Professional liability and general liability insure different allegations. Professional liability (often called errors and omissions, or E&O) is aimed at claims that a designer’s professional services contained a covered error, omission, negligence, or failure to meet a professional standard. General liability (GL) is aimed primarily at third-party bodily injury or property damage arising from business operations or premises, and may also include personal or advertising injury coverage.
A project-related dispute is not automatically a professional-liability claim. The activity, the alleged cause of loss, the policy wording, and the client contract all matter. A design firm that gives professional advice and also operates an office, visits jobsites, handles client property, or uses subcontractors can have exposures in both categories. This US-oriented guide explains the dividing line and a practical way to compare the policies without assuming either one covers every project risk.

The difference in one view
| Comparison point | Professional liability (E&O) | General liability (GL) |
|---|---|---|
| Typical allegation | A covered mistake, omission, negligence, or failure in professional services | Third-party bodily injury or property damage connected with premises or business operations; some policies also address personal or advertising injury |
| Designer example | A client alleges that incorrect specifications, advice, or design coordination caused rework or financial loss | A visitor slips in the office, or a designer accidentally damages a client’s property during a site visit |
| Main coverage question | Did the allegation arise from a covered professional service, and when was the claim made and reported under the policy? | Did the injury or property damage arise from covered premises or operations, and does an exclusion apply? |
| Contract issues | Definition of professional services, limits, exclusions, retroactive date, and any extended-reporting provision | Required limits, additional-insured wording, premises/operations scope, and certificates or other proof of insurance |
| Important limitation | It is not automatically an accident policy for ordinary office or jobsite incidents | It should not be assumed to cover professional errors or pure economic loss when there is no covered bodily injury or property damage |
The Hartford, RLI, Travelers, and design-risk guidance from PLAN describe these as separate categories. Their descriptions help explain how the products are structured, but an individual policy’s definitions, endorsements, exclusions, limits, and claim facts control the result.
What professional liability covers for a designer
The allegation has to concern professional work
Professional liability follows the alleged failure in the service you were hired to provide. Depending on the policy’s definition, that can include design, specifications, advice, coordination, technical judgment, or another listed professional service. A client might allege that a drawing contained an error, a specification omitted a necessary requirement, advice was negligent, or coordination failed and caused project loss. The fact that a designer was paid for the work does not by itself establish coverage; the service must fall within the policy wording and the other conditions must be satisfied.

Financial loss can be central
Many design disputes involve rework, delay, corrective construction, or other financial consequences rather than a person being hurt or property being physically damaged. Those allegations are commonly associated with professional liability. Whether defense costs or damages are covered depends on the policy form, exclusions, deductible or retention, limits, and the facts alleged. Do not treat the word “error” in a complaint as an automatic coverage trigger; the insurer will analyze the actual professional-services allegation.
Disciplines and services must be identified accurately
RLI’s design-professional materials list multiple design disciplines. A firm should describe the work it really performs, not a narrower service that happens to produce a lower premium or a simpler application. If your practice expands into new technical work, project coordination, consulting, or another discipline, ask whether the policy’s professional-services definition and endorsements still fit before accepting the assignment.
What general liability covers for a designer
Operations and premises are the focus
General liability generally responds to third-party bodily injury or property damage connected with your premises or business operations. A visitor who slips in the studio, a client whose equipment is accidentally damaged during a visit, or another person injured by an operational hazard are the kinds of events commonly associated with GL. Policies may also include personal or advertising injury coverage, but the exact grants and exclusions must be read in the policy.
GL is not a substitute for E&O
If a client claims that your professional judgment produced an unusable design and seeks the cost of redesign, that is not automatically a GL claim. General liability should not be assumed to cover a professional error or a purely economic loss when no covered bodily injury or property damage is alleged. Some fact patterns contain both types of allegations, so the claim may need to be reported under every potentially responsive policy rather than assigned by label alone.

Why a design firm may need both policies
Professional services and ordinary operations create different exposures. A firm can perform competent design work yet still have a visitor fall in its office. It can also maintain a safe office while a client alleges that a specification caused expensive rework. One policy category is not a broader version of the other.
Joseph Jones, Travelers’ Director of Risk Management for Professional Liability, states: “Traditional business insurance does not cover the risk design professionals have when providing professional services.” That is an insurer representative’s explanation of the distinction, not a legal conclusion about any particular policy. The practical point is to match each exposure to the actual insuring agreement and exclusions.
Boundary cases: when the activity does not answer the question
A site visit involving professional judgment
A site visit can involve inspection, observation, measurement, advice, or design coordination. If the client alleges that your professional observation or judgment was wrong, the allegation may raise professional-liability questions. The policy must still cover that service, and all claims-made or reporting conditions must be met.

