Yes—some people can pursue U.S. permanent residence without the ordinary PERM labor-certification process. The main alternatives are Schedule A for designated occupations, EB-1 classifications, EB-2 with a national interest waiver (NIW), the EB-5 investor category, and family-based immigration when a qualifying relationship exists. Each route has a different sponsor, evidence standard, cost profile, and exposure to visa-number limits. None is a universal shortcut.
PERM is only one stage of one employment-based strategy. In the usual employer case, the employer obtains a Department of Labor (DOL) labor certification and then files Form I-140 with U.S. Citizenship and Immigration Services (USCIS). Even an approved or filed I-140 is not itself a green card: the beneficiary must still complete adjustment of status or consular processing and satisfy the requirements of the chosen category.

What “without PERM” actually means
PERM is the common labor-certification process for employer-sponsored immigrant cases. The employer generally must test the labor market and obtain DOL certification before submitting the immigrant petition. The purpose is to show that hiring the foreign worker will not displace qualified U.S. workers under the rules that apply to the position.

- Labor certification: Schedule A uses a special certification procedure, while EB-1 and EB-2 NIW can avoid the ordinary PERM filing when the classification’s requirements are met.
- Sponsor: Some categories remain employer-sponsored; others permit the worker to file on their own behalf.
- Basis for immigration: EB-5 relies on investment and job creation, while a family case relies on a qualifying relationship rather than an employment offer.
Removing PERM does not remove the need for a qualifying petition, admissibility review, an available immigrant visa number when required, or the final adjustment or immigrant-visa step. The route must match the facts of the case, not simply the desire to avoid recruitment.

At-a-glance comparison
| Route | Who files or sponsors | Job offer required? | Ordinary PERM required? | Main qualification | Visa-number exposure |
|---|---|---|---|---|---|
| Standard employer case | Employer files the I-140 after labor certification | Yes | Usually yes | EB-1, EB-2, or EB-3 requirements, depending on the classification | Can affect the final immigrant-visa or adjustment stage |
| Schedule A Group I | Employer | Yes | No ordinary individualized DOL PERM adjudication; certification materials go to USCIS | Registered nurse or physical therapist requirements | Can still affect the final stage |
| Schedule A Group II | Employer | Yes | Special Schedule A procedure | Exceptional ability in qualifying science or art fields, including separate performing-arts treatment | Can still affect the final stage |
| EB-1 | Employer for some subcategories; extraordinary-ability beneficiary may self-petition in qualifying circumstances | Depends on the subcategory | Generally not for the listed EB-1 classifications | Extraordinary ability, outstanding professor or researcher, or multinational executive or manager criteria | Can affect visa issuance or adjustment |
| EB-2 NIW | Beneficiary may self-petition | Waived when NIW is approved | Waived when NIW is approved | First qualify for EB-2, then satisfy the national-interest-waiver test | Can affect the final stage |
| EB-5 | Investor files under the investor program | No conventional employer offer | No | Qualifying investment and plan to create or preserve 10 permanent full-time jobs | Visa availability can affect timing |
| Family-based | Qualifying relative petitions under the applicable family category | No employment offer | No | Relationship, petition, admissibility, and category-specific requirements | Depends on the family category and visa availability |
The table is a screening tool, not an eligibility determination. USCIS category names do not establish that a particular résumé, investment, occupation, or relationship qualifies.
Schedule A: a narrow employer-sponsored exception
What changes
Schedule A is not a blanket exemption for shortage occupations. DOL has made a prior determination about the availability of U.S. workers for specifically designated groups. Instead of obtaining individualized certification through the ordinary PERM process, the employer submits the required labor-certification materials directly with the USCIS immigrant petition. The adjudicating agency and filing sequence change; the employment relationship does not disappear.
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Group I occupations
USCIS identifies Schedule A Group I as registered nurses and physical therapists. A nurse or physical therapist therefore may have an employer-sponsored Schedule A path that bypasses ordinary PERM recruitment, provided the person and the offered position satisfy the applicable requirements. The category does not automatically cover every healthcare worker, medical occupation, or position described as hard to fill.
Group II occupations
Group II covers qualifying beneficiaries with exceptional ability in the sciences or arts. Performing arts receive separate treatment within the group. USCIS’s April 10, 2024 policy alert explains how “science or art” is interpreted for Group II and applies that guidance to requests pending or filed on or after that date.
What Schedule A does not do
- It is not a self-petition. The employer remains central to the case.
- It does not waive wage, notice, petition, or other employer obligations.
- It does not guarantee approval or eliminate the need for adjustment of status or consular processing.
- It does not make an immigrant visa number immediately available.
For a registered nurse, physical therapist, or Group II professional, the practical question is whether the employer can document the Schedule A requirements and complete the remaining employment-based process—not whether the occupation appears on a general shortage list.
EB-1: high-threshold categories that usually avoid PERM
USCIS’s employer guidance lists three EB-1 groupings: extraordinary ability, outstanding professors and researchers, and multinational executives or managers. These are distinct legal categories with different evidence requirements.

