Questions to Ask Before Accepting a Down Payment Assistance Loan

Before accepting down payment assistance (DPA), find out exactly what you are receiving, what secures it, when repayment can be demanded, and how the obligation changes your monthly budget and future plans. A program described as “assistance” may be a grant, a forgivable loan, a deferred-payment second mortgage, or a second loan with scheduled payments. Only the written note, security instrument, program agreement, and current rules for your location determine which one you have.

Start by identifying the legal form of the assistance

Ask the lender or program administrator to name the product in precise legal terms. The Consumer Financial Protection Bureau (CFPB) explains that local nonprofit and government organizations sometimes offer a second mortgage on special terms to replace part of a down payment. HUD training commonly describes this arrangement as a “soft second” mortgage, but programs differ substantially.

Type What it generally means Questions that determine your obligation
Grant Funds that normally do not have to be repaid, subject to the program’s conditions. Is there any repayment trigger, recapture clause, income rule, occupancy requirement, or lien despite the grant label?
Forgivable loan A loan balance is reduced or eliminated only after you satisfy stated conditions for a defined period. What is the forgiveness schedule, and what happens if you sell, refinance, transfer title, move out, default, or stop using the home as your primary residence?
Deferred-payment second mortgage Payments may be postponed, but the principal can remain due later. Does interest accrue? When is the balance due? Is repayment triggered by sale, refinance, maturity, or another event?
Repayable second mortgage A junior lien with scheduled payments or a lump-sum payoff requirement. What are the rate, payment amount, term, fees, late charges, and payoff rules?

Do not treat “deferred” as synonymous with “forgiven.” A deferred balance can remain fully payable. Likewise, a zero-interest loan is still debt if the principal must eventually be repaid.

Request every document before signing

  • The promissory note showing the principal, interest, payment terms, maturity, and default provisions.
  • The subordinate mortgage, deed of trust, or other security instrument that creates the lien.
  • The program agreement describing eligibility, occupancy, forgiveness, recapture, and repayment conditions.
  • A fee disclosure and written payoff examples for a sale or refinance at realistic dates.
  • Any first-mortgage disclosures that show how the assistance changes the loan amount, rate, mortgage insurance, and cash required at closing.

Read the documents together. A marketing description may use a simple label while the note or lien instrument contains the enforceable terms.

Ask exactly how repayment and forgiveness work

Interest, accrual, and payment start

Ask whether interest is charged from closing, accrues without monthly payments, or is expressly 0%. Ask when payments begin and whether the first payment can be postponed until a date, sale, refinance, transfer, default, or payoff of the first mortgage. Regulation Z section 1026.3(h) recognizes a narrow partial disclosure exemption for certain subordinate-lien homebuyer assistance loans with specified no-interest, forgiveness, deferral, and fee conditions. That provision does not make all DPA loans interest-free or deferred; the contract must state the applicable terms.

Forgiveness schedule and remaining balance

Determine whether forgiveness occurs incrementally or all at once. Ask for the exact date on which each portion is forgiven and how a partial year is treated. If an event occurs before full forgiveness, ask whether the entire original principal, the unforgiven balance, or a formula tied to the home’s value is due.

Events that can accelerate repayment

Have the administrator identify every trigger in plain language. Common contract triggers can include:

  • Selling the property.
  • Refinancing the first mortgage or taking another lien.
  • Transferring any ownership interest.
  • Moving out or no longer using the home as your primary residence.
  • Foreclosure, payment default, or failure to meet another loan condition.
  • Paying off the first mortgage early.

Ask whether a permitted refinance, divorce-related transfer, estate transfer, disability, military move, or other hardship receives an exception. Never rely on an oral assurance that a future refinance will be allowed; request the exception in writing.

Get a written payoff calculation

Request a calculation for a sale or refinance after one, three, and five years, or the intervals that match your likely plans. The statement should show principal remaining, accrued interest if any, fees, forgiven amounts, and the date through which the figure is valid. Ask how quickly the administrator can issue an updated payoff when you have a purchase contract or refinance approval.

Understand the lien and the risk to your home

CFPB defines a second mortgage or junior lien as a loan secured by your house while another loan is already secured by it. The DPA lender generally has a claim behind the first mortgage. If the home is sold to settle debts, the first mortgage is paid before the junior lien. If the sale proceeds do not cover both balances and costs, the second-lien lender may not recover everything; your contract and state law determine whether you remain personally liable for a shortfall.

Because the home is collateral, failure to satisfy a loan secured by it can put the property at risk. Ask whether the DPA lien is recorded, whether it is a fixed amount or a percentage of appreciation, and what document releases it after payoff or forgiveness. Confirm who must sign a release and how long recording typically takes, because an unreleased lien can delay a later sale or refinance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions about lien priority and future borrowing

  • Is the DPA lien subordinate to the first mortgage, and must a future lender approve any refinance?
  • Can you obtain a home-equity loan, second lien, or renovation loan while the assistance lien remains?
  • Does a refinance require the DPA balance to be paid in full, and are there approved-subordination procedures?
  • Is the balance fixed, interest-bearing, or linked to the property’s value or appreciation?

Verify eligibility and continuing conditions

Eligibility is program-specific. HUD’s training example lists household income and size, credit score, location, purchase price, property type, primary-residence occupancy, education, and use of a participating lender or pre-approval. Those are examples of criteria a program may use, not universal thresholds.

