For most individual investors who want straightforward, limited-dollar exposure to oil, an unleveraged oil ETF is the more practical choice. You buy shares in a securities account, pay the full share price, and avoid futures approval and margin calls. Direct West Texas Intermediate (WTI) futures are more precise and liquid, with nearly continuous trading and a closer link to the physical crude market, but they require a futures-enabled account, margin monitoring, expiry decisions and the ability to absorb losses that can exceed your initial deposit.
Neither vehicle simply delivers the daily spot price of crude. ETF returns can be altered by futures rolls, contango, backwardation, fund expenses and tracking differences. Futures prices are also shaped by the curve, daily mark-to-market and the contract you choose. Your holding period, tax status, risk capacity and tolerance for active management should determine the vehicle.

What you actually own
An oil ETF share
An oil ETF is a security traded on an exchange. When you buy a share, you own an interest in the fund, not a barrel of crude. The fund seeks oil exposure through futures and other permitted commodity interests. Its share price can therefore diverge from both the fund’s net asset value (NAV) during stressed markets and from the spot price of crude over time.
ETFs are designed to make access and position management simple. You place a stock-style order through a securities account, and an unleveraged share is paid in full rather than supported by a futures margin deposit. That simplicity does not remove structural risks: the fund still has to manage futures positions, contract rolls, expenses and tracking error.

A WTI futures position
A WTI futures contract is a standardized derivative tied to physically delivered light, sweet crude at Cushing, Oklahoma. You do not pay the contract’s full notional value when opening the trade. Instead, your broker requires margin, and the position is settled to market each trading day. Gains and losses are credited or debited in cash as the contract price changes.
Because margin controls a larger notional position, a relatively small move in oil can produce a large percentage gain or loss on the money in your account. If losses reduce your available margin below the broker’s requirement, you may have to add funds or reduce the position. A broker can liquidate a position without waiting for your instruction.
Oil ETFs versus WTI futures at a glance
| Factor | Oil ETF | WTI oil futures |
|---|---|---|
| How you access it | Buy and sell exchange-traded shares through a securities account; futures approval is normally unnecessary. | Use a futures-enabled account, obtain broker approval and maintain required margin. The CFTC advises checking that both the individual and firm are properly registered. |
| Trading schedule | Trades during the ETF’s exchange session. The share can trade at a premium or discount to underlying value. | CME advertises approximately 24-hour access, allowing reactions to overnight oil, weather or political events. |
| Source of exposure | The fund uses futures and other permitted commodity interests, so performance can differ from spot crude. | You select a specific WTI contract and receive direct exposure to that contract’s price, basis, expiry and any roll decision. |
| Leverage | An unleveraged share is paid in full. There is no futures-style margin call on the share, although its market value can fall substantially. | Margin supports a larger notional position. Leverage magnifies both gains and losses and can lead to forced liquidation. |
| Roll and carry | The fund must repeatedly roll expiring contracts. Contango can create negative roll yield; backwardation can contribute positively, all else equal. | You decide whether and when to roll, but the futures curve, daily settlement and expiry still affect results. |
| Liquidity and execution | Intraday share liquidity is convenient, but the ETF price can diverge from NAV, especially during market stress. | CME describes WTI as one of the world’s most liquid oil contracts, with a tight connection to the physical market. |
| Typical costs | Fund expenses, bid-ask spread, brokerage commission, roll slippage and tracking error. | Commission, exchange and clearing charges, bid-ask spread, funding or cash-management costs, and active expiry or roll management. There is no ETF management fee. |
| U.S. tax treatment | Depends on the fund’s legal structure and investments. Read the current prospectus and tax reporting documents; USO states that qualifying Section 1256 gains are allocated to shareholders. | Qualifying regulated futures generally receive Section 1256 mark-to-market treatment with a 60% long-term and 40% short-term capital-gain split. |
Why an oil ETF may not track crude oil
Futures exposure is not spot exposure
Many oil funds hold futures rather than inventories of crude. The price of a futures contract reflects expectations about supply, demand, storage, financing and delivery conditions for a particular month. Spot crude is the price for immediate physical oil. Those prices can move differently, so a fund can rise less than spot oil, fall while spot oil rises, or outperform spot for a period.

