PERM vs. EB-2 NIW: Eligibility, Process, and Employer Requirements

PERM and EB-2 National Interest Waiver (NIW) are fundamentally different employment-based immigration routes. PERM is normally an employer-driven labor-market certification for a specific permanent, full-time job. EB-2 NIW is an EB-2 immigrant petition in which the applicant asks USCIS to waive the usual job-offer and labor-certification requirements because the proposed work serves the national interest. NIW can be self-petitioned, but it is not automatic and does not eliminate the need to qualify for EB-2 first.

PERM and EB-2 NIW at a glance

The practical dividing line is who must sponsor the case and what the government is being asked to approve. In a PERM case, a qualifying U.S. employer proves to the U.S. Department of Labor (DOL) that it has a permanent job, has tested the U.S. labor market as required, and will meet wage and recruitment rules. In an NIW case, the individual seeks EB-2 classification and asks U.S. Citizenship and Immigration Services (USCIS) to waive the job-offer and labor-certification requirements because the specific proposed endeavor is in the national interest.

Issue PERM labor certification EB-2 NIW
What the government decides DOL certifies that the employer’s permanent job opportunity satisfies labor-market, wage and recruitment requirements. USCIS decides whether the applicant qualifies for EB-2 and whether the national-interest waiver should be granted.
Who normally files The employer. DOL states, “The filing of applications is the responsibility of the employer, not the employee.” The individual may self-petition. USCIS says, “Persons seeking a national interest waiver can file the petition on their own behalf.” An employer may also support the filing, but is not required for the waiver.
Job offer A qualifying permanent, full-time job opportunity is central to the case. A permanent U.S. job offer is not required if USCIS grants the waiver.
Labor certification Required before the employer files the related Form I-140. Requested to be waived; the underlying EB-2 classification still must be established.
Main evidence Job duties and requirements, prevailing wage, recruitment, notice and proof that the employer followed DOL rules. EB-2 credentials, a defined proposed endeavor, evidence of substantial merit and national importance, proof the applicant is well positioned to advance it, and evidence that waiving the job offer and labor certification benefits the United States.
Main government sequence DOL prevailing-wage determination and recruitment, ETA Form 9089, then Form I-140 with USCIS. One I-140-based EB-2 NIW filing to USCIS with evidence for both EB-2 eligibility and the three-prong waiver analysis.

Neither label establishes a universal winner on speed, cost, approval probability or convenience. Current end-to-end comparisons were not established by the official material cited here, and individual cases differ substantially.

What PERM actually requires

DOL describes permanent labor certification as the process that permits an employer to hire a foreign worker permanently in the United States. The employer must show that there are not enough U.S. workers who are able, willing, qualified and available for the job in the intended employment area, and that hiring the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. The official program overview is available from DOL’s Permanent Labor Certification page.

Employer and job prerequisites

  • The employer must be a qualifying U.S. employer with a valid Federal Employer Identification Number (FEIN).
  • It must have a U.S. location to which U.S. workers can be referred.
  • The opportunity must be permanent and full-time, rather than a temporary assignment or a part-time opening.
  • The employer must be able to offer the stated job requirements and comply with the applicable wage and recruitment rules.

PERM is tied to the particular employer, position, work location and requirements described in the filing. It is not a general credential that an employee can carry to another employer.

The prevailing-wage requirement

Before filing PERM, the employer must obtain a prevailing-wage determination from DOL’s National Prevailing Wage Center. DOL’s wage guidance explains that the employer requests this determination for PERM using Form ETA-9141; see Prevailing Wage Information and Resources. The determination supplies the wage benchmark applicable to the job, location and requirements under the governing rules.

A prevailing wage is not a guaranteed salary, a promise that the employee will be paid a particular wage level in every circumstance, or a finding that the foreign worker is qualified. It is a required regulatory determination used in the labor-certification process. The employer must receive it before submitting the PERM application.

Recruitment and notice

Recruitment is designed to test whether qualified U.S. workers are available for the opportunity. The exact advertisements, notice and timing depend on the occupation and the applicable PERM provision. The employer must complete the required pre-filing recruitment and notice of filing, retain supporting records, and be prepared to show that it followed the rules rather than tailoring the process to exclude U.S. applicants.

The DOL FLAG program’s overview of the sequence is at Permanent Labor Certification (PERM). Recruitment obligations vary, so an employer should use the current DOL instructions for the specific occupation instead of relying on a generic checklist.

PERM process: step by step

  1. Define the permanent job. The employer settles the duties, minimum education and experience, worksite and other requirements for a permanent, full-time position.
  2. Confirm employer eligibility. Verify the FEIN, U.S. location and ability to employ and pay the worker under the terms that will be filed.
  3. Request the prevailing wage. Submit the appropriate request, generally Form ETA-9141, to DOL’s National Prevailing Wage Center and wait for the determination.
  4. Complete required recruitment and notice. Conduct the advertisements, internal notice and other recruitment steps required for the occupation and retain the dates and results.
  5. File ETA Form 9089. The employer submits the PERM application to DOL, attesting to the job, wage and recruitment facts.
  6. Respond to any DOL action. If DOL audits or otherwise requests information, the employer must answer through the prescribed process and maintain the underlying records.
  7. Use an approval promptly. After certification, the employer submits the certified labor certification to the appropriate USCIS service center with Form I-140. DOL states that the certification expires if it is not submitted within 180 days of certification. That 180-day period is the validity window for forwarding the certification, not an estimate of total case processing time.

