PERM Processing Steps and Timelines for Employer-Sponsored Green Cards (2026 Guide)

PERM is the U.S. Department of Labor (DOL) labor-certification stage of many employer-sponsored green-card cases. The employer defines a permanent, full-time job, obtains a prevailing-wage determination, conducts the recruitment required for that occupation, and files Form ETA-9089. As of the DOL’s October 5, 2026 snapshot, analyst review was reported at an average of 336 calendar days for cases processed in August 2026, while the analyst queue showed December 2025 priority dates. Those figures are changing indicators, not a promise for any individual case. A certified PERM must be submitted with Form I-140 to U.S. Citizenship and Immigration Services (USCIS) within 180 days.

What PERM is—and what it is not

PERM, formally the Program Electronic Review Management labor-certification process, is an employer-led DOL procedure. It tests whether an employer has a genuine permanent, full-time U.S. job opportunity and has followed the required recruitment and notice rules before sponsoring a foreign worker for permanent residence.

PERM is not a green card, an immigrant visa, or an approval of the worker’s immigration eligibility. After DOL certifies the labor application, the employer normally files Form I-140 with USCIS. The worker may then continue through adjustment of status in the United States or consular processing abroad, subject to the immigrant-visa category, visa availability, and the worker’s individual circumstances.

The employer controls the PERM filing. The worker can supply information and monitor milestones, but the employer must establish the job requirements, pay for and document recruitment, maintain records, and submit ETA-9089.

PERM process at a glance

Stage Primary actor What happens Result or timing point
Define the job Employer Sets the permanent, full-time duties, minimum requirements, work location and applicable employment-based category. Job description used for the wage request, recruitment and ETA-9089.
Prevailing wage determination Employer and DOL National Prevailing Wage Center Employer files Form ETA-9141 describing the opportunity. DOL issues the applicable wage before PERM filing.
Recruitment and notice Employer Completes the recruitment steps required for the occupation and gives notice of filing. Recruitment report and supporting records retained for DOL review.
ETA-9089 filing Employer Files online through FLAG after establishing required accounts or submits by mail. DOL receipt date becomes the filing date and is used as the priority date by USCIS and the Department of State.
DOL adjudication DOL Certifying Officer Reviews the application and may certify, deny, audit, request information or order supervised recruitment. Audit cases receive a separate document deadline and may take longer.
Post-certification filing Employer and USCIS Submits the certified labor certification with Form I-140. Submission must occur within 180 days of certification or the labor certification expires.

Step 1: Define the permanent job opportunity

The employer must first describe the actual job it intends to offer on a permanent, full-time basis. That description includes duties, minimum education and experience, special skills, worksite and other conditions that affect recruitment and the wage.

Use the real minimum requirements

Requirements cannot be written solely around the sponsored worker’s résumé. The employer should be able to explain why each minimum requirement is genuinely needed for the position and how it is normally used in the organization. Changing duties or requirements later can create inconsistencies between the prevailing-wage request, advertisements, recruitment report and ETA-9089.

Confirm the correct occupation and category

Recruitment rules differ between professional and nonprofessional occupations, and special rules apply to some teachers, Schedule A occupations and sheepherders. The employer must identify the occupation and regulatory category before selecting its recruitment plan. A checklist designed for a typical professional case should not be treated as universal.

Step 2: Request the prevailing wage

Before filing PERM, the employer requests a prevailing wage determination (PWD) from DOL’s National Prevailing Wage Center using Form ETA-9141. The request describes the job, location, requirements and other facts needed to determine the wage level.

Why the PWD matters

The PWD identifies the wage applicable to the described opportunity. When completing ETA-9089, the employer must use the higher of the two wages when the form presents a determined prevailing wage and the offered wage for comparison. The employer therefore needs a wage offer that satisfies the applicable requirement before filing.

Keep the job description consistent

The duties and requirements in ETA-9141 should match the opportunity that is advertised and later filed on ETA-9089. A material change can require the employer to reassess the wage and recruitment work rather than simply editing one form.

Step 3: Complete recruitment and notice

Recruitment is the evidence that the employer tested the U.S. labor market for the specific permanent job. The employer must follow the rules for the occupation, preserve proof of each step, and prepare a recruitment report describing what was done and what happened.

Typical professional occupation under 20 CFR 656.17

For a typical professional occupation, the mandatory recruitment package includes:

The Psychology of Money: Timeless lessons on wealth, greed, and happiness
  • Ideal for Gifting
  • Ideal for a bookworm
  • Compact for travelling
  • A state workforce agency job order that runs for 30 days.
  • Two Sunday newspaper advertisements.
  • Three additional recruitment steps selected from the regulatory alternatives for professional occupations.

