PERM is the normal employer-sponsored labor-certification route; Schedule A is a narrow exception for listed occupations. Standard PERM requires an employer to test the U.S. labor market and obtain certification from the Department of Labor (DOL). Schedule A Group I bypasses that ordinary recruitment test for qualifying professional nurses and physical therapists, but the employer still submits an ETA Form 9089, prevailing-wage information, a notice of filing and occupation-specific evidence to U.S. Citizenship and Immigration Services (USCIS). Neither route by itself grants a green card: the worker must still qualify for an employment-based preference category, the employer must complete the immigrant-petition process, and an immigrant visa or adjustment path must be available.

PERM and Schedule A at a glance

The right route usually follows from the offered occupation and the evidence the worker can provide, not from which process sounds faster. Use this comparison before discussing strategy with an employer or immigration lawyer.

Issue Standard PERM Schedule A Group I
Who may use it Generally eligible employer-sponsored jobs that do not qualify for a labor-certification exception Qualifying professional nurses and physical therapists only for Group I
U.S. labor-market test Employer conducts prescribed recruitment and asks DOL to certify that no sufficient able, willing, qualified and available U.S. workers were found, without adverse effect on similarly employed workers DOL has already made the occupation-level Schedule A determination; the employer does not conduct ordinary PERM recruitment for the listed occupation
Where ETA-9089 is handled Filed with DOL through the PERM process; after certification it accompanies Form I-140 to USCIS Filed with the Schedule A package to the appropriate DHS/USCIS office rather than sent through ordinary DOL PERM adjudication
Worker-specific proof Worker must satisfy the employer’s stated minimum requirements and the chosen immigrant classification Worker must also provide the Group I licensing or credential evidence required for the occupation

How the standard PERM route works

PERM is shorthand for the DOL’s permanent labor-certification program. The employer, not the worker acting alone, is the principal applicant in the labor-certification stage. DOL describes the required showing as a certification that there are not sufficient U.S. workers who are able, willing, qualified and available for the opportunity and that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

1. Define the permanent job and minimum requirements

The employer identifies a genuine, permanent, full-time opportunity and records the job duties, work location, offered wage and minimum education, experience, skill and licensing requirements. Those requirements must describe the actual opportunity rather than being tailored after the foreign worker’s résumé is reviewed. The worker must be able to document each requirement by the relevant point in the immigrant-petition process.

2. Request a prevailing-wage determination

Before recruitment and filing, the employer obtains a DOL prevailing-wage determination for the occupation and area of intended employment. The offered wage must meet the applicable requirement. The location matters: a move to a different area, a materially different job or a change in duties can require fresh analysis.

3. Complete the required recruitment

PERM recruitment is designed to test whether U.S. workers are available for the specific opportunity. The employer follows the regulatory notice and advertising rules for the occupation, keeps records of applicants and recruitment results, and considers qualified U.S. applicants. A difficult recruiting market does not eliminate the process. An employer’s general inability to hire, or a worker’s strong credentials, is not itself a Schedule A designation.

4. File ETA Form 9089 with DOL

After the required steps, the employer files the labor-certification application, commonly called ETA Form 9089, through the DOL process. The filing identifies the employer, job, requirements, recruitment and foreign worker. DOL may certify the application, audit it or otherwise request records; the employer must retain and produce the recruitment file if required.

5. Use the certification in the I-140 stage

When DOL certifies the application, the employer submits the labor certification with Form I-140 to USCIS for the applicable employment-based preference category. PERM approval is therefore an intermediate approval, not the green card itself. The worker still faces the classification, admissibility and visa-availability requirements that apply to the later stages.

What Schedule A changes—and what it does not

Schedule A is an exception inside the labor-certification framework, not a separate employment-based green-card category. DOL has pre-designated certain occupations after determining that there are not sufficient U.S. workers who are able, willing, qualified and available and that U.S. workers’ wages and working conditions will not be adversely affected. The final-rule preamble states that determination in those terms in the 69 Fed. Reg. 77326 (Dec. 27, 2004) publication.

Because the occupation is listed, the employer does not run the ordinary PERM labor-market recruitment. That does not mean no labor-certification paperwork. The employer still prepares ETA Form 9089 with prevailing-wage information, gives the required notice of filing, and submits Schedule A evidence with the appropriate DHS/USCIS filing. USCIS then evaluates the petition and the evidence rather than treating the listing as an automatic approval.

