“NRI” is not, by itself, the income-tax test. India determines your residential status separately for each tax year from your days in India, citizenship or person-of-Indian-origin (PIO) facts, income and tax liability in another country. You may be a non-resident, a resident and ordinarily resident (ROR), or a resident but not ordinarily resident (RNOR). That classification controls which income India can tax, how some investments are computed, and what information appears in your return. Bank-account treatment is a separate FEMA question.
This guide covers tax years beginning before 1 April 2026 under the Income Tax Act, 1961, and tax years beginning on or after that date under the Income Tax Act, 2025. The governing Act must be identified before applying any day count.

Start with the tax year and the governing law
Residential status is assessed separately for each tax year. The Income Tax Department’s Non Resident FAQ states: “Residential status is assessed separately for each tax year.” A change in your travel pattern, work location, citizenship or income can therefore produce a different result next year.

| Beginning before 1 April 2026 | Income Tax Act, 1961 | Use the residence, deemed-residence, RNOR and investment provisions applicable to that Act. |
| Beginning on or after 1 April 2026 | Income Tax Act, 2025 | The basic individual residence tests and the relevant RNOR and deemed-residency lookbacks remain substantively aligned with the earlier rules. |
The 1961 Act continues to govern a tax year that began before 1 April 2026, even if an assessment or reassessment occurs after the 2025 Act starts. If your stay spans financial years 2025–26 and 2026–27, calculate status for each year under the law applicable to that year. Days in earlier years can still enter a lookback calculation.

The official guidance says the preceding-four-year lookback for the basic test may include days from years governed by the 1961 Act. The 2025 Act is not retroactive for earlier tax years; earlier-year status and proceedings remain subject to the old Act’s savings rules.
What “NRI,” resident and RNOR mean for tax
Non-resident
For income-tax purposes, a person who fails both applicable residence tests for the year is non-resident. “NRI” is a common shorthand, not a substitute for checking the statutory tests. A non-resident is generally taxed in India on income received, accruing or arising in India, and on income deemed to be received, accrued or arising in India under the applicable provisions. The precise scope depends on the income and the year.
Resident and ordinarily resident (ROR)
A resident who does not satisfy either RNOR lookback test is ordinarily resident. ROR treatment generally brings worldwide income into the Indian tax computation, subject to the Act, available relief and any applicable treaty. Foreign income, foreign accounts and overseas investments therefore require particular care.

RNOR is a separate status; it is not another name for non-resident. A resident is RNOR if either of these tests is met:
- The person was non-resident in at least nine of the ten preceding tax years; or
- The person was in India for 729 days or less in the seven preceding tax years.
The Department’s FAQ says these lookback criteria continue under the Income Tax Act, 2025, including lookback years governed by the earlier Act. RNOR status often matters when someone returns to India after a long period abroad because it can limit the immediate reach of Indian taxation over some foreign income, depending on the statutory conditions and the income’s connection with a business controlled or profession set up in India.
How to determine residence: the tests in order
Test 1: 182 days in India
For the relevant previous year, count your physical presence in India. Presence for 182 days or more satisfies the primary residence test. Count calendar days carefully, including arrival and departure days where they constitute presence under the applicable administrative approach. Keep passport stamps, travel records and immigration statements so the count can be reconstructed.

Test 2: 60 days plus the four-year lookback
You can also become resident if you are in India for at least 60 days during the year and had been in India for at least 365 days in the four preceding tax years. This is not an alternative that can be ignored simply because you stayed fewer than 182 days.

