Short answer: neither a provider’s headquarters nor a label such as “EU data residency” tells you whether an AI deployment is appropriate for regulated or personal data. Compare the exact product, endpoint, model, account tier, region setting, retention policy, subprocessors and connected tools. OpenAI documents European processing for eligible API projects and European at-rest storage for new ChatGPT Enterprise and Edu workspaces. Mistral describes contractual safeguards and the ability to disable some features that transfer data outside the EU, but does not state that every Enterprise workflow is EU-only. Those are different controls, not interchangeable compliance guarantees.
This guide turns the published positions of OpenAI, Mistral and European regulators into a procurement method. It is a practical comparison, not a legal opinion or an independent certification assessment.

What you are actually comparing
An AI “provider” is not a single data flow. The same company may offer a consumer chat service, an API, an enterprise workspace, hosted models and integrations, each with different storage, processing and support arrangements. Your decision should therefore identify five items before anyone asks whether a service is “European”:

- Product and contract: the exact API, workspace or hosted application and the plan governing it.
- Endpoint and model: the model version, regional endpoint and any tool or retrieval endpoint used with it.
- Data categories: prompts, outputs, uploaded files, conversation history, logs, account information, telemetry, backups and support tickets.
- Configuration: retention, zero-data-retention (ZDR), regional processing, administrator controls and integrations.
- Participants: the provider, subprocessors, cloud infrastructure, support personnel and any service your application calls.
A deployment can process inference in Europe while storing logs elsewhere, or keep prompts in a European workspace while a connected tool sends selected content to another country. Ask where each category travels and rests instead of assigning one geographic label to the whole system.

OpenAI: controls depend on project, workspace and eligibility
European processing for eligible API projects
OpenAI says eligible API customers can create a new project and select Europe as its region. Requests from such projects are handled in-region with zero data retention. In OpenAI’s definition, zero data retention means requests and responses are not stored at rest on its servers; it does not mean that no transient processing, security monitoring or customer-side copy can exist.
The project must be created with the European region. OpenAI states that an existing project cannot be converted after creation, so moving an established workload requires a new project and a deliberate migration. Eligibility is material: the regional option is not presented as a universal property of every API account, endpoint or model.
Endpoint and model exceptions
OpenAI’s API documentation provides the current matrix of supported regional-processing combinations and identifies feature-specific exceptions. Check that matrix for every endpoint and model in the intended workflow. A region selection does not automatically cover tools, tracing, caching, batch jobs, abuse monitoring, support access or a connected service. Record the date of your review because endpoint eligibility and product policies can change.
At-rest storage for new ChatGPT Enterprise and Edu workspaces
OpenAI says new ChatGPT Enterprise and Edu workspaces can store customer content at rest in Europe. The described content includes conversations, prompts, uploaded files and multimodal content. This is a workspace-level storage control, not a promise that every processing step or integration is European. Confirm whether the feature set you need is included and whether the workspace is a new, eligible one.
Privacy, contracts and assurance information
OpenAI’s business privacy materials say its practices support customer compliance with GDPR and other privacy laws. They list alignment or certification information including CSA STAR, SOC 2 Type 2 and standards in the ISO/IEC 27001 family. A certification name is not a finding that your chosen product configuration complies. During diligence, obtain the current report or certificate, inspect its scope and validity, and verify that the service, region and deployment architecture are inside the stated boundary.
OpenAI says it can execute a data-processing agreement (DPA) for ChatGPT Business, Enterprise and API customers. For Enterprise, Edu and Healthcare workspace data, it says administrators control retention and that deleted conversations are removed within 30 days unless legal retention is required. Do not apply that workspace statement to every API endpoint or feature; request the retention language that governs your contract and data classes.
Mistral: transfer safeguards and selective controls
Contractual mechanisms for transfers
Mistral says that contracts with service providers processing personal data outside the EU include safeguards under GDPR Article 46. Where the recipient country has no EU adequacy decision, it says it attaches the latest European Commission Standard Contractual Clauses. Those clauses create a transfer mechanism, but they do not make a transfer the same as EU-only processing or remove the customer’s need to assess the specific recipient and risk.

Subprocessor review and additional protections
Mistral says outside-EU subprocessors undergo a security review. It may add safeguards such as zero data retention or encryption. Ask which subprocessor receives which data, for what purpose, under which contractual role and with which technical control. “May” is important: the cited description does not establish that every subprocessor or every workflow receives the same treatment.
Enterprise feature deactivation
Mistral says Enterprise customers can deactivate some features that involve transfers outside the EU at organization level. The published wording is deliberately limited to “some features.” It does not promise that every Enterprise workflow, support path, model or integration can be made EU-only. Obtain the current feature list and document what functionality disappears when a transfer is disabled.
What a European headquarters does—and does not—prove
The European Data Protection Board’s April 2025 landscape report identifies Mistral AI, based in Paris, and Aleph Alpha, based in Heidelberg, in its discussion of European AI companies. That is useful context, not a vendor-control matrix. The available material does not establish equivalent, current first-party details for Aleph Alpha on residency, retention, DPAs or subprocessors.
A company incorporated or headquartered in Europe can still use infrastructure, support staff or subprocessors elsewhere. Conversely, a non-European provider can offer a contractually and technically constrained European deployment. Treat corporate location as one diligence fact, never as a substitute for a data-flow diagram and product-specific terms.

