Property tax and mortgage escrow FAQs: refunds, payment changes, and timelines

Short answer: Your mortgage payment can change when projected property taxes or insurance premiums change, or when an escrow shortage must be repaid. An annual escrow analysis can produce a surplus, shortage, or deficiency. Under federal Regulation X, a qualifying surplus of at least $50 is generally refunded within 30 days after the analysis if you are current. Escrow left after a full mortgage payoff is a separate event and is generally returned within 20 days, excluding weekends and legal public holidays. A refund from your county or city follows local rules, not those federal escrow deadlines.

What is an escrow or impound account?

An escrow account is a reserve your mortgage servicer maintains to pay recurring property expenses. Most commonly, the account covers real estate taxes and homeowners insurance. Each month, part of your mortgage payment goes into escrow; the servicer later disburses the money to the taxing authority or insurer when bills are due.

Your payment statement normally separates principal, interest, escrow, and other charges. When a tax bill or insurance premium changes, the escrow portion can change even though the loan’s interest rate and principal schedule have not. A payment increase therefore does not automatically mean your principal-and-interest payment changed. Read the itemized statement to identify which component moved.

Federal escrow requirements apply to covered mortgage loans and contain exceptions. Your loan documents, escrow statement, and the laws governing your property can affect the result.

Why did my monthly mortgage payment go up or change?

The servicer projects the coming year’s escrow bills and the balance needed to pay them on time. It then sets a monthly deposit. A higher property-tax assessment, a new tax rate, a higher insurance premium, or an existing escrow shortage can raise that deposit and your total payment.

Higher property taxes or insurance

If the projected tax or insurance bill is larger than last year’s bill, the servicer collects more each month so the account will have enough for the next disbursement. Check whether the analysis lists the actual bill amount, the date it expects to pay, and the amount previously paid.

Repaying an escrow shortage

A shortage means the current escrow balance is below the target balance required by the analysis. The servicer may increase future deposits to rebuild the account and may also collect the shortage over time. That combination can make the payment jump even when the new tax or insurance bill is only modestly higher.

A change unrelated to escrow

Adjustable-rate changes, changes in mortgage insurance, late charges, or other loan terms can also alter the total. Compare every line of the statement rather than assuming a tax change affected principal and interest.

If the reason is unclear, ask the servicer for the complete escrow analysis and compare its projected disbursements with your tax bill and insurance renewal notice. The Consumer Financial Protection Bureau (CFPB) advises borrowers to review the mortgage statement and contact the servicer when the explanation does not make sense.

What the annual escrow analysis and statement show

For a covered escrow account, the servicer generally performs an analysis once during each computation year. The analysis compares the account’s history and current balance with projected expenses, then sets the next year’s deposits. The annual statement generally arrives within 30 days after the computation year ends, subject to regulatory exceptions.

Look for:

  • Beginning and ending escrow balances.
  • Each deposit credited to the account.
  • Each tax and insurance disbursement, with the projected date and amount for the coming year.
  • The target balance and any permitted cushion.
  • An explanation of a surplus, shortage, or deficiency and how the servicer will handle it.
  • The new monthly escrow amount and the date the new total payment begins.

The annual statement’s timing is different from the timing of a refund. The 30-day statement deadline runs from the end of the computation year; a surplus-refund deadline runs from the date of the analysis.

Escrow surplus, shortage, and deficiency: what each term means

Surplus

A surplus is the amount by which the escrow balance exceeds the target balance at analysis. If the surplus is at least $50 and you are current under the applicable rule, the servicer generally must refund it within 30 days after the analysis. A surplus below $50 may be refunded or credited toward the next year’s escrow payments.

Shortage

A shortage is an account balance below the target balance, without the account being negative. For a current borrower, CFPB guidance describes several permitted treatments. If the shortage is less than one monthly escrow payment, the servicer may leave it in the account, collect it within 30 days, or spread repayment over at least 12 months. If it is at least one monthly escrow payment, the servicer may leave it in place or spread repayment over at least 12 months. Your statement should identify the method used; the options are not a guarantee that you can select any one treatment in every case.

Deficiency

A deficiency means the escrow account has a negative balance. It indicates that disbursements exceeded the money available. The statement should explain the deficiency and the repayment method. Contact the servicer promptly if the negative balance resulted from a payment or posting error.

When should an escrow surplus refund arrive?

For a qualifying annual-analysis surplus of at least $50, the federal refund clock generally starts on the date the servicer completes the analysis, not when you first notice a changed payment or receive the statement. The servicer generally must send the refund within 30 days, provided you are current as required by the rule.

For a surplus under $50, the servicer may send a check or apply the amount as a credit to future escrow payments. The statement should tell you which treatment it is using. If the payment is delinquent or another regulatory exception applies, the standard refund treatment may differ.

Keep the statement and the check or credit record. If 30 days have passed after the analysis and no refund or credit appears, ask the servicer to identify the analysis date, surplus amount, and delivery method. Escalate in writing if the response does not resolve the discrepancy.

What happens to escrow after I pay off the mortgage?

Payoff is a separate refund event from the annual analysis. When the mortgage is paid in full, escrow funds still within the servicer’s control generally must be returned within 20 days, excluding Saturdays, Sundays, and legal public holidays. The rule has qualifications and exceptions, so confirm the payoff date and the servicer’s final accounting.

The 20-day payoff clock does not replace the 30-day annual-surplus clock. A borrower could receive a payoff-related balance at a different time from an annual statement or annual surplus check, depending on when the loan was paid and how the servicer closes the account.

Escrow refund versus property-tax refund

Use the terms precisely because the money comes from different organizations and follows different rules.