The second threshold is modified for specified categories. The relevant exception depends on your facts, not on a generic “NRI” label.
| Situation | Day-count rule described by the Department | Additional condition |
|---|---|---|
| General individual test | 182 days in the year, or 60 days in the year plus 365 days in the preceding four years | Both tests must be checked. |
| Indian citizen or PIO visiting India | Modified threshold can apply instead of 60 days | Apply the category-specific exception and the income condition where relevant. |
| Qualifying Indian citizen or PIO visitor with non-foreign-source income above ₹15 lakh | 120 days in the year plus the applicable four-year lookback, rather than 60 days | The ₹15 lakh threshold concerns non-foreign-source income; verify the statutory category and year. |
| Indian citizen leaving India for employment abroad or as a ship’s crew | A special exception modifies the 60-day limb | Departure purpose and employment or crew facts must fit the statutory exception. |
Because exceptions change the second threshold, the question “How many days can I stay in India without becoming a tax resident?” has no single answer. A visitor may have a 120-day threshold rather than 60 days; another person may be covered by a different exception; and the 182-day test remains relevant.
Deemed residence
A separate deemed-residency rule can apply to an Indian citizen whose non-foreign-source income exceeds ₹15 lakh and who is not liable to tax in any other country by reason of domicile, residence or a similar criterion. Under this rule, the number of days spent in India is insignificant. The Income Tax Act, 2025 retains a corresponding rule for tax years beginning on or after 1 April 2026.
This rule targets a narrow fact pattern: Indian citizenship, the specified income level, and no tax liability elsewhere on the stated basis. It should not be presented as a rule that makes every Indian citizen living abroad resident.
A practical status checklist
- Identify the tax year. Mark whether it began before 1 April 2026 or on or after that date.
- Build a day log. Reconcile passport, visa, airline and employer records for every India entry and exit.
- Check the 182-day test. If you reached 182 days, the basic residence result is triggered unless a specific statutory issue changes the analysis.
- Check the 60-day test and exceptions. Compare your current-year days and preceding-four-year total; then test whether you are an Indian citizen, PIO visitor, qualifying visitor with more than ₹15 lakh of non-foreign-source income, or a person leaving for overseas employment or ship’s-crew work.
- Test deemed residence. If you are an Indian citizen with non-foreign-source income above ₹15 lakh, establish whether you were liable to tax in another country by reason of domicile, residence or a similar criterion.
- If resident, test RNOR. Review the preceding ten years and preceding seven years, not just the current year.
- Map each income source. Separate Indian-source income, foreign-source income, remittances, salary, rent, interest, dividends and gains before deciding what is taxable.
- Review account and return obligations separately. FEMA status for an NRE account and income-tax residence are related but not interchangeable.
How status changes taxation of income
Indian-source income
Salary for services performed in India, rent from Indian property, interest from Indian investments and gains on Indian assets can remain taxable in India even when you are non-resident. The applicable charging rule, withholding rate, deductions and filing requirement depend on the income type and the tax year.

Foreign-source income
ROR treatment generally requires worldwide income to be considered in India, subject to statutory relief and treaty rules. RNOR and non-resident treatment can produce a narrower Indian tax base, but the result depends on the source, receipt, control of any related business or profession, and the specific provision. Do not assume that money transferred to India is automatically taxable or automatically exempt: trace where it arose and when it was received.
Remittances are not a residency category
A transfer from your overseas account to India is not, by itself, a new income source. The underlying item might be salary, savings, a gift, investment proceeds or another receipt, each with its own rules. Keep evidence linking a remittance to its original source and tax treatment.
Does NRI status affect tax on Indian investments?
Yes, but not through one universal “NRI tax rate.” The Department’s Non Resident FAQ describes special provisions under the 1961 Act for certain NRI investment income and qualifying long-term capital gains. Corresponding provisions were retained under the 2025 Act. Their availability depends on the income type, asset, acquisition and disposal dates, foreign-exchange conditions and any election or reinvestment requirement.

Investment income and restricted deductions
Some special regimes for non-residents apply to specified investment income and may restrict deductions that a resident could otherwise consider. Eligibility is transaction-specific. Check the instrument, purchase date, sale date, currency used and whether the provision requires the proceeds to be reinvested in a qualifying asset.
Foreign-exchange asset reinvestment relief
The Department describes a reinvestment-linked exemption for qualifying assets acquired with, or purchased from, foreign exchange. It is not a blanket exemption for all securities held by an NRI. The asset must fall within the statutory category, and the timing and reinvestment conditions must be met.
Foreign-currency computation for certain shares or debentures
For gains on certain shares or debentures of an Indian company, the 2025 Act retains a mechanism under which a non-resident may calculate the gain in the original foreign currency and reconvert the result into Indian currency. This is a computation method, not an exemption from capital-gains tax. It should be applied only when the asset and transaction satisfy the provision.

Capital-gains decisions to document
- Whether the seller was non-resident, RNOR or ROR in the transfer year.
- The asset class and whether it is a share, debenture, property, fund unit or another investment.
- Acquisition and transfer dates, including any grandfathering or holding-period rule that applies for that year.
- Purchase and sale currency, exchange rates and supporting broker or bank statements.
- Whether a reinvestment or election is required to claim a concession.
- Whether tax was withheld and whether a return is needed to reconcile it.
NRE accounts: FEMA residence is a separate test
NRE-account interest treatment cannot be decided from income-tax residence alone. The Department says the exemption depends on the account being maintained under FEMA and the individual being a “person resident outside India” under FEMA, or being permitted by the Reserve Bank of India to maintain the account.
That distinction matters in common transition cases. A person can become resident under the Income Tax Act while the bank must separately assess whether the person remains eligible to maintain an NRE account under FEMA. Conversely, a person treated as non-resident for income tax cannot assume every FEMA condition is satisfied without checking the account rules.
Ask your bank to confirm the account’s permitted status, conversion requirements and interest treatment under current FEMA and RBI rules. Keep the bank’s correspondence and account classification with your tax records. The income-tax residence test and the FEMA definition answer different legal questions.

