weak documentation may not satisfy the program even when the underlying investment could be profitable. The lender’s current guide and overlays control, so obtain written confirmation instead of assuming that an agency rule guarantees approval.

Private-money loans

How private money works

Private money is capital from an individual, fund, or other non-bank source under terms negotiated for a particular transaction. It is not one standardized product. The lender may focus on the property’s collateral value and exit plan, the borrower’s experience, or a combination of those factors. Flexibility can allow a purchase or renovation that a conventional lender would decline, but it also shifts more responsibility for documentation and risk analysis to the parties.

Terms to compare in every private term sheet

Term What to verify Why it matters
Interest and points Rate type, day-count method, points, lender and broker fees, and when each fee is earned A low headline rate can be outweighed by points, minimum interest, or large fees.
Leverage Maximum LTV or LTC, whether value is based on current or completed condition, and required borrower cash More leverage reduces initial cash but increases payment and loss exposure.
Term and payments Maturity, amortization, interest-only period, payment dates, minimum interest, and balloon amount A short maturity creates refinance or sale risk even when monthly payments are manageable.
Draws Inspection standards, documentation, timing, retainage, and who pays inspection costs Delayed draws can stop a renovation or force you to supply unplanned cash.
Security First- or junior-lien position, personal guarantee, cross-collateralization, assignments, and title requirements Priority determines who is paid first after a default; guarantees can expose personal assets.
Default and extension Late charges, default rate, cure period, extension fee, foreclosure rights, and any deficiency claim These provisions determine the cost and available time if the exit slips.

Private-lender due diligence

  • Verify the lender’s legal identity, authority to lend, funding source, and track record in the relevant property type and jurisdiction.
  • Request a complete written term sheet and draft loan documents before paying nonrefundable fees.
  • Have an independent real-estate attorney review the note, mortgage or deed of trust, guaranty, assignment documents, and default language.
  • Confirm the lien will be recorded correctly, title insurance will show the agreed priority, and all existing liens will be released or subordinated as documented.
  • Ask how interest is calculated, whether unused construction funds accrue interest, and whether the lender can change draw conditions unilaterally.
  • Stress-test the exit using a lower sale price, slower lease-up, higher repair costs, and a delayed refinance. If the loan fails under modest stress, reduce leverage or add a backup source of capital.

Private money should be treated as a secured, enforceable transaction—not an informal favor. The IRS’s 2025 Schedule E instructions distinguish qualified nonrecourse financing from seller financing. A qualified person is someone who actively and regularly lends money, such as a bank or savings and loan association; the property seller is excluded from that definition. This is a tax-classification distinction, not a blanket endorsement of any private lender or loan structure.

Seller financing

Basic structure

With seller financing, the seller becomes the creditor instead of receiving all sale proceeds from a bank at closing. The buyer signs a promissory note, and the debt is secured by a mortgage or deed of trust recorded against the property. The documents should state the principal, interest method, payment schedule, maturity, late charges, prepayment treatment, insurance and tax obligations, servicing arrangements, and remedies after default.

Seller financing can solve a timing problem, a property-condition issue, or a qualification gap. It may also allow a negotiated down payment or amortization schedule. Those benefits do not eliminate underwriting: both parties should verify value, title, insurance, taxes, environmental or habitability concerns, and the buyer’s ability to make payments.

Federal seller-financer conditions

Consumer Financial Protection Bureau Regulation Z section 1026.36 describes different conditions for a natural person, estate, or trust financing one property and for a seller financing three or fewer properties in a 12-month period. The three-property safe harbor requires fully amortizing financing, a good-faith and reasonable ability-to-repay determination, and a fixed rate or an adjustable rate that is limited in the manner specified by the rule. The one-property condition prohibits negative amortization and likewise requires a fixed rate or a properly limited adjustable rate.

These are federal conditions, not a substitute for state-law analysis. Licensing, usury limits, disclosure duties, servicing rules, foreclosure procedures, recording requirements, and landlord-tenant obligations can vary by state. Use a qualified real-estate attorney and settlement or servicing professional before signing or accepting payments.

Why contract-for-deed arrangements require special care

In a contract for deed, the seller may retain legal title while the buyer makes installments and takes possession. The CFPB stated on August 13, 2024 that contracts for deed are covered by federal home-lending protections. The agency warned: “The deals often have little oversight, and investment groups and other sellers can set a series of traps that leave buyers in unlivable homes, on the hook for tax liens and expensive repairs, and at risk of losing their down payments and homes.” Treat any deed-retention structure as a mortgage-protection and consumer-law issue, not as an informal workaround. Confirm who holds title, who pays taxes and insurance, how repairs are authorized, what happens after a missed payment, and whether state law requires foreclosure rather than simple forfeiture.

Why an SBA loan usually is not a rental-property solution

SBA programs support operating businesses, not ordinary speculation in rental housing. Current SBA lender guidance states that 7(a) loans can be as large as $5 million, with terms negotiated between borrower and lender and generally 10 years or less unless the financing covers real estate or equipment with a useful life exceeding 10 years. The SBA 504 program states that speculation or investment in rental real estate is ineligible.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Therefore, do not present an SBA loan as a normal way to buy a rental property for investment. Owner-occupied real estate used by an operating business is a separate analysis: the business must meet the program’s eligibility rules, occupy the required portion, demonstrate repayment ability, and satisfy the lender’s documentation and collateral requirements.