Refund type Who sends the money Trigger Timing Tax-return consideration
Annual escrow surplus Mortgage servicer Annual escrow analysis finds a surplus of at least $50, generally while the borrower is current Generally within 30 days after analysis It changes the escrow balance; its tax effect depends on what the money represents and your tax circumstances
Payoff escrow balance Mortgage servicer Mortgage paid in full Generally within 20 days, excluding Saturdays, Sundays, and legal public holidays Usually a return of your own escrow funds; retain the final accounting
Property-tax refund or rebate City, county, or other taxing authority Local reassessment, overpayment, appeal, exemption, or other local adjustment No single nationwide schedule; state and local procedures control May require a deduction adjustment or income inclusion depending on the year and tax benefit

A local tax refund is not proof that the servicer issued an escrow refund. You may receive one, the other, or both, at different times. Check the issuer’s name and the explanation on the notice or payment.

How property-tax refunds affect federal taxes

IRS Publication 530 (2025) explains that homeowners generally deduct real estate taxes paid to the taxing authority, including amounts the lender actually paid from escrow, rather than every dollar deposited into escrow. Depositing money into escrow is not itself the same as paying the tax for deduction purposes.

If you receive a refund or rebate for taxes paid in the current year, the deduction generally must be reduced by the refunded amount. A refund of a prior year’s taxes may require some or all of the refund to be included in income if the earlier deduction produced a tax benefit. The result depends on your filing history, deduction method, and the specific refund.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the tax authority’s notice, the servicer’s escrow statement, and proof of the tax payment. For an individual filing decision, check the current IRS instructions for the relevant tax year or consult a qualified tax professional; the 2025 publication is not a substitute for later-year guidance.

What should I do if the tax authority says my taxes are unpaid?

Act quickly. A missed property-tax payment can lead to penalties, interest, collection action, or a tax lien even when your mortgage payment included escrow. The CFPB recommends contacting the servicer promptly and sending the tax bill with a notice of error when appropriate.

  1. Verify the notice. Call the taxing authority using contact information on its official bill or website. Confirm the parcel, tax period, amount due, deadline, and whether a payment was received but not posted.
  2. Contact the servicer’s escrow department. Ask when and how much it disbursed, the check or electronic-payment reference, and whether the payment was returned.
  3. Send documents in writing. Provide the bill, delinquency notice, payment history, and any proof from the tax authority. Use the servicer’s designated address for notices of error if one is listed on your statement.
  4. Protect the deadline. Ask the tax authority what prevents penalties or a lien while the servicer investigates. Do not assume the dispute pauses collection.
  5. Preserve a complete file. Keep copies of the bill, escrow analysis, monthly statements, correspondence, call notes, delivery confirmations, and receipts for any direct payment.

If the servicer failed to pay on time, a penalty is assessed, or you receive foreclosure or other legal papers, seek legal advice or a HUD-approved housing counselor promptly. A direct payment may protect the property, but ask how it will be credited and whether the servicer will reimburse an amount it should have paid.

How to check whether a payment increase is correct

  1. Compare two statements. Put the old and new monthly statements side by side and mark changes to principal, interest, escrow, mortgage insurance, fees, and past-due amounts.
  2. Match projected bills to real bills. Compare the analysis’s tax amount and due date with the latest county or city bill. Do the same for the insurance declarations page and renewal premium.
  3. Recalculate the annual deposits. Add projected tax and insurance bills, divide by 12, and compare that result with the listed monthly escrow deposit. Account for any allowed cushion and any shortage repayment.
  4. Check the analysis date. Use it to determine when a surplus refund deadline begins; the date you opened the mail is not the controlling date.
  5. Request clarification in writing. Ask for the account ledger, disbursement history, target-balance calculation, and the reason for each changed line.

Do not stop paying the undisputed mortgage amount while investigating. If the servicer’s records conflict with the tax authority’s records, ask both parties to reconcile the parcel number, tax period, payment date, and posting status.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Which deadlines apply to which event?

Event General rule What controls in practice
Annual escrow statement Generally within 30 days after the escrow computation year ends, after the analysis, with specified exceptions The servicer’s computation-year dates and the statement delivered for your loan
Annual surplus of at least $50 Generally refunded within 30 days after analysis if the borrower is current Analysis date, current status, and any applicable exception
Surplus below $50 May be refunded or credited to the next year’s escrow payments The treatment disclosed on the annual statement
Escrow remaining after full payoff Generally returned within 20 days, excluding legal public holidays, Saturdays, and Sundays Payoff date, funds still under servicer control, and regulatory exceptions
Tax disbursement Servicer must pay on or before the deadline to avoid a penalty, subject to the rule’s conditions Local bill due date and the taxing authority’s posting rules
Local tax assessment or refund No single national deadline under federal escrow rules State law and the specific assessor or tax collector

When to escalate an escrow problem

Escalate when the servicer will not explain a calculation, a required refund is late, a tax payment was not made, or the account ledger does not match your records. Start with a written request that identifies the loan, property, disputed transaction, dates, and the correction you seek. Attach only copies and keep the originals.

For urgent tax-lien, foreclosure, or legal-document issues, do not wait for a routine complaint cycle. Contact a lawyer or HUD-approved housing counselor. Federal servicing protections are important, but they do not erase local tax deadlines or replace individualized legal and tax advice.

Practical records checklist

  • Annual escrow analysis and statement.
  • At least one year of mortgage statements and payment history.
  • Property-tax bills, receipts, appeal decisions, and refund notices.
  • Insurance declarations pages and renewal invoices.
  • Servicer correspondence, notice-of-error submissions, and delivery proof.
  • Tax-return worksheets showing real estate taxes claimed and any refund received.

These records let you identify whether money came from the servicer or the taxing authority, establish the applicable date, and support a correction request or tax filing.