One event can raise both issues
A single incident can contain separate allegations—for example, an injury claim plus an assertion that a design decision contributed to the condition. Do not decide coverage solely from the location, the project name, or the phrase “site visit.” Preserve the complaint, contract, drawings, correspondence, and incident records and notify the appropriate insurers promptly under the policies’ instructions.
How client contracts change the insurance decision
Many design-firm agreements specify the insurance types, limits, additional-insured status, and proof-of-insurance documents a designer must provide. A certificate of insurance is evidence of a policy at a point in time; it does not amend the policy or create coverage that the policy does not contain. Read the insurance clause before signing and compare it with the declarations and endorsements.
Professional-liability contract checks
- Does the contract require professional liability, and does the policy define your exact services as covered professional services?
- What per-claim and aggregate limits are requested, and is a deductible or self-insured retention acceptable to the client?
- Does the policy’s retroactive date reach the work being performed?
- What notice and reporting deadlines apply to claims, circumstances, or potential claims?
- Does the agreement ask for an extended reporting period after cancellation, expiration, or a project’s completion?
General-liability contract checks
- What GL limits are required for premises and operations?
- Must the client or another party be added as an additional insured, and does the endorsement provide the wording the contract demands?
- Are completed-operations requirements relevant to the work and project duration?
- What certificate, endorsement, or other proof must be delivered, and by what date?
Match the contract to the actual policy documents rather than relying on a proposal summary or a certificate alone. If language is unclear, obtain advice from a licensed commercial insurance professional and, for a significant contract, qualified legal counsel.

A step-by-step policy comparison for designers
- Inventory the services you perform. List design disciplines, specifications, consulting, coordination, inspections, project administration, technology-enabled work, and any services performed by employees or subconsultants. Mark which services are promised in each client agreement.
- Separate professional acts from operations. For each activity, ask whether a client could allege a failure of professional judgment or a physical accident connected with premises, equipment, or routine operations. Some activities can create both types of exposure.
- Read the insuring agreements and definitions. Confirm the professional-services definition in the E&O policy and the premises-and-operations grant in the GL policy. Check whether the policy treats design-build, construction management, supervision, product-related work, or other services differently.
- Review exclusions and endorsements. Focus on exclusions that could affect your discipline, contractual liability, property in your care, prior knowledge, pollution, cyber or data issues, intellectual property, and subcontractor arrangements. An exclusion’s effect depends on its exact text and the claim facts.
- Check the claims-made mechanics. Many professional-liability policies are claims-made. Confirm the retroactive date, the definition of a claim or circumstance, the notice method, and the deadline for reporting. A claim made during the policy period may still present a problem if it relates to known circumstances or falls outside the retroactive date.
- Check the GL structure. Determine whether the policy is occurrence-based or uses another form, what constitutes an occurrence, how completed operations are treated, and which additional-insured endorsements are attached. The Hartford explains that claims-made, occurrence, retroactive-date, and extended-reporting features are policy-dependent.
- Compare limits and retentions with the contract. Record each required limit, aggregate, deductible, and retention in a worksheet. Do not substitute a general industry figure for a contractual requirement.
- Confirm geography and parties. Ask whether work in another state or country, remote services, hired professionals, and subconsultants fall within the policy territory and definitions. Travelers identifies geography, technology, intellectual property, data handling, and subconsultant relationships as issues to review; inclusion must be verified in your policy.
- Preserve evidence and reporting instructions. Keep the policy, endorsements, applications, contracts, certificates, project records, and insurer contact details together. Report a demand or circumstance according to the policy, even if you are unsure which coverage category applies.
Claims-made details that deserve special attention
Professional liability is often written on a claims-made basis, although the form varies. Under a claims-made structure, the timing of the claim and the timing and manner of reporting can be as important as when the design work occurred. A retroactive date can limit coverage for acts before that date. An extended reporting period may allow certain claims to be reported after the policy ends, but it does not generally create new coverage for work or circumstances excluded by the policy.