Extraordinary ability
In qualifying circumstances, a person of extraordinary ability may petition for themself rather than relying on a permanent job offer and employer-filed petition. That option is limited to people who can document the demanding extraordinary-ability standard. A strong résumé, senior title, advanced degree, or high salary by itself does not turn an ordinary professional profile into an EB-1 extraordinary-ability case.
Outstanding professors and researchers
This classification is built around sustained recognition and the specific academic or research requirements that apply to the position and employer. It is not interchangeable with an ordinary faculty or research job. The sponsoring institution and the beneficiary must meet the category’s evidence rules.
Multinational executives and managers
This route depends on a qualifying multinational relationship and executive or managerial work. The existence of an overseas employer and a U.S. transfer alone is not enough; the corporate relationship, prior employment, and offered U.S. role must fit the classification.
EB-1 avoids ordinary PERM for the listed classifications, but it remains evidence-intensive. Treat it as a separate category with its own test, not as a faster version of EB-2 or a general reward for career success.
EB-2 national interest waiver (NIW)
How the waiver works
An NIW can waive the permanent job-offer and labor-certification requirements for a person who first qualifies for the underlying EB-2 classification. The beneficiary may file on their own behalf. That two-part structure matters: a petitioner must establish EB-2 eligibility and then establish that the national-interest waiver should be granted.

Underlying EB-2 eligibility
USCIS describes EB-2 as covering professionals with advanced degrees and people of exceptional ability. The petitioner must fit one of those foundations before the waiver analysis begins. A claim that a project is useful to the economy, public health, technology, or another important field does not substitute for the underlying EB-2 qualification.
What the January 15, 2025 alert clarifies
USCIS’s January 15, 2025 policy alert emphasizes that the proposed endeavor and the exceptional-ability analysis must be connected in the manner described by USCIS guidance. The evidence should explain what the person proposes to do, why the work has national importance, why the person is well positioned to advance it, and why waiving the job offer and labor certification is justified under the governing framework. Generic letters of praise or a broad assertion that the work benefits the United States are not an automatic waiver.
Employment and planning implications
Because an NIW is self-petitioned, it can be useful when a person’s work is portable across employers or projects. It is still not a work permit by itself, and approval of the immigrant petition does not complete the green-card process. The applicant must separately handle the immigrant-visa or adjustment stage and any visa-number wait.
EB-5: an investment-based route
EB-5 is fundamentally different from the professional categories. USCIS states that an investor may qualify by making the required investment in a U.S. commercial enterprise and planning to create or preserve 10 permanent full-time jobs for qualified U.S. workers. The investor’s spouse and unmarried children under 21 may also apply as derivative applicants when the program requirements are met.
Investment amounts are time-sensitive
The USCIS page reflected in the available materials lists a standard minimum investment of $1.8 million and $900,000 for a targeted employment area (TEA). Those figures are legally and administratively time-sensitive. Before relying on either amount, confirm the live USCIS rules, the qualifying location, and the applicable filing instructions; do not treat an older web page or a secondary summary as a permanent price list.

Evidence and risk
- The source and lawful path of the capital must be documented.
- The investment must be placed in a qualifying commercial enterprise.
- The business plan must support the required job creation or preservation showing.
- Investment risk is separate from immigration eligibility: an approved petition does not turn a private investment into a guaranteed return.
EB-5 can avoid PERM and does not depend on a conventional employer sponsor, but it requires substantial capital, detailed financial documentation, and compliance with program rules. It is not a substitute for EB-1 or NIW evidence, and a person should not choose it solely because an employment case is inconvenient.
Family sponsorship: a separate legal basis
Family immigration can provide a non-employment basis when a petitioner and beneficiary have a qualifying relationship under the current family-immigration rules. The exact petition categories, preference queues, financial-sponsorship obligations, and visa-availability rules depend on the relationship and the applicant’s circumstances. They should be checked against current USCIS and Department of State guidance before filing.

