Mortgage foreclosure rescue scams: warning signs, common tactics, and how they work

Mortgage foreclosure rescue scams target homeowners who are behind on payments or afraid of losing their homes. The fraudster promises a guaranteed modification, a fast government solution, or a way to stay in the house, then seeks money, mortgage payments, authority over the loan, or ownership of the property.

Do not let a stranger replace your direct relationship with the mortgage servicer. Verify every offer through the servicer’s trusted contact information, use free HUD-approved housing counseling, and obtain prompt legal advice when notices or court papers set a deadline.

What a foreclosure-rescue scam is

A foreclosure-rescue scam is a deceptive offer aimed at a borrower in mortgage distress. The promoter may present itself as a government program, law firm, housing expert, auditor, investor, or loss-mitigation company. Its central promise is usually that it can save the home or change the loan faster or more reliably than the servicer can.

The danger is not limited to losing an upfront fee. A scam can cause missed payments, lost time, unauthorized changes to the loan account, or a transfer of ownership. A homeowner may also be persuaded to sign documents without understanding that they assign control of the mortgage or deed.

The Consumer Financial Protection Bureau (CFPB) has described a common pattern: a distressed borrower is contacted or finds an advertisement, the promoter claims special access or legal expertise, and the borrower is pushed to pay or sign before checking with the servicer. The pitch often works because foreclosure notices create a genuine deadline and fear makes a guaranteed answer sound plausible.

“Real government officials never ask for payment to help you.” — Consumer Financial Protection Bureau, How to spot and avoid foreclosure relief scams.

In 2014, the CFPB said federal and state partners had charged mortgage-rescue scammers with taking more than $25 million in illegal advance fees. That is a historical enforcement figure, not a current estimate of how common scams are.

How the scheme can work

1. Finding a homeowner under pressure

Promoters look for people who have missed payments, received a default letter, or publicly asked for help. Contact can come by phone, text, email, social media, a letter designed to look official, or a referral from someone who claims to have been helped.

2. Creating official-looking credibility

A scammer may use a government-style seal, a name resembling an agency, a lawyer’s title, a license number, or technical language about federal programs. An official appearance is not proof of a relationship with the government, your lender, or a court. Independently locate the agency’s contact details rather than using the number or web address in the solicitation.

3. Making a promise the promoter cannot control

Typical claims include “your modification is guaranteed,” “we can stop the sale,” or “you cannot lose your home.” The lender or servicer decides whether a modification or other loss-mitigation option is available. A third party cannot guarantee that decision or the ultimate foreclosure result.

4. Asking for money, payments, or authority

The promoter may demand an advance “processing,” “application,” “consulting,” or “forensic audit” fee. It may tell you to send future mortgage payments to the company, sign a third-party authorization, or stop communicating with the servicer. Those requests can remove your ability to verify the account and leave the loan further behind.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

5. Taking control of the property

Some pitches use a “rent-to-buy,” “temporary transfer,” or “deed-back” arrangement. You may be told to sign the deed over and remain in the home as a tenant, with a promise that you can buy it back later. Once title changes, you may lose ownership, face eviction, or discover that the promised buy-back terms were never enforceable or affordable.

Warning signs and the safer response

What the pitch says or asks Why it is a red flag and what to do
“Pay us first,” including an audit or evaluation fee For mortgage-relief companies, CFPB guidance says fees generally cannot be collected until the company provides a written offer from the lender or servicer that you accept, together with a written explanation of the offer’s key mortgage changes. Do not pay an advance fee; ask the servicer or a HUD-approved counselor for help instead.
“We guarantee a modification” or “you cannot lose your home” The servicer controls eligibility and approval. Treat a guaranteed outcome as a warning and verify the available options directly with the servicer.
“Stop paying your mortgage” or “pay us instead” Diverting payments can increase delinquency and fees. Continue dealing directly with the servicer and confirm payment instructions through a number on a mortgage statement or the servicer’s official website.
“Sign the deed over; you can rent or buy it back” A deed transfer can put ownership at risk. Do not sign unfamiliar papers or transfer title without independent advice from a qualified attorney who does not represent the promoter.
“We are with the government,” accompanied by a seal or agency-like name Scammers imitate government names, logos, and notices. Contact the agency through independently verified official details.
“Act today and do not call your lender” Urgency and isolation prevent verification. Keep direct contact with the servicer, and understand any limited third-party authorization before signing it.
A “forensic audit” said to uncover errors that will erase the loan An audit does not guarantee a modification, cancellation of debt, or a delay in foreclosure. Ask what specific service is being provided, who performs it, what it costs, and what the servicer has actually agreed to in writing.