The mandatory steps must be conducted at least 30 days and no more than 180 days before the PERM filing. The additional steps have their own timing requirements. The employer should calendar the earliest and latest permissible dates for every item so that no step falls outside the filing window.

Nonprofessional occupations

Nonprofessional jobs have a different minimum recruitment package, including a 30-day job order and two newspaper advertisements. The employer should not copy the professional checklist without confirming the regulation that applies to the position.

Special cases

The regulations include exceptions or special handling for certain cases, including competitively recruited college and university teachers, Schedule A occupations and sheepherders. These categories can change which labor-certification steps are required. An employer should determine whether a special rule applies before beginning recruitment.

Notice of filing

The employer must provide the required notice of filing to the relevant workforce and employee audiences. The notice and its method of posting should be documented with the rest of the recruitment file.

Records to preserve

DOL may request recruitment evidence before issuing a final decision or as part of an audit. The employer should retain copies of advertisements, job-order records, posting and notice evidence, applicant résumés or results as required, contact information, dates, and the signed recruitment report. The records need to show what was done, when it was done and how the employer handled responses.

Step 4: File Form ETA-9089

Once the wage and recruitment requirements are complete, the employer files Form ETA-9089 with DOL. Online filing is available through the FLAG system after the employer establishes the required accounts; mailing the application is also permitted.

Priority date starts with DOL receipt

The date DOL receives ETA-9089 is the PERM filing date. USCIS and the Department of State use that date as the worker’s priority date for the employment-based case. The priority date is therefore established before DOL decides whether to certify the application.

Check every field before submission

Errors in the job title, requirements, worksite, wage, employer information or sponsored worker’s details can create a mismatch with the PWD and recruitment record. The filing should be reviewed against the signed job description, wage determination, advertisements, notice and recruitment report before submission.

Step 5: Wait for DOL’s determination

DOL may certify the application, deny it, select it for audit, request more information or require supervised recruitment. A case’s path depends on its facts and on the documentation available to the Certifying Officer.

Certification

Certification means DOL has accepted the labor certification for the described job and recruitment process. It does not approve the worker’s I-140, establish visa availability, or grant work authorization or permanent residence.

Denial

A denial ends that PERM application unless the employer uses the available administrative procedures or starts a new case. The reason in the decision controls what corrective action is possible; an employer should not assume that repeating the same filing will solve the problem.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Audit or information request

An audit letter identifies the documents DOL wants and sets a response deadline 30 days from the date of the letter. The Certifying Officer may, at discretion, grant one extension of up to 30 days. A substantial failure to provide the requested documents can result in denial.

An audit can lengthen a case because the employer must assemble and submit the specified evidence before DOL can finish its review. The employer should use the actual deadline in the notice rather than relying on a general estimate.

Supervised recruitment

DOL can require supervised recruitment when it needs additional assurance that the employer conducted a genuine test of the labor market. That route follows instructions from the Certifying Officer and is not the same as the standard recruitment package.

How long PERM takes in 2026

The latest cited DOL FLAG processing snapshot, dated October 5, 2026, showed PERM analyst review at December 2025 priority dates. The same page reported an average analyst-review processing time of 336 calendar days for cases processed in August 2026, according to the Office of Foreign Labor Certification.

Those are two different measurements:

  • Queue priority date: the priority-date point DOL said its analysts were reviewing when the snapshot was published.
  • Average calendar days: the reported average time for analyst-review cases processed in a specified month.

A queue position is not a prediction that every case filed on that date will be decided on a particular day. The average is not a service-level guarantee. DOL states that actual times vary with each employer’s material facts and circumstances.

Analyst review versus audit review

Standard analyst review and audit review should be treated as separate paths. The October 5 processing page displayed the August 2026 audit-review average as unavailable. An audited case also has to meet the document deadline in the audit letter, so its timeline cannot be inferred from the analyst average.

How to read a personal estimate

For an individual case, record the ETA-9089 filing date, whether an audit or information request has arrived, and any response deadline. Compare those facts with the live FLAG processing page rather than adding 336 days mechanically. The employer’s job details, the quality of the record and any additional DOL request can move the decision earlier or later.

Monthly updates and the shutdown notice

DOL says PERM and prevailing-wage data are generally updated by the end of the first work week of each month. The processing page should therefore be checked close to publication and labeled with its as-of date.