Schedule A Group I: professional nurses

Group I is narrow. A nurse must qualify as a professional nurse under the applicable rules and provide one of the specified forms of proof. The regulation identifies these alternatives:

  • Certification from the Commission on Graduates of Foreign Nursing Schools (CGFNS);
  • an unrestricted permanent license to practice professional nursing in the state of intended employment; or
  • passing the National Council Licensure Examination for Registered Nurses (NCLEX-RN).

The evidence must match the offered role and intended state. A temporary, restricted or unrelated credential should not be assumed to satisfy the rule. The employer must also establish a qualifying permanent job and the worker must meet the requirements of the relevant immigrant classification.

Schedule A Group I: physical therapists

A physical therapist must possess the qualifications necessary to take the licensing examination in the state of intended employment. The filing uses the statement or other evidence specified by the state licensing official under the regulation. The state, examination eligibility and documentation therefore matter; a general degree or work history, without the required state-based proof, is not enough.

Group I is not every health-care job

Other clinical, technical and support occupations do not become Schedule A because a hospital or clinic has persistent vacancies. Group I examples are professional nurses and physical therapists. Schedule A Group II has separate regulatory criteria and is not interchangeable with Group I. If the job is outside the applicable list, the employer generally returns to ordinary PERM unless another legal basis applies.

Why the distinction matters for an employer and worker

Recruitment burden

PERM requires a documented U.S. labor-market test. Schedule A removes that occupation-level recruitment requirement, which can simplify the employer’s preparation, but it does not remove the need to define the job, obtain the wage information, provide notice and preserve supporting evidence.

Evidence burden

PERM focuses heavily on the employer’s recruitment and the worker’s ability to meet the stated job requirements. Schedule A shifts a larger share of attention to occupation-specific proof. A nurse or physical therapist can lose the apparent advantage of Schedule A if the license, examination eligibility or required certificate is missing, expired, restricted or tied to a different state.

Filing destination

In a standard case, DOL processes ETA-9089 and the certified application is later filed with Form I-140. In a Schedule A case, the employer files the Schedule A materials, including ETA-9089 and evidence, with USCIS/DHS. The different filing path is procedural; it does not create a new preference category or bypass USCIS adjudication.

Employer control and commitment

Both routes are employer-sponsored. The employer must offer the permanent position, attest to the job’s requirements and wage, and carry the filing through the required stages. A worker cannot unilaterally convert an ordinary job into Schedule A or file a PERM labor certification without a sponsoring employer.

  1. What is the actual offered occupation? Use the duties, not a preferred title. Compare the role to the regulatory description of professional nurse or physical therapist for Group I. If the duties do not fit, analyze ordinary PERM or another legal basis.
  2. Where will the worker be employed? Record the state and worksite. Nursing licensure and physical-therapy examination eligibility are state-linked, and the work location also affects prevailing-wage analysis.
  3. Can the worker prove the required credential now? Gather the unrestricted permanent license, CGFNS certification or NCLEX-RN result for a nurse, or the required state licensing-official statement for a physical therapist. Do not rely on an application receipt when the rule requires an actual qualification.
  4. What does the employer’s job require? Compare the worker’s education and experience with the minimum requirements that will appear in the filing. A Schedule A listing does not excuse a shortfall in the employer’s requirements.
  5. Will the employer sponsor and maintain the permanent offer? Confirm who controls the filing, who pays required costs, where the job is located and what happens if the position changes. Sponsorship is a business commitment, not merely a worker’s eligibility.
  6. Which immigrant preference category applies? Schedule A is not EB-2 or EB-3 by itself. The petition must fit the applicable employment-based classification, and the worker must satisfy that category’s requirements.
  7. Is a separate waiver theory realistic? A qualifying EB-2 national interest waiver (NIW) may waive the job-offer and labor-certification requirements. NIW is a distinct, generally self-petitioned waiver route—not a faster form of Schedule A and not an automatic alternative for someone who dislikes recruitment. The complete current NIW test requires separate analysis.

Job changes, portability and route risk

Route selection affects what may happen after the petition and adjustment filing. USCIS explains that certain employment-based adjustment applicants may use AC21 portability when the adjustment application has been pending for at least 180 days and the new job is in the same or a similar occupational classification. The rule has conditions, and it is not a blanket permission to change employers at any point.

