Short answer: an oil-and-gas regulator authorizes and supervises the well, lease and production activity, while an environmental agency controls pollution pathways and protects air, water, land, wildlife and public health. A single project can therefore need an oil-and-gas approval plus separate air, water, waste, spill-prevention or environmental-review approvals.
Which office issues each approval depends on the land, minerals, facility and delegation arrangement. Federal-lease drilling commonly involves the Bureau of Land Management (BLM), the Environmental Protection Agency (EPA) or a state agency operating an EPA-approved program, and sometimes other federal or Tribal authorities. State, federal and Tribal requirements can apply at the same time.

What each regulator is actually regulating
The oil-and-gas regulator regulates the resource operation
An oil-and-gas commission, conservation department or federal oil-and-gas office is concerned first with the petroleum activity itself. Its jurisdiction commonly includes:
- Whether a lease or mineral area is available for development.
- Approval of exploration and drilling applications.
- Well location, design, casing and cementing requirements.
- Completion, workover and production conditions.
- Measurement and reporting of oil, gas and other production.
- Resource conservation, waste prevention and operating rules.
- Well integrity, plugging and abandonment.
- Inspections of drilling, production, workovers, abandonment, records and operating conditions.
On federal leases, BLM’s application-for-permit-to-drill program illustrates this role. BLM’s rules govern exploration, development and production on federal leases, and BLM inspects drilling, production, workovers, abandonment, records and environmental conditions. BLM has reported more than 25,000 inspections annually since fiscal year 2015.

The environmental agency regulates the effects and pollution pathways
An environmental agency starts with the environmental medium or public-health risk rather than ownership of the well. EPA describes its permitting programs as protecting air, land, groundwater, surface water, marine resources and communities. Those permits can set emission and discharge limits and require monitoring, recordkeeping and reports.
Depending on the activity, an environmental authority may regulate:
- Air emissions from drilling, production, processing, storage or other equipment.
- Discharges to surface water or other waters.
- Groundwater protection and underground injection or related activities.
- Hazardous or other regulated waste handling and disposal.
- Spill prevention, preparedness, reporting and response obligations.
- Disturbance of land, habitat or other environmental resources.
- Monitoring, sampling, corrective action and public-health safeguards.
The same physical facility can be subject to both sets of rules. A drilling permit does not automatically authorize an air emission, a water discharge, a waste-management activity or a spill-risk practice.

Who issues a drilling permit?
There is no single nationwide answer. The issuing office is determined by the land, mineral ownership, facility and governing program.
Federal onshore leases
For drilling on federal leases, BLM is the central oil-and-gas permitting authority for the application for permit to drill. BLM reviews the proposed operation under its leasing and drilling rules and attaches lease stipulations and site-specific conditions of approval.
BLM cannot approve a federal-land drilling application until required environmental reviews are completed. Those reviews can include the National Environmental Policy Act (NEPA), the National Historic Preservation Act (NHPA) and the Endangered Species Act (ESA). Completion of that review does not turn BLM into the issuer of every environmental permit, and it does not eliminate separate air, water, waste or spill requirements.

State or private mineral estates
A state oil-and-gas commission or equivalent conservation agency commonly handles the drilling, completion, production and plugging approval for wells on state or private mineral estates. The environmental permit may come from a separate state environmental department, a delegated state program or, in some circumstances, EPA or another federal authority.