DOL’s Foreign Labor Certification page also reported that a government shutdown beginning October 1, 2026 stopped OFLC processing and suspended public access to FLAG. The official material containing the October 5 snapshot does not resolve whether operations resumed after that snapshot. Before assuming that a new filing, wage request or adjudication is moving, verify the current DOL and FLAG status.

What happens after PERM is certified

File Form I-140 promptly

DOL says the certified labor certification must be submitted to USCIS with Form I-140 within 180 days of certification. If the employer misses that window, the labor certification expires and cannot be used for the intended filing.

PERM is only one part of the green-card case

The I-140 stage asks USCIS to approve the employer’s immigrant petition and requires evidence such as the certified labor certification, the offered position and the employer’s ability to pay, as applicable to the petition. After I-140 approval, the worker still needs an immigrant visa number and must complete either adjustment of status or consular processing, depending on eligibility and location.

Priority-date consequences

The PERM filing date established the priority date, but having a priority date does not by itself make an immigrant visa immediately available. The worker’s employment-based category and the Department of State’s visa-bulletin movement determine when the final green-card stage can proceed.

Employer and worker checklists

Employer checklist before filing

  • Define the permanent, full-time opportunity and its genuine minimum requirements.
  • Confirm the correct occupational category and whether a special rule applies.
  • Submit ETA-9141 and obtain the PWD before ETA-9089.
  • Plan the mandatory and additional recruitment steps with dates inside the permitted windows.
  • Provide and document the required notice of filing.
  • Prepare the recruitment report and organize supporting records.
  • Reconcile the offered wage, prevailing wage, job duties and requirements across every document.
  • Confirm FLAG account access or prepare the paper-filing package.

Worker checklist

  • Ask the employer for the ETA-9089 filing date, which is the priority date.
  • Confirm the sponsored position, worksite, minimum requirements and offered wage match the role you understand.
  • Ask whether DOL issued an audit or information request and, if so, when the response is due.
  • After certification, confirm that the employer plans to file I-140 before the 180-day expiration.
  • Track visa-bulletin availability separately from PERM processing; PERM approval does not create an immediately available green card.
  • Keep copies of personal immigration records and all notices supplied by the employer or counsel.

Common timeline mistakes and how to avoid them

Treating PERM as the whole green-card process

PERM is a DOL labor-certification decision. I-140 adjudication, visa-number availability and the final adjustment or consular stage are separate events with separate agencies and timing.

Using one recruitment checklist for every job

Professional and nonprofessional occupations have different minimums, and special categories can follow different rules. Identify the category before placing advertisements or a job order.

Counting from the wrong date

The relevant PERM filing date is when DOL receives ETA-9089. A wage-request date, advertisement date or the date a worker signs paperwork is not the priority date.

Ignoring an audit deadline

The audit letter controls. Missing the 30-day response deadline, or an extension that DOL actually grants, can lead to denial. Assign one person to gather the requested records and verify submission before the deadline.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Waiting beyond the certification validity period

Certification is not permanent. The employer must deliver it with I-140 to USCIS within 180 days, so the filing package should be prepared while the certification is still valid.

Questions to ask the employer or immigration team

  • What is the ETA-9089 filing date and resulting priority date?
  • Which occupation category and recruitment rule were used?
  • When was the prevailing wage issued, and does the offered wage meet the applicable requirement?
  • Were all mandatory and additional recruitment steps completed within their permitted windows?
  • Has DOL issued an audit, information request or supervised-recruitment instruction?
  • What is the plan and target date for filing I-140 after certification?
  • Which later stage—adjustment of status or consular processing—will apply, and what visa-number conditions must be met?

Practical way to track a PERM case

  1. Create a dated case log. Record the job-definition date, ETA-9141 submission, PWD issuance, each recruitment activity, notice dates, ETA-9089 receipt, audit correspondence and certification.
  2. Separate agency clocks. Keep DOL PERM review, any audit response period, the 180-day post-certification period, USCIS I-140 processing and visa availability in different columns.
  3. Check FLAG and DOL notices. Use the current processing page for the as-of month and verify whether any shutdown or system interruption affects filings or adjudications.
  4. Escalate factual changes. Tell the employer or immigration counsel before changing the job duties, requirements, worksite or offered wage; those changes can affect the labor-certification record.
  5. Calendar hard deadlines. Put the audit response deadline and the 180-day certification-expiration date on shared calendars with reminders well in advance.
