Mortgage loan originator (MLO) is a U.S. federal regulatory category, while loan officer is a broad occupational title. An individual is generally an MLO when they take a residential mortgage-loan application and offer or negotiate mortgage terms for compensation or gain, subject to statutory and regulatory exclusions. A loan officer may handle mortgage, consumer, or commercial lending, and the title alone does not establish a licensing requirement.
The practical dividing lines are the person’s actual activities, loan type, employer, and applicable exclusions. Licensing and registration also follow different routes: employees of covered financial institutions generally register through the Nationwide Multistate Licensing System and Registry (NMLS), while state-licensed originators meet the requirements of the states where they work. Pay ranges from salary to per-loan or percentage compensation, but federal rules restrict compensation tied to loan terms and prohibit steering and certain dual-compensation arrangements.

Mortgage loan originator vs. loan officer at a glance
| Dimension | Mortgage loan originator (MLO) | Loan officer |
|---|---|---|
| Meaning | A federal regulatory category based on covered residential-mortgage activities performed for compensation or gain. | A broad occupational title for someone who evaluates, authorizes, or recommends approval of loan applications. |
| Loan scope | Residential mortgage lending under applicable legal definitions, with statutory and regulatory exclusions. | May work in mortgage, consumer, automobile, commercial, or other lending specialties. |
| What determines legal status | Actual duties, loan type, compensation, employer, and exclusions—not the title on a business card. | The title itself does not determine whether a license is required. |
| Credential route | State license and NMLS registration, or federal registration through a covered financial institution, depending on the situation. | Requirements depend on the specialty and employer; mortgage duties can trigger MLO rules. |
| Typical pay forms | Salary, a fixed amount per loan, a fixed percentage, commission, or a combination, subject to federal compensation restrictions. | Employer-specific salary and commission arrangements across several lending specialties. |
These categories overlap in ordinary conversation. A bank may call a person a “loan officer” even though the person performs activities that make them a federally defined MLO. Conversely, someone with a loan-officer title who works only on nonmortgage products may not be an MLO.

What a mortgage loan originator is under U.S. law
Regulation G’s activity-based definition covers an individual who takes a residential mortgage-loan application and offers or negotiates residential mortgage-loan terms for compensation or gain. The definition is concerned with what the person does, not whether the employer uses “originator,” “loan officer,” “mortgage consultant,” or another label.

The activities that usually matter
- Taking an application: Receiving the information used to begin a residential mortgage application can be a covered activity.
- Offering or negotiating terms: Discussing or negotiating items such as rate, fees, or other mortgage terms for compensation or gain can place the person within the MLO definition.
- Residential purpose: The relevant product is a residential mortgage loan. Commercial credit and many other loan types are outside this specific definition.
- Compensation or gain: The activity must be performed for compensation or gain, subject to the rule’s details and exclusions.
Regulation G and related CFPB guidance also describe activities and categories that can fall outside the definition. A person should therefore analyze the complete job function and the applicable exclusion rather than assume that every employee who touches a mortgage file is an MLO.
What a loan officer does
The U.S. Bureau of Labor Statistics (BLS) describes loan officers as workers who evaluate, authorize, or recommend approval of loan applications. Mortgage lending is one specialization; other loan officers work in consumer, automobile, commercial, or other credit markets.
Mortgage-focused work
A mortgage loan officer commonly helps a borrower identify a suitable product, gathers application information, explains documentation, and coordinates the file through underwriting and closing. BLS notes that mortgage loan officers may develop relationships with real-estate companies and other referral sources to find clients. The exact division of work varies: some employers give the officer substantial responsibility for initial qualification and product selection, while others route underwriting, processing, and compliance tasks to separate teams.
Nonmortgage loan-officer work
A loan officer in an automobile, personal, small-business, or commercial-lending unit may analyze income, collateral, cash flow, credit history, and policy requirements without handling a residential mortgage. That person can be a loan officer for occupational purposes without being an MLO under Regulation G.