A repeatable buyer checklist
1. Draw the complete data flow
Start with one use case, such as summarizing support tickets. Diagram the user interface or API client, model endpoint, prompt and output stores, safety or abuse systems, observability tools, retrieval database, file store, support channel, backups and downstream applications. Mark the country and legal entity for each hop. If a vendor cannot identify a hop, treat it as an unresolved risk rather than assuming it is local.
2. Pin down processing location
- Which exact endpoints and models support European processing?
- Does the setting cover inference only, or also moderation, embeddings, batch work, evaluation, tracing and support?
- Are tools, caches, uploads, fine-tuning jobs or web-connected features excluded?
- Can personnel outside Europe access content for security or support, and under what controls?
3. Inventory storage and retention
Request a table covering prompts, outputs, files, conversation history, logs, backups, account metadata and abuse records. For each class, record the storage country, default retention, customer-configurable period, deletion trigger, deletion deadline and legal or security exceptions. A ZDR label should be defined in operational terms, including what is retained temporarily and what your own application stores.
4. Map transfers and subprocessors
Obtain the current subprocessor list and DPA annex. For every recipient, record entity, country, purpose, data categories, controller or processor role, transfer mechanism and objection or replacement process. Ask whether a transfer can be disabled and which functionality is lost. If SCCs are used, assess the recipient-country legal environment and supplementary measures with your privacy counsel.

5. Validate the contract
Confirm that the DPA and commercial terms apply to the exact plan and service. Look for documented instructions, confidentiality, security measures, breach notification, assistance with data-subject rights, deletion or return, audit evidence, subprocessor notice, international-transfer language and liability allocation. A marketing privacy page cannot replace the signed terms.

6. Check assurance evidence
Request the current SOC report, ISO certificate or other assurance evidence and read its scope, system boundary, control period, exceptions and subservice organizations. Verify that your region, endpoint and deployment model are included. “Certified” without a boundary is not a useful procurement conclusion.
7. Confirm commercial and technical eligibility
Regional processing, ZDR or transfer controls may require a particular tier, approval, new project or new workspace. Have the vendor confirm eligibility in writing before architecture is finalized. Test the setting in a non-production project and inspect logs, network destinations and administrative controls.
8. Assign customer responsibilities
Document the data you will send, user groups, lawful basis, notices, minimization, access control, retention schedule, incident process and deletion workflow. Determine whether a data-protection impact assessment is needed. Vendor safeguards do not replace your governance, employee training or access reviews.
How to make a decision without a misleading pass/fail score
Define your requirement before comparing vendors. “No personal data leaves the EU” is stricter than “EU inference with contractual safeguards,” which is stricter than “GDPR-compatible DPA.” Write the requirement as testable conditions:
- Strict geographic requirement: every listed data class, recipient and support path must remain in approved countries, with technical enforcement and evidence.
- Controlled-transfer requirement: transfers may occur only to named recipients under an accepted mechanism, with supplementary safeguards and a documented risk assessment.
- Risk-based requirement: sensitive fields are minimized or pseudonymized, retention is bounded, access is logged and the residual transfer risk is approved.
Score each candidate against the same axes, but keep “not established” separate from “no.” Unknown retention or an unconfirmed endpoint is a diligence gap, not proof that the provider lacks a control. Require evidence for the production configuration, not a generic corporate statement.

Your organization must identify its role, the system’s purpose, risk classification and applicable duties. Depending on the use case, that can involve governance, documentation, transparency, human oversight, monitoring or prohibited-practice analysis. Use qualified legal and compliance advice for the classification; do not infer it from a vendor’s marketing language or European location.
A practical procurement evidence pack
Before approval, keep one dated package containing:
- the product name, plan, endpoint, model and region;
- architecture and data-flow diagrams;
- the DPA, terms and subprocessor annex;
- retention and deletion schedules for every data class;
- regional-processing and feature-eligibility confirmations;
- security reports or certificates with scope and validity;
- transfer-impact analysis and supplementary safeguards;
- configuration screenshots, test results and access-control settings;
- customer-side lawful-basis, minimization, DPIA and incident records; and
- an owner and review date for policy or endpoint changes.
This evidence lets procurement, security and privacy teams revisit the decision when a model, endpoint, subprocessor or product policy changes.

OpenAI offers specifically described European options for eligible API projects and for at-rest content in new Enterprise and Edu workspaces, with important endpoint, model and feature qualifications. Mistral describes Article 46 transfer safeguards, SCCs, subprocessor review and selective Enterprise feature deactivation, but the cited material does not establish that every workflow is EU-only or provide an equivalent universal residency matrix.