Ask what is checked before closing

  • Maximum household income and how income is calculated, including bonuses, overtime, self-employment, or adult household members.
  • Household-size definitions and documentation requirements.
  • Minimum credit score, debt-to-income limits, and first-mortgage product rules.
  • Eligible counties, municipalities, census areas, purchase prices, and property types.
  • Whether the home must be your principal residence and how soon you must occupy it.
  • Whether the program is limited to first-time buyers or allows repeat buyers under stated exceptions.
  • Required lender, title company, closing agent, inspection, or appraisal.

Ask what can change after closing

Some obligations continue for years. Ask whether a change in household income, ownership, occupancy, tenancy, insurance, taxes, or first-mortgage status can affect forgiveness or trigger repayment. Find out how to report a move, a transfer, or a change in household composition and whether missing a notice deadline has consequences.

Clarify education and counseling

Ask who must complete homebuyer education or counseling, which providers qualify, the completion deadline, the format, and any fee. HUD’s HOME program requires counseling for a homebuyer who enters a written agreement for HOME assistance, such as down-payment or closing-cost assistance, or a sales contract for a HOME-assisted unit. HUD says required counseling must be delivered by HUD-certified counselors working for an agency approved to participate in its Housing Counseling program. Confirm whether your assistance uses HOME funds and ask the administrator for the current approved-agency process.

Calculate the full cost, not just the cash you receive

Borrowing a down payment can reduce cash needed at closing while increasing total debt and monthly obligations. Ask the first-mortgage lender for a side-by-side estimate that includes the first mortgage and the assistance loan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Cost or feature What to request
Cash at closing Down payment, closing costs, prepaid items, required reserves, and any contribution you still must provide.
First-mortgage payment Principal, interest, mortgage insurance, taxes, homeowners insurance, and association dues where applicable.
DPA payment Monthly payment, deferred amount, interest accrual, servicing fee, and payment-change rules.
Up-front and ongoing fees Origination, recording, counseling, application, servicing, late, or payoff fees, with the party receiving each fee.
Future payoff Amount due after likely sale or refinance dates, including any unforgiven principal or appreciation share.
First-mortgage effects Loan amount, interest rate, mortgage-insurance cost, term, and underwriting conditions with and without assistance.

Then compare the obligation with alternatives such as a gift that complies with first-mortgage rules, saving longer, a different assistance program, or a mortgage option that requires more cash but creates no second lien. CFPB notes that down-payment money can come from several sources and that borrowing it increases debt and monthly payments. A lower cash requirement is not automatically the lowest-cost choice.

Use a consistent framework when comparing offers

If more than one program is available, put the offers in one worksheet and compare the same fields. Mark “not stated” when a provider has not supplied a term; do not assume the most favorable interpretation.

  1. Record the assistance amount and the date the offer expires.
  2. Enter the interest rate, fees, whether interest accrues during deferral, and the payment schedule.
  3. Map the forgiveness amount and date for each period.
  4. List every repayment trigger, occupancy rule, transfer restriction, and lien-release condition.
  5. Check income, credit, location, purchase-price, property-type, first-mortgage, and education requirements.
  6. Calculate the combined monthly cost and total debt at closing.
  7. Insert payoff balances for the sale or refinance dates you are considering.
  8. Ask each provider to confirm differences in writing before choosing.

What the HUD training example shows—and what it does not prove

HUD Housing Counselors Training Module 2.2 describes a fictional sample Metropolitan Affordable Homeownership Assistance Program with $10,000 of 0% soft-second assistance. In that example, 20% is forgiven each year for five years. A prorated balance is due if the home is sold, refinanced, foreclosed, is no longer owner-occupied, or title transfers during the five-year period. The guide’s footer reports a last update of September 2022, while its file name identifies a 2025 module revision.

Those figures illustrate how a contract can work; they are not a national schedule or promise that another program offers 0% interest, five-year forgiveness, or the same triggers. Ask your administrator to show your actual schedule and formula. Also do not confuse the 20-year deferral condition mentioned in Regulation Z section 1026.3(h) with a standard DPA term. It is one criterion in a narrow regulatory exemption, not a general repayment period. The same provision describes an exemption condition under which bona fide, reasonable application and housing-counseling fees total less than 1% of the credit extended; that percentage does not apply to every assistance loan.

Complete a final review before signing

Documents and numbers

  • You have copies of the note, lien instrument, program agreement, fee disclosures, and first-mortgage disclosures.
  • The principal, interest treatment, forgiveness schedule, maturity, and payoff formula match the written offer.
  • You know the combined monthly payment and the cash you must bring to closing.
  • You have written payoff examples for an early sale and refinance.

Restrictions and contingencies

  • You can satisfy the occupancy period and understand how a move or rental affects the lien.
  • You know whether a refinance, title transfer, divorce, estate plan, or additional lien needs prior consent.
  • You have completed required education or counseling, or have a documented deadline and approved provider.
  • You know whom to contact for payoff figures, servicing questions, and lien release.

Independent explanation

If a clause is unclear, pause the signing. Ask an independent housing counselor or another qualified professional to explain the actual documents and the rules in your location. The program administrator can explain its procedures, but you should not assume that a sales representative’s summary overrides the signed contract.

Bottom line: accept assistance only when the future obligation is clear

DPA can solve a short-term cash problem, but it may add a lien, monthly debt, occupancy restrictions, and a repayment bill when you sell or refinance. Proceed only after you can state, in your own words, what is forgiven, what remains payable, which events accelerate repayment, and how the combined cost fits your budget under both a normal ownership period and an early move. The governing contract and current local program rules—not the phrase “down payment assistance”—control the result.