What to do when someone offers foreclosure help

  1. Pause the transaction. Do not send money, mortgage payments, identity documents, or a signed authorization while the offer is unverified. Save the advertisement, emails, texts, caller ID, payment instructions, and documents.
  2. Call the servicer through a trusted channel. Use the telephone number printed on your mortgage statement or find the servicer’s official website independently. Explain the payment difficulty, ask which loss-mitigation programs may apply, and request instructions in writing.
  3. Ask for the account status and deadlines. Confirm the amount needed to bring the loan current, whether a foreclosure referral or sale date exists, and where a complete application must be sent. Record the representative’s name, date, and reference number.
  4. Use free housing counseling. A HUD-approved housing counseling agency can help organize income and expenses, prepare information for the servicer, and explain choices at no cost. The CFPB’s mortgage-help information lists HUD’s referral number as (800) 569-4287; verify the current number before calling because contact details can change.
  5. Get independent legal advice when the stakes are high. If a notice, summons, sale date, deed, power of attorney, or settlement agreement is involved, consult an attorney familiar with foreclosure law in the property’s state. Legal-aid programs and local bar associations may provide referrals or eligibility-based assistance.
  6. Keep a written file. Store the note, payment history, notices, applications, delivery confirmations, and every communication with the servicer or promoter. A chronological file helps a counselor or attorney identify missed deadlines and disputed conduct.

Legitimate help routes compared

Source What it can do Cost and cautions
Your mortgage servicer Review the account and determine whether options such as a modification, repayment plan, forbearance, refinance, short sale, or deed-in-lieu may be available. Eligibility depends on the loan, income, hardship, investor rules, and timing. Obtain the terms in writing and continue following the servicer’s instructions.
HUD-approved housing counselor Provide free budgeting and housing counseling, help assemble documents, and help communicate with the servicer. There is no fee for the counseling service described by CFPB guidance. A counselor cannot guarantee approval or stop a foreclosure by filing a complaint.
Foreclosure attorney or legal-aid provider Explain state procedure, review notices and contracts, identify defenses or deadlines, and advise on deeds, authorizations, or bankruptcy questions where appropriate. Ask how the provider is paid and what services are included before signing. Advice must be based on the state where the property is located.

A paid lawyer or consultant is not automatically fraudulent, and a third-party authorization is not automatically a scam. The warning signs are deception, unsupported guarantees, pressure, unexplained fees, loss of direct access to the servicer, and documents that shift control without informed consent.

Mortgage options a servicer may consider

When you contact the servicer, ask which options fit your circumstances rather than asking a stranger to choose for you.

  • Loan modification: The servicer may change the interest rate, term, payment structure, or other terms. Approval is not guaranteed.
  • Repayment plan: Past-due amounts may be spread over future payments while regular payments continue.
  • Forbearance: Payments may be reduced or paused for a period, but the missed amount is generally still addressed under the agreement.
  • Refinance: A new loan may replace the existing one if the borrower, property, and market support approval.
  • Short sale: The home may be sold for less than the mortgage balance with the servicer’s approval; tax, deficiency, and credit consequences require advice.
  • Deed-in-lieu of foreclosure: Ownership is voluntarily transferred to the lender under an agreement, subject to eligibility and documented terms.

Ask how any option changes the payment, total amount owed, interest, escrow, credit reporting, tax position, and responsibility for a remaining balance. Do not rely on a promoter’s verbal description.

If you already paid, signed, or redirected a payment

Money sent to the promoter

Contact your bank, card issuer, or payment service immediately and ask whether the transaction can be stopped or disputed. Preserve receipts and the recipient’s payment instructions. Then notify the servicer that a payment may have been diverted and ask how to keep the loan account current while the dispute is reviewed.

Documents or authorizations signed

Obtain complete copies of everything you signed, including powers of attorney, assignments, deeds, leases, and settlement agreements. Do not sign a replacement document to “fix” the first one. An independent attorney can explain whether a rescission period, recording issue, or other remedy exists under state law.

Reporting the conduct

You can report suspected mortgage-relief fraud to the CFPB and discuss the matter with legal aid or a local bar association. A complaint creates a record but does not automatically stop, delay, or cancel foreclosure. Continue meeting every deadline and pursuing loss mitigation with the servicer and counsel.

Foreclosure timing, state differences, and the 120-day rule

Foreclosure procedure is state-specific. Some states generally use a court case (judicial foreclosure); others may permit a non-judicial process under a deed of trust or statute. Notice periods, mediation programs, reinstatement rights, sale procedures, and the effect of a pending application differ by state and by loan.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The CFPB describes a general federal rule that a servicer cannot make the first foreclosure notice or filing until the borrower is more than 120 days delinquent. Additional protections may apply when a timely, complete loss-mitigation application is submitted, but the details depend on the facts and timing. The rule is not a universal guarantee, does not erase missed-payment consequences, and should not be treated as individualized legal advice.

The CFPB’s consumer mortgage-options Q&A was last reviewed August 28, 2026; its mortgage-modification-scam Q&A was last reviewed September 11, 2024; and its foreclosure-process Q&A was last reviewed April 3, 2024. Because rules, phone numbers, and servicing practices can change, confirm current information with the servicer, CFPB, HUD-approved counseling, and a state-qualified attorney.

Questions to ask before trusting any helper

  • What exact service will you perform, and what written result can you promise?
  • Are you authorized by my servicer, and can I verify that authorization independently?
  • Who will receive my payment, and will it be credited to my mortgage account?
  • What happens if the servicer rejects the proposal?
  • Will I retain title, and have my own attorney reviewed every deed, lease, or power of attorney?
  • What is the total cost, when is it due, and what happens if I cancel?

What to remember

A real loss-mitigation decision comes from the servicer, not from a stranger’s guarantee. Keep control of your payments, title, documents, and direct communications. Verify help independently, use no-cost HUD-approved counseling, and treat every foreclosure deadline as real until a qualified professional confirms otherwise.
