The father is the guardian identified by SEBI, or the mother when the father is absent; if both parents are absent, a court may appoint the guardian. At 18, the young adult must confirm the holdings and complete the depository participant’s or broker’s required formalities before continuing in the account.
Who actually owns and operates the account?
The securities belong to the minor named as the account holder. The guardian is the person authorised to operate the account while that holder is under 18. SEBI’s official FAQ describes the arrangement this way: “The account will be operated by a guardian till the minor becomes major.” The guardian’s role is therefore operational, not a change in ownership.

For an Indian minor demat account, SEBI identifies the following order of eligibility:

- Mother: the mother may act when the father is absent.
- Court-appointed guardian: when both parents are absent, a guardian may be appointed by a court.
The account provider will still apply its customer-identification and document checks. SEBI says the guardian and the minor must comply with applicable KYC requirements when opening the minor demat or trading account. The exact documents, authentication method and submission channel can vary by depository participant (DP) or broker.
#1 Best Overall
A minor cannot be added as a joint holder in a demat account. The child is the sole account holder, while the eligible guardian operates it until majority. This is different from simply adding a child to an adult’s jointly held account.
Demat ownership and trading permissions are different
A demat account records and holds securities. A trading account is the facility used to place market transactions with a broker. A minor can have arrangements connected with both, but SEBI’s FAQ places much tighter limits on trading activity than on holding securities in dematerialised form.
| Account function | What the SEBI FAQ allows for a minor | Important limit |
|---|---|---|
| Demat account | Opened in the minor’s name and operated by the eligible guardian. | The minor cannot be a joint holder. |
| Trading account | May be maintained for selling securities that came to the minor through specified routes. | The minor cannot enter a contract with a stock broker to purchase or sell securities generally. |
Consequently, having a demat account does not mean the child can trade like an adult. The account may hold shares, bonds or other eligible securities, while trading permissions remain restricted by the minor-account rules.
When can a minor trading account sell securities?
SEBI says a minor trading account is permitted only for selling securities the minor has obtained through specified routes. The FAQ lists these situations:

- Ideal for Gifting
- Ideal for a bookworm
- Compact for travelling
- an initial public offering (IPO) investment;
- inheritance;
- a corporate action; and
- specified off-market transfers, including a gift or donation, a transfer between family members, or implementation of a government or regulatory direction or order.
These are source-of-the-securities conditions, not a general licence to buy and sell. The guardian operates the account until the child becomes a major, but the minor still cannot contract with a broker to purchase or sell securities as an ordinary adult client. Before placing any instruction, ask the DP or broker how it verifies the security’s origin and what supporting records it requires.
What changes on the 18th birthday?
Turning 18 ends the guardian-operation period. SEBI says the demat or trading account may continue in the same account, but the former minor must first confirm the account balance and complete the formalities required for opening a demat or trading account as a major.
This means the account does not automatically become fully adult-operated merely because the birthday has arrived. The young adult becomes the person who must complete the status-change process, provide the provider’s requested information and accept responsibility for future instructions. Until the provider records the change, the account may not function as the young adult expects.
SEBI’s FAQ does not prescribe one universal form set or processing deadline for every DP and broker. Account providers can therefore differ in their forms, KYC refresh, signature or authentication checks, bank-account requirements and temporary transaction controls. Treat the birthday as a trigger to start a provider-specific conversion, not as proof that conversion has already happened.

How to prepare for the minor-to-major change
Start before the child’s 18th birthday. Early contact gives the provider time to explain its process and identifies missing records while the guardian is still available to answer questions.
- Identify every linked service. List the DP, broker and any other facility attached to the minor’s securities account. A demat account and a trading account may be serviced by different teams or entities.
- Ask for the provider’s minor-to-major procedure. Request the exact forms, submission route, acceptable identity and address records, KYC requirements, bank details, signature or electronic-authentication rules, and expected processing time.
- Confirm the holdings. SEBI requires the former minor to confirm the account balance. Compare the provider’s statement with the family’s records and raise any discrepancy before submitting the status change.
- Complete the adult-account formalities. Submit the documents and declarations the DP or broker specifies for continuing in the same account. Do not assume that a form used by another provider will be accepted.
- Check the account after approval. Obtain confirmation that the status has changed, verify the holder and contact details, and ask whether any transaction restriction remains.
Keep copies of the submitted forms and the provider’s acknowledgement. If the account has a pending corporate action, transfer or sale instruction, ask how the status change affects that item rather than assuming it will process normally.
What documents should you expect?
There is no single SEBI-published demat checklist that applies to every provider. The practical starting point is to ask for the DP or broker’s current list. It may ask the now-major account holder to refresh personal details, complete KYC-related requirements, provide bank information and authenticate a new signature or electronic instruction. The guardian may also need to participate in the provider’s records review because the account was previously operated under the guardian arrangement.

