Short answer: If you were newly appointed to a Central Government civil post on or after 1 January 2004, you are generally covered by the National Pension System (NPS), not the Old Pension Scheme (OPS) under the Central Civil Services pension rules. However, recruitment chronology, a qualifying technical resignation, or a narrowly defined UPS contingency can change the result. The decisive evidence is your recruitment record, appointment order, previous employer, resignation documents and any option accepted by the competent authority.
This explanation applies to Central Government civil employees. State Government employees must use their own State’s pension rules and orders; Central rules cannot be assumed to apply.

What changed on 1 January 2004?
The Government of India introduced NPS for new Central Government recruits, except the armed forces, from 1 January 2004. The Ministry of Personnel stated in 2022 that OPS benefits under the CCS (Pension) Rules, 1972 were not admissible to civil servants appointed on or after that date because the rules were amended when NPS was introduced.

Some employees recruited against pre-cutoff vacancies, and some employees who moved between qualifying government establishments after a technical resignation, may fall under specific transition orders. Those are defined exceptions rather than a general reopening of OPS.

What the 2022 policy statement does—and does not—say
The 2022 Government statement said there was no proposal then under consideration to restore OPS broadly for Central civil employees covered by NPS. This was a statement of policy at that time, not a guarantee about every later development. It should not be read as cancelling the historical exceptions or the later UPS rules described below.
Are you eligible if you joined after 2004?
Joining after 1 January 2004 normally places a new Central civil recruit in NPS. To determine whether an exception applies, separate the dates and events that are often incorrectly treated as one date.
| Fact to establish | Why it matters |
|---|---|
| Date of appointment | New Central civil appointments on or after 1 January 2004 were generally brought under NPS. |
| Date the recruitment result was declared | A one-time route covered some candidates whose result was declared by 31 December 2003. |
| Date of the vacancy | The 2020 route required a vacancy occurring before 1 January 2004. |
| Date the post or vacancy was advertised or notified | A later instruction concerned certain posts or vacancies advertised or notified before 22 December 2003. |
| Previous employer and departure method | Technical resignation from a qualifying establishment can preserve service in limited circumstances; ordinary resignation does not automatically do so. |
| Option and acceptance record | Historical options had prescribed windows and conditions. A submitted option may also have needed acceptance by the competent authority. |
Exception 1: recruitment before the cutoff, joining later
The 2020 one-time option
The Department of Pension and Pensioners’ Welfare (DoPPW) issued a 2020 release for certain Central employees whose recruitment result had been declared by 31 December 2003 against vacancies occurring before 1 January 2004, but who joined on or after 1 January 2004. The release specified 31 May 2020 as the deadline to exercise the option and stated that an option once exercised was final.
This route is not an open application today. The deadline has passed, so an employee cannot rely on the existence of the old order without proving that the person qualified and exercised the option within the permitted period. The appointment file should show the recruitment result, the relevant pre-2004 vacancy and the joining date.

The advertised-or-notified cutoff described in 2023
An official PIB publication page summarised a March 2023 instruction concerning Central civil employees appointed against posts or vacancies advertised or notified before 22 December 2003, even though they were covered by NPS when they joined on or after 1 January 2004. The wording is narrower than a general rule for everyone recruited through an old examination or advertisement.
Because the PIB page is a summary, an employee seeking a decision should obtain the underlying DoPPW order and compare its exact conditions with the recruitment notice, vacancy file and appointment order. The 22 December 2003 date is a cutoff used in that instruction; it does not replace the general 1 January 2004 NPS start date.
How to test a pre-cutoff recruitment claim
- Obtain the original recruitment advertisement or notification and identify the post, vacancy year and issuing authority.
- Obtain the result notice or selection list and confirm whether the result was declared by 31 December 2003.
- Match the record to the applicable DoPPW order: the 2020 result-and-vacancy route or the later advertised/notified-post route.
- Check whether the prescribed option was filed by the relevant deadline and whether the department accepted it.
- Ask the personnel or pension section to record its decision in writing, with the order relied upon.
Does service count after moving to another government department?
It can, but only where the move fits the rules for technical resignation and the applicable service-continuity orders. A person who simply resigns, leaves a break in service and later obtains another government job does not automatically carry the earlier service into the new pension calculation.
What “technical resignation” means in this context
Technical resignation is a documented transition from one qualifying government post to another, handled under the applicable government instructions, rather than a voluntary severance that ends all service rights. The resignation acceptance, release order, continuity of appointment and any required transfer of pensionary value or related formalities are important. The label must appear in the official records; an employee cannot create continuity merely by describing an ordinary resignation as technical.

Employees appointed before 1 January 2004
DoPPW instructions address counting past service where an employee appointed before 1 January 2004 moved to Central Government service on or after that date after technical resignation from qualifying Central Government or State Government service, or from certain qualifying autonomous bodies. The purpose was to preserve the applicable old-scheme position for an eligible transition, subject to the conditions in the relevant orders.
The former establishment matters. A Central department, a State department and an autonomous body may operate under different pension arrangements. The service book should show that the earlier post was covered by the required rules and that the move was processed through the prescribed channel.
Limited NPS-era transition: 1 January 2004 to 28 October 2009
A separate memorandum reproduced in a Government-hosted copy discusses an option for certain employees who entered Central Government service or a Central autonomous body under NPS between 1 January 2004 and 28 October 2009 after technical resignation from a qualifying previous establishment. The memorandum describes a three-month period to exercise the option and refers to conditions in other orders.