Ask the insurer or broker to explain, in writing, how the policy treats a notice of circumstances that might later become a claim, a change to another insurer, a cancellation, and a gap between policies. Do not wait for a lawsuit if the policy requires earlier notice of a demand or circumstance. The exact reporting trigger and available reporting period are policy-specific.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Technology, data, intellectual property, and subcontractors
Design practices increasingly use digital files, cloud collaboration, automated tools, and outside specialists. These features do not automatically fall within professional-liability coverage. Review whether the policy addresses the technology and data responsibilities you actually undertake, including confidentiality, transmission or loss of project data, intellectual-property allegations, and the work of subconsultants. Travelers’ risk guidance identifies these topics as areas for review, not as guarantees that a particular policy includes them.
Ask who is insured when a subconsultant performs part of the service, whether the contract requires the subconsultant to carry its own E&O and GL, and how your policy responds if the client alleges vicarious responsibility. Obtain and retain certificates and endorsements required by the contract, while remembering that a certificate alone does not change coverage.

Limits, budgeting, and the $1 million figure
No universal limit can be recommended from the available evidence. The ACEC Business Insurance Trust guide dated 2021 describes $1 million each claim as a typical minimum requested of small design firms in that guide’s context. That dated, context-specific observation is not a current market statistic, legal requirement, or recommendation for every designer.

Common mistakes and how to correct them
Buying GL and assuming design errors are included
Why it fails: GL is built around bodily injury, property damage, and related covered offenses, not every economic loss caused by professional judgment.
Correction: Request a professional-liability quote that lists your actual services and read the professional-services definition and exclusions.
Buying E&O and ignoring office or jobsite accidents
Why it fails: A professional policy is not automatically an accident policy for visitors, property damage, or routine operations.
Correction: Review GL premises-and-operations coverage, completed operations, and any contract-required additional-insured wording.
Quick wins for a faster PC:
Repair Windows errors before they cause bigger problemsFix Now →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Relying on a certificate
Why it fails: A certificate summarizes insurance evidence but does not expand the insuring agreement or override exclusions.
Correction: Obtain the declarations and relevant endorsements and compare them with the contract.
Letting a claims-made policy lapse without a plan
Why it fails: A gap, retroactive-date change, or missed notice can affect claims arising from earlier work.
Correction: Calendar renewal dates, ask about continuity and extended reporting, and follow the policy’s notice instructions.
Using a generic service description
Why it fails: A policy written for one design discipline may not clearly include newly added consulting, coordination, technology, or supervisory work.
Correction: Update the application and ask for written confirmation or an endorsement before taking on materially different work.
Worked examples
| Situation | Alleged cause | Coverage question to ask |
|---|---|---|
| Specifications omit a required detail and the client pays for redesign | Professional error or omission | Is the specification service covered, is the claim made and reported in the required period, and do exclusions or limits apply? |
| Visitor trips over equipment in the studio | Premises or operational hazard | Does GL cover the location and occurrence, and are any premises exclusions relevant? |
| Equipment is damaged during a site visit | Accidental property damage during operations | Does GL apply to property in the care, custody, or control of the firm, and what exclusions or endorsements govern? |
| Client alleges that an inspection judgment and an unsafe walkway both caused loss | Potentially professional and operational allegations | Should the matter be reported under both policies, and how do the policies coordinate defense and allocation? |
A practical decision framework
- If the complaint centers on what you designed, specified, advised, coordinated, or judged, start with the professional-liability policy and verify the service definition and claims-made conditions.
- If it centers on someone being hurt or property being physically damaged because of premises, equipment, or routine operations, start with GL and verify the operations grant and exclusions.
- If it contains both kinds of allegations, notify each potentially relevant insurer and let the policies’ terms determine allocation rather than choosing one label yourself.
- If a client contract sets requirements, treat those requirements as a separate checklist: type of policy, limits, additional-insured status, retroactive date, reporting, and proof.
- If the wording or jurisdiction is uncertain, ask a licensed commercial broker and, where appropriate, qualified counsel to interpret the contract and policy together.
Coverage varies by insurer, policy form, jurisdiction, design discipline, and actual work performed. Insurer materials are useful explanations of product categories, not a determination that a particular claim is covered. Keep the full policy wording and the contract in front of you whenever you make the final decision.
