What you need depends first on whether you work for a state-licensed nonbank or a federally regulated bank or credit union, then on the states where you conduct covered activity, your license authority, filing type, employer sponsorship and state-specific education, testing, background, financial and renewal rules. Use the NMLS State Licensing Checklist Compiler and the License Requirements and Fees Chart for each state and license type, then confirm unclear items with that state’s regulator before you file.
What an MLO license means in different jobs
A mortgage loan originator (MLO) is an individual who performs covered mortgage-origination work. The authorization route is not identical for every person using that job title. The key dividing line is the institution employing the MLO.

State-licensed MLOs at nonbank companies
People working for state-licensed mortgage companies and other nondepository firms generally maintain an active state license through the Nationwide Multistate Licensing System & Registry (NMLS). The state agency, license type and business activity determine the exact authority you must obtain.

MLOs employed by federally regulated depository institutions, such as banks and credit unions, generally maintain an active federal registration rather than a state MLO license. The institution’s regulatory status and your employment relationship matter; do not assume that changing employers leaves your authorization unchanged.
#1 Best Overall
The Conference of State Bank Supervisors (CSBS) operates NMLS for state regulators. CSBS reported that more than 556,000 individuals were licensed or registered in NMLS in 2023, and more than 41,000 companies held a license or registration. That industry figure is background only; it does not prove that any particular originator is authorized in your state.
How to check your state’s exact requirements
Use this workflow whenever you are applying, changing employers, adding a state, renewing, amending a record or surrendering a license. It is more reliable than copying a list from a different state or an older application guide.
- Classify your employment route. Determine whether your employer is a state-licensed nonbank company or a federally regulated depository institution. Ask the employer’s compliance team which NMLS relationship and authorization it expects.
- Identify every state and activity. List the state or states in which you will conduct covered activity. Identify the state agency and the precise MLO license authority or license type, rather than searching only for the words “MLO license.”
- Open the NMLS State Licensing Checklist Compiler. Select the state agency, license type and filing type. Filing choices can include a new application, transition, amendment or surrender. Export the resulting checklist. It separates tasks completed in NMLS from items that must be sent directly to the state agency or completed elsewhere.
- Read the License Requirements and Fees Chart. Record application fees, recurring fees, bonds, forms, supporting documents and any financial or employer requirements shown for the selected authority. The chart does not include every NMLS processing charge, including charges associated with testing, education-credit banking, background checks or credit reports.
- Cross-check education rules. Compare the checklist with the NMLS state-specific education table. Confirm pre-licensure education (PE), continuing education (CE), course topics, expiration rules and deadlines. A state may require additional hours or an earlier agency deadline than general NMLS guidance.
- Follow the live application prompts. Complete the current Individual MU4 application, submit state forms outside NMLS, pay the applicable charges and monitor regulator messages. Current prompts control if they differ from an old PDF or screenshot.
- Wait for active approval. Do not perform activity requiring a license until the regulator has approved the application and the NMLS record shows the appropriate active status.
NMLS summarizes the governing principle this way: “Requirements and sequencing can vary by state; always verify state-specific instructions and timelines.” Treat the checklist as guidance, not a substitute for your legal responsibility to satisfy every requirement.
Common baseline for a state-licensed MLO
Most prospective state-licensed MLOs should expect the following baseline. These items are not a complete 50-state rule; the selected state’s checklist can add conditions or change sequencing.
| Requirement | What it normally involves | Important qualification |
|---|---|---|
| Pre-licensure education | At least 20 hours of NMLS-approved education under the SAFE Act framework. | States can add hours, topics, course-expiration rules or earlier deadlines. |
| SAFE MLO Test | A national examination covering ethics, federal law, state law, fraud, consumer protection, fair lending and the nontraditional mortgage marketplace. | Check the state’s instructions for any component, scheduling or retake requirements. |
| Criminal background review | Authorization for an FBI fingerprint-based criminal background check through NMLS. | State agencies may request explanations or additional records. |
| Credit review | Authorization for NMLS to obtain and review a credit report. | A credit issue is not automatically the same as a denial; the regulator evaluates the facts under its law. |
| Individual application | An Individual MU4 filing with personal, employment, disclosure and authorization information. | State forms or supporting documents may sit outside NMLS. |
| Employer sponsorship | Company access to your NMLS record and, where required, a sponsorship request submitted for regulator approval. | NMLS says sponsorship is required in most states, not universally. |
| Continuing education | Annual NMLS-approved CE to maintain an active state license. | Hours, subjects, deadlines and renewal consequences vary by state. |
Education: the 20-hour rule is only a starting point
NMLS-approved pre-licensure education is commonly 20 hours under the SAFE Act framework. The NMLS state-specific education resource lists differing PE and CE requirements, and a state can require extra hours or a different deadline. Confirm that a course is currently approved for the course type and state before paying for it.

Education completion and reporting are not always instantaneous. Leave a buffer between finishing a course and filing or renewing so the credit can appear in NMLS before the regulator’s deadline. A commercial study guide can help you prepare for the exam, but it does not replace approved education, the test, the background and credit authorizations or the state’s checklist.
The SAFE MLO Test and other screening steps
What the national test covers
The SAFE MLO Test addresses ethics, federal and state mortgage law, fraud prevention, consumer protection, fair lending and the nontraditional mortgage marketplace. Use the current test content outline and your state’s instructions when planning study time; a generic practice book cannot establish that you have met a licensing requirement.