PERM and the I-140 are separate stages. DOL decides the labor certification; USCIS later decides the immigrant petition and the worker’s EB-2 or other employment-based classification. A PERM approval by itself does not grant permanent residence.

EB-2 NIW eligibility: the two layers USCIS examines

NIW analysis starts with ordinary EB-2 eligibility. USCIS’s January 15, 2025 policy alert, Second Preference Eligibility for National Interest Waiver Petitions, explains that the applicant must first qualify either as an advanced-degree professional or as a person of exceptional ability. Only then does USCIS evaluate the waiver request.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Underlying EB-2 classification

For the advanced-degree route, USCIS describes an advanced degree as a U.S. academic or professional degree, or a foreign equivalent, above a bachelor’s degree. A U.S. bachelor’s degree or foreign equivalent followed by at least five years of progressive experience in the specialty may be considered equivalent to an advanced degree. The equivalency must be documented and tied to the specialty; it is not a blanket substitute for any five years of work.

The alternative is exceptional ability in the sciences, arts or business, established under the applicable regulatory evidence framework. A strong résumé, senior title or high salary alone does not automatically satisfy either EB-2 route.

The three NIW prongs

After EB-2 eligibility is shown, USCIS applies a case-specific, discretionary three-prong framework. The framework is illustrated in USCIS decisions such as the administrative decision applying the NIW framework.

1. The proposed endeavor has substantial merit and national importance

The endeavor is the specific work the applicant proposes to advance in the United States, not merely the occupation’s general label. The record must explain what the applicant will do, why it has substantial merit, and why its potential implications extend beyond a single employer or a narrowly local benefit when the evidence calls for broader significance. National importance is assessed from the endeavor’s prospective impact, not from the applicant’s assertion that the field is important.

2. The applicant is well positioned to advance the endeavor

USCIS considers evidence such as education, specialized knowledge, record of accomplishments, publications or citations where relevant, prior results, a credible plan, support from interested organizations, investment or resources, and progress already made. No single résumé item guarantees this prong. The evidence should connect the applicant’s background and resources to the concrete endeavor described in prong one.

3. On balance, waiving the job offer and labor certification benefits the United States

The applicant must show why the United States would benefit from allowing the work to proceed without the conventional employer sponsorship and labor-market test. This is a balancing inquiry, not a claim that labor certification is inconvenient. USCIS weighs the total record, including the nature of the endeavor, the applicant’s positioning and the practical value of permitting the work without tying it to one permanent job offer.

Meeting one prong does not satisfy the others. A persuasive NIW filing addresses all three separately and explains how the evidence fits together.

How an EB-2 NIW filing works

  1. Choose the EB-2 basis. Document the advanced-degree-professional or exceptional-ability route before arguing the waiver.
  2. Define one proposed endeavor. Describe the work, its U.S. objectives, affected industries or communities, and the results the applicant intends to produce. Avoid a vague statement such as “continue working in my field.”
  3. Assemble prong-one evidence. Use objective material showing substantial merit and national importance, such as the endeavor’s projected effects, adoption, public or economic significance, or relevance to a documented national need.
  4. Assemble prong-two evidence. Connect the applicant’s education, experience, achievements, implementation plan, collaborators and resources to the ability to carry out the endeavor.
  5. Address prong three directly. Explain why the benefits of the proposed work justify waiving the job offer and labor certification, rather than simply stating that the applicant would prefer self-petitioning.
  6. File the I-140 petition with USCIS. Include the EB-2 documentation, the NIW legal argument and supporting exhibits in the format and with the fee required by the current USCIS form instructions.
  7. Handle any USCIS request or decision. A request for evidence, notice of intent or denial must be answered under its stated deadline and procedure. Approval of the NIW petition does not itself confer a green card; visa availability and the later adjustment-of-status or consular process remain separate questions.

Because the NIW is discretionary, a self-petition is not the same as a guaranteed approval. USCIS’s permission to self-petition removes the employer-filing requirement for the waiver request; it does not relax the EB-2 standard or the evidentiary burden.

Employer requirements: what changes between the routes

Employer question PERM EB-2 NIW
Must a U.S. employer sponsor the initial filing? Yes, in the normal structure. The employer owns the labor-certification filing and signs the required attestations. No, if the individual self-petitions and USCIS grants the waiver.
Must there be a specific permanent job? Yes. The job opportunity, requirements and location are central to the application. No job offer is required for the waiver, although the applicant’s proposed U.S. work must be concrete.
Who manages recruitment? The employer conducts and documents the required recruitment and notice. There is no PERM recruitment campaign when the labor-certification requirement is waived.
Who obtains the prevailing wage? The employer obtains it before filing PERM. There is no prevailing-wage determination for a waived labor-certification requirement.
Can the beneficiary change employers freely? PERM is tied to the sponsoring employer and job; it is not portable as a standalone approval. The petition is based on the individual’s endeavor rather than a PERM job, but later immigration steps and any employment must still comply with the governing rules.