Do not treat a mutual-fund folio conversion list as a guaranteed demat-account list. A SEBI-published mutual-fund scheme document describes a different process: guardian operation is frozen on the date of majority, transactions are suspended until satisfactory status-change documents arrive, and the document lists a status-change service request, a new bank mandate, bank-signature attestation and KYC acknowledgement. Those provisions apply to the mutual-fund folio described in that document, not universally to demat accounts.

The mutual-fund example is still a useful warning: an account provider may pause transactions while it verifies the change. Only your DP or broker can tell you whether that will happen in your account and which documents will release the restriction.
What the guardian can and cannot do
While the child is a minor
The guardian operates the demat account and gives instructions under the account’s documented authority. The guardian does not turn the child into a joint holder, and the child’s trading access does not become unrestricted. For a minor trading account, the permitted purpose remains the sale of securities acquired through the routes recognised by SEBI.
After the child becomes a major
The former minor, now an adult, must take over the account formalities. The guardian should not assume that the previous operating authority continues indefinitely. Ask the provider when the guardian’s authority ends in its system and whether any instruction submitted around the birthday needs special handling.

Common mistakes and how to avoid them
- Assuming automatic conversion: The birthday does not itself confirm that the account has been updated. Obtain the provider’s confirmation after completing its formalities.
- Using adult trading permissions too early: A minor trading account is not a normal brokerage account. Confirm that a proposed sale fits one of SEBI’s specified acquisition routes.
- Confusing holding with trading: The ability to hold securities in the minor’s demat account does not create a general right to buy and sell them through a broker.
- Adding the child as a joint holder: SEBI’s FAQ says a minor cannot be a joint holder in a demat account.
- Copying a mutual-fund checklist: Mutual-fund folio documents describe that product’s process. They are not a universal demat conversion form.
- Waiting until after the birthday: The provider’s review may require forms, KYC work or authentication. Begin early and ask about any expected transaction pause.
- Ignoring the balance confirmation: Reconcile the holdings and report errors before the account is continued in the adult holder’s name and operation.
Questions to put to the DP or broker
Use a written support request or the provider’s official service channel and ask:
Best Value
- It can be a gift option
- Comes with secure packaging
- Helpful in various ways
- What is the exact procedure to change a minor account to a major account while retaining the same account?
- Which forms and KYC documents are required, and can they be submitted online?
- Must the new adult holder submit a fresh bank mandate or signature authentication?
- Does the guardian need to sign, attend a verification or provide any additional record?
- When will the guardian’s operating authority stop in the provider’s system?
- Will buying, selling, transfers or corporate-action instructions be temporarily blocked?
- How will the provider confirm completion, and what is the expected processing time?
These questions address the parts SEBI leaves to the account provider. Keep the answers with the account records so there is a clear audit trail if a transaction is delayed.
SEBI’s official guidance
SEBI’s Frequently Asked Questions on Demat/Trading Account for Minor explains guardian eligibility, the prohibition on a minor being a joint holder, the limited trading purpose and the formalities required when the minor becomes a major. The FAQ itself does not state a publication date.
For the separate mutual-fund context, the SEBI-published scheme document with minor-folio provisions describes the guardian-operation freeze and its document process. Use it only for understanding that mutual-fund folio procedure, not as a substitute for instructions from a demat-account provider.
Practical outcome
The child remains the owner of the minor demat account, the eligible guardian operates it until majority, and minor trading permissions remain limited to the circumstances SEBI specifies. At 18, the young adult must verify the balance and complete the DP or broker’s adult-account formalities. Because SEBI does not publish one universal conversion checklist or deadline, the provider’s written procedure is the controlling practical guide.