Contango creates a roll drag
When later-dated contracts cost more than the expiring contract, the curve is in contango. A fund that maintains exposure must sell the nearer contract and buy a more expensive later contract. If the curve remains in contango, the fund may repeatedly sell low relative to the replacement contract and incur a negative roll contribution even when headline oil prices are stable.
The CFTC describes this maintenance process as closing the expiring “near” or “front-month” contract and entering an “out-month” contract with a later delivery date. The effect compounds over repeated rolls. A long holding period can therefore produce disappointing returns compared with a chart of spot crude.

Backwardation can help, but is not guaranteed
In backwardation, later contracts are priced below nearer contracts. Rolling forward can then provide a positive roll contribution, all else equal. That benefit can disappear if the curve changes, if spot prices move against the fund, or if expenses and trading friction outweigh the roll gain.
Expenses, slippage and NAV differences
Fund operating expenses are deducted from assets. Bid-ask spreads and the cost of trading contracts add friction. Around a roll, the relationship between the ETF share price and the value of its holdings can weaken, and market stress can widen the gap between the trading price and NAV. These effects explain why an ETF’s return should be evaluated against its stated benchmark and actual total-return history, not against spot crude alone.
How direct WTI futures work
Margin is a deposit, not a maximum loss
The initial margin is collateral that supports a futures position; it is not a down payment that caps your risk. CME gives an illustrative range of roughly 3% to 12% of a NYMEX WTI contract’s value, while emphasizing that requirements change. A broker can require more than the exchange minimum, and maintenance requirements can rise when volatility increases.
For example, if the contract value moves against you, the daily settlement debit comes out of available cash. A position that met the opening requirement can become under-margined later the same day. You must have a plan for additional capital, a smaller position or an immediate exit.
Daily mark-to-market
Futures are settled daily rather than waiting until you close the trade. Profits can be withdrawn or used as collateral, while losses reduce your account balance immediately. This mechanism makes risk visible quickly but also means a short-lived adverse move can trigger a margin call even if you expect the market to recover eventually.

Expiry, delivery and rolling
WTI contracts have defined delivery months. A trader who does not want physical delivery must close or roll before the broker’s cutoff. Rolling means selling the current contract and buying a later one; the price difference between those contracts affects the trade’s result. The exact timing and contract month matter because the curve can change from contango to backwardation between rolls.

CME promotes roughly 24-hour trading. This can be valuable when an election, storm, geopolitical event or inventory announcement moves oil outside the ETF’s exchange session. It also means prices can move while you sleep, so resting orders, alerts and sufficient available margin are essential.
Access, account and operational requirements
What an ETF investor needs
- A securities account that permits exchange-traded funds.
- Cash sufficient to pay for the shares, plus any brokerage commission and spread.
- A benchmark and prospectus review that explains the fund’s contracts, roll schedule, expenses and tax reporting.
- A position size that remains acceptable if oil prices fall sharply.
You can generally hold an unleveraged ETF without monitoring futures margin or a delivery calendar. You still need to check the fund’s holdings and tracking behavior, particularly if you intend to hold it for months or years.
What a futures trader needs
- A futures-enabled account and broker approval.
- Cash for initial and maintenance margin, plus a reserve for adverse daily settlements.
- Knowledge of contract size, tick value, trading hours, price limits, expiry and the broker’s liquidation policy.
- A written plan for stop levels, maximum loss, overnight exposure and rolling or closing before delivery.
- Verification through the CFTC that the person and firm handling the account are registered.
Approval does not make a futures position suitable. A trader must be able to tolerate losses that exceed the initial margin deposit and respond quickly when margin requirements change.
Costs that determine the real result
ETF cost stack
The visible share price is only one part of the cost. The fund’s expense ratio reduces NAV over time. You also pay the bid-ask spread when entering or exiting, any brokerage commission, and the implicit cost of rolling contracts. Tracking error combines these effects with differences between the fund’s portfolio and its benchmark.

Futures cost stack
Futures costs include commissions, exchange and clearing charges, and the bid-ask spread. You may incur financing or opportunity costs on cash held as collateral. Rolling can create a gain or loss depending on the curve. Although there is no ETF management fee, the need to monitor positions and roll dates creates an active-management burden.
Why “cheaper” is not a complete comparison
An ETF can appear inexpensive because it requires no margin account, yet persistent contango or tracking error can dominate its expense ratio. Futures can have tight execution and no management fee, yet leverage, commissions and forced liquidation can overwhelm those advantages. Compare expected holding period, curve conditions, position size and tax treatment rather than a single fee number.