This is a historical, conditional route—not an automatic conversion for everyone appointed during that period. The original memorandum, later amendments and the employee’s actual option record must be checked. In particular, confirm the previous establishment’s pension scheme, the technical-resignation wording, continuity between posts and whether the option was exercised within the prescribed window.

Technical resignation versus ordinary resignation
| Situation | Likely significance |
|---|---|
| Technical resignation recorded while moving to a qualifying government post | Past service may be countable if every condition in the applicable order is met. |
| Ordinary resignation from the earlier post | Past service is not automatically preserved for OPS or NPS purposes. |
| Break between jobs with no approved continuity | Continuity cannot be assumed; the break and departure documents require review. |
| Move from an autonomous body | Eligibility depends on whether that body and its pension scheme are covered by the relevant order. |
What documents decide an individual case?
Verbal assurances are rarely enough for a pension classification. Assemble a chronological file before asking for a final determination.
- Recruitment advertisement, vacancy notification and evidence of the vacancy date.
- Result notice, selection list and the date the result was declared.
- Appointment order, joining report and first entry in the service book.
- Previous employer’s service book extracts and pension-scheme coverage.
- Resignation letter, acceptance order and any document expressly recording technical resignation.
- Relieving and joining orders showing whether the transition was continuous.
- Orders concerning transfer of pensionary value, contributions or other required formalities.
- Copies of any OPS, NPS or UPS option, acknowledgement and competent-authority decision.
- Current NPS or UPS account details and the department’s scheme classification.
A practical decision path
- Identify the employer. Confirm that the post is in the Central civil service. If it is a State post, stop and obtain the State’s current pension orders.
- Apply the baseline. If this was a new Central civil appointment on or after 1 January 2004, classify it as NPS unless a specific exception is documented.
- Check recruitment chronology. Compare the result date, vacancy date and advertisement or notification date with the 31 December 2003 and 22 December 2003 cutoffs used in the historical instructions.
- Check transition history. If the employee moved from another government establishment, determine whether the departure was technical resignation and whether the former establishment is covered.
- Check option history. Look for the 31 May 2020 deadline, the three-month historical option described for the 2004–2009 transition and any other deadline stated in the applicable order.
- Check the current scheme. Establish whether the employee remains in NPS or has selected UPS from the available Central Government options.
- Request a written ruling. Submit the documents to the Ministry or Department pension authority and ask for the exact rule and order supporting the classification.
Where UPS fits—and where it does not
The Government introduced the Unified Pension Scheme (UPS) as an option under NPS for eligible Central Government employees from 1 April 2025. The CCS (UPS) Rules, 2025 were notified on 2 September 2025. UPS is therefore a current scheme choice within the NPS framework; it is not a universal restoration of OPS for every NPS employee.
Death, invalidation and disablement provisions
In June 2025, DoPPW issued instructions allowing an employee covered by UPS to choose benefits under the CCS (Pension) Rules, 2021 or the CCS (Extraordinary Pension) Rules, 2023 in specified events: death during service, or discharge because of invalidation or disablement. The prescribed option must be exercised through the employee’s Ministry or Department for the relevant event.
This contingency should not be confused with a general right to switch from UPS or NPS to OPS while continuing in service. The June instruction establishes a defined benefit route for defined circumstances, not an unrestricted election for all UPS members.

Common mistakes that lead to rejected claims
- Using joining date alone: recruitment result, vacancy and advertisement dates may be material.
- Treating every old advertisement as qualifying: the exact cutoff and order wording control.
- Calling any resignation “technical”: the official acceptance and continuity documents must support that status.
- Assuming previous service always transfers: the former employer, pension scheme and required formalities must all qualify.
- Relying on a missed historical deadline: the 31 May 2020 deadline and other limited option windows are not automatically reopened.
- Confusing UPS with OPS: UPS operates as an option under NPS, with a separate contingency for death or invalidation-related cases.
- Applying Central rules to State employees: each State sets its own pension framework and transition orders.
Key dates and what each date means

| 2 September 2025 | Date the CCS (UPS) Rules, 2025 were notified. |
What State Government employees should do
State employees should not use the Central 1 January 2004 rule as their answer. States may have adopted NPS on different dates, retained OPS for different categories or issued their own recruitment and service-continuity orders. Obtain the State finance or personnel department’s current notification, then compare the employee’s appointment, recruitment and resignation records with that State’s rules.
Final answer for the most common questions
“I joined a Central Government job after 2004. Do I get OPS?”
Usually no, because NPS applies to new Central civil recruits from 1 January 2004. A pre-cutoff recruitment exception or a qualifying technical-resignation transition must be proven from the records.
“I joined another department. Does my earlier service count?”
It may count only under the applicable technical-resignation and service-continuity orders. Ordinary resignation, an undocumented transition or an uncovered former employer does not establish continuity.

“Can I switch from NPS or UPS to OPS?”
There is no general switch for all members. Historical options were limited and deadline-bound. UPS has a defined OPS-rule benefit option for death in service or discharge due to invalidation or disablement, subject to the prescribed departmental process.
Frequently Asked Questions
Do armed-forces personnel follow the same 1 January 2004 NPS rule described here?
No. The Central Government’s NPS introduction described here expressly excluded the armed forces. Their pension framework must be checked under the rules applicable to military service.
Is the 31 May 2020 option still available to a new applicant?
No. It was a one-time deadline stated by DoPPW for the specified recruitment-result exception. A current claim requires proof that the employee qualified and exercised the option in time.
Which authority should decide a disputed classification?
The employee’s Ministry or Department pension or personnel authority should examine the service book and recruitment records and issue a decision under the applicable DoPPW order.