During the MU4 process, authorize the fingerprint-based criminal background check and credit report. Answer disclosure questions accurately and provide explanations or documents when the regulator requests them. Omissions or inconsistent dates can create delays even when the underlying event would not have barred licensure.
Recent disclosure prompt change
Following an April 18, 2026 system change, CSBS reported on May 6, 2026 that individuals filing MU4 or MU2 forms must update their disclosure questions. Follow the questions displayed in the current form and any resulting regulator request rather than relying on an older completed application.
Typical NMLS application sequence
The exact order is state-specific, but this sequence describes the usual path for an individual state licensee.

- Complete PE and other pre-licensure conditions. Verify that the hours and subjects match the selected state.
- Pass the SAFE MLO Test. Save the score documentation and observe any state retest or component rules.
- Prepare the MU4. Enter identity, residence, employment, disclosure and authorization information consistently with your supporting records.
- Arrange sponsorship when required. Grant the company access to your NMLS record; the company establishes the relationship and submits its sponsorship request for regulator approval.
- Submit fingerprints and authorize the credit check. Complete NMLS instructions promptly and retain confirmation.
- Pay NMLS and state charges. Use the current fee chart and state invoice instructions; do not assume a fee shown for one license type applies to another.
- Handle outside-NMLS items. Send bonds, attestation forms, certified records, financial documents or other materials through the channel named by the state agency.
- Respond to regulator conditions. Monitor NMLS and your designated contact method for deficiency notices, deadlines and requests for clarification.
- Confirm approval and status. Begin covered activity only after approval and an active status are visible for the correct state, license and employer.
NMLS’s standard renewal period is November 1 through December 31, but states can impose different procedures, deadlines or late consequences. Plan CE and renewal work well before the date displayed for your license.
How state requirements differ
When comparing states, compare the decision points below rather than assuming that the 20-hour baseline, one fee or one timeline applies everywhere.
| Comparison point | Questions to answer in the current checklist |
|---|---|
| Regulator and authority | Which agency issues the MLO authority, and what exact license type covers your activity? |
| Education | Are extra PE or CE hours, subjects, expiration rules or earlier deadlines required? |
| Testing | Is a state component, special score report or state-specific testing instruction required? |
| Employer and sponsorship | Must a company sponsor the individual, and what must the employer hold or file? |
| Screening and documents | Are fingerprints, credit authorization, disclosures, certified records or additional forms required? |
| Financial conditions | Is there a surety bond, net-worth standard, recovery-fund contribution or other financial requirement? |
| Fees | What are the application, amendment, renewal and late fees, and which NMLS processing charges are separate? |
| Timing and status | How are applications sequenced, what is the renewal window, and when is the status considered active? |
Individual state fees, bonds, exceptions, forms and timelines are volatile. Check the current NMLS materials and the regulator’s own instructions immediately before filing.
Can you originate loans in more than one state?
Often, yes, but each additional state is a separate authorization question. Identify where the covered activity occurs, select the correct license authority in each jurisdiction, export a checklist for each filing and satisfy each state’s education, sponsorship, fee and out-of-system requirements. An active license in one state does not automatically authorize activity in another, and a federal registration does not turn into a state license merely because you serve borrowers across state lines.
For a multi-state portfolio, maintain a matrix with the state agency, license type, NMLS status, sponsor, PE and CE completion, renewal window, fees paid and outstanding regulator conditions. Assign an owner to check for changed instructions before each renewal cycle.

How consumers and employers can verify an MLO
Use NMLS Consumer Access, a free public resource from CSBS, to search for an MLO or company. Check the professional’s name, NMLS identifier, employer, state authorization and current status. Confirm that the authorization covers the state in which the relevant activity is taking place and that the employer shown is the one the person represents.
The public record can also show available regulatory-action information. A search result is not a substitute for asking the company which individual will handle your loan, but it is a useful independent check before sharing sensitive financial information.
Common mistakes and how to correct them
Assuming every MLO needs a state license
First classify the employer as a state-licensed nonbank or federally regulated depository institution. Ask the institution’s compliance contact which registration or license route applies.
Using a generic checklist
Re-run the compiler for the exact agency, license type and filing type. A transition, amendment, renewal and new application can have different tasks.

Ignoring work outside NMLS
Read every “outside NMLS” item and submit it through the named state channel. An application can remain deficient even when the MU4 itself is complete.
Starting work before active status
Wait for regulator approval and confirm the active status for the correct state and employer. Keep a dated status record for your compliance file.
Relying on an old screenshot or PDF
NMLS introduced an improved state-licensed individual experience through NMLS Connect in September 2025 and said checklists would be embedded in NMLS while remaining available through its Resource Center. Interface labels can change, so use the current compiler and live prompts.
Missing renewal or CE timing
Track the November 1–December 31 standard renewal period while checking the state-specific date and late rules. Finish CE early enough for reporting and resolve deficiencies before renewal closes.
A practical file for your application
- Employer classification and compliance contact.
- States, agencies, license types and filing types selected in the compiler.
- Exported checklists and the current fee chart.
