Online gaming GST vs TDS: what Indian players pay and when

No. GST and TDS are different taxes. GST is an indirect tax on the online-gaming supply and is accounted for by the supplier. TDS is income-tax withholding on a player’s net winnings. For online gaming, the clarified GST rate is 28% from 1 October 2023, while section 194BA generally requires 30% TDS on net winnings, deducted when winnings are withdrawn and again on net winnings left in the account at the end of the financial year.

The amount shown in a deposit, entry fee or withdrawal can therefore reflect two separate calculations. GST may be included in the platform’s pricing or invoice, while TDS reduces the amount released as winnings. The exact GST presentation is platform-specific, so use the wallet ledger and tax invoice rather than assuming that 28% was deducted from every deposit.

GST and TDS at a glance

Question GST TDS
What kind of tax is it? Indirect tax on the taxable online-gaming supply. Income-tax withholding on the player’s net winnings.
Who accounts for it? The gaming supplier collects and pays it under GST rules. The person responsible for paying online-game winnings deducts it under section 194BA.
What is the base? The value of the taxable gaming supply. The official material does not establish one universal player-facing display for every platform. Net winnings in the user’s account, calculated under Rule 133 after aggregating winnings and losses during the financial year.
Rate in the cited provisions 28% for actionable claims supplied in online gaming, effective 1 October 2023. 30% under section 194BA.
When does it arise? When the platform supplies the taxable gaming service or claim and records the charge in its pricing or invoice. When a withdrawal occurs, and on remaining net winnings at financial year-end, even if no withdrawal is made.
What might a player see? An invoice line, an entry-fee or wallet-price component, or no separate line where the cost is built into the quoted price. A deduction in the withdrawal statement or an end-of-year adjustment against the wallet balance.

These taxes can affect the same gaming activity without being the same charge. GST is connected to the supply; TDS is connected to income attributed to the player.

How GST applies to online gaming

The 28% rate and its effective date

The GST Council clarified a 28% rate for actionable claims supplied in online gaming. A government press release dated 26 March 2025 states that the online-gaming GST change took effect on 1 October 2023. The date matters when reconciling an old wallet statement with a current one: a transaction before that implementation date should not automatically be read as if the current treatment had always applied.

GST is the supplier’s tax obligation

GST is charged on the taxable supply made by the platform. The platform is responsible for accounting for the tax and remitting it under the GST system; it is not a withholding of your winnings. A player may bear the economic cost because the platform can include GST in an entry amount, service price or other quoted amount, but the platform’s invoice and terms determine how that cost is presented.

Does GST apply to a deposit or only to the game entry amount?

There is no single player-facing display mandated in the cited government material for every platform. A deposit is money placed in a wallet; an entry amount is consideration connected with a game or contest. Whether the platform shows GST separately, embeds it in the amount you pay, or presents it on an invoice depends on its current billing design and the applicable valuation rules.

Do not infer the answer from the word “deposit” alone. Check:

  • the tax invoice or receipt for the particular transaction;
  • the platform’s fee and GST description in its terms;
  • the wallet ledger showing the amount debited for an entry, contest or service; and
  • whether the statement distinguishes a cash deposit from a gaming charge.

If the statement does not explain the amount, ask the platform for an invoice-level breakup. Keep that response with your transaction records; a generic 28% calculation on every wallet top-up may be wrong.

How TDS works under section 194BA

The 30% withholding rate

The Income Tax Department’s current TDS-rate table lists section 194BA at 30%. The provision became effective on 1 April 2023. Section 194BA requires the person responsible for paying income by winnings from an online game to deduct tax on the “net winnings in his user account.”

This is not a 30% deduction from every deposit, every stake or every gross credit. It is withholding against net winnings calculated under the prescribed rule. The statutory rate applies to online games as defined in the provision; the cited sections do not create separate TDS rates for games described as skill-based and games described as chance-based.

When the deduction is made

There are two checkpoints during an Indian financial year (1 April to 31 March):

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Withdrawal: when you withdraw money, the platform calculates the net winnings attributable under the applicable method and deducts TDS before releasing the amount.
  2. Year-end: the platform must also deduct tax on net winnings remaining in the user account at the end of the financial year. This applies even when you made no withdrawal.

Consequently, a player can see no TDS on an early deposit, a deduction on a later withdrawal, and another deduction or wallet adjustment around 31 March. Those events are parts of one annual calculation, not three different tax rates.

Rule 133 and the meaning of “net winnings”

The Ministry of Electronics and Information Technology stated in a Lok Sabha answer on 2 August 2023 that Rule 133 of the Income-tax Rules, 1962 lays down the formula for calculating net winnings. In simplified form, the annual calculation uses:

Net winnings = (aggregate withdrawals during the financial year + closing user-account balance) − (non-taxable deposits during the financial year + opening user-account balance).

The exact ledger categories and treatment must follow Rule 133 and the platform’s records. The important practical point is that the calculation aggregates the year’s activity. It is not a 30% levy on each incoming credit, and it does not ignore losses merely because a particular winning transaction appears separately in the app.

Are losses adjusted before TDS?

Yes, the government explanation of Rule 133 says net winnings are calculated after aggregating all winnings, including losses, during the year. A losing contest can therefore reduce the year’s net result used for TDS. It does not, however, create a right to withdraw tax already deducted immediately from an earlier event; the platform’s subsequent annual reconciliation and your final income-tax position determine how the numbers are reflected.

  • Note: Nintendo devices do not support Fortnite Shared Wallet, so V-Bucks purchased using your account balance will not show up on your Nintendo device. Worked examples of the timing

These figures are illustrations of the mechanics, not a prediction of any platform’s ledger or invoice.

