Platform liability insurance and worker insurance protect different people against different events. A platform’s commercial general liability (or public liability) policy is mainly designed for claims by customers, members of the public, contractors or other third parties who allege that the platform’s business caused bodily injury or property damage. Worker insurance—such as statutory workers’ compensation, a work-injury compensation scheme or a personal-accident policy—addresses an eligible worker’s own work-related injury, illness, incapacity or death.
A liability policy normally does not substitute for workers’ compensation. Whether a driver, courier or other platform worker is covered depends on the jurisdiction, legal classification, the hours or activities treated as covered work, exclusions and the actual policy wording. Read those details before assuming that a platform’s statement that it provides “insurance” means you have wage replacement or medical benefits.

What platform liability insurance is designed to cover
“Platform liability insurance” is a practical label rather than one universal policy form. It commonly refers to commercial general liability (CGL) or public liability insurance purchased by a marketplace, delivery app, ride-hail operator or other platform. California’s Department of Insurance describes casualty liability as protection responding to negligence by a business that causes bodily injury or property damage to a third party. Its business-liability guide identifies CGL as the standard business liability policy, with premises, products and completed-operations sections.
The insured business is defending a claim made against it. For example, a customer might allege that a platform’s negligent operating procedure caused an injury at a site, or that a product supplied through the platform damaged property. Depending on the wording, the insurer may pay defense costs and a covered settlement or judgment, up to the policy limit and subject to deductibles, conditions and exclusions. A policy can also contain specialized endorsements for the platform’s sector, vehicles, contractors or technology operations; those additions cannot be assumed without seeing the schedule and wording.

Who can make a claim
The usual claimant is someone other than the insured platform: a customer, visitor, member of the public, contractor or another third party alleging a covered loss. The fact that a claimant happens to have used the app or performed a task arranged through it does not by itself turn the claim into a worker-compensation claim. The legal basis of the claim and the policy’s definitions control.
What it usually does not do
CGL policies commonly exclude workers’ compensation and employers’ liability obligations. They may also exclude or restrict auto liability, intentional acts and other risks that require separate insurance. A courier who is hurt while making a delivery may therefore have a bodily-injury claim against another negligent party, but the platform’s CGL policy is not automatically the mechanism that pays the courier’s medical bills or lost income.
What worker insurance is designed to cover
Worker insurance is an umbrella term for several different arrangements. A statutory workers’ compensation or work-injury scheme can provide medical treatment, wage or income replacement, rehabilitation and benefits for permanent incapacity or death when the legal requirements are met. The exact benefits, thresholds, waiting periods and claim process are set by the applicable law. Personal-accident insurance is a private alternative or supplement; it can be narrower, paying specified benefits for accidental injury rather than the full package available under a statutory scheme.

These schemes generally focus on the worker’s injury or illness and its connection to work, not on proving that the platform was negligent. A covered employee may qualify even when no customer or platform error caused the incident. Eligibility can turn on the worker’s legal status, the activity being performed, the place and time of the incident and statutory definitions of employment.
Personal-accident cover
Independent contractors often buy personal-accident or personal-injury insurance when they are outside a statutory scheme. Such a policy may pay a scheduled amount for accidental death, disability or medical costs, but it may not replace earnings in the same way as workers’ compensation. Exclusions, benefit caps, definitions of “accident” and requirements to notify the insurer can materially change the result.

Employers’ liability in the United Kingdom
Employers’ liability is a related but distinct protection. In the UK, an employer must generally obtain Employers’ Liability insurance as soon as it becomes an employer, with at least £5 million of cover, subject to listed exceptions. The UK Government describes it as helping pay compensation when an employee is injured or becomes ill because of the work they do. This obligation is not the same as a platform’s CGL cover and does not automatically extend to every person who uses a platform.
Platform liability insurance and worker insurance compared
| Issue | Platform liability insurance | Worker insurance |
|---|---|---|
| Protected claimant | Customer, member of the public, contractor or another third party alleging a covered loss against the platform | Eligible worker, or dependants where the applicable compensation law provides survivor benefits |
| Typical trigger | Negligent platform operation causing third-party bodily injury, property damage or related liability | Work-related injury, illness, incapacity or death meeting the governing scheme or policy definition |
| Typical payments | Defence costs and covered settlements or judgments, subject to policy terms, limits and conditions | Medical expenses, wage or income replacement, rehabilitation and disability or death benefits where provided |
| Legal status | Usually purchased commercially; contracts, licences and sector rules may require it | Often statutory for employees; platform-worker rules differ by jurisdiction and classification |
| Frequent exclusions or disputes | Workers’ compensation and employers’ liability, auto, intentional acts and other excluded operations | Worker classification, off-duty or waiting periods, excluded conduct, benefit caps and claim procedures |
The table is a starting point, not a coverage determination. “Insurance” on a platform’s help page could describe a liability policy, an accident benefit, a statutory scheme or several layers with different triggers. Ask for the certificate, policy summary and governing terms.
Why a worker’s injury does not automatically become a liability claim
Suppose a delivery worker slips on a wet floor at a restaurant. If the restaurant’s negligence caused the fall, the worker might pursue a third-party negligence claim under the relevant liability policy, if that policy covers the restaurant and the facts. Separately, the worker may have a workers’ compensation or work-injury claim if the worker qualifies under the local scheme. Those are different legal routes with different proof requirements and benefits.
Now suppose the worker crashes alone while travelling between assignments. There may be no negligent third party to sue. A statutory work-injury scheme, platform-provided accident policy or the worker’s own personal-accident cover could be the relevant source of benefits, depending on the jurisdiction and the covered period. A platform CGL policy does not become wage-loss insurance simply because the accident occurred while the app was open.
Conversely, a customer injured by a courier may have a third-party claim against the platform, the courier’s employer or another responsible business. That claim seeks compensation for the customer’s loss and a defence for the business; it is not the courier’s workers’ compensation claim. Multiple policies can respond to one event, but each insurer applies its own insured persons, triggers, exclusions, limits and contribution rules.