The fact that a state office issued the drilling approval therefore does not establish that all environmental permissions are complete.
Tribal lands
Tribal lands can involve Tribal, federal and state authorities, depending on the land status and the program at issue. A Tribal or federal oil-and-gas approval may address the well and mineral activity, while environmental requirements may be administered by a Tribal authority, EPA or another authorized agency. The responsible offices must be confirmed for the specific project.
Offshore facilities and transfers
Offshore operations add another layer of jurisdiction. EPA’s oil-facility guidance explains that EPA generally regulates drilling, producing, refining, storing, disposing and certain transferring operations at various facility types. The Department of Transportation generally handles transportation and transfers to or from vessels, while a complex facility may be regulated by EPA and DOT or the U.S. Coast Guard. The facility boundary and the particular movement of oil or hazardous material matter.
How approvals interact on one project
Think of a project as a set of linked approvals rather than one universal permit. The oil-and-gas approval answers whether and under what conditions the operator may drill or produce. Environmental permits answer how emissions, discharges, waste and other effects must be controlled.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsA typical federal-lease sequence
- Confirm land and mineral status. Determine whether the location is a federal lease, state or private mineral estate, Tribal land, offshore area or another jurisdiction.
- Submit the oil-and-gas application. On a federal lease, the operator submits an application for permit to drill to BLM. A state or Tribal oil-and-gas office may receive the equivalent application elsewhere.
- Identify environmental pathways. List every potential air emission, water discharge, waste stream, spill risk, land disturbance and habitat or cultural-resource effect.
- Complete required environmental review. For a federal decision, BLM must satisfy applicable NEPA, NHPA and ESA requirements before approving the application. The review can analyze both site-specific and cumulative effects.
- Obtain separate environmental permissions. Apply to EPA or the authorized state, Tribal, territorial or local authority for the air, water, waste or spill-related approvals that the project triggers.
- Read all conditions together. Lease stipulations, BLM conditions of approval and environmental permit terms can impose different obligations. The strictest applicable condition is not automatically the only one that matters; each approval remains enforceable on its own terms.
- Operate with monitoring and reporting. Keep the production, integrity, emissions, discharge, waste and inspection records required by the respective programs.
- Prepare for inspections and closure. Oil-and-gas inspectors may examine the well, equipment and records, while environmental inspectors focus on pollution controls and environmental conditions. Plugging, abandonment, site restoration and post-operation obligations must be completed under the applicable approvals.
Environmental review is not the same as an environmental permit
NEPA is a procedural obligation for federal agencies. It requires the agency to assess environmental effects and coordinate before making a decision such as approving a drilling application. It can lead to alternatives, mitigation measures, lease stipulations and site-specific conditions.

NEPA does not replace the substantive permits administered under the Clean Air Act, Clean Water Act, Safe Drinking Water Act or Resource Conservation and Recovery Act. An environmental analysis may be complete while a separate air, water, waste or injection authorization is still required. Conversely, an environmental permit does not by itself authorize drilling on a federal lease.
Where the agencies’ responsibilities overlap
Well-site pollution controls
The oil-and-gas regulator may require a properly constructed and maintained well, approved equipment, production records and a plugging plan. The environmental authority may regulate emissions from that equipment, discharges from the site, waste containers, spill-prevention measures and monitoring. A casing or cementing violation and an unauthorized discharge are different violations, even if they occur at the same well.
Environmental conditions attached to a drilling decision
BLM’s planning and approval process can include lease stipulations and site-specific conditions of approval based on cumulative and site-specific environmental analysis. Those conditions are part of the federal oil-and-gas decision. They should not be confused with every permit administered by EPA or a delegated state program.
Delegated programs and federal oversight
EPA often approves states, Tribes, territories or local authorities to implement environmental permitting programs. A delegated program must meet federal requirements, but EPA retains oversight and enforcement authority. The local permitting office may therefore be the operator’s day-to-day contact while EPA remains able to oversee the program or take enforcement action.
Who inspects and who enforces?
Oil-and-gas inspections
Oil-and-gas inspectors look at whether the operator is complying with the lease, drilling approval and field rules. Their work can cover drilling, production, workovers, abandonment, records, well integrity and environmental conditions within the oil-and-gas program. BLM’s reported level of more than 25,000 inspections per year since fiscal year 2015 shows the scale of its federal-lease inspection role; that figure is a BLM program statistic, not a count of all oil-and-gas or environmental inspections nationwide.
Environmental inspections
Environmental inspectors examine the pollution-control obligations created by an environmental permit or statute: emission sources, discharge points, waste storage and handling, spill controls, monitoring data and required reports. An environmental agency can require corrective action, impose penalties or use other enforcement tools when a permit or environmental requirement is violated.