Do mortgage loan originators and loan officers do the same thing?
Sometimes, but not always. In a mortgage department, the same individual may be called a loan officer internally and an MLO for regulatory purposes. The overlap ends when the occupational title covers broader lending work or when a person’s mortgage-related tasks fit an exclusion.
Use this three-question test when a title is unclear:
- What loan is involved? Is it a residential mortgage loan or another type of credit?
- What does the person actually do? Do they take applications, offer terms, or negotiate terms, or do they perform only administrative, clerical, or support tasks?
- Who employs them and what rules apply? A covered financial institution, a state-licensed mortgage company, and another employer can place workers on different licensing or registration tracks.
The answers, rather than the job title, determine the relevant legal analysis.
Does a loan officer need an MLO license?
Not automatically. A mortgage loan officer whose duties meet the federal MLO definition may need either a state MLO license or federal registration, depending largely on the employer and jurisdiction. A loan officer working only in nonmortgage lending may not need an MLO credential, although other employer, state, or product-specific requirements can apply.

State-licensed originators
Individuals who work for employers that require state licensing generally obtain the relevant state license and register through the NMLS. States set the detailed application, education, testing, background, renewal, and continuing-compliance requirements within the SAFE Act framework and their own laws.
Federally registered originators
Employees of covered financial institutions generally have a registration obligation rather than the state-licensing route used by mortgage-company employees. The institution and the individual provide information through the NMLS, and the institution remains responsible for complying with the federal registration framework. “Registered” is not simply a shorter version of “licensed”; it is a different route tied to the employer and legal structure.
Why the employer matters
Two people performing similar mortgage duties can face different credential paths because one works for a covered bank and the other for a state-licensed mortgage company. A person changing employers may need to move from registration to state licensing, or vice versa, and must satisfy the receiving jurisdiction’s current requirements.

- Confirm the route. Determine whether the employer is a covered financial institution requiring federal registration or an employer whose originators need state licenses.
- Check the state’s current prerequisites. Requirements can include approved prelicensing education, a national exam, fingerprints and background review, credit review, fees, and other state-specific conditions.
- Complete education and testing where required. BLS describes prelicensing courses and a national exam in its overview of the occupation. Course hours, testing rules, and retesting procedures are controlled by current law and NMLS guidance.
- Submit the application or registration information. The employer, the individual, or both may have filing responsibilities. Follow the regulator’s instructions for disclosures, fingerprints, and supporting records.
- Maintain the credential. BLS notes annual renewal and possible additional state requirements. Renewal, continuing education, and changes in employment or residence should be tracked through the applicable regulator and NMLS account.
Do not treat a temporary-authority provision as a general shortcut. CFPB SAFE Act guidance describes limited eligibility that can depend on applying for a license in the new state, employment by a state-licensed mortgage company there, and specified history requirements. Temporary authority is therefore a fact-specific transition rule, not a universal substitute for licensing.

Compensation depends on the employer, business model, geography, seniority, and loan volume. CFPB consumer guidance says a mortgage loan officer or broker is usually paid a loan-specific fee or commission, which may be paid by the consumer or the lender. Lenders can also use a salary, a fixed amount per loan, a fixed percentage of the loan amount, or a combination.
Common compensation structures
| Structure | How it works | What to verify in an offer |
|---|---|---|
| Base salary | A fixed wage, sometimes supplemented by incentives. | Salary amount, review cycle, bonus criteria, and whether incentive payments are discretionary. |
| Fixed amount per closed loan | A set payment for each qualifying loan, regardless of the loan’s terms. | When a loan becomes payable, treatment of cancellations, and any monthly cap or floor. |
| Percentage of loan amount | Compensation calculated as a fixed percentage of principal. | The stated percentage, eligible loan types, and whether the formula is fixed rather than adjustable by terms. |
| Salary plus commission | A base wage combined with a per-loan or percentage incentive. | Draws, recoverable advances, benefits, and the volume needed to reach target earnings. |
Federal limits on compensation
Federal mortgage-compensation rules prohibit compensation from varying based on mortgage terms. An employer cannot lawfully change an originator’s compensation because the borrower accepted a particular interest rate, prepayment feature, or other term. CFPB guidance also identifies restrictions on dual compensation and steering. These rules do not prohibit every commission plan; they constrain how the plan is designed and how a loan is presented to a consumer.