Are platforms required to insure their workers?
There is no global rule. Start with the country or state where the work occurred, then check whether the law treats the person as an employee, deemed worker, contractor or another protected category. A platform’s contract label is evidence of its position, not conclusive proof of legal status. Some jurisdictions impose insurance duties on platforms even when workers are not traditional employees; others leave contractors to arrange their own cover.
Australia
Safe Work Australia says gig workers are generally independent contractors and typically do not have workers’ compensation, unlike employees performing similar work. Its 2025 national policy approach says schemes should consider extending coverage to gig workers, but implementation remains a matter for each Australian jurisdiction. A courier or driver therefore needs to identify the state or territory scheme, the legal classification applied there and any platform-specific arrangement before relying on workers’ compensation.
Safe Work Australia’s wording is direct: “Independent contractors, such as those engaged in the gig economy, are usually not covered by workers’ compensation and must arrange their own personal injury insurance.” “Usually” matters. It signals a general position, not a determination for every occupation or state. Check the local regulator and the platform’s written policy for exceptions.
Singapore
From 1 January 2025, all platform operators must provide Work Injury Compensation (WIC) insurance to platform workers under Singapore’s rules. The Ministry of Manpower states that, under WICA, all platform operators are required to provide WIC insurance to their platform workers. Covered benefits include compensation for income loss, medical expenses and a lump sum for permanent incapacity or death.
The protection is not an unlimited, all-hours promise. It applies to specified delivery and ride-hail work periods and contains exclusions. A worker should confirm when coverage starts and ends, what activities count as platform work, how an incident must be reported and whether another policy is needed for commuting, waiting or non-platform activity.

United Kingdom
In the UK, the central question for Employers’ Liability insurance is whether the business is an employer and the person is an employee for the relevant legal test. An employer generally needs at least £5 million of Employers’ Liability cover as soon as it becomes an employer, subject to listed exceptions. The obligation is separate from public liability insurance. A platform or business that engages genuine independent contractors may face different duties, while misclassification can create legal and insurance consequences.
How to establish what cover applies to you
Use documents and legal definitions rather than the word “covered” in an advertisement or app notification. Work through these checks before an incident and again after one.
- Identify the work location. Record the country, state, territory or other jurisdiction whose law governed the activity. Rules can change across a border or even between assignments.
- Determine the legal classification. Read the contract, but also check the statutory test used by the local regulator or court. Ask whether you are treated as an employee, worker, contractor or another protected category for injury insurance.
- Define the covered activity. Note whether protection applies while logged in, while waiting for an assignment, while travelling to a pickup, during the delivery or ride itself, and after the task ends. Do not assume that “online” equals “at work.”
- Request the actual insurance information. Obtain the insurer’s name, policy or certificate number, insured entity, effective dates, limits, deductibles, exclusions and claims contact. A marketing summary is not a substitute for the wording.
- Separate benefit types. Make a list of medical costs, temporary income loss, rehabilitation, permanent impairment and death benefits. Mark which are statutory, which are supplied by the platform and which depend on your own policy.
- Check vehicle and third-party liability. If driving or riding, verify whether motor liability, the platform’s liability policy and your personal policy cover the vehicle and the specific use. CGL commonly excludes auto risks.
- Confirm reporting deadlines. Write down the incident-notification method and deadlines for the platform, workers’ compensation authority, insurer, police or medical provider. Missing a procedure can delay a claim even when an injury is genuine.
What to do after a platform-related injury
Prompt, accurate records protect both a potential statutory claim and any third-party claim. The correct route depends on local law, but this sequence helps preserve options.
- Get emergency care first. Tell the clinician that the injury occurred during platform work and keep medical records, receipts and prescriptions.
- Make the scene safe and document it. Photograph hazards, vehicle damage, road conditions or property damage where lawful. Collect names and contact details of witnesses and other involved parties.
- Report through every required channel. Notify the platform in the app or in writing, contact the workers’ compensation or WIC authority if applicable, and notify any personal-accident or motor insurer. Ask for a claim reference.
- Describe facts, not legal conclusions. State the time, location, task, assignment status, sequence of events and symptoms. Avoid guessing about fault or signing a release before understanding the benefits it may waive.
- Track income and recovery. Keep assignment records, pay statements, cancelled shifts, medical appointments, rehabilitation plans and out-of-pocket expenses. These records can be relevant to wage-loss or income-loss benefits.
- Ask for a written coverage decision. If the platform or insurer says you are excluded, request the specific clause, the reason it applies and the appeal or review process. A denial under one policy does not necessarily decide eligibility under another.
What platform operators should keep separate
A platform’s risk program may need several policies. Public or CGL liability addresses third-party allegations arising from operations. Workers’ compensation or a statutory work-injury arrangement addresses eligible workers. Employers’ liability may be mandatory where the platform has employees. Motor, professional, cyber or other specialist coverage may be needed for separate exposures.