An employer can still play a supporting role in an NIW case by supplying plans, letters, contracts, project evidence or other documentation. That support is optional for self-petitioning and does not turn the case into PERM.

Evidence comparison: what each adjudicator is testing

Evidence area PERM question NIW question
Job definition Is there a real, permanent, full-time position with stated minimum requirements? What specific endeavor will the applicant advance in the United States?
Labor market Did the employer complete the required recruitment and determine whether qualified U.S. workers were available? Not applicable when the labor-certification requirement is waived.
Wage Did the employer obtain and follow the applicable prevailing-wage determination? Not the focus of the waiver analysis.
Qualifications Does the foreign worker meet the job’s filed requirements? Does the applicant first meet EB-2 and then show the ability to advance the endeavor?
Public benefit Will employment comply with protections for U.S. workers’ wages and conditions? Is the endeavor nationally important and is the United States better served by waiving the normal job-offer and labor-certification requirements?

Choosing a pathway without treating them as interchangeable

PERM is usually the better structural fit when

  • A U.S. employer has a defined permanent, full-time role and is prepared to own the recruitment, wage and filing obligations.
  • The immigration case is naturally tied to that employer’s job rather than to an independent professional endeavor.
  • The employer can document the job requirements and complete the labor-market test under the applicable DOL rules.

NIW may fit when

  • The applicant can establish an EB-2 category independently of a particular employer.
  • The proposed work has identifiable substantial merit and national importance beyond a generic occupational description.
  • The applicant has evidence of being well positioned to advance that work and a reasoned case for waiving the job offer and labor certification.
  • Employer sponsorship is unavailable, unstable or inconsistent with the way the proposed endeavor will be carried out.

These are structural indicators, not an eligibility decision. A person may have a strong career history but no sufficiently defined nationally important endeavor, while another may have a compelling endeavor but inadequate EB-2 documentation. A qualified immigration lawyer can evaluate the proposed endeavor, credentials, employer and evidence together.

Common mistakes and how to prevent them

  • Calling NIW a shortcut around EB-2. The waiver is considered only after the applicant qualifies for an underlying EB-2 classification.
  • Describing an occupation instead of an endeavor. “I will work as an engineer” does not explain the particular work, expected results or national importance.
  • Assuming a prestigious résumé proves all three prongs. Achievements must be tied to the proposed work and supported with evidence relevant to each prong.
  • Treating a prevailing wage as a salary guarantee. It is a DOL determination used in PERM, not a general statement that the worker will receive a particular wage in every job.
  • Starting PERM recruitment before the wage determination is available. DOL requires the prevailing-wage determination before the PERM filing.
  • Letting a certified PERM expire. The employer must submit the certification with Form I-140 within 180 days of certification.
  • Confusing PERM approval with permanent residence. PERM is a DOL labor-certification stage; the employer still files Form I-140 with USCIS, followed by the immigrant-visa or adjustment process when eligible.
  • Using stale forms or instructions. DOL and USCIS requirements can change. Check the current ETA and USCIS form instructions, fees and filing addresses immediately before filing.

Timing, cost and outcome expectations

The available official material does not establish a reliable, apples-to-apples end-to-end timeline for PERM versus NIW, nor does it establish a general cost, approval-rate or speed advantage for either route. PERM has multiple employer-controlled stages before the I-140; NIW avoids PERM but requires a detailed discretionary USCIS analysis. Processing times depend on the agency, filing type, workload, visa availability and case-specific events such as audits or requests for evidence.

The one explicit timing figure is the DOL rule that a certified PERM must be submitted to USCIS with Form I-140 within 180 days. That deadline should be tracked separately from the time DOL or USCIS takes to adjudicate the case.

Documents to organize before selecting a route

  • Passports, immigration history and prior filings.
  • Degrees, transcripts and foreign-equivalency documentation where applicable.
  • Detailed employment history, job duties and progressive experience records.
  • For PERM: the employer’s corporate information, FEIN, job description, worksite, recruitment records, wage determination and notice documentation.
  • For NIW: a written proposed-endeavor plan, evidence of national importance, accomplishment records, publications or other field-specific evidence where relevant, implementation resources, letters that explain concrete contributions, and documentation supporting each EB-2 route.
  • Copies of every form, exhibit and deadline notice, with a calendar entry for responses and the 180-day PERM certification window when applicable.

Bottom-line distinction

PERM asks an employer to certify a particular permanent job after testing the U.S. labor market. EB-2 NIW asks USCIS to classify the individual under EB-2 and waive the job-offer and labor-certification requirements because the individual’s defined endeavor is in the national interest. The right analysis starts with the employer and job facts for PERM, or with EB-2 credentials, the proposed endeavor and all three NIW prongs for a waiver case—not with assumptions that one pathway is universally faster or easier.