Loan officer pay: the latest BLS figures
BLS reported a $76,690 median annual wage for loan officers in May 2025. This is the broad loan-officer occupation, not an MLO-only median. The BLS profile was last modified August 27, 2026, and the wage reference period is May 2025.
| BLS measure | Amount | Scope and reference period |
|---|---|---|
| Median annual wage | $76,690 | All loan officers, U.S., May 2025 |
| Lowest 10 percent threshold | Less than $39,430 | All loan officers, U.S., May 2025 |
| Highest 10 percent threshold | More than $153,180 | All loan officers, U.S., May 2025 |
| Automobile dealers industry median | $106,000 | Loan officers in this industry, May 2025 |
| Management of companies and enterprises industry median | $79,570 | Loan officers in this industry, May 2025 |
| Credit intermediation and related activities industry median | $76,070 | Loan officers in this industry, May 2025 |
These figures show the spread of the broad occupation and selected industries; they are not mortgage-only pay bands. The sources reviewed do not provide a separate national MLO-only median. State and local results can differ, so a location-specific decision should use current BLS area data and the employer’s actual compensation plan.
Mortgage broker vs. loan officer
A mortgage broker and a loan officer are not interchangeable labels. The CFPB explains the consumer-facing distinction this way: Mortgage loan officers often work for one specific lender. Mortgage brokers typically work with multiple lenders.
A loan officer generally represents or works within one lender’s product and approval system, while a broker typically shops among multiple lenders for a borrower.

This business distinction does not by itself resolve licensing. A broker’s employees or individual originators still must follow the licensing or registration rules that apply to their activities, employer, and state. Likewise, calling someone a “broker” does not make every task they perform an MLO activity; the activity-based legal definition still controls.
Career and job-offer decisions
Questions to ask before accepting an MLO or loan-officer role
- Which legal entity employs me, and will I be state licensed or federally registered?
- Which states and loan products will I handle?
- Who pays for prelicensing education, testing, fingerprints, licensing, renewals, and continuing education?
- Is compensation salary, a fixed amount per loan, a fixed percentage, commission, or a combination?
- What happens to compensation when a borrower withdraws, a loan is denied, or a closing is delayed?
- Are there caps, floors, draws, chargebacks, or minimum production requirements?
- How are leads generated, and am I expected to build referral relationships?
- Which benefits, paid leave, insurance, and retirement contributions are included?
Ask for written answers. Verbal descriptions such as “uncapped earnings” do not reveal the volume assumptions, timing rules, or compliance limits behind the plan.
Skills that transfer across the roles
Both mortgage and nonmortgage loan officers need financial-document analysis, accurate data collection, communication, and the ability to explain complex terms clearly. Mortgage work adds detailed regulatory, disclosure, and documentation requirements. Relationship development can also matter: BLS specifically notes that mortgage loan officers may cultivate real-estate and referral relationships.
Common mistakes and how to avoid them
- Relying on the title: Classify the job by duties, product, employer, and exclusions.
- Assuming every originator follows one licensing path: Confirm whether the employer requires state licensing or federal registration.
- Calling the BLS median an MLO salary: The $76,690 figure covers loan officers broadly.
- Assuming commission is illegal: Commission can be permitted; compensation cannot be structured to vary with mortgage terms or used in prohibited steering or dual-compensation arrangements.
- Using temporary authority as a blanket shortcut: Check the CFPB’s conditions and the current state and NMLS rules for the individual transition.
- Comparing headline rates only: Review the complete written plan, expected volume, caps, benefits, and lead obligations.
Bottom line
“Mortgage loan originator” answers a regulatory question about covered residential-mortgage activities. “Loan officer” answers an occupational question and can include several lending specialties. A mortgage loan officer may be both, but neither title alone settles licensing or pay. Determine the person’s actual duties and employer, confirm the applicable state-license or NMLS-registration route, and evaluate compensation using the written formula rather than a job title or a broad industry median.