Section 1256 futures
Qualifying regulated futures generally are marked to market at year-end, even if you have not closed the position. Gains and losses are generally treated as 60% long-term and 40% short-term capital gains under Section 1256. The split is based on the tax rule, not on how long you personally held the contract. U.S. Congress identifies this 60/40 treatment, and IRS Publication 550 (2025) explains the reporting framework.
Tax treatment can differ for hedging, special account types, non-U.S. taxpayers and contracts that do not qualify. A tax professional should review your circumstances before you rely on the 60/40 result.

An oil ETF’s reporting depends on its legal structure and the instruments it holds. Read the current prospectus, annual tax information and shareholder reporting documents. USO states that qualifying Section 1256 gains are allocated to shareholders, but that statement does not establish identical treatment for every oil fund. Do not assume that every commodity ETF receives the same tax result as a direct futures position.

Risk scenarios investors should understand
Oil rises, but the ETF lags
Spot crude can rise while an ETF underperforms because the fund rolls from a cheaper expiring contract into a more expensive contract, pays expenses and experiences tracking error. This is a normal consequence of futures-based exposure, not necessarily a fund malfunction.
Oil is flat, but the ETF loses value
A persistent contango can create a negative roll contribution while spot prices remain unchanged. Over a long holding period, that drag can be material.
A futures trade moves against you overnight
A sharp move can reduce available margin before the regular ETF session opens. You may face a margin call or liquidation at an unfavorable price. The possibility of eventual recovery does not prevent the daily cash debit.
A futures position reaches expiry
If you have not closed or rolled in time, delivery procedures can apply. Broker deadlines may be earlier than the exchange’s final date. Confirm the firm’s cutoff and delivery policy before opening the contract.
The ETF trades away from NAV
During a stressed or illiquid market, the share price can trade at a premium or discount to the value of the underlying positions. A market order may execute far from the price shown moments earlier. Limit orders and attention to spreads can reduce execution surprises, although they cannot eliminate market risk.
A decision framework for individual investors
Choose an unleveraged oil ETF when
- You want a defined cash outlay and stock-style order entry.
- You do not have, or do not want, futures approval.
- You cannot monitor margin and expiry throughout the trading day.
- Your intended exposure is modest and you accept that returns may diverge from spot oil.
- You are prepared to examine the fund’s prospectus, roll policy, expenses and tax documents.
Consider direct WTI futures only when
- You understand contract notional value, tick movements, margin and daily settlement.
- You can fund losses beyond the opening margin deposit without jeopardizing essential finances.
- You need near-continuous access or a tighter link to a selected WTI contract.
- You have a specific plan for stop levels, overnight risk, expiry and rolling.
- You have verified the broker’s registration, fees, liquidation rules and margin schedule.
When neither is appropriate
If a potential oil loss would threaten rent, emergency savings, debt payments or other essential goals, neither vehicle fits that money. Oil can be highly volatile, and a diversified portfolio may offer a more appropriate way to express a long-term investment objective than a concentrated commodity position.
Practical checklists before placing a trade
ETF checklist
- Read the current prospectus and identify exactly which futures contracts and other instruments the fund may hold.
- Check whether the fund targets front-month exposure, a broader strip or another benchmark.
- Review the expense ratio, historical tracking difference and the fund’s stated roll process.
- Compare the current share price with NAV and use a limit order when spreads are wide.
- Decide in advance what loss, holding period or curve change would make you exit.
- Save the fund’s annual tax reporting information for your records.
Futures checklist
- Confirm the contract month, delivery terms, tick value and current exchange and broker margin.
- Calculate the full notional exposure and the dollar loss from a plausible adverse price move; do not size from the margin deposit alone.
- Reserve cash for daily settlement and a possible margin increase.
- Set alerts and define whether the position may remain open overnight.
- Record the broker’s expiry, first-notice and liquidation deadlines.
- Write the roll instruction, including the replacement month and the maximum acceptable spread.
- Verify registration and understand commissions, exchange charges and clearing costs.
Bottom line
An unleveraged oil ETF is usually the better starting point for an individual investor who values simplicity, a defined cash commitment and no futures margin call. It is not a spot-oil substitute: contango, roll costs, expenses and NAV differences can materially change the result. Direct WTI futures are the more precise and liquid tool for an experienced trader who can manage leverage, daily settlement, expiry and rolling. The appropriate choice depends on your holding period, the shape of the futures curve, tax situation and ability to withstand losses—not on a universal claim that one instrument is always superior.