One incident, several authorities
A spill, uncontrolled emission or contaminated discharge can trigger more than one response. The oil-and-gas authority may investigate well integrity, operating practices or failure to follow a condition of approval. EPA or a delegated environmental agency may investigate the release, require reporting and cleanup, and enforce pollution limits. Transportation or marine authorities may become involved when the incident concerns transportation or a vessel transfer.
How to identify the right authority for a specific site
Use this checklist before assuming that one office controls the entire project:
- Location: Is the site on federal, state, private, Tribal, territorial or offshore property?
- Mineral ownership: Who owns or administers the minerals and lease?
- Activity: Is the proposal exploration, drilling, completion, production, processing, storage, disposal, transportation, abandonment or site restoration?
- Pollution pathway: Will the activity emit to air, discharge to water, handle regulated waste, affect groundwater or create a reportable spill risk?
- Program delegation: Does a state, Tribal, territorial or local agency run an EPA-approved program, and what remains under EPA’s direct authority?
- Special resources: Could historic properties, endangered species, wetlands, habitat or cultural resources require additional review?
- Facility boundary: Does the activity cross from production into processing, storage, transportation or a vessel transfer?
Then contact both the relevant oil-and-gas regulator and the environmental permitting authority. Ask each office which approval it issues, which activities it covers, what records must be kept and whether another agency’s authorization is also required.
Common misconceptions and the accurate answer
“The drilling permit covers pollution.”
Usually not. A drilling approval controls the well and resource operation. Air, water, waste and spill obligations can arise under separate programs with their own applications, limits, monitoring and enforcement.
“EPA regulates every part of every oil well.”
No. EPA’s role depends on the environmental program, facility and delegation arrangement. A state, Tribal, territorial or local authority may implement an approved program, while EPA retains oversight and enforcement authority. The oil-and-gas regulator still controls the well or lease activity.

“A state permit means federal rules do not apply.”
Not necessarily. State and federal requirements may apply concurrently, especially on federal lands, unless a federal rule preempts the state requirement. The permit documents and jurisdiction-specific rules control.
“One inspection proves the site is compliant.”
No. An oil-and-gas inspection and an environmental inspection examine different obligations. Passing one inspection does not eliminate the need to comply with the other program’s permits, monitoring and reporting requirements.
What operators, landowners and communities should keep
For operators
- Maintain a permit matrix listing every oil-and-gas approval, environmental permit, condition, expiration or renewal date and reporting duty.
- Keep drilling, production, workover, abandonment, emissions, discharge, waste and spill records in the format required by each authority.
- Train field personnel to recognize which events require immediate notice to the oil-and-gas office, the environmental authority or both.
- Review lease stipulations and site-specific conditions before changing equipment, production methods, waste practices or site layout.
- Plan plugging, abandonment and restoration early; closure obligations are part of the regulated life cycle, not an administrative afterthought.
For landowners and nearby communities
- Ask the oil-and-gas regulator for the well, lease, drilling and inspection records it maintains.
- Ask the environmental authority for air, water, waste, spill, monitoring and enforcement records for the facility.
- When reporting a problem, describe the location, date, visible or measured effect and whether it involves a well operation, emission, discharge, waste or spill.
- Do not assume that the office issuing the drilling approval is the office that receives every pollution complaint.
Appeals, oversight and changes in responsibility
The route for challenging a permit, condition, inspection finding or enforcement action is set by the authority that issued the decision and by the applicable jurisdiction. A federal BLM decision, an EPA action and a state-delegated permit can have different administrative deadlines and review paths. Read the decision notice for its appeal instructions and deadline, and identify whether EPA oversight or another federal authority remains available.
Responsibility can also change as a project changes. A proposal that begins as drilling may later include production, processing, storage, disposal or transportation. Each new operation can create a different environmental trigger or place part of the activity under another agency’s authority. Recheck the jurisdiction before expanding a facility or changing how materials move on or off the site.
Bottom line
The oil-and-gas regulator governs the well, lease and resource-development activity; the environmental agency governs pollution, environmental media and public-health protections. Federal-land drilling can require BLM approval, NEPA/NHPA/ESA review and separate environmental permits. Because state, federal, Tribal and local programs can overlap, the reliable answer for any site is a jurisdiction-specific permit map—not the name of a single agency.
