Non-QM vs. Conventional Mortgages: How to Compare Rates, Fees, and Requirements

Non-QM and conventional are not opposite mortgage types. “Conventional” describes whether a loan is part of a government program, while “Qualified Mortgage” (QM) and “Non-QM” describe a regulatory category with specific underwriting, pricing, fee, and product-feature rules. A conventional loan can be QM or Non-QM, and a conventional loan can also be nonconforming.

The reliable way to compare an offer is to identify its exact program and QM status, then compare written Loan Estimates for the same loan amount, down payment, term, property, rate structure, and lock assumptions. Evaluate the interest rate, APR, points, lender credits, closing costs, cash to close, payment changes, and any costs added to the balance—not just the advertised rate.

What is the difference between a Non-QM and conventional mortgage?

These labels answer different questions:

  • Conventional: The loan is not part of a specific government-insured or government-guaranteed program. It may be conforming or nonconforming.
  • Qualified Mortgage (QM): The loan fits a regulatory category under the ability-to-repay framework. The applicable QM category has requirements concerning underwriting, product features, pricing and fees, and documentation.
  • Non-QM: The loan does not meet the requirements for the applicable QM category. It is still subject to the rules that apply to its creditor and transaction; Non-QM does not mean the lender can ignore your ability to repay.

Because the categories overlap, asking only whether a loan is “conventional” is incomplete. Ask the lender to identify the government-program status, conforming or nonconforming status, the stated QM category (if any), and how the lender documented your ability to repay.

How the labels can overlap

Question the label answers What to ask the lender Why it matters
Government-program status Is this a conventional loan or part of a specific government program? Establishes the broad program family, but does not tell you whether the loan is QM.
Conforming status Does the loan fit the current county and property-unit conforming limit? Affects whether the loan is conforming or jumbo; the limit varies by county and unit count.
Regulatory status Does the creditor classify the loan as QM? If so, which category? Shows which QM requirements and legal protections the creditor is relying on.
Ability-to-repay documentation Which income, assets, debts, employment, credit and expense information was considered and verified? Explains how the lender determined that the payment is reasonably repayable.

For example, a conventional conforming loan may be QM. A conventional loan above the conforming limit may be a jumbo loan and may still be QM. A conventional loan may also be Non-QM if it does not satisfy the relevant QM requirements. “Jumbo” therefore describes loan size, not QM status.

How the ability-to-repay and QM rules affect the comparison

The CFPB’s Ability-to-Repay/Qualified Mortgage Rule generally requires a covered creditor to make a reasonable, good-faith determination that a consumer can repay the mortgage. The rule has defined scope and exceptions, so the precise analysis depends on the transaction and creditor.

QM is one route for meeting the applicable regulatory requirements. The CFPB’s consumer guidance says lenders generally consider and document income, assets, employment, credit history and monthly expenses. A creditor cannot base the analysis only on a temporary teaser rate when the rate and payment can rise later.

Features generally restricted in the general QM framework

The CFPB describes general QM criteria that restrict or limit features such as:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Interest-only payments.
  • Negative amortization, where scheduled payments can cause the balance to grow.
  • Balloon payments, subject to the rules and exceptions for the applicable category.
  • Loan terms longer than 30 years in the general QM framework.

QM rules also include an applicable price threshold, limits on certain upfront points and fees, and requirements to consider and verify income or assets and debts. Specific QM categories and exceptions exist, so the lender should identify the category rather than treating every QM as identical.

What Non-QM changes—and what it does not

A Non-QM loan falls outside the requirements for the applicable QM category, but it is not automatically prohibited and it does not automatically waive ability-to-repay analysis. Program rules vary by lender. A Non-QM creditor may use a different documentation or underwriting approach, but you should request the written documentation list and the lender’s explanation of how repayment ability was evaluated.

Are Non-QM loans more expensive?

There is no universal Non-QM-versus-conventional rate premium established by the official sources summarized here. Actual pricing depends on the borrower, property, state, loan amount, loan structure, documentation, market conditions and lender. Do not assume a quoted spread applies to every Non-QM loan.

Compare actual written offers built from identical assumptions. A lower note rate can be paired with more points, higher lender fees or a payment structure that creates greater future risk. Conversely, a “no-closing-cost” offer may use a higher rate or add costs to the loan balance.