Compare the three structures by decision criteria

Criterion Agency or portfolio mortgage Private money Seller financing
Qualification Documented borrower income, credit, assets, reserves, and property eligibility Negotiated mix of borrower experience, collateral, value, and exit plan Negotiated, but ability to repay, disclosures, and applicable safe-harbor conditions still matter
Cash required Down payment plus closing costs, reserves, and any required repairs Down payment, points, fees, repair equity, and contingency capital set by the lender Negotiated down payment and closing costs, plus reserves and repair funds
Speed Appraisal, underwriting, title, insurance, and condition clearance can lengthen closing Can be faster, but draw, title, and legal review still require time Can be efficient when seller and buyer agree, but documentation and compliance cannot be skipped
Payment and term Often standardized amortization and disclosures Frequently interest-only or shorter-term with a balloon; entirely document-specific Negotiated amortization, rate, maturity, and possible balloon
Security and recourse Recorded mortgage with lender-specific guarantees and remedies Lien priority, guarantees, and cross-collateralization require close review Mortgage or deed of trust, or a deed-retention structure with additional legal risk
Primary risk Rejection because the property or documentation misses a rule or overlay High cost, short maturity, aggressive remedies, or unreliable draws Defective documents, tax and insurance failures, ability-to-repay issues, or contract-for-deed forfeiture

A practical financing decision sequence

  1. Classify the use. Separate long-term rental, renovation-and-sale, mixed-use, and owner-occupied business cases. Do not assume a program for one use applies to another.
  2. Inspect condition and title. Obtain a professional inspection, identify required repairs, verify insurability, review title and liens, and confirm zoning and permitted use.
  3. Build a conservative budget. Include purchase price, closing costs, points, interest, taxes, insurance, utilities, management, repairs, reserves, and a contingency. Model vacancy and schedule delays.
  4. Set a maximum safe loan amount. Calculate both LTV and LTC where relevant. Keep enough liquidity to finish the project and make payments during a delayed exit.
  5. Get comparable written proposals. Request term sheets from qualified mortgage lenders and private sources. For seller financing, exchange a draft note and security instrument early enough for legal review.
  6. Analyze the exit. Underwrite a refinance, sale, or stabilized cash-flow hold using conservative value, rent, rate, and timing assumptions. Identify a backup if the primary exit fails.
  7. Close with independent review. Confirm title recording, insurance, tax escrows, servicing instructions, draw procedures, and every condition precedent before funds are released.

Costs investors commonly underestimate

  • Financing charges: interest, points, underwriting, appraisal, inspection, broker, wire, document, and servicing fees.
  • Time-related costs: extension fees, default interest, minimum-interest provisions, additional insurance, taxes, utilities, and vacancy during delays.
  • Capital-gap costs: repair overruns, reserve requirements, retainage on draws, and the need to fund work before reimbursement.
  • Exit costs: refinance fees, sale commissions, transfer taxes, prepayment penalties, and taxes on disposition.
  • Legal and compliance costs: attorney review, title work, recording, required disclosures, servicing setup, and state-specific licensing or usury analysis.

Compare total dollars paid through the planned exit, not just the nominal interest rate. A private loan with points and a six-month extension can cost more than a conventional mortgage even if its initial closing is faster. Conversely, a mortgage that cannot fund the property’s condition may create expensive delay or a failed purchase.

Warning signs and recovery steps

Warning signs before signing

  • The lender will not provide a complete term sheet or draft documents.
  • The note permits unilateral changes to the rate, draw conditions, collateral, or maturity.
  • The agreement relies on a balloon payment without a documented refinance or sale path.
  • Lien priority, guaranties, cross-collateralization, or deficiency rights are unclear.
  • A seller proposes a contract for deed while avoiding title, tax, insurance, habitability, or ability-to-repay review.
  • Fees are due before the lender identifies its legal entity, funding conditions, or refund policy.

If the deal is already under stress

  1. Notify the lender or seller early and request a written forbearance, extension, or modification proposal before a payment is missed.
  2. Prepare updated construction costs, rent or sale evidence, a current appraisal if available, and a credible source-and-use statement.
  3. Preserve insurance, tax payments, permits, and property maintenance; allowing these to lapse can trigger default or destroy collateral value.
  4. Have counsel review any notice of default, acceleration, deed transfer, release, or settlement before signing.
  5. Evaluate a sale, supplemental equity, refinance, or orderly payoff against the documented foreclosure timeline and potential deficiency exposure.

Investor closing checklist

  • Property use, condition, zoning, insurance, title, and lien status verified.
  • Borrower income, credit, liquidity, reserves, and entity documents assembled where required.
  • Purchase price, repairs, carrying costs, fees, contingency, and exit assumptions modeled conservatively.
  • Written term sheet reconciled to the final note, mortgage or deed of trust, guaranty, and settlement statement.
  • LTV/LTC, lien priority, draw process, maturity, extension rights, default remedies, and prepayment terms understood.
  • Regulation Z, ability-to-repay, state licensing, usury, disclosure, servicing, and tax questions reviewed by qualified professionals.
  • Backup capital or an alternative exit identified before closing.

The financing choice is sound only when the property, documents, capital requirements, and exit work together. Agency or portfolio debt favors documented borrowers and eligible properties; private money favors negotiated flexibility but demands rigorous term and collateral review; seller financing can bridge a gap but carries substantial documentation and compliance responsibility. Choose the structure you can repay under a conservative scenario, not merely the one that gets you to closing.