USCIS also explains that extraordinary-ability and NIW cases are exceptions to that portability provision because those classifications are not tied to the same employer-sponsored labor-certification structure. That difference is one reason a worker should not treat PERM, Schedule A and NIW as interchangeable. Read the current USCIS Policy Manual discussion of transfer of the underlying basis before relying on a job-change plan.

Common mistakes and how to correct them

Mistake: treating Schedule A as automatic approval

Why it fails: The list only removes ordinary PERM recruitment for a qualifying occupation. USCIS still reviews the petition, the job, the worker’s evidence and the preference category.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Correction: Build a complete filing package: ETA-9089, prevailing-wage information, notice evidence, the Group I credential proof, employer evidence and the I-140 materials.

Mistake: assuming any nurse title qualifies

Why it fails: Group I concerns qualifying professional nurses, not every aide, technician, practical-nurse position or health-care job.

Correction: Match the offered duties, professional classification, state license and required alternative credential before selecting Schedule A.

Mistake: using recruitment difficulty as a Schedule A argument

Why it fails: Employer shortages do not add an occupation to the regulatory list.

Correction: If the occupation is not listed and no other exception applies, plan for the standard PERM process.

Mistake: ignoring the intended state

Why it fails: Nursing licenses and physical-therapy examination eligibility are tied to the state of intended employment; a credential from another state may not satisfy the filing.

Correction: Confirm state-specific eligibility and obtain the exact licensing evidence before filing.

Mistake: assuming a later job change is harmless

Why it fails: Portability depends on the stage of the case, the 180-day pending threshold, a same-or-similar occupation and other conditions.

Correction: Get case-specific advice before changing employers, duties, worksite or occupation, and preserve records showing how the new role compares.

Answers to common questions

Do nurses need PERM for an employment-based green card?

Not necessarily. A qualifying professional nurse may use Schedule A Group I instead of ordinary PERM recruitment if the nurse provides one of the listed credentials and the employer submits the required Schedule A package. Nurses who do not satisfy Group I, or whose offered position is not a qualifying professional-nurse job, generally need another applicable route.

Can physical therapists use Schedule A?

Yes, Group I covers qualifying physical therapists who possess the qualifications needed to take the licensing examination in the intended state and provide the specified state licensing-official evidence. The occupation, state and documentation must all line up.

Does Schedule A create an EB-2 case?

No. Schedule A is a labor-certification exception. The employer still has to establish the appropriate employment-based preference classification, and the worker must meet that classification’s requirements.

Can a worker file Schedule A without an employer?

No. Schedule A remains employer-led. The employer offers the permanent job, prepares the labor-certification materials and files the petition. A worker seeking an employer-independent theory must examine a separate option, such as a potentially qualifying NIW, rather than relabeling Schedule A.

Is NIW simply a faster Schedule A?

No. NIW is a distinct EB-2 waiver route that may waive the job-offer and labor-certification requirements for a qualifying case. Its eligibility and evidence standards are different, and the available facts here do not establish a complete NIW eligibility checklist.

Can I predict approval from the occupation alone?

No. Occupation is only the first screen. The employer’s offer and requirements, licensing evidence, preference category, admissibility, visa availability and the procedural history of the filing all affect the outcome.

Bottom line

Choose standard PERM when the job is an ordinary employer-sponsored opportunity outside a qualifying exception. Choose Schedule A Group I only when the offered job is a qualifying professional-nurse or physical-therapist position and the worker has the exact state-linked credential evidence required by the regulation. Treat NIW as a separate waiver analysis. In every route, verify the employer’s commitment, job requirements, preference category and current visa availability before filing.

Frequently Asked Questions

What if my employer has trouble recruiting for a job that is not nursing or physical therapy?

Recruiting difficulty does not place an occupation on Schedule A. Unless another exception applies, the employer should analyze the ordinary PERM process and its required recruitment record.

Does a state license from a future work location satisfy Schedule A?

The evidence must correspond to the intended state of employment and the occupation-specific rule. Confirm the state and the exact credential before submitting the package.

What should I do before changing jobs while an employment-based case is pending?

Check the case stage, whether the adjustment application has been pending at least 180 days, whether the new role is same or similar, and any route-specific exception. Obtain individualized legal advice before the move.