Schedule FA
The Income Tax Department’s ITR-2 manual says Schedule FA, which reports foreign assets, need not be completed by a non-resident or RNOR. This is a rule about that return schedule; it does not mean a non-resident has no filing obligation or that foreign information can never be relevant elsewhere.
Schedule FSI
The same manual says Schedule FSI for foreign-source income is available for residents only. A resident who has foreign income must evaluate whether the schedule, foreign-tax-credit documentation and other disclosures apply for the chosen return form.

Filing is not eliminated by non-resident status
Whether you must file depends on income, tax deducted, losses, assets, transactions and other statutory conditions. A non-resident with Indian rent, securities gains or other reportable income may still need a return. Review the filing trigger for the relevant year rather than relying on the label “NRI.”
Worked examples of the decision process
Example 1: Long annual visits
An Indian citizen living abroad spends 175 days in India during the year and had 400 days in India over the preceding four years. The person does not cross 182 days, but the 60-day-plus-365-day test is satisfied unless a category-specific exception changes the threshold. The result cannot be decided from the 182-day count alone.
Example 2: Qualifying visitor with more than ₹15 lakh of non-foreign-source income
A PIO visits India for 130 days, has more than ₹15 lakh of non-foreign-source income and meets the other conditions for the visitor rule. The 120-day threshold, rather than 60 days, is the relevant second-limb threshold. The four-year lookback must still be checked.
Example 3: Indian citizen not liable to tax abroad
An Indian citizen has more than ₹15 lakh of non-foreign-source income and is not liable to tax in another country because that country does not treat the person as resident, domiciled or otherwise taxable on that basis. Deemed residence may apply even if the person spent very few days in India.
Example 4: Return after years abroad
A person satisfies a residence test after moving back to India but was non-resident in at least nine of the preceding ten years. The person may be RNOR rather than ROR. That classification must then be applied to foreign income and disclosure questions instead of treating the person as fully resident by default.
Common mistakes and how to correct them
- Using only the 182-day rule. Recalculate under the 60-day-plus-lookback test and its exceptions.
- Counting a calendar year instead of the tax year. Use the relevant previous year and retain the records used.
- Treating “NRI” as permanent. Reassess status every tax year.
- Skipping RNOR. A newly resident person may qualify for RNOR under the nine-of-ten-year or 729-day test.
- Assuming an overseas tax number proves foreign tax liability. The deemed-residency rule asks whether you are liable to tax elsewhere by reason of domicile, residence or a similar criterion.
- Calling every investment concession an exemption. Confirm the asset, dates, currency and reinvestment conditions.
- Equating FEMA and income-tax residence. NRE interest treatment requires the FEMA or RBI condition described by the Department.
- Assuming no return is required. Check filing triggers, withholding, gains, rent and other conditions for that year.
- Reporting all overseas assets in every return schedule. Apply the specific Schedule FA, FSI and AL instructions for your status and form.
When individualized advice is necessary
Obtain a professional review when your day count is near a threshold; you are an Indian citizen or PIO visitor; non-foreign-source income exceeds ₹15 lakh; you may be deemed resident; you returned after many years abroad; you have foreign business or investment income; you sold Indian securities or property; you claim a currency or reinvestment provision; or a tax treaty may affect the result.
A treaty analysis must name the other country and the income category. The residence tests described here do not establish how another country taxes you, whether a treaty grants relief, or whether foreign tax credit is available. Those outcomes require your dates, citizenship or PIO facts, income composition, foreign tax liability and transaction documents.

Key takeaways for planning
- Determine status separately for each tax year and apply the Act that governs that year.
- Check both the 182-day test and the 60-day-plus-365-day test, then apply the correct visitor or employment exception.
- Test deemed residence for an Indian citizen with more than ₹15 lakh of non-foreign-source income who is not liable to tax elsewhere.
- If resident, calculate RNOR before assuming ROR treatment.
- Classify each income and investment by source, asset, date and currency; there is no single NRI investment rate.
- Review NRE eligibility under FEMA and RBI rules separately from income-tax residence.
- Use the return schedules that match your status and filing form, and verify whether a return is required at all.