Rate and cost items to compare

Item What to check Potential effect
Interest rate The note rate and whether it is fixed or adjustable. Determines scheduled interest, but not the complete cost or future payment risk.
Annual percentage rate (APR) APR on each comparable Loan Estimate. Includes the rate plus certain finance charges, making it useful for comparing total borrowing cost.
Discount points How many points are charged and the dollar amount. Can reduce the rate while increasing cash needed at closing.
Lender credits The credit amount and what rate or fees accompany it. May reduce upfront cash but can be offset by a higher rate or other charges.
Lender and third-party fees Origination, underwriting, appraisal, title, recording and other disclosed charges. Increase cash to close and total transaction cost.
Prepaid items and escrow Prepaid interest, taxes, insurance and initial escrow deposits. Change the amount due at closing even though some items are not lender revenue.
Costs financed Whether points or closing costs are added to the principal balance. Reduces cash needed now but increases the amount on which interest is charged.
Payment structure Initial payment, first principal payment, adjustment dates and maximum possible payment where applicable. A low introductory payment may not represent the later payment obligation.

How to compare mortgage rates and closing costs step by step

  1. Define one comparison scenario. Give every lender the same loan amount, down payment, property type and location, occupancy, term, fixed or adjustable structure, and desired lock period. Tell each lender about the same income, assets, debts and credit circumstances. Differences in assumptions can make two apparently different offers impossible to compare.
  2. Request at least three written offers. The CFPB recommends comparing at least three lender offers and obtaining Loan Estimates. Ask each lender to identify the exact program, QM classification, loan size category and documentation method.
  3. Check the loan amount and conforming status. Look up the applicable 2026 conforming limit in the Federal Housing Finance Agency’s county and unit table. Use the row for the property’s county and number of units. Do not substitute an old national example for the current local limit.
  4. Read the note rate and APR together. Record whether the rate is fixed or adjustable, the APR, the number and cost of points, lender credits, and the total closing costs. A rate comparison without these figures can reward an offer that simply shifts cost from one line to another.
  5. Calculate the cash required at closing. Compare lender charges, third-party charges, prepaid items, initial escrow, credits, deposits and the final cash-to-close figure. Confirm whether any costs are financed into the balance.
  6. Map the payment over time. For a fixed loan, verify when principal and interest begin and how taxes, insurance and mortgage insurance affect the total payment. For an adjustable or interest-only structure, record the initial period, adjustment dates, index or margin information supplied by the lender, payment caps, and the highest payment shown in the disclosures. Ask when the balance begins amortizing if principal is deferred.
  7. Review the underwriting path. Ask for the income, asset and debt documents required, how variable or irregular income is treated, and what alternative documentation the program permits. Request a written explanation of any condition that differs from a standard documentation process.
  8. Confirm the lock. Compare the lock period, expiration date, extension charges and the circumstances under which the rate or fees can change before closing. An unlocked quote is not an equivalent offer to a locked quote.
  9. Ask for corrected disclosures when assumptions change. If the rate, points, credits, loan amount, property details or documentation changes, obtain an updated Loan Estimate and compare the new figures with the prior version.

What credit score, down payment or DTI do you need for a Non-QM loan?

There is no single universal Non-QM credit-score, down-payment, debt-to-income (DTI) or documentation threshold established by the cited official sources. Each lender sets program rules and evaluates the complete application, property and repayment evidence.

That means a lender’s statement that a program is “flexible” is not a qualification decision. Ask for the actual minimums and overlays that apply to your case, including:

  • Minimum credit score and any requirements for recent late payments, bankruptcies or foreclosures.
  • Maximum DTI or the alternative method used when DTI is not the primary measure.
  • Required down payment, reserves and acceptable source of funds.
  • Income, asset and employment documentation, including how the lender treats self-employment, commission, bonus or other variable income.
  • Property type, occupancy, state and loan-size restrictions.
  • Whether a prepayment charge, interest-only period, balloon feature or other special term is part of the offer.

For a QM, the lender generally must consider and verify income or assets and debts under the applicable QM requirements. A Non-QM designation does not turn those questions off; it means the loan does not fit the relevant QM category.

How conforming limits and jumbo loans fit into the decision

The FHFA has set 2026 conforming loan limits and publishes an all-counties table with county- and unit-specific values. The applicable limit depends on geography and property configuration, so check the current FHFA table for the county and number of units involved in your transaction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A loan above the applicable conforming limit is generally called jumbo. Jumbo is a size classification, not a synonym for Non-QM. A jumbo mortgage can be QM or Non-QM, and a conventional loan below the conforming limit can also be Non-QM. Use the current FHFA entry before deciding whether an offer is conforming or jumbo.