Example 1: profit remains in the wallet

Assume an opening balance of ₹0, non-taxable deposits of ₹10,000 during the year, no withdrawals, and a closing balance of ₹20,000 after all games. Applying the simplified Rule 133 structure gives net winnings of ₹20,000 − ₹10,000 = ₹10,000. At 30%, the illustrative TDS is ₹3,000. The absence of a withdrawal does not prevent the year-end deduction.

Example 2: withdrawal during the year and a closing balance

Assume an opening balance of ₹0, deposits of ₹10,000, withdrawals totalling ₹25,000, and a closing balance of ₹5,000. The annual net-winnings figure is (₹25,000 + ₹5,000) − (₹10,000 + ₹0) = ₹20,000. The indicative 30% tax on that net amount is ₹6,000. In practice, the platform applies the withdrawal and year-end checkpoints as they occur, so the deductions may appear in separate statements rather than as one ₹6,000 line.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Example 3: losses reduce the annual result

Suppose deposits total ₹15,000, withdrawals total ₹12,000 and the closing balance is ₹5,000. The simplified annual result is (₹12,000 + ₹5,000) − ₹15,000 = ₹2,000, not 30% of the ₹12,000 withdrawn and not 30% of every winning credit. The illustrative TDS at 30% would be ₹600, subject to the platform’s Rule 133 ledger and timing calculations.

How GST and TDS can appear together

Consider a contest entry shown as ₹1,000 and a later withdrawal. The ₹1,000 may be displayed as a tax-inclusive price, a base amount plus GST, or another platform-defined charge. Separately, if the year’s account activity produces net winnings, TDS can be deducted from the withdrawal. The two lines should not be added together as if both were 30% taxes, nor should a GST line be treated as proof that you have made taxable winnings.

Use separate records for each tax:

  • GST record: invoice or receipt, date of supply, description of the gaming charge, and amount paid.
  • TDS record: withdrawal statement, tax deducted, date of deduction, and the platform’s cumulative net-winnings calculation.
  • Reconciliation record: opening balance, deposits, withdrawals, losses, winnings and closing balance for each financial year.

What to do when 30% is deducted from a withdrawal

  1. Identify whether the deduction is labelled TDS, income tax or section 194BA. Do not assume an unexplained “fee” is tax.
  2. Check the withdrawal date and the financial year in which it falls.
  3. Download the account ledger for the full year, not only the winning transaction.
  4. Verify opening balance, deposits, withdrawals and closing balance against the Rule 133 categories.
  5. Look for losing games and cancelled or reversed entries; these may affect the aggregate net result.
  6. Check whether a year-end deduction has already been made or is still pending.
  7. Ask the platform for a written calculation when its statement cannot be reconciled.
  8. Retain the deduction statement and other tax records for your income-tax filing.

If the platform deducted 30% from a deposit or from the entire withdrawal without showing a net-winnings basis, seek clarification. Section 194BA does not describe a blanket 30% charge on deposits.

Withholding versus your final income-tax position

Section 194BA is the withholding mechanism. Section 115BBJ provides a special 30% income-tax rate on online-game net winnings for assessment year 2024-25 onward. The assessment year follows the financial year in which the winnings arose, so keep the year labels straight when matching a March deduction with the return filed for the corresponding assessment year.

A TDS deduction is evidence of tax withheld; it is not a substitute for checking the year’s complete online-game income and records. Reconcile the platform statement with the tax information available to you and report the income under the rules that apply to your circumstances. If multiple platforms, refunds, disputed transactions or unusual balances are involved, obtain advice from a qualified tax professional rather than estimating from one withdrawal screen.

Skill, chance and regulatory context

The statutory definition used for these provisions covers an internet-accessible “online game.” The cited section 194BA and section 115BBJ materials do not prescribe one rate for skill games and another for chance games. Describing a game as skill-based therefore does not, by itself, remove the 30% TDS rule or create a different rate under these provisions.

Tax treatment is separate from whether a particular service is permitted to operate. The Ministry of Electronics and Information Technology and the Press Information Bureau reported 1,410 blocking directions relating to online betting, gambling and gaming websites between 2022 and February 2025. That regulatory figure does not change the GST or TDS arithmetic for a transaction, but it is a reason to keep records and verify that a platform is lawfully available in your jurisdiction.

Common mistakes to avoid

  • Calling GST and TDS the same tax: GST is a supply tax; TDS is withholding on net winnings.
  • Multiplying every deposit by 30%: section 194BA targets net winnings, not deposits.
  • Ignoring losses: Rule 133 aggregates winnings and losses for the year.
  • Expecting TDS only at withdrawal: remaining net winnings are subject to the year-end checkpoint.
  • Assuming every 28% amount is GST on a top-up: inspect the invoice and wallet description.
  • Confusing a financial year with an assessment year: deductions from 1 April to 31 March relate to the return for the following assessment year.
  • Using a single winning transaction to estimate tax: reconcile the complete annual ledger.

Annual player checklist

  • Save every GST invoice or receipt issued after the 1 October 2023 implementation date.
  • Export a complete wallet ledger at least once each financial year.
  • Record opening balance, deposits, withdrawals, winnings, losses and closing balance.
  • Mark each TDS deduction and whether it occurred on withdrawal or at year-end.
  • Compare the platform’s net-winnings figure with the Rule 133 structure.
  • Keep the platform’s TDS statement with your income-tax records.
  • Resolve unexplained GST or TDS entries in writing before filing.

The practical rule is simple: treat GST as the platform’s charge for supplying online gaming, and treat TDS as a 30% withholding calculation on annual net winnings under section 194BA. The wallet ledger, invoice and financial-year dates determine which amount you actually pay and when.