Combining these labels in a single “we insure you” message creates avoidable disputes. A clear notice should identify the insurer, the class of beneficiary, the covered work period, benefit categories, limits, exclusions and claim instructions. It should also explain whether the worker is expected to maintain personal accident, health, income-protection or motor insurance.

Do independent contractors need personal-accident insurance?
Often, they should investigate it, particularly where the local scheme excludes contractors and the platform provides only third-party liability. Safe Work Australia’s guidance expressly says gig-economy contractors usually must arrange their own personal injury insurance. In another jurisdiction, a statutory platform scheme may make separate cover less urgent but still leave gaps for off-duty time, waiting periods, excluded conduct, benefit caps or activities outside the specified work.
Compare the policy’s definition of accident and injury, exclusions for pre-existing conditions or hazardous activity, waiting periods, maximum medical reimbursement, temporary-disability formula, permanent-impairment schedule, death benefit and claim deadline. Check coordination with public health coverage, vehicle insurance and any government compensation. A cheap policy with a narrow accident definition may not replace income after an illness that is work-related but not accidental.
Limits, exclusions and claim disputes to look for
- Classification disputes: The insurer or platform may say the person is an independent contractor, while the worker argues the law treats them as an employee or protected platform worker.
- Coverage-time disputes: A policy may cover an accepted assignment but not unpaid waiting, personal errands, commuting or time after a delivery.
- Excluded conduct: Criminal acts, intentional injury, intoxication, unauthorized passengers or other listed conduct can affect benefits. The exact wording and local law govern.
- Benefit caps: Medical, income-loss and permanent-impairment benefits may have separate limits. A lump-sum schedule is not the same as unlimited treatment or full earnings.
- Other-insurance clauses: A policy may coordinate with workers’ compensation, motor insurance or another accident policy instead of paying first.
- Notice and proof: Late reporting, missing medical evidence or failure to cooperate can delay or restrict a claim, subject to any statutory protections.
- Geographic limits: Work across state or national borders may trigger a different scheme, insurer or required endorsement.
When a claim is denied, preserve the denial letter, policy wording, medical evidence and work records. Use the insurer’s internal review or the relevant compensation authority, ombudsman or regulator. For a serious injury, disputed classification or threatened lawsuit, independent legal advice can be more valuable than relying on a platform support agent’s summary.
Questions to ask before accepting a platform assignment
- Am I treated as an employee, a statutory platform worker or an independent contractor for injury purposes?
- Which policy responds if I am injured while waiting, travelling to pickup, completing a task or returning home?
- Who pays medical bills first, and is there income or wage replacement?
- What permanent-incapacity and death benefits apply, and how are they calculated?
- What conduct, vehicles, locations or time periods are excluded?
- What is the reporting deadline and claims contact?
- Does the platform’s policy cover only claims against the platform, or does it provide direct benefits to me?
- Do I need personal-accident, health, income-protection or motor insurance for gaps?
- What happens if I work through more than one platform or cross a jurisdictional boundary?
Request written answers. If a representative cannot identify the policy type, insured parties, effective dates and exclusions, treat the coverage as unverified until you obtain the documents.
A practical decision rule
Use this order when deciding which protection matters. First, determine whether a statutory workers’ compensation or work-injury scheme covers you. Second, identify any platform-provided worker benefits and their covered periods. Third, assess your own personal-accident or income-protection needs for gaps. Fourth, verify motor and third-party liability separately. Finally, keep the platform’s CGL or public-liability information in perspective: it is primarily there to defend the platform against covered claims by other people, not to guarantee your own injury benefits.
The decisive facts are your legal classification, where and when the incident occurred, what you were doing, which policy was in force and what its exclusions say. No platform label can answer those questions on its own.