Payment and balance risks to examine in any offer

Do not evaluate an offer solely by its first payment. Read the payment schedule and disclosures for structural features that can change what you owe:

  • Adjustable rate: Identify the initial fixed period, adjustment frequency, caps and the payment at the maximum rate illustrated in the disclosure.
  • Interest-only period: Confirm how long payments exclude principal and how much the payment changes when amortization starts.
  • Negative amortization: Determine whether the payment can be less than accruing interest and cause the balance to grow.
  • Balloon payment: Check whether a large balance becomes due before the scheduled loan term ends and what refinancing assumptions the offer requires.
  • Term longer than 30 years: Ask why the term is used, how it affects total interest, and whether the loan is being presented under a QM category that permits it.
  • Prepayment terms: Read the disclosure for any charge when you sell, refinance or pay down the loan early.

These features can be permissible or restricted differently depending on the applicable QM category, transaction and exception. The lender should identify the rule and explain the practical payment and balance consequences in dollars.

Questions to ask before choosing between offers

  • What exact mortgage program is this, and is it conventional or part of a government program?
  • Is the loan QM or Non-QM? If QM, which category and which requirements are being used?
  • How did you document my ability to repay?
  • Which income, assets, debts, employment history, credit information and monthly expenses were counted?
  • What documents are required, and what happens if an item cannot be verified in the standard way?
  • What are the note rate, APR, points, lender credits and total closing costs?
  • Which costs are paid in cash and which are financed into the balance?
  • Is the rate fixed or adjustable? When can the payment change, and what is the highest payment shown in the disclosures?
  • Does the loan include interest-only payments, negative amortization, a balloon payment, a term over 30 years or a prepayment charge?
  • What county and unit-count conforming limit did you use for the loan-size classification?
  • How long is the rate lock, and what are the extension or re-lock charges?
  • Which assumptions would cause the Loan Estimate, rate or fees to change before closing?

Common comparison mistakes and how to correct them

Comparing unlike scenarios

A quote for a 15-year fixed loan cannot be compared directly with a 30-year adjustable loan, and a quote based on a different down payment or property type is not a clean rate test. Give each lender the same inputs and ask for revised estimates when an assumption differs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Focusing on the advertised rate

The advertised rate may assume points, a particular credit profile, a short lock or a different loan amount. Use the written note rate, APR, points, credits, fees and cash-to-close figures for your facts.

Assuming “no closing costs” means free

Check whether the lender raises the rate, provides a credit that is offset elsewhere, or adds the costs to the balance. Compare the total economics over the period you expect to keep the loan.

Assuming Non-QM means no repayment review

Ask how the creditor made its ability-to-repay determination and which documents support it. Non-QM describes the loan’s QM classification; it is not a promise that underwriting is absent.

Using an old conforming-limit example

Conforming limits change and vary by county and unit count. Use the FHFA’s current 2026 table rather than a historical dollar example from a general consumer page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating jumbo as a regulatory category

Jumbo tells you that the loan exceeds the applicable conforming limit. It does not tell you whether the loan is QM, Non-QM, conventional or part of another program. Ask for each classification separately.

When a Non-QM offer may warrant closer scrutiny

A Non-QM offer deserves a more detailed review when the lender relies on an unusual documentation method, proposes an adjustable or interest-only payment, includes a large upfront fee or credit, or places a substantial cost into the loan balance. Those features do not by themselves determine whether the loan is suitable, but they make a side-by-side cash-flow and repayment analysis essential.

Before accepting, obtain the complete Loan Estimate and applicable disclosures, verify the payment path, and make sure you understand what evidence the lender used to conclude that the loan is repayable. If you cannot explain the first payment, the later payment, the maximum illustrated payment and the cash required at closing, the offers are not yet comparable.

Bottom line

Start by separating the labels: conventional concerns government-program status, while QM and Non-QM concern regulatory classification and underwriting protections. Then compare at least three written Loan Estimates built on the same assumptions. The meaningful decision is the complete package—rate, APR, points, credits, fees, cash to close, documentation, payment changes, loan-size classification and long-term balance risk—not a headline rate or the word “Non-QM” by itself.