A USCIS Policy Manual example describes an applicant who originally pursued adjustment through an employment petition, later married a U.S. citizen, and preferred a family-based basis. The example shows that an adjustment case can, in practice, involve a change in the underlying basis. It does not establish that every marriage, every pending application, or every overstay can be converted successfully.
Questions that can change the result
- Who is the petitioner and what is the exact qualifying relationship?
- Is the beneficiary inside the United States or applying through a consulate?
- Is the category immediately available, or is there a preference-category queue?
- Do prior status violations, unauthorized employment, removal history, or inadmissibility issues affect adjustment?
- Are the petitioner’s financial-support documents and domicile requirements satisfied?
Family sponsorship should therefore be evaluated as its own case, not as a backup form of employer sponsorship. The fact that an employment-based applicant later marries a U.S. citizen does not itself answer every eligibility or procedural question.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to choose a route without making an expensive mistake
- Identify the legal foundation. Decide whether your strongest fact is a designated occupation, extraordinary achievement, an advanced degree or exceptional ability tied to a national-interest endeavor, qualifying multinational experience, investment capital, or a family relationship.
- Determine who must file. Schedule A remains employer-driven. Some EB-1 cases and NIW cases can be self-petitioned. EB-5 is filed by the investor. Family cases require the appropriate relative petitioner.
- Separate the petition from the green card. An I-140 approval, family petition approval, or other approved petition does not by itself grant permanent residence. Confirm whether adjustment of status or consular processing is available and whether a visa number is available when required.
- Map the evidence before filing. Build a document list around the category’s actual test: licenses and employer records for Schedule A, sustained recognition for EB-1, degree or exceptional-ability proof plus endeavor evidence for NIW, source-of-funds and job-creation records for EB-5, or civil and financial documents for a family case.
- Check interactions with existing status. A pending adjustment, prior petition, or immigration violation can change which strategy is workable. Do not assume that filing a second petition automatically preserves status or work authorization.
- Model the financial exposure. Budget for government filing fees, medical examinations, translations, document procurement, and any professional advice, while treating EB-5 capital as an investment subject to business risk. Verify current fees and form editions immediately before filing.
Process, timing, and visa availability
There is no reliable universal ranking of these routes by total processing time. Timing can change with the category, country of chargeability, visa-number availability, filing location, agency workload, evidence requests, and individual case facts. A route that avoids PERM may still face a long wait at the immigrant-visa stage.

Typical decision points
- Before the petition: confirm classification, sponsor or self-petition authority, evidence, and current forms.
- At petition filing: verify that the filing package addresses every required element rather than merely describing a desirable outcome.
- After petition approval: monitor visa availability and prepare the adjustment or consular-processing submission when permitted.
- During adjustment: track address changes, biometrics, medical requirements, employment authorization, and requests for evidence.
Use current USCIS notices and Department of State visa-availability information for live timing. A date quoted for one country, category, or filing month should not be presented as a promise for every applicant.
Job changes after filing: a limited portability rule
USCIS explains that certain employment-based adjustment applicants with approved EB-1, EB-2, or EB-3 petitions may change jobs when the adjustment application has been pending for at least 180 days and the new job is in the same or a similar occupational classification. This is a specific portability provision, not a general permission to change employers without consequences.
USCIS excludes extraordinary-ability and NIW-based petitions from that portability provision. Schedule A, standard employer cases, and other categories must be analyzed under the rules that apply to the particular petition and adjustment filing. Before changing jobs, compare the old and new duties, confirm the category’s portability rules, and obtain case-specific advice when the change could affect the petition.
Common misconceptions to avoid
- “No PERM” means “no employer.” Schedule A still requires an employer, and several EB-1 classifications are employer-sponsored.
- “Self-petition” means “automatic approval.” EB-1 extraordinary ability and EB-2 NIW have demanding evidence standards.
- “A petition approval is a green card.” The immigrant-visa or adjustment stage remains.
- “Schedule A covers all healthcare jobs.” The cited Group I occupations are registered nurses and physical therapists.
- “Any beneficial project qualifies for NIW.” The petitioner must first qualify for EB-2 and then satisfy the waiver test.
- “EB-5 is simply a fee.” It involves qualifying capital, a commercial enterprise, and a 10-job requirement, with investment risk.
- “Marriage always fixes an employment case.” A family-based option depends on the relationship, procedure, admissibility, and current category rules.
When professional review is especially important
Fact-specific review is prudent when more than one route appears possible, when a case includes prior status violations or removal proceedings, when the applicant has changed employers, when a proposed NIW endeavor is difficult to define, or when EB-5 funds involve multiple transfers or business entities. The relevant question is not whether a professional can promise approval; it is whether the chosen category is supported by documentary evidence and whether the later adjustment or consular stage is workable.
